57 | 56 | | SECTION 1. AMENDATORY 61 O.S. 2021, Section 327, as |
---|
58 | 57 | | amended by Section 47, Chapter 2 38, O.S.L. 2022 (61 O.S. Supp. 2024, |

59 | 58 | | Section 327), is amended to read as follows: |

60 | 59 | | Section 327. A. Unless procedures for state agency real |
---|
61 | 60 | | property transactions are otherwise specifically provided for by |
---|
62 | 61 | | law, no state agency shall sell, lease, exchange, o r otherwise |
---|
63 | 62 | | dispose of such real property subject to its jurisdiction, or lease, |
---|
64 | 63 | | purchase or otherwise acquire real property subject to its |
---|
65 | 64 | | jurisdiction, except as authorized by subsection L of this section |
---|
93 | 93 | | section, “state agency” means any department, board, commission, |
---|
94 | 94 | | institution, agency or entity of state government. |
---|
95 | 95 | | B. 1. Every state agency shall request the Office of |
---|
96 | 96 | | Management and Enterprise Services to dispose of real property upon: |
---|
97 | 97 | | a. legislative authorization, |
---|
98 | 98 | | b. authorization by the Long -Range Capital Planning |
---|
99 | 99 | | Commission, or |
---|
100 | 100 | | c. a determination, in writing, by the Office of |
---|
101 | 101 | | Management and Enterprise Services or the state agency |
---|
102 | 102 | | that a parcel of real property subject to its |
---|
103 | 103 | | jurisdiction is no longer needed. |
---|
104 | 104 | | 2. Upon the request of the state agency to dispose of real |
---|
105 | 105 | | property, the Office of Management and Enterprise Services shall |
---|
106 | 106 | | estimate the value of the property, and: |
---|
107 | 107 | | a. for properties with an estimated value of greater than |
---|
108 | 108 | | Twenty-five Thousand Dollars ($25,000.00), obtain at |
---|
109 | 109 | | least one complete appraisal made by a pe rson |
---|
110 | 110 | | certified by the Real Estate Appraiser Board of the |
---|
111 | 111 | | Oklahoma Insurance Department, who shall ascertain: |
---|
112 | 112 | | (1) the present fair value of the property, |
---|
113 | 113 | | (2) the present value of the improvements on such |
---|
114 | 114 | | property, and |
---|
143 | 144 | | b. after completion of the provisions of subsection L of |
---|
144 | 145 | | this section, cause notice of such sale to be |
---|
145 | 146 | | published for at least one (1) day in a news paper of |
---|
146 | 147 | | general statewide circulation authorized to publish |
---|
147 | 148 | | legal notices, and weekly for three (3) consecutive |
---|
148 | 149 | | weeks in a newspaper of general circulation published |
---|
149 | 150 | | in the county or counties in which the property is |
---|
150 | 151 | | located. The notice shall contain the legal |
---|
151 | 152 | | description of each parcel of real property to be |
---|
152 | 153 | | offered for sale, the appraised value thereof, the |
---|
153 | 154 | | time and location of the sale or opening of the bids, |
---|
154 | 155 | | and terms of the sale including the fact that no |
---|
155 | 156 | | parcel of property shall be sold for less tha n ninety |
---|
156 | 157 | | percent (90%) of the appraised value of the real |
---|
157 | 158 | | property; provided, in lieu of such procedure, the |
---|
158 | 159 | | information may be published electronically on the |
---|
159 | 160 | | Office of Management and Enterprise Services ’ website |
---|
160 | 161 | | if the notice of sale and instructions on accessing |
---|
161 | 162 | | the public information are published in a newspaper of |
---|
162 | 163 | | general circulation in the county or counties in which |
---|
163 | 164 | | the property is located weekly for three (3) |
---|
164 | 165 | | consecutive weeks, |
---|
193 | 195 | | the last publication of the notice. The property |

194 | 196 | | shall be sold to the highest bidder. The Office of |

195 | 197 | | Management and Enterprise Services shall not accept a |
---|
196 | 198 | | bid of less than ninety percent (90%) of the average |

197 | 199 | | appraised fair value of the property and the |
---|
198 | 200 | | improvements on such property, |
---|
199 | 201 | | d. if the property is being disposed of in compliance |
---|
200 | 202 | | with Section 908 of Title 62 of the Oklahoma Statutes, |
---|
201 | 203 | | the Office may auction the property at public or |
---|
202 | 204 | | electronic auction provided prop er public notice is |
---|
203 | 205 | | given in compliance with this section and the property |
---|
204 | 206 | | has been approved for liquidation by the Long -Range |
---|
205 | 207 | | Capital Planning Commission. The Office of Management |
---|
206 | 208 | | and Enterprise Services is authorized to reject all |
---|
207 | 209 | | bids, |
---|
208 | 210 | | e. if the property has an estimated value of less than |
---|
209 | 211 | | Twenty-five Thousand Dollars ($25,000.00), the Office |
---|
210 | 212 | | of Management and Enterprise Services may establish |
---|
211 | 213 | | the value through market comparison and may dispose of |
---|
212 | 214 | | the property based on estimated value without |
---|
213 | 215 | | obtaining a certified appraisal; provided, however, |
---|
242 | 245 | | f. if the property is landlocked, the Office of |
---|
243 | 246 | | Management and Enterprise Services may offer the |
---|
244 | 247 | | property through indirect sale to the adjacent |
---|
245 | 248 | | property owner for not less than ninety percent (90%) |
---|
246 | 249 | | of fair market value, as determined in compliance with |
---|
247 | 250 | | this section. All sales costs, including any required |
---|
248 | 251 | | surveys and appraisals, shall be at the expense of the |
---|
249 | 252 | | buyer. |
---|
250 | 253 | | 3. The cost of the appraisal requ ired by the provisions of this |
---|
251 | 254 | | section, together with other necessary expenses incurre d pursuant to |
---|
252 | 255 | | this section, shall be paid by the state agency for which the real |
---|
253 | 256 | | property is to be sold from funds available to the state agency for |
---|
254 | 257 | | such expenditure. Al l monies received from the sale or disposal of |
---|
255 | 258 | | the property, except those monies necessary to pay the expenses |
---|
256 | 259 | | incurred pursuant to this section, shall be deposited in the |
---|
257 | 260 | | Maintenance of State Buildings Revolving Fund unless otherwise |
---|
258 | 261 | | provided by law. |
---|
259 | 262 | | 4. The Office of Management and Enterprise Services may dismiss |
---|
260 | 263 | | from consideration any ap praisal found to be incomplete or flawed. |
---|
261 | 264 | | C. Unless otherwise provided by law, the Office of Management |
---|
262 | 265 | | and Enterprise Services shall review and approve state agency rea l |
---|
263 | 266 | | property transactions. A state agency shall not lease or acquire |
---|
292 | 296 | | the state agency. Prior to approval, a state agency s hall provide |
---|
293 | 297 | | documents to the Office and provide reference to statutory or other |
---|
294 | 298 | | legal authority of the state agency to lease or acquire real |
---|
295 | 299 | | property, or lease, dispose of or transfer state -owned real |
---|
296 | 300 | | property. If the state agency intends to lease or acq uire real |
---|
297 | 301 | | property, the state agency shall state the intended use of the real |
---|
298 | 302 | | property, and shall provide the Office with required telework |
---|
299 | 303 | | documentation. Within thirty (30) days of receipt, the Office shall |
---|
300 | 304 | | provide notice of transaction approval or disap proval to the state |
---|
301 | 305 | | agency. |
---|
302 | 306 | | D. The provisions of this section shall not apply to the lease |
---|
303 | 307 | | of office space or real property subject to supervision of the |
---|
304 | 308 | | Commissioners of the Land Office or district boards of education. |
---|
305 | 309 | | E. 1. The Office of Management an d Enterprise Services shall |
---|
306 | 310 | | maintain a comprehensive inventory of state -owned real property and |
---|
307 | 311 | | its use excluding property of the public schools and property |
---|
308 | 312 | | subject to the jurisdiction of the Commissioners of the Land Office. |
---|
309 | 313 | | 2. Each state agency shall, within thirty (30) days of the |
---|
310 | 314 | | closing date for lands newly acquired, provide to the O ffice a list |
---|
311 | 315 | | of records, deeds, abstracts and other title instruments showing the |
---|
312 | 316 | | description of and relating to any and all such lands or interests |
---|
313 | 317 | | therein. |
---|
342 | 347 | | beneficiary, but shall not apply to lands of municipalities, |
---|
343 | 348 | | counties, school districts, or agencies thereof, or Department of |
---|
344 | 349 | | Transportation rights-of-way. |
---|
345 | 350 | | 4. A state agency that sells or otherwise disposes of land |
---|
346 | 351 | | shall notify the Office within thirty (30) days of the disposition |
---|
347 | 352 | | closing date. |
---|
348 | 353 | | F. This section shall not be construed to authorize any state |
---|
349 | 354 | | agency, not otherwise authorize d by law, to sell, lease, or |
---|
350 | 355 | | otherwise dispose of any real property owned by the state. |
---|
351 | 356 | | G. The Office of Management and Enterprise Services and the |
---|
352 | 357 | | Secretary of the Commissioners of the Land Office, or designee, as |
---|
353 | 358 | | provided in subsection L of this section may provide services to |
---|
354 | 359 | | sell, transfer, trade or purchase real property for other sta te |
---|
355 | 360 | | agencies. |
---|
356 | 361 | | H. The Director of the Office of Management and Enterprise |
---|
357 | 362 | | Services shall, pursuant to the Administrative Procedures Act, |
---|
358 | 363 | | promulgate rules to effect procedu res necessary to the fulfillment |
---|
359 | 364 | | of its responsibilities under this section. |
---|
360 | 365 | | I. The Oklahoma Ordnance Works Authority and its lands, and the |
---|
361 | 366 | | Northeast Oklahoma Public Facilities Authority, the Oklahoma |
---|
362 | 367 | | Historical Society, the Oklahoma Department of Transp ortation, the |
---|
363 | 368 | | Oklahoma Turnpike Authority and the Department of Wildlife managed |
---|
392 | 398 | | application of this section for any real prop erty disposed of prior |
---|
393 | 399 | | to November 1, 2006. The Office of the State Treasurer shall be |
---|
394 | 400 | | exempt from the application of this section for the purchase of a |
---|
395 | 401 | | state depository facility. |
---|
396 | 402 | | J. Unless otherwise provided for by law, the procedures |
---|
397 | 403 | | established pursuant to this section for the sale or exchange of |
---|
398 | 404 | | real estate or personal property as aut horized pursuant to Sections |
---|
399 | 405 | | 2222 and 2223 of Title 74 of the Oklahoma Statutes shall be followed |
---|
400 | 406 | | unless the sale is to an entity of state government. |
---|
401 | 407 | | K. The Director of the Office of Management and Enterprise |
---|
402 | 408 | | Services shall contract with experts, professionals or consultants |
---|
403 | 409 | | as necessary to perform the duties of the Office. Selections shall |
---|
404 | 410 | | be made using the qualifications -based procedures established in |
---|
405 | 411 | | Section 62 of this title and the rules promulgated by the Director |
---|
406 | 412 | | for the selection of construction managers and design consultants. |
---|
407 | 413 | | L. 1. No state agency shall sell, lease, exchange, or |
---|
408 | 414 | | otherwise dispose of such real property subject to its jurisdiction, |
---|
409 | 415 | | or lease, purchase or otherwise acquire real property subject to its |
---|
410 | 416 | | jurisdiction, until such agency or the Office of Management and |
---|
411 | 417 | | Enterprise Services acting on the agency ’s behalf has presented to |
---|
412 | 418 | | the Secretary of the Commissioners of the Land Office, or designee, |
---|
413 | 419 | | all information collected pursuant to subparagraph a of paragraph 2 |
---|
442 | 449 | | period to provide a proposal for the acquisition or di sposal of |
---|
443 | 450 | | applicable real property. |
---|
444 | 451 | | 2. The Secretary of the Commissioners of the Land Office or |
---|
445 | 452 | | designee may decline to provide such a proposal; provided such |
---|
446 | 453 | | notice of decline is communicated to the Office of Management and |
---|
447 | 454 | | Enterprise Services in written or electronic form. Upon the |
---|
448 | 455 | | reception of such notice of decline by the Office of Ma nagement and |
---|
449 | 456 | | Enterprise Services, the twenty -calendar-day period otherwise |
---|
450 | 457 | | required by this subsection shall be deemed to have expired. |
---|
451 | 458 | | SECTION 2. AMENDATORY 74 O.S. 2021, Section 63, is |
---|
452 | 459 | | amended to read as follows: |
---|
453 | 460 | | Section 63. A. The Office of Management and Enterprise |
---|
454 | 461 | | Services shall have power to promulgate rules not inconsistent with |
---|
455 | 462 | | the laws of this state. |
---|
456 | 463 | | B. The Office of Management and Ent erprise Services shall have |
---|
457 | 464 | | charge of the construction, repair, maintenance, insurance , and |
---|
458 | 465 | | operation of all buildings owned, used, or occupied by or on behalf |
---|
459 | 466 | | of the state including buildings owned by the Oklahoma Capitol |
---|
460 | 467 | | Improvement Authority where such services are carried out by |
---|
461 | 468 | | contract with the Authority, except as otherwise provided by law. |
---|
462 | 469 | | Whenever feasible, the Office of Management and Enterprise Services |
---|
463 | 470 | | may utilize the Construction Division of the Department of |
---|
492 | 500 | | C. The Director of the Offi ce of Management and Enterprise |
---|
493 | 501 | | Services shall have authority to purchase all material and perform |
---|
494 | 502 | | all other duties necessary in the construction, repair, and |
---|
495 | 503 | | maintenance of all buildings under its management or control, shall |
---|
496 | 504 | | make all necessary contracts by or on behalf of the state for any |
---|
497 | 505 | | buildings or rooms rented for the use of the state or any of the |
---|
498 | 506 | | officers thereof, and shall have charge of the arrangement and |
---|
499 | 507 | | allotment of space in such buildings among the different state |
---|
500 | 508 | | officers except as otherwise provided by law. |
---|
501 | 509 | | D. The Office of Management and Enterprise Services shall not |
---|
502 | 510 | | have any authority or responsibility for buildings, rooms or space |
---|
503 | 511 | | under the management o r control of the University Hospitals |
---|
504 | 512 | | Authority. |
---|
505 | 513 | | E. The Office of Management and Enterprise Services shall have |
---|
506 | 514 | | the custody and control of all state property, and all other |
---|
507 | 515 | | property managed or used by the state, except military stores and |
---|
508 | 516 | | such property under the control of the State Banking Department and |
---|
509 | 517 | | the two houses of the State Legisl ature, shall procure all necessary |
---|
510 | 518 | | insurance thereon against loss and shall allot the use of the |
---|
511 | 519 | | property to the several offices of the state, and prescribe where |
---|
512 | 520 | | the property shall be kept for public use. |
---|

552 | 561 | | under the management or control of CompSource Oklahoma if CompSource |
---|
553 | 562 | | Oklahoma is operating pursuant to a pilot program authorized by |
