7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to b e codified
7979 in the Oklahoma Statutes as Section 353.8a of Title 59, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. A pharmacy located outside of this s tate that ships drugs
8282 into this state shall be licensed by the State Board of Pharmacy and
8383 shall be subject to applicable laws of this state including, but not
8484 limited to, the Oklahoma Pharmacy Act and rules promulgated by the
8585 Board.
8686 B. A pharmacy describ ed in subsection A of this section shall
8787 be subject to disciplinary action as p rovided by subsection D of
8888 this section if the pharmacy commits any of the following:

140140 1. Violation of the pharmacy technician -to-pharmacist ratio
141141 prescribed by rules of the Boa rd;
142142 2. Shipping of any drug into this state whose active
143143 ingredients and regimen would be used by the patient to induce an
144144 abortion in violation of state law ;
145145 3. Failure to follow manufacturer storage and delivery
146146 guidelines; or
147147 4. Any other violation a s determined by the Board.
148148 C. The Board shall perform an initial on-site inspection of all
149149 pharmacies that meet the description of subsection A of this
150150 section:
151151 1. Within six (6) months of the effective date of this act if
152152 the pharmacy is in operation on the effective date of this act ; or
153153 2. As soon as practicable if the pharmacy begins operating
154154 after the effective date of this act .
155155 The Board shall also perform subsequent annual on-site
156156 inspections of all pharmacies that meet the description of
157157 subsection A of this section.
158158 D. 1. If, upon inspection, the Board discovers a violat ion
159159 described in subsection B of this section, the Board shall notify
160160 the pharmacist in charge of such violation , shall order the
161161 pharmacist in charge to correct such violation , and shall impose a
162162 fine for each violation not to exceed Fifty Thousand Dollars

215215 2. The Board shall perform an additional on -site inspection of
216216 the pharmacy within ninety (90) days following the notice of
217217 violation to determine whether all violations have been corrected.
218218 3. If all such violations have been corrected, the Board shall
219219 so notify the pharmacist in charge and no additional disciplinary
220220 action shall be taken by the Board; however, the pharmacy shall be
221221 subject to follow-up on-site inspections every six (6) months until
222222 no violations are found for at least two inspections.
223223 4. If the pharmacy refuses or fails to correct a violation, the
224224 Board shall permanently revoke the license of the pharmacy and the
225225 pharmacist in charge.
226226 E. The inspections required by this section shall be performed:
227227 1. Directly by inspectors employed by the Board. The Board
228228 shall not rely solely on inspections performed by out -of-state
229229 regulatory agencies to satisfy the inspection requirements provided
230230 by this section; and
231231 2. At the expense of the pharmacy.
232232 SECTION 2. This act shall become effective November 1, 2025.
