75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 8 O.S. 2021, Section 143, is
77	77	amended to read as follows:
78	78	Section 143. In any county of this state, the board of county
79	79	commissioners is hereby authorized and empowered to utilize
80	80	employees under its jurisdiction and county -owned tools, machinery,
81	81	equipment, and materials for the purposes of opening and closing
82	82	graves and maintaining and improving any publicly owned cemetery or
83	83	other cemetery within the county not owned and maintained by an
84	84	individual or private organization; provided , that, there is a
85	85	documented and known tribal burial presence, and where appropriate,
86	86	a reasonable fee, not to exceed the actual cost of the service, may
87	87	be charged for such services.
