5049 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51-SECTION 1. AMENDATORY 63 O.S. 2021, Section 420, as
52-amended by Section 1, Chapter 182, O.S.L. 2024 (63 O.S. Supp. 2024,
53-Section 420), is amended to rea d as follows:
54-Section 420. A. A person in possession of a state -issued
55-medical marijuana patient license shall be able to:
56-1. Consume marijuana legally;
57-2. Legally possess up to three (3) ounces or eighty -four and
58-nine-tenths (84.9) grams of marijuana on their person;
59-3. Legally possess six mature marijuana plants and the
60-harvested marijuana therefrom;
61-4. Legally possess six seedling plants;
50+SECTION 1. AMENDATORY 63 O.S. 2021, Section 427 .14, as
51+last amended by Section 1, Chapter 342, O.S.L. 2024 (63 O.S. Supp.
52+2024, Section 427.14), is amended to read as follows:
53+Section 427.14. A. There is hereby created the medical
54+marijuana business license, which shall include the following
55+categories:
56+1. Medical marijuana commercial grower;
57+2. Medical marijuana processor;
58+3. Medical marijuana dispensary;

88-5. Legally possess one (1) ounce or twenty -eight and three
89-tenths (28.3) grams of concentrated marijuana;
90-6. Legally possess seventy -two (72) ounces or two thousand
91-thirty-seven and six-tenths (2037.6) grams of edible marijuana;
92-7. Legally possess up to eight (8) ounces or two hundred
93-twenty-six and four-tenths (226.4) grams of marijuana in their
94-residence; and
95-8. Legally possess s eventy-two (72) ounces of topical
96-marijuana.
97-B. Possession of up to one and one -half (1.5) ounces or forty -
98-two and forty-five one-hundredths (42.45) grams of marijuana by
99-persons who can state a medical condition, but are not in posse ssion
100-of a state-issued medical marijuana patient license, shall
101-constitute a misdemeanor offense punishable by a fine not to exceed
102-Four Hundred Dollars ($400.00) and shall not be subject to
103-imprisonment for the offense. Any law enforcement officer who c omes
104-in contact with a person in violation of this subsection and who is
105-satisfied as to the identity of the person, as well as any other
106-pertinent information the law enforcement officer deems necessary,
107-shall issue to the person a written citation contai ning a notice to
108-answer the charge against the person in the appropriate court. Upon
109-receiving the written promise of the alleged violator to answer as
110-specified in the citation, the law enforcement officer shall release
88+B. The Oklahoma Medical Marijuana Authority, with the aid of
89+the Office of Management and Enterprise Services, shall develop a
90+website for medical marijuana business applications.
91+C. The Authority shall make available on its website in an
92+easy-to-find location, applications for a medical marijuana
93+business.
94+D. 1. The annual, nonrefundable fee for a medical marijuana
95+transporter license shall be Two Thousand Five Hundred Dollars
96+($2,500.00).
97+2. The initial, nonrefundable fee for a medical marijuana
98+commercial grower license shall be calculated based upon the total
99+amount of square feet of canopy or acres the grower estimates will
100+be harvested, transferred, or sold for the year. The annual,
101+nonrefundable license fee shall be based upon the total amount of
102+square feet of canopy or acres harvested, transferred, or sol d by
103+the grower during the previous twelve (12) months. The amount of
104+the fees shall be determined as follows:
105+a. For an indoor, greenhouse, or light deprivation
106+medical marijuana grow facility:
107+(1) Tier 1: Up to ten thousand (10,000) square feet
108+of canopy, the fee shall be Two Thousand Five
109+Hundred Dollars ($2,500.00),
110+(2) Tier 2: Ten thousand one (10,001) square feet of
111+canopy to twenty thousand (20,000) square feet of

137-the person upon personal recogniza nce unless there has been a
138-violation of another provision of law.
139-C. The Oklahoma Medical Marijuana Authority shall be
140-established which shall receive applications for medical marijuana
141-patient and caregiver license recipients, dispensaries, growers, and
142-processors within sixty (60) days of the passage of this initiative.
143-D. The Authority shall, within thirty (30) days of passage of
144-this initiative, make available on its website, in an easy -to-find
145-location, an application for a medical marijuana patient license.
146-The license shall be valid for two (2) years. The biannual
147-application fee shall be One Hundred Dollars ($100.00), or Twenty
148-Dollars ($20.00) for individuals on Medicaid, Medicare or
149-SoonerCare. The methods of payment shall be provided on the website
150-of the Authority. Reprints of the medical marijuana patient license
151-shall be Twenty Dollars ($20.00).
152-E. A short-term medical marijuana patient license application
153-shall also be made available on the website of the Authority. A
154-short-term medical marijuana patient l icense shall be granted to any
155-applicant who can meet the requirements for a two -year medical
156-marijuana patient license, but whose physician recommendation for
157-medical marijuana is only valid for sixty (60) days. Short -term
158-medical marijuana patient licenses shall be issued for sixty (60)
159-days. The fee for a short -term medical marijuana patient license,
160-reprints of the short -term medical marijuana patient license, and

187-the procedure for extending or renewing the license shall be
188-determined by the Executive Director of the Authority.
189-F. A temporary medical marijuana patient license application
190-shall also be made available on the website of the Authority for
191-residents of other states. Temporary medical marijuana patient
192-licenses shall be granted to any medical marijuana license holders
193-from other states, provided that such states have state -regulated
194-medical marijuana programs, and applicants can prove they are
195-members of such programs. Temporary medical marijuana patient
196-licenses shall be issued for thirty (30) days. The cost for a
197-temporary license shall be One Hundred Dollars ($100.00). Renewal
198-shall be granted with resubmission of a new application. No
199-additional criteria shall be required. Reprints of the temporary
200-medical marijuana patient license shall be Twenty Dollars ($20.00).
201-G. Medical marijuana patient license applicants shall submit
202-their applications to the Authority for approval. The applicant
203-shall be a resident of this state and shall prove residency by a
204-valid driver license, utility bills, or other accepted methods.
205-H. The Authority shall review the medical marijuana patient
206-license application; approve, reject, or deny the application; and
207-mail the approval, rejection, or denial letter stating any reasons
208-for rejection, to the applicant within fourteen (14) business days
209-of receipt of the application. Approved applicants shall be issued
210-a medical marijuana patient license which shall act as proof of his

191+b. For an outdoor medical marijuana grow facility:
192+(1) Tier 1: Less than two and one -half (2 1/2)
193+acres, the fee shall be Two Thousand Five Hundred
194+Dollars ($2,500.00),
195+(2) Tier 2: More than two and one -half (2 1/2) acres
196+up to five (5) acres, the fee shall be Five
197+Thousand Dollars ($5,000.00),
198+(3) Tier 3: More than five (5) acres up to ten (10)
199+acres, the fee shall be Ten Thousand Dollars
200+($10,000.00),
201+(4) Tier 4: More than ten (10) acres up to twenty
202+(20) acres, the fee shall be Twenty Thousand
203+Dollars ($20,000.00),
204+(5) Tier 5: More than twenty (20) acres up to thirty
205+(30) acres, the fee shall be Thirty Thousand

237-or her approved status. Applications may only be rejected or denied
238-based on the applicant not meeting stated criteria or improper
239-completion of the application the standards set forth in the
240-provisions of the Oklahoma Medical Marijuana and Patient Protection
241-Act and Sections 420 through 427.28 of this title, improper
242-completion of the application, unpaid license or application fees ,
243-or for a reason provided for in the provisions of the Oklahoma
244-Medical Marijuana and Patient Protection Act and Sections 420
245-through 427.28 of this title . If an application is reject ed for
246-failure to provide required information, the applicant shall have
247-thirty (30) days to submit the required information for
248-reconsideration. Unless the Authority determines otherwise, an
249-application that has been resubmitted but contains errors or
250-omissions that are not clerical or typographical in nature shall be
251-denied. The Authority shall deny any application that has been
252-submitted more than once with any errors or omissions that are not
253-clerical or typographical in nature .
254-I. The Authority shal l make available, bot h on its website and
255-through a telephone verification system, an easy method to validate
256-the authenticity of the medical marijuana patient license by the
257-unique twenty-four-character identification number.
258-J. The Authority shall ensur e that all medical marijuana
259-patient and caregiver records and information are sealed to protect
260-the privacy of medical marijuana patient license applicants.
240+(8) Tier 8: If the amount of acreage exceeds fifty
241+(50) acres, the fee shall be Fifty Thousand
242+Dollars ($50,000.00) plus an additional Two
243+Hundred Fifty Dollars ($250.00) per acre.
244+c. For a medical marijuana commercial grow er that has a
245+combination of both indoor and outdoor growing
246+facilities at one location, the medical marijuana
247+commercial grower shall be required to obtain a
248+separate license from the Authority for each type of
249+grow operation and shall be subject to the l icensing
250+fees provided for in subparagraphs a and b of this
251+paragraph.
252+d. As used in this paragraph:
253+(1) “canopy” means the total surface area within a
254+cultivation area that is dedicated to the
255+cultivation of flowering marijuana plants. The
256+surface area of the plant canopy must be
257+calculated in square feet and measured and must
258+include all of the area within the boundaries
259+where the cultivation of the flowering marijuana
260+plants occurs. If the surface of the plant
261+canopy consists of noncontiguous areas, ea ch
262+component area must be separated by identifiable

287-K. A caregiver license shall be made available for qualified
288-caregivers of a medical marijuana pa tient license holder who is
289-homebound. As provided in Section 427.11 of this title, the
290-caregiver license shall provide the caregiver the same rights as the
291-medical marijuana patient licensee including the ability to possess
292-marijuana, marijuana products and mature and immature plants or
293-cultivated medical marijuana pursuant to the Oklahoma Medical
294-Marijuana and Patient Protection Act, but excluding the ability to
295-use marijuana or marijuana products unless the caregiver has a
296-medical marijuana patient lice nse. Applicants for a caregiver
297-license shall submit proof of the license status and homebound
298-status of the medical marijuana patient and proof that the applicant
299-is the designee of the medical marijuana patient. The applicant
300-shall also submit proof th at he or she is eighteen (18) years of age
301-or older and proof of his or her state residency. This shall be the
302-only criteria for a caregiver license. A licensed caregiver shall
303-not cultivate medical marijuana for more than five medical marijuana
304-patient licensees and shall n ot charge a medical marijuana patient
305-licensee for cultivating medical marijuana in excess of the actual
306-costs incurred in cultivating the medical marijuana.
307-L. All applicants for a medical marijuana patient license shall
308-be eighteen (18) years of age or older. A special exception shall
309-be granted to an applicant under the age of eighteen (18); however,
291+used in the cultivation area, the surface area of
292+each tier or shelf must be included in
293+calculating the area of the plant canopy.
294+Calculation of the area o f the plant canopy may
295+not include the areas within the cultivation area
296+that are used to cultivate immature marijuana
297+plants and seedlings, prior to flowering, and
298+that are not used at any time to cultivate mature
299+marijuana plants. If the flowering plant s are
300+vertically grown in cylinders, the square footage
301+of the canopy shall be measured by the
302+circumference of the cylinder multiplied by the
303+total length of the cylinder,
304+(2) “greenhouse” means a structure located outdoors
305+that is completely covered by a material that
306+allows a controlled level of light transmission,
307+and
308+(3) “light deprivation” means a structure that has
309+concrete floors and the ability to manipulate
310+natural light.
311+3. The initial, nonrefundable fee for a medical marijuana
312+processor license shall be Two Thousand Five Hundred Dollars
313+($2,500.00). The annual, nonrefundable license fee for a medical

336-these applications shall be signed by two physicians and the parent
337-or legal guardian of the applicant.
338-M. All applications for a me dical marijuana patie nt license
339-shall be signed by an Oklahoma physician licensed by and in good
340-standing with the State Board of Medical Licensure and Supervision,
341-the State Board of Osteopathic Examiners, or the Board of Podiatric
342-Medical Examiners. The re are no qualifying conditions. A medical
343-marijuana patient license shall be recommended according to the
344-accepted standards a reasonable and prudent physician would follow
345-when recommending or approving any medication. No physician may be
346-unduly stigmatized, penalized, sub jected to discipline, sanctioned,
347-reprimanded or harassed for signing a medical marijuana patient
348-license application;, provided, the physician acted in accordance
349-with the provisions of this subsection and all other rules governing
350-the medical license of the physician in this state.
351-N. Counties and cities may enact medical marijuana guidelines
352-allowing medical marijuana patient license holders or caregiver
353-license holders to exceed the state limits set forth in subsection A
354-of this section.
355-SECTION 2. AMENDATORY 63 O.S. 2021, Section 427.14, as
356-last amended by Section 1, Chapter 342, O.S.L. 2024 (63 O.S. Supp.
357-2024, Section 427.14), is amended to read as follows:
341+marijuana processor license shall be determined based on the
342+previous twelve (12) months as follows:
343+a. Tier 1: The transfer or sale of zero (0) to ten
344+thousand (10,000) pounds of biomass or the production,
345+transfer, or sale of up to one hundred (100) liters of
346+cannabis concentrate, whichever is greater, the annual
347+fee shall be Two Thousand Five Hundred Dollars
348+($2,500.00),
349+b. Tier 2: The transfer or sale of ten thousand one
350+(10,001) pounds to fifty thousand (50,000) pounds of
351+biomass or the production, transfer, or sale of one
352+hundred one (101) to three hundred fifty (350) liters
353+of cannabis concentrate, whichever is greater, the
354+annual fee shall be Five Thousand Dollars ($5,000.00),
355+c. Tier 3: The transfer or sale of fifty thousand one
356+(50,001) pounds to one hundred fifty thousand
357+(150,000) pounds of biomass or the production,
358+transfer, or sale of three hundred fifty -one (351) to
359+six hundred fifty (650) liters of cannabis
360+concentrate, whichever is greater, the annual fee
361+shall be Ten Thousand Dollars ($10,000.00),
362+d. Tier 4: The transfer or sale of one hundred fifty
363+thousand one (150,001) pounds to three hundred
364+thousand (300,000) pounds of bioma ss or the

406-square feet of canopy or acres harvested, transferred, or sold by
392+production, transfer, or sale of six hundred fifty -one
393+(651) to one thousand (1,000) liters of cannabis
394+concentrate, whichever is greater, the annual fee
395+shall be Fifteen Thousand Dollars ($15,000.00), and
396+e. Tier 5: The transfer or sale of more than three
397+hundred thousand one (300,001) pounds of biomass or
398+the production, transfer, or sale in excess of one
399+thousand one (1,001) liters of cannabis concentrate,
400+the annual fee shall be Twenty Thousand Dollars
401+($20,000.00).
402+For purposes of this parag raph only, if the cannabis concentrate
403+is in nonliquid form, every one thousand (1,000) grams of
404+concentrated marijuana shal l be calculated as one (1) liter of
405+cannabis concentrate.
406+4. The initial, nonrefundable fee for a medical marijuana
407+dispensary license shall be Two Thousand Five Hundred Dollars
408+($2,500.00). The annual, nonrefundable license fee for a medical
409+marijuana dispensary license shall be calculated at ten percent
410+(10%) of the sum of twelve (12) calendar months of the combined
411+annual state sales tax and state excise tax of the dispensary during
412+the previous twelve (12) months. The minimum fee shall be not less
413+than Two Thousand Five Hundred Dollars ($2,500.00) and the maximum
414+fee shall not exceed Ten Thousand Dollars ($10,000.00).

445+E. All applicants seeking licensure or licensure renewal as a
446+medical marijuana business shall comply with the following general
447+requirements:
448+1. All applications for licenses and registrations authorized
449+pursuant to this section shall be made upon forms pr escribed by the
450+Authority;
451+2. Each application shall identify the city or county in which
452+the applicant seeks to obtain licensure a s a medical marijuana
453+business;
454+3. Applicants shall submit a complete application to the
455+Authority before the application may be accepted or considered;
456+4. All applications shall be complete and accurate in every
457+detail;
458+5. All applications shall includ e all attachments or
459+supplemental information required by the forms supplied by the
460+Authority;
461+6. All applications for a tr ansporter license, initial
462+dispensary license, initial processor license, or laboratory license
463+shall be accompanied by a full remit tance for the whole amount of
464+the license fee as set forth in subsection D of this section. All

495+($2,500.00). The Authority shall invoice license applicants, if
496+applicable, for any additional licensing fees owed pursuant to
497+subsection D of this section prior to approval of a license
498+application. License fees are nonrefund able;
499+7. All applicants shall be approved for licensing review that,
500+at a minimum, meet the following criteria:
501+a. twenty-five (25) years of age or older,
502+b. if applying as an individual, proof that the applicant
503+is a resident of this state pursuant to pa ragraph 11

505+c. if applying as an entity, proof that seventy -five
506+percent (75%) of all members, managers, executive

493-b. For an outdoor medical marijuana grow facility:
494-(1) Tier 1: Less than two and one -half (2 1/2)
495-acres, the fee shall be Two Thousand Five Hundred
496-Dollars ($2,500.00),
497-(2) Tier 2: More than two and one -half (2 1/2) acres
498-up to five (5) acres, the fee shall be Fiv e

541-(8) Tier 8: If the amount of acreage exceeds fifty
542-(50) acres, the fee shall be Fifty Thousand
543-Dollars ($50,000.00) plus an additional Two
544-Hundred Fifty Dollars ($250.00) per acre.
545-c. For a medical marijuana commercial grower that has a
546-combination of both indoor and outdoor growing
547-facilities at one location, the medical marijuana
548-commercial grower shall be required to obtain a
549-separate license from the Authority fo r each type of
550-grow operation and shall be subject to the licensing
551-fees provided for in subparagraphs a and b of this
552-paragraph.
553-d. As used in this paragraph:
554-(1) “canopy” means the total surface area within a
555-cultivation area that is dedicated to the
543+f. proof that the medical marijuana business, medical
544+marijuana research facility, medical marijuana
545+education facility and medical marijuana waste
546+disposal facility applicant or licensee has not been
547+convicted of a nonviolent felony in the la st two (2)
548+years, or any other felony conviction within the last
549+five (5) years, is not a current inmate in the custody
550+of the Department of Corrections, or currently
551+incarcerated in a jail or corrections facility.
552+Upon reasonable suspicion that a medical marijuana business licensee
553+is illegally growing, processing, transferring, selling, disposing,
554+or diverting marijuana, the Authority, the Oklahoma State Bureau of
555+Narcotics and Dangerous Drugs Control, the Oklahoma State Bureau of
556+Investigation (OSBI), or the Attorney General may subpoena documents
557+necessary to establish the personal identifying information of all
558+owners and individuals with any ownership interest in the business;
559+8. There shall be no limit to the number of medical marijuana
560+business licenses or categories that an individual or entity can
561+apply for or receive, although each application and each category
562+shall require a separate application, application fee, or license
563+fee. A commercial grower, processor and dispensary, or any
564+combination thereof, are authorized to share the same address or
565+physical location, subject to the restrictions set forth in the
566+Oklahoma Medical Marijuana and Patient Protection Act;

583-surface area of the plant canopy must be
584-calculated in square feet and measured and must
585-include all of the area within the boundaries
586-where the cultivation of the flowering marijuana
587-plants occurs. If the surf ace of the plant
588-canopy consists of noncontiguous areas, each
589-component area must be separated by identifiable
590-boundaries. If a tiered or shelving system is
591-used in the cultivation area, the surface area of
592-each tier or shelf must be included in
593-calculating the area of the plant canopy.
594-Calculation of the area of the plant canopy may
595-not include the areas within the cultivation area
596-that are used to cultivate immature marijuana
597-plants and seedlings, prior to flowering, and
598-that are not used at any time to cultivate mature
599-marijuana plants. If the flowering plants are
600-vertically grown in cylinders, the square footage
601-of the canopy shall be measured by the
602-circumference of the cylinder multiplied by the
603-total length of the cylinder,
604-(2) “greenhouse” means a structure located outdoors
605-that is completely covered by a material that
594+9. No medical marijuana business premises is permitted to have
595+multiple licenses of the same type pursuant to the licensing
596+requirements of this section, excluding the following:
597+a. a commercial grower with a combination of an indoor or
598+outdoor growing facility on one parcel of land,
599+b. a licensed medical marijuana processor used by
600+multiple licensees, and
601+c. a licensed medical marijuana business that has an
602+approved application by the Authority while the new
603+business seeks registration from the Oklahoma State
604+Bureau of Narcotics and Dangerous Drugs Control
605+pursuant to Section 2 of this a ct;
606+10. All applicants for a medical marijuana business license,
607+research facility license or education facility license au thorized
608+by the Oklahoma Medical Marijuana and Patient Protection Act, or for
609+a renewal of such license, shall undergo a national fi ngerprint-
610+based background check conducted by the Oklahoma State Bureau of
611+Investigation within thirty (30) days prior to the application for
612+the license, including:
613+a. individual applicants applying on their own behalf,
614+b. individuals applying on behalf o f an entity,
615+c. all principal officers of an entity, and
616+d. all owners of an entity as defined by the Oklahoma
617+Medical Marijuana and Patient Protection Act;

645+11. All applicable fees charged by the OSBI are the
646+responsibility of the applicant and shall not be higher than fees
647+charged to any other person or industry for such background checks;
648+12. In order to be considered a resident of this state for
649+purposes of a medical marijuana business application, all applicants
650+shall provide proof of state residency for at least two (2) years
651+immediately preceding the date of application or five (5) years of
652+continuous state residency dur ing the preceding twenty -five (25)
653+years immediately preceding the date of application. Sufficient
654+documentation of proof of reside ncy shall include a combination of
655+the following:
656+a. an unexpired state-issued driver license,
657+b. a state-issued identification card,
658+c. a utility bill preceding the date of application,
659+excluding cellular telephone and Internet bills,
660+d. a residential property deed to property in this state,
633661 and
634-(3) “light deprivation” means a structure that has
635-concrete floors and the ability to manipulate
636-natural light.
637-3. The initial, nonrefundable fee for a medical marijuana
638-processor license shall be Two Thousand Five Hundred Dollars
639-($2,500.00). The annual, nonrefundable license fee for a medical
640-marijuana processor license shall be determined based on the
641-previous twelve (12) months as follows:
642-a. Tier 1: The transfer or sale of zero (0) to ten
643-thousand (10,000) pounds of biomass or the production,
644-transfer, or sale of up to one hundred (100) liters of
645-cannabis concentrate, whichever is greater, the annual
646-fee shall be Two Thousand Five Hundred Dollars
647-($2,500.00),
648-b. Tier 2: The transfer or sale of ten thousand one
649-(10,001) pounds to fifty thousand (50,000) pounds of
650-biomass or the production, transfer, or sale of one
651-hundred one (101) to three hundred fifty ( 350) liters
652-of cannabis concentrate, whichever is greater, the
653-annual fee shall be Five Thousand Dollars ($5,000.00),
654-c. Tier 3: The transfer or sale of fifty thousand one
655-(50,001) pounds to one hundred fifty thousand
662+e. a rental agreement preceding the date of application
663+for residential property l ocated in this state.
664+Applicants that were issued a medical marijuana business license
665+prior to August 30, 2019, are hereby exempt f rom the two-year or
666+five-year Oklahoma residence requirement mentioned above;
667+13. All license applicants shall be required to submit a

690-production, transfer, or sale of six hundred fifty -one
691-(651) to one thousand (1,000) liters of cannabis
692-concentrate, whichever is greater, the annual fee
693-shall be Fifteen Thousand Dollars ($15,000.00), and
694-e. Tier 5: The transfer or sale of more than three
695-hundred thousand one (300,001) pounds of biomass or
696-the production, transfer, or sale in excess of one
697-thousand one (1,001) liters of cannabis concentrate,

700-For purposes of this paragraph only, if the cannabis concentrate
701-is in nonliquid form, every one thousand (1,000) grams of
702-concentrated marijuana shall be calculated as one (1) liter of
703-cannabis concentrate.
704-4. The initial, nonrefundable fee for a medical marijuana
705-dispensary license shall be Two Thousand Five Hundred Dollars
696+Dangerous Drugs Control as provided in Sections 2 -302 through 2-304
697+of this title;
698+14. All applicants shall establish their identity through
699+submission of a color copy or digital ima ge of one of the following
700+unexpired documents:
701+a. front of a state-issued driver license,
702+b. front of a state-issued identification card,
703+c. a United States passport or other photo identification
704+issued by the United States government, or
705+d. a tribal identification card approved for
706+identification purposes by the Department of Public
707+Safety;
708+15. All applicants shall submit an applica nt photograph; and
709+16. All applicants for a medical marijuana business license
710+seeking to operate a commercial growing oper ation shall file along
711+with their application a bond as prescribed in Section 427.26 of
712+this title.
713+F. The Authority shall review t he medical marijuana business
714+application; approve, reject, or deny the application; and send the
715+approval, rejection, denial, or status -update letter to the
716+applicant in the same method the application was submitted to the
717+Authority within ninety (90) bus iness days of receipt of the

739-5. The annual, nonrefundable license fee for a medical

751+business license for the specific category applied under, which
752+shall act as proof of their approved status. Rejection and denial
753+letters shall provide a reason for the rejection or denial.
754+Applications may only be rejected or denied based on the applicant
755+not meeting the standards set forth in the provisions of th e
756+Oklahoma Medical Marijuana and Patient Protection Act and Sections
757+420 through 426.1 of this title, improper completion of the
758+application, unpaid license or application fees, or for a reason
759+provided for in the Oklahoma Medical Marijuana and Patient
760+Protection Act and Sections 420 through 426.1 of this title. If an
761+application is rejected for failure to provide required information ,
762+the applicant shall have thirty (30) days to submit the required
763+information for reconsideration. Unless the Authority de termines
764+otherwise, an application that has been resubmitted but is still
765+incomplete or contains errors that are not clerical or typ ographical
766+in nature shall be denied. The Authority shall deny any application
767+that has been resubmitted more than once for a material deficiency
768+or recurring clerical error that has not been cured on consecutive

803+submitted to the Authority.
804+H. A license for a medical marijuana business, medical
805+marijuana research facility, medical marijuana education facility or
806+medical marijuana waste disposal facil ity shall not be issued to or
807+held by:
808+1. A person until all required fees have been paid;
809+2. A person who has been convic ted of a nonviolent felony
810+within two (2) years of the date of application, or within five (5)
811+years for any other felony;
812+3. A corporation, if the criminal history of any of its
813+officers, directors or stockholders indicates that the officer,
814+director or stockholder has been convicted of a nonviolent felony
815+within two (2) years of the date of application, or within five (5)
816+years for any other felony;
817+4. A person under twenty -five (25) years of age;
818+5. A person licensed pursuant to this section who, duri ng a
819+period of licensure, or who, at the time of application, has failed

852+6. A sheriff, deputy sheriff, police officer or prosecuting
853+officer, or an officer or employee of the Authority or municipality;
854+7. A person whose authority to be a caregiver, as defined in
855+Section 427.2 of this title, has been revoked by the Authority; or
856+8. A person who was involved in the management or operations of
857+any medical marijuana business, medical marijuana research facility,
858+medical marijuana education facility or medical marijuana waste
859+disposal facility that, after the initiation of a disciplinary
860+action, has had a medical marijuana license revoked, not renewed, or
861+surrendered during the five (5) years preceding submission of the
862+application and for the following violations:
863+a. unlawful sales or purchases,
864+b. any fraudulent acts, falsification of records or
865+misrepresentation to the Authority, medical marijuana
866+patient licensees, caregiver licensees or medical
867+marijuana business licen sees,
868+c. any grossly inaccurate or fraudulent reporting,
869+d. threatening or harming any medical marijuana patient,
870+caregiver, medical practitioner or employee of the
871+Authority,

902-by the Oklahoma Medical Marijuana and Patien t Protection Act, or for
903-a renewal of such license, shall undergo a national fingerprint -
899+e. knowingly or intentionally refusing to permit the
900+Authority access to premise s or records,
901+f. using a prohibited, hazardous substance for processing
902+in a residential area,
903+g. criminal acts relating to the operation of a medical
904+marijuana business, or
905+h. any violations that endanger public health and safety
906+or product safety.
907+I. In investigating the qualifications of an applicant or a
908+licensee, the Authority and municipalities may have access to

911+J. The failure of an applicant or licensee to provide the
912+requested information by the Authority deadline may be grounds for
913+denial of the application.
914+K. All applicants and licensees shall submit information to the
915+Authority in a full, faithful, truthful and fai r manner. The
916+Authority may recommend denial of an application where the applicant
917+or licensee made misstatements, omissions, misrepresentations or
918+untruths in the application or in connection with the background
919+investigation of the applicant. This type of conduct may be grounds
920+for administrative action against the applicant or licensee. Typos
921+and scrivener errors shall no t be grounds for denial.

930-based background check conducted by the Oklahoma State Bureau of
931-Investigation within thirty (30) days prior to the application for
932-the license, including:
933-a. individual applicants applying on their own behalf,
934-b. individuals applying on behalf of an entity,
935-c. all principal officers of an entity, and
936-d. all owners of an entity as defined by the Oklahoma
937-Medical Marijuana and Patient Protection Act;
938-11. All applicable fees charged by the OSBI are the
939-responsibility of the applicant and shall not be higher than fees
940-charged to any other person or industry for such background checks;
941-12. In order to be considered a resident of this state for
942-purposes of a medical marijuana business application, all applicants
943-shall provide proof of state residency for at least two (2) years
944-immediately preceding the date of application or five (5) years of
945-continuous state residency during the preceding twenty -five (25)
946-years immediately preceding the date of application. Sufficient
947-documentation of proof of residency shall include a combination of
948-the following:
949-a. an unexpired state-issued driver license,
950-b. a state-issued identification card,
951-c. a utility bill preceding the date of application,
952-excluding cellular telephone and Internet bills,
949+L. A licensed medical marijuana business premises shall be
950+subject to and responsible for compliance with applicable provisions
951+consistent with the zoning where such business is located as
952+described in the most recent versions of the Oklahoma Uniform
953+Building Code, the International Building Code and the International
954+Fire Code, unless granted an exemption by a municipality or
955+appropriate code enforcement entity.
956+M. All medical marijuana business, medical marijuana research
957+facility, medical marijuana education facility and medical marijuana
958+waste disposal facility licensees shall pay the relevant licensure
959+fees prior to receiving licensure to operate.
960+N. A medical marijuana business, medical marijuana research
961+facility, medical marijuana education facility or medical marijuana
962+waste disposal facility that attempts to renew its license after the
963+expiration date of the license shall pay a late renewal fee of Five
964+Hundred Dollars ($500.00) per week that the license is expired.
965+Late renewal fees are nonrefundable. A license that has been
966+expired for more than sixty (60) calendar days shall not be renewed.
967+Only license renewal applications submitted at least sixty (60)
968+calendar days prior to the expiration date shall be considered
969+timely submitted and subject to the provisions of subsection F of
970+this section. A medical marijuana business license shall remain
971+unexpired during the pendency of the application for renewal

981-e. a rental agreement preceding the date of application
982-for residential property located in this state.
983-Applicants that were issued a m edical marijuana business license
984-prior to August 30, 2019, are hereby exempt from the two -year or
985-five-year Oklahoma residence requirement mentioned above;
986-13. All license applicants shall be required to submit a
987-registration with th e Oklahoma State Bureau of Narcotics and
988-Dangerous Drugs Control as provided in Sections 2-302 through 2-304
989-2-301 through 2-309 of this title;
990-14. All applicants shall establish their identity through
991-submission of a color copy or digital image of one of the following
992-unexpired documents:
993-a. front of a state-issued driver license,
994-b. front of a state-issued identification card,
995-c. a United States passport or other photo identification
996-issued by the United States government, or
997-d. a tribal identification c ard approved for
998-identification purposes by the Department of Public
999-Safety;
1000-15. All applicants shall submit an applicant photograph; and
1001-16. All applicants for a medical marijuana business license
1002-seeking to operate a commercial growing operation shall file along
1000+shall allow renewal applications to be submitted at least one
1001+hundred twenty (120) calendar days prior to the expiration date of a
1002+medical marijuana business license.
1003+O. Except as provided by this section, immediately upon
1004+expiration of a license, any medical marijuana business, medical
1005+marijuana research facility, medical marijuana education facility,
1006+or medical marijuana waste dis posal facility shall cease all
1007+possession, transfer, or sale of medical marijuana or medical
1008+marijuana products. Any contin ued possession, sale, or transfer
1009+shall subject the business owners and operators to felony
1010+prosecution pursuant to the Uniform Cont rolled Dangerous Substances
1011+Act.
1012+P. A medical marijuana business license holder shall require
1013+all individuals employed under his or her license to be issued a
1014+credential pursuant to the provisions of Section 427.14b of this
1015+title prior to employment.
1016+Q. An original medical marijuana business license issued on or
1017+after June 26, 2018, by the Authority, for a medical marijuana
1018+commercial grower, a medical marijuana processor or a medical
1019+marijuana dispensary shall be deemed to have been grandfathered into
1020+the location on the date the original license was first issued for
1021+purposes of determining the authority of the business to conduct and
1022+continue the same type of business at that location under a license
1023+issued by the Authority, except as may be provided in Sections 425

1030-this title.
1031-F. The Authority shall review the medical marijuana business
1032-application; approve, reject, or deny the application; and send the
1033-approval, rejection, denial, or status -update letter to the
1034-applicant in the same method the application was submitted to the
1035-Authority within ninety (90) business days of receipt of the
1036-application.
1037-G. 1. The Authority shall review the medical marijuana
1038-business applications, conduct all in vestigations, inspect ions, and
1039-interviews, and collect all license and application fees before
1040-approving the application.
1041-2. Approved applicants shall be issued a medical marijuana
1042-business license for the specific category applied under, which
1043-shall act as proof of their approved status. Rejection and denial
1044-letters shall provide a reason for the rejection or denial.
1045-Applications may only be rejected or denied based on the applicant
1046-not meeting the standards set forth in the provisions of the
1047-Oklahoma Medical Marijuana and Patient Protection Act and Sections
1048-420 through 426.1 427.28 of this title, improper completion of the
1049-application, unpaid license or application fees, or for a reason
1050-provided for in the Oklahoma Medical Marijuana and Patient
1051-Protection Act and Sections 420 through 426.1 427.28 of this title.

1085-errors or omissions that are not clerical or t ypographical in
1086-nature. The lack of a certificate of occupancy shall not be the
1087-sole cause for denial of an application.
1088-3. Status-update letters shall provide a reason for delay in
1089-either approval, rej ection or denial shou ld a situation arise in
1090-which an application was submitted properly but a delay in
1091-processing the application occurred.
1092-4. Approval, rejection, denial or status -update letters shall
1093-be sent to the applicant in the same method the appl ication was
1094-submitted to the Authority.
1095-H. A license for a medical marijuana business, medical
1096-marijuana research facility, medical marijuana education facility or
1097-medical marijuana waste disposal facility shall not be issued to or
1098-held by:
1099-1. A person until all required fee s have been paid;
1100-2. A person who has been convicted of a nonviolent felony
1101-within two (2) years of the date of application, or within five (5)
1102-years for any other felony;

1129-3. A corporation, if the criminal history of any of its
1130-officers, directors or stockholders indicates that the officer,
1131-director or stockholder has been convicted of a nonviolent felony
1132-within two (2) years of the date of application, or within five (5)
1133-years for any other felony;
1134-4. A person under twenty -five (25) years of age;
1135-5. A person licensed pursuant to this section who, during a
1136-period of licensure, or who, at the time of application, has failed
1137-to:
1138-a. file taxes, interest or penalties due related to a
1139-medical marijuana business, or
1140-b. pay taxes, interest or penalties due related to a
1141-medical marijuana business;
1142-6. A sheriff, deputy sheriff, police officer or prosecuting
1143-officer, or an officer or employee of the Authority or municipality;
1144-7. A person whose authority to be a caregiver, as defined in
1145-Section 427.2 of this title , has been revoked by the Authority; or
1146-8. A person who was involved in the management or operations of
1147-any medical marijuana business, medical marijuana research facility,
1148-medical marijuana education facility or medical marijuana was te
1149-disposal facility that, after the initiation of a disciplinary
1150-action, has had a medical marijuana license revoked, not renewed, or
1151-surrendered during the five (5) years preceding submission of the
1152-application and for the following violations:

1184-c. any grossly inaccurate or fraudulent reporti ng,
1185-d. threatening or harming any medical marijuana patient,
1186-caregiver, medical practitioner or employee of the
1187-Authority,
1188-e. knowingly or intentionally refusing to permit the
1189-Authority access to premises or records,
1190-f. using a prohibited, hazardous substa nce for processing
1191-in a residential area,
1192-g. criminal acts relating to the operation of a medical
1193-marijuana business, or
1194-h. any violations that endanger public health and safety
1195-or product safety.
1196-I. In investigating the qualifications of an applicant or a
1197-licensee, the Authority and municipalities may have access to
1198-criminal history record information furnished by a criminal justice
1199-agency subject to any restrictions imposed by such an agency.

13461060 R. A medical marijuana bus iness license holder shall require
13471061 all individuals employed under their license to be issued a
13481062 credential pursuant to the provisions of Section 427.14b of this
13491063 title prior to employment.
13501064 S. The Executive Director of the Authority may promulgate rules
13511065 to implement the provisions of this section including, but not
13521066 limited to, required application materials to be submitted by the
