53 | 79 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

54 | 80 | | SECTION 1. AMENDATORY 59 O.S. 2021, Section 1873, as |

55 | 81 | | amended by Section 1, Chapter 88, O.S.L. 2023 (59 O.S. Supp. 2024, |

56 | 82 | | Section 1873), is amended to read as follows: |

57 | 83 | | Section 1873. A. There is hereby re -created, to continue until |
---|
58 | 84 | | July 1, 2025, in accordance with the provisions of the Oklahoma |
---|
59 | 85 | | Sunset Law, the Oklahoma Board of Licensed Alcohol and Drug |
---|
60 | 86 | | Counselors, consisting of seven (7) members , to be appointed by the |
---|
61 | 87 | | Governor, with the advice and consent of the Senate, as follows: |
---|
62 | 88 | | 1. a. Six members who shall be alcohol and drug counselors |
---|
63 | 89 | | certified by an entity recognized to do professional |
---|
92 | 142 | | state; provided, however, five of such members shall |
---|
93 | 143 | | subsequently secure licensure and one such member |
---|
94 | 144 | | shall subsequently secure certification, pursuant to |
---|
95 | 145 | | the provisions of the Licensed Alcohol and Drug |
---|
96 | 146 | | Counselors Act, no later than January 1, 2005. |
---|
97 | 147 | | b. Thereafter, five members shall be licensed alcohol and |
---|
98 | 148 | | drug counselors at the time of appointment , and one |
---|
99 | 149 | | member shall be certified as an alcohol and drug |
---|
100 | 150 | | counselor at the time of appointment. |
---|
101 | 151 | | c. Pursuant to the provisions of this paragraph, the |
---|
102 | 152 | | Governor shall appoint: |

103 | 153 | | (1) four members from a list of names submitted by |
---|
104 | 154 | | the Oklahoma Drug and Alcohol Professional |
---|
105 | 155 | | Counselors Association, |
---|
106 | 156 | | (2) one member from a list of names submitted by the |
---|
107 | 157 | | Oklahoma Substance Abuse Services Alliance, and |
---|
108 | 158 | | (3) one member from a list of names subm itted by the |
---|
109 | 159 | | Oklahoma Citizen Advocates for Recovery and |
---|
110 | 160 | | Treatment Association |
---|
111 | 161 | | In selecting appointees, the Governor may consider |
---|
112 | 162 | | recommendations from a statewide organization |
---|
113 | 163 | | representing alcohol and drug counselors, a state |
---|
114 | 164 | | chapter of a national organiz ation representing |
---|
143 | 217 | | representing individuals in recovery, or other groups |
---|
144 | 218 | | or individuals in this state . |
---|
145 | 219 | | d. One member shall be appointed from and shall represent |
---|
146 | 220 | | the general public. Such member shall be a resident |
---|
147 | 221 | | of this state who has attained the age of majority and |
---|
148 | 222 | | shall not be, nor shall ever have been, a licensed or |
---|
149 | 223 | | certified alcohol and drug counselor, or the spouse of |
---|
150 | 224 | | a licensed or certified alcohol and drug counselor, or |
---|
151 | 225 | | a person who has ever had any material financial |
---|
152 | 226 | | interest in the provision of alcohol and drug |
---|
153 | 227 | | counseling services or has engaged in any activity |
---|
154 | 228 | | directly related to the practice of alcohol and drug |
---|
155 | 229 | | counseling. |
---|
156 | 230 | | 2. The composition of the Board shall include five members who |
---|
157 | 231 | | hold a master’s or higher degree and one member whose highest degree |
---|
158 | 232 | | held is a bachelor’s degree. |
---|
159 | 233 | | 3. The Governor shall appoint the members to the Board no later |
---|
160 | 234 | | than July 1, 2004. |
---|
161 | 235 | | B. Each member of the Board appointed as a licensed alcohol and |
---|
162 | 236 | | drug counselor shall: |
---|
163 | 237 | | 1. Be certified or licensed to engage in the practice of |
---|
164 | 238 | | alcohol and drug counseling in this state and shall be in good |
---|
165 | 239 | | standing; and |

197 | 295 | | five-year terms, as designated by the Governor. Thereafter, the |

198 | 296 | | terms of all members shall be five (5) years. |

199 | 297 | | D. A vacancy on the B oard shall be filled in the same manner as |
---|
200 | 298 | | the original appointment for the balance of the unexpired term. |
---|
201 | 299 | | Members may succeed themselves but shall serve no more than two |
---|
202 | 300 | | consecutive terms. Each member shall serve until a successor is |
---|
203 | 301 | | appointed and qualified. |
---|
204 | 302 | | E. Members of the Board may be removed from office for one or |
---|
205 | 303 | | more of the following reasons: |
---|
206 | 304 | | 1. The refusal or inability for any reason to perform the |
---|
207 | 305 | | duties of a Board member in an efficient, responsible and |
---|
208 | 306 | | professional manner; |
---|
209 | 307 | | 2. The misuse of office for pecuniary or material gain or for |
---|
210 | 308 | | personal advantage for self or another; |
---|
211 | 309 | | 3. A violation of the laws or rules governing the practice of |
---|
212 | 310 | | alcohol and drug counseling; or |
---|
213 | 311 | | 4. Conviction of a felony as verified by a certified copy of |
---|
214 | 312 | | the record of the court of conviction. |
