58 | 57 | | BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA: |

59 | 58 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
60 | 59 | | in the Oklahoma Statutes as Section 6 -517 of Title 2, unless there |
---|
61 | 60 | | is created a duplication in numbering, reads as follows: |

62 | 61 | | A. For purposes of this section , “commercial harvesting |
---|
63 | 62 | | facility” means a privately or publicly owned premises managed or |
---|
64 | 63 | | engaged on a business basis for the harvesting or hunting of legally |
---|
65 | 64 | | acquired and privately owned cervidae, which may include w hite- |
---|
66 | 65 | | tailed deer, mule deer, and elk, cervidae hybrids, turkey, exotic |
---|
94 | 94 | | sell, or for the possession with intent to sell for profit or |
---|
95 | 95 | | monetary gain. |
---|
96 | 96 | | B. No person may propagate or hold in captivity any wildlife or |
---|
97 | 97 | | domesticated animals hunted for sport for a commercial harvesting |
---|
98 | 98 | | facility without having procured a commercial harvesting facility |
---|
99 | 99 | | license from the Oklahoma Department of Agriculture, Food, and |
---|
100 | 100 | | Forestry. A commercial harvesting faci lity shall be issued a |
---|
101 | 101 | | commercial harvesting facility license upon completion of an |
---|
102 | 102 | | application and adherence to all applicable laws and rules governing |
---|
103 | 103 | | the harvesting of legally acquired cervidae , which may include |
---|
104 | 104 | | white-tailed deer, mule deer, and elk, cervidae hybrids, turkey, |
---|
105 | 105 | | exotic species, and exotic hybrid species harvested in a commercial |
---|
106 | 106 | | harvesting facility. Nothing in this section shall allow a person |
---|
107 | 107 | | to propagate or hold in captivity any wildlife belonging to the |
---|
108 | 108 | | state. |
---|
109 | 109 | | C. Before obtaining a commercial harvesting facility license or |
---|
110 | 110 | | renewal of a license, the applicant shall submit proof that any |
---|
111 | 111 | | additional wildlife or domesticated animals have been secured from a |
---|
112 | 112 | | source other than wild stock in this state. |
---|
113 | 113 | | D. The Secretary of Agriculture, State Veterinarian, or his or |
---|
114 | 114 | | her designees shall have the authority to inspect a commercial |
---|
115 | 115 | | harvesting facility and its operations at any time upon evidence of |
---|
116 | 116 | | probable cause that a violation of this section or of the Oklahoma |
---|

153 | 154 | | G. The Department shall promulgate rules as necessary to |

154 | 155 | | implement the provisions of this section . |

155 | 156 | | SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -106, is |

203 | 205 | | B. Before obtaining a an upland game license or a renewal of a |

204 | 206 | | license the applicant shall submit proof that such wildlife or |

205 | 207 | | domesticated animals hunted for sport will be or have been secured |
---|
206 | 208 | | from a source other than the wild stock in this state. Any person |
---|
207 | 209 | | obtaining or renewing a an upland game license shall submit a true |
---|
208 | 210 | | and complete inventory of said the animals before a license shall be |
---|
209 | 211 | | approved. Each license shall specifically list the different |
---|
210 | 212 | | species and/or subspecies to be hunted on the listed hunting area or |
---|
211 | 213 | | premises. |

212 | 214 | | C. Any game warden of the Oklahoma Department of Wildlife |
---|
213 | 215 | | Conservation shall have authority to inspect any and all records and |
---|
214 | 216 | | invoices pertaining to the commercial hunting operations of any |
---|
215 | 217 | | person licensed or requesting licensure pursuant to subsection B of |
---|

255 | 258 | | E. All licenses An upland game license issued pursuant to this |

256 | 259 | | section shall expire on June 30 of each year. |

257 | 260 | | F. Exemptions from this li cense requirement shall be operators |
---|
258 | 261 | | of running pens used for the performance test or training of dogs. |
---|
259 | 262 | | Operators of such running pens may acquire coyotes from wild stock |
---|
260 | 263 | | without having to possess a fur dealer ’s license for such purpose |
---|
261 | 264 | | and no license shall be required of those involved in pe rformance |
---|
262 | 265 | | testing or training dogs in such running pens so long as no other |
---|
263 | 266 | | wildlife are taken or hunted in any manner. |

264 | 267 | | G. Any person convicted of violating the provisions of this |
---|
265 | 268 | | section shall be punished by a fine of not less than Five Hundred |
---|
266 | 269 | | Dollars ($500.00) nor more than One Thousand Five Hundred Dollars |

302 | 306 | | SECTION 3. This act shall become effective July 1, 2025. |

303 | 307 | | SECTION 4. It being immediately necessary for the preservation |

304 | 308 | | of the public peace, health or safety, an emergency is he reby |
---|
305 | 309 | | declared to exist, by reason whereof this act shall take effect and |
---|
