4855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4956 SECTION 1. AMENDATORY 37A O.S. 2021, Section 2-101, as
5057 amended by Section 3, Chapter 338, O.S.L. 2023 (37A O.S. Supp. 2024,
5158 Section 2-101), is amended to read as follows:
5259 Section 2-101. A. Except as otherwise provided in this
5360 section, the licenses issued by the ABLE Alcoholic Beverage Laws
5461 Enforcement (ABLE) Commission, and the annual fees therefor, shall

246257 B. 1. There shall be added to the initial or renewal fees for

249260 ($500.00), which shall be paid at the same time and in the same
250261 manner as the license fees prescribed by paragraph 12 of subsection
251262 A of this section; provided, this fee shall not be assessed against
252263 service organizations or fraternal beneficiary societies which are
253264 exempt under Section 501(c)(19), (8) or (10) of the Internal Revenue
254265 Code of 1986, as amended.
255266 2. There shall be added to the fee for a mixed beverage/caterer
256267 combination license an administrative fee, which shall not be deemed
257268 to be a license fee, in the amount of Two Hundred Fifty Dollars
258269 ($250.00), which shall be paid at the same time and in the same
259-manner as the license fee prescribed by paragraph 13 of subsection A

287299 C. Notwithstanding the provisions of subsection A of this
288300 section:
289301 1. The license fee for a mixed beverage or bottle club license
290302 for those service organizations or fraternal beneficiary societies
291303 which are exempt under Section 501(c)(19), (8) or (10) of the
292304 Internal Revenue Code of 1986, as amended, shall be Five Hundred
293305 Dollars ($500.00) per year; and
294306 2. The renewal fee for an airline/railroad/commercial passenger
295307 vessel beverage license held by a railroad described in 49 U.S.C.,
296308 Section 24301, shall be One Hundred Dollars ($100.00).
297309 D. An applicant may apply for and receive both an on -premises
298310 beer and wine license and a caterer license.
299311 E. All licenses, except as otherwise provided, shall be va lid
300312 for one (1) year from date of issuance unless revoked or
301313 surrendered. Provided, all employee licenses and delivery driver
302314 licenses shall be valid for two (2) years.
303315 F. The holder of a license, issued by the ABLE Commission, for
304316 a bottle club located in a county of this state where the sale of
305317 alcoholic beverages by the individual drink for on -premises
306318 consumption has been authorized, may exchange the bottle club
307319 license for a mixed beverage license or an on -premises beer and wine
308320 license and operate t he licensed premises as a mixed beverage
309-establishment or an on-premises beer and wine establishment subject
310-to the provisions of the Oklah oma Alcoholic Beverage Control Act.

337350 There shall be no additional fee for such exchange and the mixed
338351 beverage license or on-premises beer and wine license issued shall
339352 expire one (1) year from the date of issuance of the original bottle
340353 club license.
341354 G. In addition to the applicable licensing fee, the following
342355 surcharge shall be assessed annually on the following lice nses:

395409 The surcharge shall be paid concurren t with the licensee’s

398412 driver license fee, shall be deposited in the Alcoholic Beverage
399413 Governance Revolving Fund establish ed pursuant to Section 5 -128 of
400414 this title.
401415 H. Any license issued by the ABLE Commission under this title
402416 may be relied upon by other licensees as a valid license, and no
403417 other licensee shall have any obligation to independently determine
404418 the validity of such license or be held liable solely as a
405419 consequence of another licensee ’s failure to maintain a valid
406420 license.
407421 SECTION 2. AMENDATORY 37A O.S. 2021, Section 2 -161, is
408422 amended to read as follows:

439454 1. Only employees Employees of the retail spirit licensee shall
440455 be permitted to make alcoholic beverage product deliveries ,
441456 including curbside, to consumers. Employees licensed as delivery
442457 drivers and independent contractors of delivery service licensees
443458 shall be permitted to make alcoholic beverage product deliveries,
444459 including curbside, to consumers on behalf of a retail spirit
445460 licensee;
446461 2. Payment for alcoholic beverage product delivery by the
447462 retail spirit licensee may be made by cash, check, transportable
448463 credit/debit card processors or advance on-line online payment
449464 methods; and
450465 3. The retail spirit licensee shall be responsible for his or
451466 her delivery employees as provided in Section 2 -133 of Title 37A of
452467 the Oklahoma Statutes this title. An action by a delivery service
453468 licensee or by a delivery driver of a delive ry service licensee
454469 shall not be attributable to the retail spirit licensee with regard
455470 to:
456471 a. providing, selling, or serving alcohol to a minor or
457472 to an intoxicated individual,
458-b. the delivery of alcohol in a dry or otherwise illegal
459-area, unless the retailer has contractually agreed to

500-winery shall be permitted to make alcoholic beverage product

502-2. Payment for alcoholic beverage product delivery by licensed
503-small brewers or small farm wineries may be made by cash, check,
504-transportable credit/debit card processors, or advance on-line
505-online payment methods; and
506-3. Small brewers and small farm wineries shall be responsible
507-for their delivery employees as provided in Section 2 -133 of Title
508-37A of the Oklahoma Statutes this title.

535-C. Restaurants, bars and clubs holding mixed beverage, beer and

551-3. Restaurants, bars and clubs licensed by the Oklahoma ABLE
552-Commission shall be responsible for their delivery employees as
553-provided in Section 2 -133 of Title 37A of the Oklahoma Statutes this

590-4. A restaurant, bar , or club licensee’s responsibility under
591-this title regarding delivery of an alcoholic beverage product to a
592-consumer shall be considered satisfied at the moment the retailer
593-transfers possession of an alcoholic beverage product to the
594-delivery service licensee or the delivery driver of a delivery
595-service licensee.
596-D. Grocery and convenience stores holding a retail beer and/or
597-retail wine license issued by the Oklahoma ABLE Commission may sell
598-curbside and deliver original sealed containers of beer and/or wine
599-only according to the license held to consumers aged twenty -one (21)
505+4. A retail spirit licensee ’s responsibility under this title
506+regarding delivery of alcoholic beverage products to a consumer
507+shall be considered satisfied at the moment the retailer transfers
508+possession of an alcoholic beverage product to the delivery service
509+licensee or the delivery driver of a delivery service licensee.
510+B. Small brewers and small farm wineries licensed by the

683-E. Licensees authorized by this section to make alcoholic

685-utilizing third-party vendors or delivery services for purposes of
686-completing such product deliveries to consumers.
687-F. Licensees authorized by this section to make alcoholic
688-beverage product deliveries to consumers shall comply with the laws,
689-rules, procedures and executive orders i ncumbent on such licensee.
690-G. F. The Oklahoma ABLE Commission is authorized to promul gate
691-rules, regulations, forms and procedures necessary to implement and
692-enforce the provisions of this section.
693-H. G. For purposes of this section each delivery authori zed by
694-a licensee to be made by his or her employee shall be deemed a
695-direct hand-to-hand sale as though the consumer was physically
696-present on the licensed premises and authorized by law by such
697-licensee.
698-H. Notwithstanding any law or rule to the contrar y, a delivery
699-service licensee or a delivery driver of a delivery service
700-licensee, in accordance with Section 3 of this act, may transport
701-and deliver alcoholic beverage products, including curbside, from a
702-retailer or a restaurant, bar, or club holding a mixed beverage,
703-beer and wine, or caterer/mixed beverage license , or a grocery or
704-convenience store holding a retail beer or retail wine license , to a

614+D. Grocery and convenienc e stores holding a retail beer and/or
615+retail wine license issued by the Oklahoma ABLE Commission may sell
616+curbside and deliver original sealed containers of beer and/or wine
617+only according to the license held to consumers aged twenty -one (21)
618+years and older as follows:
619+1. Only employees Employees of such licensed grocery or
620+convenience store shall be permitted to make alcoholic beverage

738-J. A delivery service licensee or a delivery driver of a
739-delivery service licensee who is authorized by law and by
740-contractual agreement with a retailer or a restaurant, bar, or club
741-holding a mixed beverage, beer and wine, or caterer/mixed beverage
742-license to deliver alcoholic beverage products to a consumer shall be
743-liable for violations of alcoholic beverage laws or administrative
744-rules of the ABLE Commission, affecting his or her license privilege
745-to deliver alcoholic beverage products to consumers.
746-K. A retailer or a restaurant, bar, or club holding a mixed
747-beverage, beer and wine, caterer/mixed beverage, or grocery or
748-convenience store license e:
749-1. Is not required to verify that the delivery service licensee
750-or the delivery driver of a delivery service licensee has received
751-delivery driver training or a delivery driver license under this act;
752-and
753-2. Shall not be liable for any reason under this title or
754-statutory or common law for the actions of a delivery service
755-licensee or a delivery driver of a delivery service licensee.
756-L. Notwithstanding any law or rule to the contrary:
650+service licensees shall be permitted to make alcoholic beverage
651+product deliveries, including curbside, to consumers on behalf of a
652+grocery or convenience store licensee;
653+2. Payment for alcoholic beverage product delivery by a
654+licensed grocery or convenience store may be made by cash, check,
655+transportable credit/debit card processors or advance on-line online
656+payment methods; and
657+3. Grocery and convenience store licensees shall be responsible
658+for their delivery employees as provided in Secti on 2-133 of Title
659+37A of the Oklahoma Statutes this title. An action by a delivery
660+service licensee or a delivery driver of a delivery service licensee
661+shall not be attributable to the grocery or convenience store
662+licensee with regard to:

792-discriminating between any retailers or groups of retailers in
793-advertising, fees, and costs of online search results.
794-M. 1. In any county with a population of sixty-five thousand
795-(65,000) or less according to the most recent Federal Decennial
796-Census, any delivery service licensee or delivery driver of a
797-delivery service licensee engaged in an authorized delivery shall
798-only do so within fifteen (15) miles from the location of the
799-licensed premises of the retailer.
800-2. In any county with a population greater than sixty-five
801-thousand (65,000) according to the most recent Federal Decennial
802-Census, any delivery service licensee or delivery driver of a deliver
803-service licensee engaged in an authorized delivery shall only do so
804-within five (5) miles from the location of the licensed premise s of
805-the retailer.
806-N. A delivery service licensee shall not :
701+the delivery service licensee or the delivery driver of a deliv ery

838-license, rectifier license, or nonresident seller license ; or
839-3. Engage in central warehousing.
840-O. Any delivery of alcoholic beverage products conducted by a
841-delivery service licensee or by a delivery driver of a delivery
842-service licensee shall only be done from the premise s of the retail
843-licensee.
844-SECTION 3. NEW LAW A new section of law to be codified
845-in the Oklahoma Statutes as Section 2 -161.1 of Title 37A, unless
846-there is created a duplication in numbering, read s as follows:
847-A. For the purposes of this section, “retail licensee” or
848-“retailer” means a retailer or a restaurant, bar, or club holding a
849-mixed beverage, beer and wine, or caterer/mixed beverage license, or
850-a grocery or convenience store holding a retai l beer or retail wine
851-license.
852-B. Any individual, limited liability company, corporation, or
853-partnership that is registered to do business in this state,
854-regardless of the residency of the ownership of the entity, may
855-apply for and be issued a delivery se rvice license that authorizes
856-the licensee to deliver alcoholic beverages from a retailer licensed

753+personal use and not for resale.

885-twenty-one (21) years of age or older for the individual ’s personal

887-C. To receive a delivery service license, an applicant shall:
888-1. File an application with the ABLE Commission;
889-2. Provide to the ABLE Commission a sample contract that the
890-applicant intends to enter into with a retail licensee for the
891-delivery of alcoholic beverage produc ts, unless the applicant is the
892-holder of a retail license or operates under the same parent company
893-as the retail license holder;
894-3. Submit to the ABLE Commission an ou tline of internal or
895-external training for delivery driver licensees that addresses
896-topics including, but not limited to, identifying underage persons,
897-intoxicated persons, and fake or altered identification;
898-4. Provide an attestation that the applicant i s twenty-one (21)
899-years of age or older and has not been convicted of a felony in any
900-state or federal court;
901-5. Provide proof of a general liability insurance policy in an
902-amount not less than One Million Dollars ($1,000,000.00) per
903-occurrence; and
904-6. Be properly registered to conduct business in this state.
905-D. A delivery service licensee:

945-electronic means for the sale and delivery of alcoholic beverage
946-products. If payment is not received at the time of the order, the
947-delivery service licensee may act as an agent of the retail licensee
948-in the collection of payment from the sale of alcoholic beverage
949-products, but the full amount of each order must be handled in a
950-manner that gives the retail licensee control over the ultimate
951-receipt of the payment from the consumer with the retail licensee
952-operating as the merchant of record. The reta il licensee shall
953-remain responsible for the proper remittance of all applicable taxes
954-on the sale of the product;

983-5. Shall obtain from the consumer a confirmation that he or she
984-is twenty-one (21) years of age or older at the time the order is

986-6. Shall require the recipient, at the time of delivery, to
987-provide valid photo identification verifying that he or she is
988-twenty-one (21) years of age or older, and sign for the delivery;
989-7. Shall possess identification scanning software technology or
990-a state-of-the-art alternative at the point of delivery to
991-authenticate that th e recipient is twenty -one (21) years of age or
992-older, and collect the recipient ’s name and date of birth;
993-8. Shall return all alcoholic beverage products to the retail
994-licensee if the recipient is under twenty -one (21) years of age,
995-appears intoxicated, f ails to provide proof of identification, fails
996-or refuses to sign for delivery, fails to complete the
997-identification verification process, declines to accept the delivery
998-of an alcoholic beverage product, or if any circumstances in the
999-delivery environment indicate illegal conduct, overconsumption, or
1000-any otherwise unsafe environment for the consumption of alcohol.
1001-Such return shall occur on the same business day ;
1002-9. May not deliver any alcoholic beverage product to any person
1003-located within a dry jurisdi ction in this state;

1030-10. Shall pick up alcoholic beverage products for delivery only
1031-during lawful sales hours in that jurisdiction for the retail
1032-licensee, provided that orders may be delivered and completed on the
1033-same day or within a reasonable time th ereafter. No order shall be
1034-picked up by a delivery driver licensee after 11:00 p.m. to ensure
1035-delivery no later than midnight;
1036-11. Shall permit the ABLE Commission to perform an audit of the
1037-delivery driver or delivery service licensee ’s records upon request
1038-and with sufficient notification;
1039-12. Shall be deemed to have consented to the jurisdiction of
1040-the ABLE Commission and the courts of this state pursuant to this
1041-section and any related laws or rules; and
1042-13. Shall be responsible for delivery of alc oholic beverage
1043-products pursuant to this act.
1044-E. A delivery service licensee may renew his or her license
1045-with the ABLE Commission by maintaining all qualifications, paying
1046-annually a renewal fee of Ten Thousand Dollars ($10,000.00), and
1047-providing the ABLE Commission with a copy of the current license.
1048-The annual fee for delivery service licensees shall be collected by
1049-the ABLE Commission for deposit and credit to the General Revenue
1050-Fund of this state.
1051-F. 1. A delivery service licensee shall be authorized to
1052-charge the consumer a delivery fee but shall not charge, add on, or
1053-collect any portion of the amount of the retail sales price for the

1084-Any order containing alcoholic beverage products shall have an
1085-independent delivery fee of Fifteen Dollars ( $15.00) or fifteen
1086-percent (15%), whichever is greater , of the alcoholic beverage
1087-product subtotal separate and exclusive from nonalcoholic beverage
1088-product items in the delivery.
1089-2. A fee shall be remitted to the ABLE Commission of One Dollar
1090-($1.00) for each delivery performed by a delivery driver or delivery
1091-service licensee to be apportioned as follows:
1092-a. fifty cents ($0.50) shall be deposited into the
1093-Alcoholic Beverage Governance Revolving Fund for the
1094-purpose of funding an ABLE Commission division with
1095-the sole purpose of enforcing trade practice
1096-violations, and
1097-b. fifty cents ($0.50) shall be deposited in the general
1098-fund to be used specifically for the treatment of
1099-alcoholic abuse by the Department of Mental Health and
1100-Substance Abuse Services.
1101-G. Nothing in this act shall be construed to require a
1102-technology services company to o btain a delivery service license if
1103-the company does not employ or contract with delivery driver or
1003+receipt of the payment from the consumer with the retail licensee
1004+operating as the merchant of record. The reta il licensee shall
1005+remain responsible for the proper remittance of all applicable taxes
1006+on the sale of the product;
1007+4. Shall deliver only sealed containers of alcoholic beverage
1008+products;
1009+5. Shall obtain from the consumer a confirmation that he or she
1010+is twenty-one (21) years of age or older at the time the order is
1011+placed;
1012+6. Shall require the rec ipient, at the time of delivery, to
1013+provide valid photo identification verifying that he or she is
1014+twenty-one (21) years of age or older, and sign for the delivery;
1015+7. Shall possess identification scanning software technology or
1016+a state-of-the-art alternative at the point of delivery to
1017+authenticate that the recipient is twenty -one (21) years of age or
1018+older, and collect the recipient ’s name and date of birth;
1019+8. Shall return all alcoholic beverage products to the retail
1020+licensee if the recipient is under twenty-one (21) years of age,
1021+appears intoxicated, fails to provide proof of identification, fails
1022+or refuses to sign for delivery, fails to complete the
1023+identification verification process, declines to accept the delivery
1024+of an alcoholic beverage product, or if any circumstances in the
1025+delivery environment indicate illegal conduct, overconsumption, or

1130-delivery service licensees, and solely p rovides software or a
1131-digital network application that connects consumers and retailer
1132-licensees for the delivery of alcoholic beverage products from the
1133-retail licensee. However, the act of connecting consumers to
1134-delivery driver and delivery service licensees shall serve to grant
1135-jurisdiction to this state.
1136-H. The ABLE Commission shall enforce the requirements of th is
1137-section by the same administrative proceedings that apply to all
1138-other alcoholic beverage licensees.
1139-I. The ABLE Commission shall enforce the requirements of this
1140-section against any delivery driver or delivery service licensee .
1141-Delivery to a minor shall be treated as furnishing alcohol to a
1142-minor and shall result in any applicable disciplinary action. The
1143-retail licensee shall not be held liable for violations that occur
1144-after transferring possession of the alcoholic beverage product to
1145-the delivery driver or delivery service licensee .
1146-J. Nothing in this act shall be construed to authorize the
1147-direct shipment of alcohol, liquor, wine, or beer from any
1148-manufacturer.
1149-K. No person shall use a license or exercise any privileges
1150-granted by the license except pursuant to this act.
1151-L. No alcoholic beverage products shall be delivered to or left
1152-unattended at a resident or business address except for the delivery
1053+any otherwise unsafe environment for the consumption of alcohol.
1054+Such return shall occur on the same business day ;
1055+9. May not deliver any alcoholic bevera ge product to any person
1056+located within a dry jurisdiction in this state;
1057+10. Shall pick up alcoholic beverage products for delivery only
1058+during lawful sales hours in that jurisdiction for the retail
1059+licensee, provided that orders may be delivered and com pleted on the
1060+same day or within a reasonable time thereafter. No order shall be
1061+picked up by a delivery driver licensee after 11:00 p.m. to ensure
1062+delivery no later than midnight;
1063+11. Shall permit the ABLE Commission to perform an audit of the
1064+delivery driver or delivery service licensee ’s records upon request
1065+and with sufficient notification;
1066+12. Shall be deemed to have consented to the jurisdiction of
1067+the ABLE Commission and the courts of this state pursuant to this
1068+section and any related laws or rul es; and
1069+13. Shall be responsible for delivery of alcoholic beverage
1070+products pursuant to this act.
1071+E. A delivery service licensee may renew his or her license
1072+with the ABLE Commission by maintaining all qualifications, paying
1073+annually a renewal fee of Te n Thousand Dollars ($10,000.00), and
1074+providing the ABLE Commission with a copy of the current license.
1075+The annual fee for delivery service licensees shall be collected by

1181-M. The ABLE Commission shall be authorized to promulgate rules,
1182-regulations, forms, and procedures necessary to implement and
1183-enforce the provisio ns of this section.
1184-N. Each delivery authorized by a delivery driver or delivery
1185-service licensee to be made to a consumer shall be deemed a direct
1186-hand-to-hand sale as though the consumer was physically present on
1187-the licensed premises and authorized by such license.
1188-O. Nothing in this section shall authorize a retai l licensee to
1189-engage in central warehousing of alcohol ic beverage products , nor
1190-shall it allow a delivery service licensee to purchase from a
1191-licensed wholesaler or nonresident seller for res ale.
1192-SECTION 4. NEW LAW A new section of law to be codified
1193-in the Oklahoma Statutes as Section 2 -161.2 of Title 37A, unless
1194-there is created a duplication in numbering, reads as follows:
1195-A. For the purposes of this section, “retail licensee” or
1196-“retailer” means a retailer or a restaurant, bar, or club holding a
1197-mixed beverage, beer and wine, or caterer/mixed beverage license, or
1198-a grocery or convenience store holding a retail beer or retail wine
1199-license.
1200-B. A delivery driver or delivery service license shall
1201-authorize the delivery of alcoholic beverage products to a consumer
1202-for personal use and not for resale pursuant to this act.
1103+the ABLE Commission for deposit and credit to the General Revenue
1104+Fund of this state.
1105+F. 1. A delivery service licensee shall be authorized to
1106+charge the consumer a delivery fee but shall not charge, add on, or
1107+collect any portion of the amount of the retail sales price for the
1108+alcoholic beverage product from the retail licensee. A delivery
1109+driver or delivery service licensee shall not engage in the free
1110+delivery of alcoholic beverage products. Alcoholic beverage
1111+products may not be delivered under any subscription delivery plan.
1112+Any order containing alcoholic beverage products shall have an
1113+independent delivery fee of Fifteen Dollars ($15.00) or fifteen
1114+percent (15%), whichever is greater , of the alcoholic beverage
1115+product subtotal separate and exclusive from nonalcoholic beverage
1116+product items in the delivery.

1229-C. Applicants for a delivery driver license shall be twenty -one
1230-(21) years of age or older. As a prerequisite to the issuance of a
1231-delivery driver license, not later than fourteen (14) days after
1232-initial licensure, a first -time applicant shall be required to have
1233-successfully completed a training program conducted by the ABLE
1234-Commission, or by another e ntity approved by the Commission
1235-including, but not limited to, an in -house training program
1236-conducted by the delivery service licensee. Proof of training
1237-completion shall be made available by the delivery service licensee
1238-or the delivery driver licensee for inspection by the ABLE
1239-Commission. The failure of a delivery driver licensee to c omply
1240-with this section may constitute a revocable offense.
1241-D. In the event the ABLE Commission denies an application for a
1242-delivery driver license, the ABLE Commission shall provide written
1243-notice to the licensee or licensees the applicant provides delivery
1244-services for, if any. The notice shall be given at the time notice
1245-is provided to the applicant.
1246-E. Notwithstanding any law or rule to the contrary , a delivery
1247-service licensee with training approved by the ABLE Commission may
1248-purchase delivery drive r licenses on behalf of the delivery drivers
1249-and may provide such delivery drivers with such permits upon
1250-successful completion of the delivery service licensee’s approved
1251-training.
