5655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5756 SECTION 1. AMENDATORY 61 O.S. 2021, Section 327, as
5857 amended by Section 47, Chapter 2 38, O.S.L. 2022 (61 O.S. Supp. 2024,
5958 Section 327), is amended to read as follows:
6059 Section 327. A. Unless procedures for state agency real
6160 property transactions are otherwise specifically provided for by
6261 law, no state agency shall sell, lease, exchange, o r otherwise
6362 dispose of such real property subject to its jurisdiction, or lease,
6463 purchase or otherwise acquire real property subject to its
6564 jurisdiction, except as authorized by subsection L of this section
65+and as otherwise provided for in this section. A s used in this

92-and as otherwise provided for in this section. As used in this
9393 section, “state agency” means any department, board, commission,
9494 institution, agency or entity of state government.
9595 B. 1. Every state agency shall request the Office of
9696 Management and Enterprise Services to dispose of real property upon:
9797 a. legislative authorization,
9898 b. authorization by the Long -Range Capital Planning
9999 Commission, or
100100 c. a determination, in writing, by the Office of
101101 Management and Enterprise Services or the state agency
102102 that a parcel of real property subject to its
103103 jurisdiction is no longer needed.
104104 2. Upon the request of the state agency to dispose of real
105105 property, the Office of Management and Enterprise Services shall
106106 estimate the value of the property, and:
107107 a. for properties with an estimated value of greater than
108108 Twenty-five Thousand Dollars ($25,000.00), obtain at
109109 least one complete appraisal made by a pe rson
110110 certified by the Real Estate Appraiser Board of the
111111 Oklahoma Insurance Department, who shall ascertain:
112112 (1) the present fair value of the property,
113113 (2) the present value of the improvements on such
114114 property, and
115+(3) the actual condition of the improvements on the
116+property,

141-(3) the actual condition of the improvements on the
142-property,
143144 b. after completion of the provisions of subsection L of
144145 this section, cause notice of such sale to be
145146 published for at least one (1) day in a news paper of
146147 general statewide circulation authorized to publish
147148 legal notices, and weekly for three (3) consecutive
148149 weeks in a newspaper of general circulation published
149150 in the county or counties in which the property is
150151 located. The notice shall contain the legal
151152 description of each parcel of real property to be
152153 offered for sale, the appraised value thereof, the
153154 time and location of the sale or opening of the bids,
154155 and terms of the sale including the fact that no
155156 parcel of property shall be sold for less tha n ninety
156157 percent (90%) of the appraised value of the real
157158 property; provided, in lieu of such procedure, the
158159 information may be published electronically on the
159160 Office of Management and Enterprise Services ’ website
160161 if the notice of sale and instructions on accessing
161162 the public information are published in a newspaper of
162163 general circulation in the county or counties in which
163164 the property is located weekly for three (3)
164165 consecutive weeks,
166+c. offer the property through electronic auction, public
167+auction or sealed bids within three (3) weeks after

191-c. offer the property through electron ic auction, public
192-auction or sealed bids within three (3) weeks after
193195 the last publication of the notice. The property
194196 shall be sold to the highest bidder. The Office of
195197 Management and Enterprise Services shall not accept a
196198 bid of less than ninety percent (90%) of the average
197199 appraised fair value of the property and the
198200 improvements on such property,
199201 d. if the property is being disposed of in compliance
200202 with Section 908 of Title 62 of the Oklahoma Statutes,
201203 the Office may auction the property at public or
202204 electronic auction provided prop er public notice is
203205 given in compliance with this section and the property
204206 has been approved for liquidation by the Long -Range
205207 Capital Planning Commission. The Office of Management
206208 and Enterprise Services is authorized to reject all
207209 bids,
208210 e. if the property has an estimated value of less than
209211 Twenty-five Thousand Dollars ($25,000.00), the Office
210212 of Management and Enterprise Services may establish
211213 the value through market comparison and may dispose of
212214 the property based on estimated value without
213215 obtaining a certified appraisal; provided, however,
216+the sale shall comply with all other require ments of
217+statute, and

240-the sale shall comply with all other require ments of
241-statute, and
242245 f. if the property is landlocked, the Office of
243246 Management and Enterprise Services may offer the
244247 property through indirect sale to the adjacent
245248 property owner for not less than ninety percent (90%)
246249 of fair market value, as determined in compliance with
247250 this section. All sales costs, including any required
248251 surveys and appraisals, shall be at the expense of the
249252 buyer.
250253 3. The cost of the appraisal requ ired by the provisions of this
251254 section, together with other necessary expenses incurre d pursuant to
252255 this section, shall be paid by the state agency for which the real
253256 property is to be sold from funds available to the state agency for
254257 such expenditure. Al l monies received from the sale or disposal of
255258 the property, except those monies necessary to pay the expenses
256259 incurred pursuant to this section, shall be deposited in the
257260 Maintenance of State Buildings Revolving Fund unless otherwise
258261 provided by law.
259262 4. The Office of Management and Enterprise Services may dismiss
260263 from consideration any ap praisal found to be incomplete or flawed.
261264 C. Unless otherwise provided by law, the Office of Management
262265 and Enterprise Services shall review and approve state agency rea l
263266 property transactions. A state agency shall not lease or acquire
267+real property, or lease, dispose of or transfer state -owned real
268+property until the Office provides notice of transaction approval to

290-real property, or lease, dispose of or transfer state -owned real
291-property until the Office provides notice of transaction approval to
292296 the state agency. Prior to approval, a state agency s hall provide
293297 documents to the Office and provide reference to statutory or other
294298 legal authority of the state agency to lease or acquire real
295299 property, or lease, dispose of or transfer state -owned real
296300 property. If the state agency intends to lease or acq uire real
297301 property, the state agency shall state the intended use of the real
298302 property, and shall provide the Office with required telework
299303 documentation. Within thirty (30) days of receipt, the Office shall
300304 provide notice of transaction approval or disap proval to the state
301305 agency.
302306 D. The provisions of this section shall not apply to the lease
303307 of office space or real property subject to supervision of the
304308 Commissioners of the Land Office or district boards of education.
305309 E. 1. The Office of Management an d Enterprise Services shall
306310 maintain a comprehensive inventory of state -owned real property and
307311 its use excluding property of the public schools and property
308312 subject to the jurisdiction of the Commissioners of the Land Office.
309313 2. Each state agency shall, within thirty (30) days of the
310314 closing date for lands newly acquired, provide to the O ffice a list
311315 of records, deeds, abstracts and other title instruments showing the
312316 description of and relating to any and all such lands or interests
313317 therein.
318+3. The provisions of paragraph 2 of this subsection shall apply
319+to all lands of public trusts having a state agency as the primary

340-3. The provisions of paragraph 2 of this subsection shall apply
341-to all lands of public trusts having a state agency as the primary
342347 beneficiary, but shall not apply to lands of municipalities,
343348 counties, school districts, or agencies thereof, or Department of
344349 Transportation rights-of-way.
345350 4. A state agency that sells or otherwise disposes of land
346351 shall notify the Office within thirty (30) days of the disposition
347352 closing date.
348353 F. This section shall not be construed to authorize any state
349354 agency, not otherwise authorize d by law, to sell, lease, or
350355 otherwise dispose of any real property owned by the state.
351356 G. The Office of Management and Enterprise Services and the
352357 Secretary of the Commissioners of the Land Office, or designee, as
353358 provided in subsection L of this section may provide services to
354359 sell, transfer, trade or purchase real property for other sta te
355360 agencies.
356361 H. The Director of the Office of Management and Enterprise
357362 Services shall, pursuant to the Administrative Procedures Act,
358363 promulgate rules to effect procedu res necessary to the fulfillment
359364 of its responsibilities under this section.
360365 I. The Oklahoma Ordnance Works Authority and its lands, and the
361366 Northeast Oklahoma Public Facilities Authority, the Oklahoma
362367 Historical Society, the Oklahoma Department of Transp ortation, the
363368 Oklahoma Turnpike Authority and the Department of Wildlife managed
369+lands shall be exempt from the application of this section. The
370+Grand River Dam Authority and its lands shall be exempt from the

390-lands shall be exempt from the application of this section. The
391-Grand River Dam Authority and its lands shall be exempt from the
392398 application of this section for any real prop erty disposed of prior
393399 to November 1, 2006. The Office of the State Treasurer shall be
394400 exempt from the application of this section for the purchase of a
395401 state depository facility.
396402 J. Unless otherwise provided for by law, the procedures
397403 established pursuant to this section for the sale or exchange of
398404 real estate or personal property as aut horized pursuant to Sections
399405 2222 and 2223 of Title 74 of the Oklahoma Statutes shall be followed
400406 unless the sale is to an entity of state government.
401407 K. The Director of the Office of Management and Enterprise
402408 Services shall contract with experts, professionals or consultants
403409 as necessary to perform the duties of the Office. Selections shall
404410 be made using the qualifications -based procedures established in
405411 Section 62 of this title and the rules promulgated by the Director
406412 for the selection of construction managers and design consultants.
407413 L. 1. No state agency shall sell, lease, exchange, or
408414 otherwise dispose of such real property subject to its jurisdiction,
409415 or lease, purchase or otherwise acquire real property subject to its
410416 jurisdiction, until such agency or the Office of Management and
411417 Enterprise Services acting on the agency ’s behalf has presented to
412418 the Secretary of the Commissioners of the Land Office, or designee,
413419 all information collected pursuant to subparagraph a of paragraph 2
420+of subsection B of this section, and provided the Secretary of the
421+Commissioners of the Land Office or designee a twenty -calendar-day

440-of subsection B of this section, and provided the Secretary of the
441-Commissioners of the Land Office or designee a twenty -calendar-day
442449 period to provide a proposal for the acquisition or di sposal of
443450 applicable real property.
444451 2. The Secretary of the Commissioners of the Land Office or
445452 designee may decline to provide such a proposal; provided such
446453 notice of decline is communicated to the Office of Management and
447454 Enterprise Services in written or electronic form. Upon the
448455 reception of such notice of decline by the Office of Ma nagement and
449456 Enterprise Services, the twenty -calendar-day period otherwise
450457 required by this subsection shall be deemed to have expired.
451458 SECTION 2. AMENDATORY 74 O.S. 2021, Section 63, is
452459 amended to read as follows:
453460 Section 63. A. The Office of Management and Enterprise
454461 Services shall have power to promulgate rules not inconsistent with
455462 the laws of this state.
456463 B. The Office of Management and Ent erprise Services shall have
457464 charge of the construction, repair, maintenance, insurance , and
458465 operation of all buildings owned, used, or occupied by or on behalf
459466 of the state including buildings owned by the Oklahoma Capitol
460467 Improvement Authority where such services are carried out by
461468 contract with the Authority, except as otherwise provided by law.
462469 Whenever feasible, the Office of Management and Enterprise Services
463470 may utilize the Construction Division of the Department of
471+Corrections for the construction a nd repair of buildings for the
472+Department of Corrections.

490-Corrections for the construction and repair of buildings for the
491-Department of Corrections.
492500 C. The Director of the Offi ce of Management and Enterprise
493501 Services shall have authority to purchase all material and perform
494502 all other duties necessary in the construction, repair, and
495503 maintenance of all buildings under its management or control, shall
496504 make all necessary contracts by or on behalf of the state for any
497505 buildings or rooms rented for the use of the state or any of the
498506 officers thereof, and shall have charge of the arrangement and
499507 allotment of space in such buildings among the different state
500508 officers except as otherwise provided by law.
501509 D. The Office of Management and Enterprise Services shall not
502510 have any authority or responsibility for buildings, rooms or space
503511 under the management o r control of the University Hospitals
504512 Authority.
505513 E. The Office of Management and Enterprise Services shall have
506514 the custody and control of all state property, and all other
507515 property managed or used by the state, except military stores and
508516 such property under the control of the State Banking Department and
509517 the two houses of the State Legisl ature, shall procure all necessary
510518 insurance thereon against loss and shall allot the use of the
511519 property to the several offices of the state, and prescribe where
512520 the property shall be kept for public use.
521+F. The Office of Management and Enterprise Services shall keep
522+an accurate account of all property purchased for the state or any
523+of the departments or officers thereof, except that purchased for

539-F. The Office of Management and Enterprise Services shall keep
540-an accurate account of all property purchased for the state or any
541-of the departments or officers thereof, except that pur chased for
542551 and by the two houses o f the State Legislature. The two houses
543552 shall have the exclusive use, care, and custo dy of their respective
544553 chambers, committee rooms, furniture, and property, and shall keep
545554 their respective records of said furniture and property.
546555 G. The Office of Manag ement and Enterprise Services shall not
547556 have any authority or responsibility for property purchased for or
548557 under the management or control of the University Hospitals
549558 Authority except as expressly provided by law.
550559 H. The Office of Management and Enterpris e Services shall not
551560 have any authority or responsibility for property purchased for o r
552561 under the management or control of CompSource Oklahoma if CompSource
553562 Oklahoma is operating pursuant to a pilot program authorized by
554563 Sections 3316 and 3317 of this titl e.
555564 I. The Office of Management and Enterprise Services shall not
556565 have any authority or responsibility for purposes of purchasing and
557566 operating a state depository under the Office of the State
558567 Treasurer.
559568 SECTION 3. NEW LAW A new sec tion of law to be codified
560569 in the Oklahoma Statutes as Section 374 of Title 74, unless there is
561570 created a duplication in numbering, reads as follows:
571+The Office of the State Treasurer may purchase, acquire, lease,
572+and otherwise manage the properties of the Office, and shall not be
573+subject to the provisions of Section 327 of Title 61 of the Oklahoma
574+Statutes for the purposes of purchasing or acquiring such property.

592602 SECTION 4. This act shall become effective July 1, 2025.
593603 SECTION 5. It being immediately necessary for the preservation
594604 of the public peace, heal th or safety, an emergency is hereby
595605 declared to exist, by reason whereof this act shall take effect and
596606 be in full force from and after its passage and approval.
