56 | 57 | | SECTION 1. NEW LAW A new section of law to be codified |

57 | 58 | | in the Oklahoma Statutes as Section 426.2 of Title 63, unless there |

58 | 59 | | is created a duplication in numbering, reads as follows: |

59 | 60 | | A. The Oklahoma Medical Marijuana Authority shall require all |

60 | 61 | | medical marijuana co mmercial growers licensed as an indoor grow |
---|
61 | 62 | | facility operating within the corporate limits of a municipal ity to |
---|
62 | 63 | | submit an odor control plan on or before January 1, 2027. An odor |
---|

102 | 102 | | c. the timing and duration of odor -emitting activities; |

104 | 104 | | 3. Odor mitigation best management practices , which shall |

106 | 106 | | a. odor mitigation practices to be deployed to control |
---|
107 | 107 | | odor-emitting activities, sources, and locations, |

108 | 108 | | b. how such practices will be utilized, and |
---|
109 | 109 | | c. during what times such practices will be utilized. |

110 | 110 | | B. If a medical marijuana business receives three or mor e odor |

111 | 111 | | nuisance complaints within a thirty -day period, the business shall |

662 | 651 | | a. a commercial grower with a combination of an indoor or |
---|
663 | 652 | | outdoor growing facility o n one parcel of land, |

664 | 653 | | b. a licensed medical marijuana processor used by |

812 | 798 | | b. an affidavit confirming the odor control plan on file |

813 | 799 | | is current. |
---|
814 | 800 | | F. The Authority shall review the medical marijuana business |
---|
815 | 801 | | application; approve, reject, or deny the application; and send the |
---|
816 | 802 | | approval, rejection, denial, or status -update letter to the |
---|
817 | 803 | | applicant in the same method the application was submitted to the |
---|
818 | 804 | | Authority within ninety (90) business days of receipt of the |
---|
819 | 805 | | application. |

820 | 806 | | G. 1. The Authority shall review the medical marijuana |

865 | 850 | | otherwise, an application that has been resubmitted but is still |

866 | 851 | | incomplete or contains errors that are not clerical or typographical |

867 | 852 | | in nature shall be denied. |

868 | 853 | | 3. Status-update letters shall provide a reason for delay in |

869 | 854 | | either approval, rejection or denial should a situation arise in |

870 | 855 | | which an application was submitted properly but a delay in |

970 | 953 | | e. knowingly or intentionally refusing to permit the |
