56	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	51		SECTION 1. NEW LAW A new section of law to be codified
58	52		in the Oklahoma Statutes as Sect ion 6060.5b of Title 36, unless
59	53		there is created a duplication in numbering, reads as follows:
60	54		A. For the purposes of this section:
61	55		1. “Clinical utility” means clinical utility as defined
62	56		pursuant to Section 6060.5a of Title 36 of the Oklahoma Statutes;
63	57		2. “Evidence-based cancer imaging ” means appropriate
64	58		preventative screening and imag ing supported by evidence;
	59	+	3. “Genetic testing for an inherited mutation ” means multi-gene
	60	+	testing for an inherited mutation associated with an increased risk
	61	+	of cancer;

92		-	3. “Genetic testing for an inherited mutation ” means multi-gene
93		-	testing for an inherited mutation associated with an increased risk
94		-	of cancer;
95	88		4. “Health benefit plan” means a health benefit plan as defined
96	89		pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes; and
97	90		5. “Health care provider ” means any physician, hospital, or
98	91		other entity or person that is licensed or otherwise authoriz ed in
99	92		this state to furnish health care services.
100	93		B. Any health benefit plan includi ng the Oklahoma Employees
101	94		Insurance Plan that is offered, issued, or renewed in this state on
102	95		or after the effective date of this act shall provide coverage for:
103	96		1. Clinical genetic testing for an inherited gene mutation for
104	97		individuals with a personal or family history of cancer when such
105	98		test provides clinical utility and when ordered or recommended by a
106	99		health care provider in accordance with medical and scientific
107	100		evidence including, but not limited to:
108	101		a. the most recent version of the National Compre hensive
109	102		Cancer Network (NCCN) clinical practice
110	103		recommendations that are Category 2A or higher,
111	104		b. Centers for Medicare and Medicaid Services national
112	105		coverage determinati ons or Medicare administrative
113	106		contractor local coverage determinations, or
114	107		c. nationally recognized clinical practice guidelines;

	110	+	increased risk of cancer when such test provides clinical utili ty
	111	+	and when ordered or recommended by a health care provider in

143		-	2. Evidence-based cancer imaging for individuals with an
144		-	increased risk of cancer when such test provides clinical utility
145		-	and when ordered or recommended by a health care provider in
146	138		accordance with the m ost recent version of the NCCN clinical
147	139		practice recommendations that are Category 2A or higher, or in
148	140		accordance with other nationally recognized clinical practice
149	141		guidelines.
150	142		C. Coverage under this section shall not be subject to any
151	143		annual deductibles, copayments, or coinsurance limits as established
152	144		for all covered benefits under the health benefit plan.
153	145		D. If application of this section would result in health
154	146		savings account ineligibility under Section 223 of the Internal
155	147		Revenue Code of 1986, as amended, the provisions of this section
156	148		shall only apply to health savings accounts with qualified high
157	149		deductible health plans with respect to the deductible of such a
158	150		plan after the enrollee has satisfied the minimum deductible.
159	151		Provided, however, the provisions of this section shall apply to
160	152		items or services that are preventive care pursuant to Section
161	153		223(c)(2)(C) of the Internal Revenue Code of 1986, as amended,
162	154		regardless of whether the minimum deductible has been satisfied.
163	155		SECTION 2. This act shall become effective November 1, 2025.
