5650 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5751 SECTION 1. NEW LAW A new section of law to be codified
5852 in the Oklahoma Statutes as Sect ion 6060.5b of Title 36, unless
5953 there is created a duplication in numbering, reads as follows:
6054 A. For the purposes of this section:
6155 1. “Clinical utility” means clinical utility as defined
6256 pursuant to Section 6060.5a of Title 36 of the Oklahoma Statutes;
6357 2. “Evidence-based cancer imaging ” means appropriate
6458 preventative screening and imag ing supported by evidence;
59+3. “Genetic testing for an inherited mutation ” means multi-gene
60+testing for an inherited mutation associated with an increased risk
61+of cancer;

92-3. “Genetic testing for an inherited mutation ” means multi-gene
93-testing for an inherited mutation associated with an increased risk
94-of cancer;
9588 4. “Health benefit plan” means a health benefit plan as defined
9689 pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes; and
9790 5. “Health care provider ” means any physician, hospital, or
9891 other entity or person that is licensed or otherwise authoriz ed in
9992 this state to furnish health care services.
10093 B. Any health benefit plan includi ng the Oklahoma Employees
10194 Insurance Plan that is offered, issued, or renewed in this state on
10295 or after the effective date of this act shall provide coverage for:
10396 1. Clinical genetic testing for an inherited gene mutation for
10497 individuals with a personal or family history of cancer when such
10598 test provides clinical utility and when ordered or recommended by a
10699 health care provider in accordance with medical and scientific
107100 evidence including, but not limited to:
108101 a. the most recent version of the National Compre hensive
109102 Cancer Network (NCCN) clinical practice
110103 recommendations that are Category 2A or higher,
111104 b. Centers for Medicare and Medicaid Services national
112105 coverage determinati ons or Medicare administrative
113106 contractor local coverage determinations, or
114107 c. nationally recognized clinical practice guidelines;

109+2. Evidence-based cancer imaging for individuals with an
110+increased risk of cancer when such test provides clinical utili ty
111+and when ordered or recommended by a health care provider in

143-2. Evidence-based cancer imaging for individuals with an
144-increased risk of cancer when such test provides clinical utility
145-and when ordered or recommended by a health care provider in
146138 accordance with the m ost recent version of the NCCN clinical
147139 practice recommendations that are Category 2A or higher, or in
148140 accordance with other nationally recognized clinical practice
149141 guidelines.
150142 C. Coverage under this section shall not be subject to any
151143 annual deductibles, copayments, or coinsurance limits as established
152144 for all covered benefits under the health benefit plan.
153145 D. If application of this section would result in health
154146 savings account ineligibility under Section 223 of the Internal
155147 Revenue Code of 1986, as amended, the provisions of this section
156148 shall only apply to health savings accounts with qualified high
157149 deductible health plans with respect to the deductible of such a
158150 plan after the enrollee has satisfied the minimum deductible.
159151 Provided, however, the provisions of this section shall apply to
160152 items or services that are preventive care pursuant to Section
161153 223(c)(2)(C) of the Internal Revenue Code of 1986, as amended,
162154 regardless of whether the minimum deductible has been satisfied.
163155 SECTION 2. This act shall become effective November 1, 2025.
