5556 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5657 SECTION 1. NEW LAW A new section of law to be codified
5758 in the Oklahoma Statutes as Section 426.2 of Title 63, unless there
5859 is created a duplication in numbering, reads as follows:
5960 A. The Oklahoma Medical Marijuana Authority shall require all
6061 medical marijuana co mmercial growers licensed as an indoor grow
6162 facility operating within the corporate limits of a municipal ity to
6263 submit an odor control plan on or before January 1, 2027. An odor
6364 control plan shall include:
6465 1. Facility information including, but not limit ed to:

9393 b. the contact information of the owner or operator,
9494 c. the facility’s physical and mailing address,
9595 d. the facility type,
9696 e. the facility’s hours of operation, and
9797 f. a description of the facility ’s operations;
9898 2. Facility odor emissions information including, but not
9999 limited to:
100100 a. the facility floor plan,
101101 b. odor-emitting activities, and
102102 c. the timing and duration of odor -emitting activities;
103103 and
104104 3. Odor mitigation best management practices , which shall
105105 include:
106106 a. odor mitigation practices to be deployed to control
107107 odor-emitting activities, sources, and locations,
108108 b. how such practices will be utilized, and
109109 c. during what times such practices will be utilized.
110110 B. If a medical marijuana business receives three or mor e odor
111111 nuisance complaints within a thirty -day period, the business shall
112112 be required to submit an odor c ontrol plan to the Authority.
113113 C. The Authority shall promulgate rules as necessary to
114114 implement the provisions of this section.

142141 SECTION 2. AMENDATORY 63 O.S. 2021, Section 427.14, as
143142 last amended by Section 1, Chapter 342, O.S.L. 2024 (63 O.S. Supp.

145144 Section 427.14. A. There is hereby created the medical
146145 marijuana business license, which shall include the following
147146 categories:
148147 1. Medical marijuana commercial grower;
149148 2. Medical marijuana processor;
150149 3. Medical marijuana dispensary;
151150 4. Medical marijuana transporter; and
152151 5. Medical marijuana testing laboratory.
153152 B. The Oklahoma Medical Marijuana Authority, with the aid of
154153 the Office of Management and Enterprise Services, shall develop a
155154 website for medical marijuana business applications.
156155 C. The Authority shall make available on its website in an
157156 easy-to-find location, applications for a medical marijuana
158157 business.
159158 D. 1. The annual, nonrefundable fee for a medical marijuana
160159 transporter license shall be Two Thousand Five Hundred Dollars
161160 ($2,500.00).
162161 2. The initial, nonrefundable fee for a medical marijuana
163162 commercial grower license shall be calculated based upon the total
164163 amount of square feet of canopy or acres the grower estimates will
165164 be harvested, transferred, or sold for the year. The annual,

194192 square feet of canopy or acres harvested, transferred, or sold by
195193 the grower during the previous twelve (12) months . The amount of
196194 the fees shall be determined as follows:
197195 a. For an indoor, greenhouse, or light deprivation
198196 medical marijuana grow facility:
199197 (1) Tier 1: Up to ten thousand (10,000) square feet
200198 of canopy, the fee shall be Two Thousand Five

202200 (2) Tier 2: Ten thousand one (10,001) square feet of

309305 c. For a medical marijuana commercial grower that has a
310306 combination of both indoor and outdoor g rowing
311307 facilities at one location, the medical marijuana
312308 commercial grower shall be required to obtain a
313309 separate license from the Authority for each t ype of
314310 grow operation and shall be subject to the licensing
315311 fees provided for in subparagraphs a and b of this
316312 paragraph.

344339 d. As used in this paragraph:
345340 (1) “canopy” means the total surface area within a
346341 cultivation area that is dedicated to the
347342 cultivation of flowering marijuana plants. The
348343 surface area of the plant canopy must be
349344 calculated in square feet a nd measured and must
350345 include all of the area within the boundaries
351346 where the cultivation of the flowering marijuana
352347 plants occurs. If the surface of t he plant
353348 canopy consists of noncontiguous areas, each
354349 component area must be separated by identifiable
355350 boundaries. If a tiered or shelving system is
356351 used in the cultivation area, the surface area of
357352 each tier or shelf must be included in
358353 calculating the area of the plant canopy.
359354 Calculation of the area of the plant canopy may
360355 not include the areas within th e cultivation area
361356 that are used to cultivate immature marijuana
362357 plants and seedlings, prior to flowering, and
363358 that are not used at any time to cultiva te mature
364359 marijuana plants. If the flowering plants are
365360 vertically grown in cylinders, the square footage
366361 of the canopy shall be measured by the

395389 total length of the cylinder,
396390 (2) “greenhouse” means a structure located outdoors
397391 that is completely covered by a material that
398392 allows a controlled level of light tran smission,

400394 (3) “light deprivation” means a structure that has
401395 concrete floors and the ability to manipulate
402396 natural light.
403397 3. The initial, nonrefun dable fee for a medical marijuana
404398 processor license shall be Two Thousand Five Hundred Dollars
405399 ($2,500.00). The annual, nonrefundable license fee for a medical
406400 marijuana processor license shall be determined based on the
407401 previous twelve (12) months as fol lows:
408402 a. Tier 1: The transfer or sale of zero (0) to ten
409403 thousand (10,000) pounds of biomass or the prod uction,
410404 transfer, or sale of up to one hundred (100) liters of
411405 cannabis concentrate, whichever is greater, the annual
412406 fee shall be Two Thousand Five Hu ndred Dollars
413407 ($2,500.00),
414408 b. Tier 2: The transfer or sale of ten thousand one
415409 (10,001) pounds to fifty thousand (50,000) pounds of
416410 biomass or the production, transfer, or sale of one
417411 hundred one (101) to three hundred fifty (350) liters

446439 annual fee shall be Five Thousand Dollars ($5,000.00),
447440 c. Tier 3: The transfer or sale of fifty thousand one
448441 (50,001) pounds to one hundred fifty thousand
449442 (150,000) pounds of biomass or the production,
450443 transfer, or sale of three hundred fifty -one (351) to
451444 six hundred fifty (650) liters of cannabis
452445 concentrate, whichever is greater, the annual fee
453446 shall be Ten Thousand Dollars ($10,000.00),
454447 d. Tier 4: The transfer or sale of one hundred fifty
455448 thousand one (150,001) pounds to three hundred
456449 thousand (300,000) pounds of biomass or the
457450 production, transfer, or sale of six hundred fifty-one
458451 (651) to one thousand (1,000) liters of cannabis
459452 concentrate, whichever is greater, the annual fee
460453 shall be Fifteen Thousand Dollars ($15,00 0.00), and
461454 e. Tier 5: The transfer or sale of more than three
462455 hundred thousand one (300,001) pounds of biomass or
463456 the production, transfer, or sale in excess of one
464457 thousand one (1,001) liters of cannabis concentrate,
465458 the annual fee shall be Twenty Thousa nd Dollars
466459 ($20,000.00).
467460 For purposes of this paragraph only, if the cannabis concentrate
468461 is in nonliquid form, every one thousand (1,000) grams of

497489 cannabis concentrate.
498490 4. The initial, nonref undable fee for a medical marijuana
499491 dispensary license shall be Two Thousand Five Hundred Dollars
500492 ($2,500.00). The annual, nonrefundable license fee for a medical
501493 marijuana dispensary license shall be calculated at ten percent
502494 (10%) of the sum of twelve ( 12) calendar months of the combined
503495 annual state sales tax and state excise tax of the dispensary during
504496 the previous twelve (12) months. The minimum fee shall be not less
505497 than Two Thousand Five Hundred Dollars ($2,500.00) and the maximum
506498 fee shall not exceed Ten Thousand Dollars ($10,000.00).
507499 5. The annual, nonrefundable license fee for a medical
508500 marijuana testing laboratory shall be Twenty Thousand Dollars
509501 ($20,000.00).
510502 E. All applicants seeking licensure or licensure renewal as a
511503 medical marijuana bus iness shall comply with the following general
512504 requirements:
513505 1. All applications for licenses and registr ations authorized
514506 pursuant to this section shall be made upon forms prescribed by the
515507 Authority;
516508 2. Each application shall identify the city or county in which
517509 the applicant seeks to obtain licensure as a medical marijuana
518510 business;

546537 3. Applicants shall submit a complete application to the
547538 Authority before the application may be accepted or considered;
548539 4. All applications shall be complete and accurate in every
549540 detail;
550541 5. All applications shall include all attachments or
551542 supplemental information required by the forms supplied by the
552543 Authority;
553544 6. All applications for a transporter license, initial
554545 dispensary license, initial processor license, or testing laboratory
555546 license shall be accompanied by a full remittance for the whole
556547 amount of the license fee as set forth in subsection D of this
557548 section. All submissions of commercial grower applications, renewal
558549 processor applications, and renewal dispensar y applications shall be
559550 accompanied by a remittance of a fee of Two Thousand Five Hundred
560551 Dollars ($2,500.00). The Authority shall invoice license
561552 applicants, if applicable, for any additional licensing fees owed
562553 pursuant to subsection D of this section p rior to approval of a
563554 license application. License fees are nonrefundable;
564555 7. All applicants shall be approved for licensing review that,
565556 at a minimum, meet the following criteria:
566557 a. twenty-five (25) years of age or older,
567558 b. if applying as an individua l, proof that the applicant
568559 is a resident of this state pursuant to paragraph 11
569560 12 of this subsection,

597587 c. if applying as an entity, proof that seventy -five
598588 percent (75%) of all members, managers, executive
599589 officers, partners, board members or any other fo rm of
600590 business ownership are residents of this state
601591 pursuant to paragraph 11 12 of this subsection,
602592 d. if applying as an individual or entity, proof that the
603593 individual or entity is registered to conduct business
604594 in this state,
605595 e. disclosure of all owners hip interests pursuant to the
606596 Oklahoma Medical Marijuana and Patient Protection Act,
607597 and
608598 f. proof that the medical marijuana business, medical
609599 marijuana research facility, medical marijuana
610600 education facility and medical marijuana waste
611601 disposal facility applicant or licensee has not been
612602 convicted of a nonviolent felony in the last two (2)
613603 years, or any other felony conviction within the last
614604 five (5) years, is not a current inmate in the custody
615605 of the Department of Corrections, or currently
616606 incarcerated in a jail or corrections facility.
617607 Upon reasonable suspicion that a medical marijuana business licensee
618608 is illegally growing, processing, transferring, selling, disposing,
619609 or diverting marijuana, the Authority, the Oklahoma State Bureau of
620610 Narcotics and Dangerous Drugs Control, the Oklahoma State Bureau of

648637 Investigation (OSBI), or the Attorney General may subpoena documents
649638 necessary to establish the personal identifying information of all
650639 owners and individuals with any ownership interest in the business;
651640 8. There shall be no limit to the number of medical marijuana
652641 business licenses or categories that an in dividual or entity can
653642 apply for or receive, although each application and each category
654643 shall require a separate application, application fee, or lice nse
655644 fee. A commercial grower, processor and dispensary, or any
656645 combination thereof, are authorized to share the same address or
657646 physical location, subject to the restrictions set forth in the
658647 Oklahoma Medical Marijuana and Patient Protection Act;
659648 9. No medical marijuana business premises is permitted to have
660649 multiple licenses of the same type pursuant to th e licensing
661650 requirements of this section, excluding the following:
662651 a. a commercial grower with a combination of an indoor or
663652 outdoor growing facility o n one parcel of land,
664653 b. a licensed medical marijuana processor used by
665654 multiple licensees, and
666655 c. a licensed medical marijuana business that has an
667656 approved application by the Authority while the new
668657 business seeks registration from the Oklahoma State
669658 Bureau of Narcotics and Dangerous Drugs Control
670659 pursuant to Section 2 427.14c of this act title;

698686 10. All applicants for a medical marijuana business license,
699687 research facility license or education facility license authorized
700688 by the Oklahoma Medical Marijuana and Patient Protection Act, or for
701689 a renewal of such license, shall undergo a national fingerprint -
702690 based background check conducted by the Oklahoma State Bureau of
703691 Investigation within thirty (30) days prior to the application for
704692 the license, including:
705693 a. individual applicants applying on their own behalf,
706694 b. individuals applying on behalf of an entity,
707695 c. all principal officers of an entity, and
708696 d. all owners of an entity as defined by the Oklahoma
709697 Medical Marijuana and Patient Protection Act;
710698 11. All applicable fees charged by the OSBI are the
711699 responsibility of the applicant and shall not be higher than fees
712700 charged to any other person or industry for such background checks;
713701 12. In order to be considered a resident of this state for
714702 purposes of a medical marijuana business application, all applicants
715703 shall provide proof of state residency for at least tw o (2) years
716704 immediately preceding the date of application or five (5) years of
717705 continuous state residency during the preceding twenty -five (25)
718706 years immediately preceding the date of application. Sufficient
719707 documentation of proof of residency shall include a combination of
720708 the following:
721709 a. an unexpired state-issued driver license,

750737 c. a utility bill preceding the date of application,
751738 excluding cellular telephone and Internet bills,
752739 d. a residential property deed to p roperty in this state,

754741 e. a rental agreement preceding the date of application
755742 for residential property located in this state.
756743 Applicants that were issued a medical marijuana business license
757744 prior to August 30, 2019, are hereby exempt from the two -year or
758745 five-year Oklahoma residence requirement mentioned above;
759746 13. All license applicants shall be required to submit a
760747 registration with the Oklahoma State Bureau of Narcotics and
761748 Dangerous Drugs Control as provided in Sections 2-302 2-301 through
762749 2-304 2-309 of this title;

802788 seeking to operate a commercial growing operation shall file along
803789 with their application a bond as prescribed in Section 427.26 of

805791 17. All applicants for a medical marijuana commercial grower
806792 license shall submit an odor control plan pursuant to Section 1 of
807793 this act. Renewal medical marijuana commercial growe r license
808794 applications shall require:
809795 a. a current odor control plan when a licensee ’s odor
810796 control plan is inconsistent with the odor control
811797 plan on file with the Authority, or
812798 b. an affidavit confirming the odor control plan on file
813799 is current.
814800 F. The Authority shall review the medical marijuana business
815801 application; approve, reject, or deny the application; and send the
816802 approval, rejection, denial, or status -update letter to the
817803 applicant in the same method the application was submitted to the
818804 Authority within ninety (90) business days of receipt of the
819805 application.
820806 G. 1. The Authority shall review the medical marijuana
821807 business applications, conduct all investigations, inspections, and
822808 interviews, and collect all license and application fees before
823809 approving the application.

851836 2. Approved applicants shall be issued a medical marijuana
852837 business license for the specific category applied under, which
853838 shall act as proof of their approved status. Rejection and denial
854839 letters shall provide a reason for the rejection or denial.
855840 Applications may only be rejected or denied based on the applicant
856841 not meeting the standards set forth in the provisions of the
857842 Oklahoma Medical Marijuana and Patient Protection Act and Sections
858843 420 through 426.1 of this title, improp er completion of the
859844 application, unpaid license or application fees, or for a reason
860845 provided for in the Oklahoma Medical Marijuana and Patient
861846 Protection Act and Sections 420 through 426.1 of this title. If an
862847 application is rejected for failure to prov ide required information,
863848 the applicant shall have thirty (30) days to submit the required
864849 information for reconsideration. Unless the Authority determines
865850 otherwise, an application that has been resubmitted but is still
866851 incomplete or contains errors that are not clerical or typographical
867852 in nature shall be denied.
868853 3. Status-update letters shall provide a reason for delay in
869854 either approval, rejection or denial should a situation arise in
870855 which an application was submitted properly but a delay in
871856 processing the application occurred.
872857 4. Approval, rejection, denial or status -update letters shall
873858 be sent to the applicant in the same method the application was
874859 submitted to the Authority.

902886 H. A license for a medical marijuana business, medical
903887 marijuana research facility, medical marijuana education facility or
904888 medical marijuana waste disposal facility shall not be issued to or
905889 held by:
906890 1. A person until all required fees have been paid;
907891 2. A person who has been convicted of a nonviolent felony
908892 within two (2) years of the date of application, or within five (5)
909893 years for any other felony;
910894 3. A corporation, if t he criminal history of any of its
911895 officers, directors or stockholders indicates that the officer,
912896 director or stockholder has been convicted of a nonvi olent felony
913897 within two (2) years of the date of application, or within five (5)
914898 years for any other felony;
915899 4. A person under twenty -five (25) years of age;
916900 5. A person licensed pursuant to this section who, during a
917901 period of licensure, or who, at the time of application, has failed
918902 to:
919903 a. file taxes, interest or penalties due related to a
920904 medical marijuana business, or
921905 b. pay taxes, interest or penalties due related to a
922906 medical marijuana business;
923907 6. A sheriff, deputy sheriff, police officer or prose cuting
924908 officer, or an officer or employee of the Authority or municipality;

952935 7. A person whose authority to be a caregiver, as defined in
953936 Section 427.2 of this title, has been revoked by the Authority; or
954937 8. A person who was involved in the management or operations of
955938 any medical marijuana business, medical marijuana research facility,
956939 medical marijuana educ ation facility or medical marijuana waste
957940 disposal facility that, after the initiation of a disciplinary
958941 action, has had a medical marijuana license re voked, not renewed, or
959942 surrendered during the five (5) years preceding submission of the
960943 application and for the following violations:
961944 a. unlawful sales or purchases,
962945 b. any fraudulent acts, falsification of records or
963946 misrepresentation to the Authority, m edical marijuana
964947 patient licensees, caregiver licensees or medical
965948 marijuana business licensees,
966949 c. any grossly inaccurate or fraudulent reporting,
967950 d. threatening or harming any medical marijuana patient,
968951 caregiver, medical practitioner or employee of the
969952 Authority,
970953 e. knowingly or intentionally refusing to permit the
971954 Authority access to premises or records,
972955 f. using a prohibited, hazardous substance for processing
973956 in a residential area,
974957 g. criminal acts relating to the operation of a medical
975958 marijuana business, or
976959

1005987 I. In investigating the qualifications of an applicant or a
1006988 licensee, the Authority and municipalities may have access to
1007989 criminal history record information furnished by a criminal justice
1008990 agency subject to any restrictions imposed by such an agency.
1009991 J. The failure of an applicant or licensee to provide the
1010992 requested information by the Authority deadline may be grounds for
1011993 denial of the application.
1012994 K. All applicants an d licensees shall submit information to the
1013995 Authority in a full, faithful, truthful and fair manner. The
1014996 Authority may recommend denial of an application where the applicant
1015997 or licensee made misstatements, omissions, misrepresentations or
1016998 untruths in the application or in connection with the background
1017999 investigation of the applicant. This type of conduct may be grounds
10181000 for administrative action against the applicant or licensee. Typos
10191001 and scrivener errors shall not be grounds for denial.
10201002 L. A licensed medical marijuana business premises shall be
10211003 subject to and responsible for compliance with applicable pro visions
10221004 consistent with the zoning where such business is located as
10231005 described in the most recent versions of the Oklahoma Uniform
10241006 Building Code, the I nternational Building Code and the International
10251007 Fire Code, unless granted an exemption by a municipality or
10261008 appropriate code enforcement entity.

10541035 M. All medical marijuana business, medical marijuana research
10551036 facility, medical marijuana education facility and medical marijuana
10561037 waste disposal facility licensees shall pay the relevant licensure
10571038 fees prior to receiving licensure to operate.
10581039 N. A medical marijuana business, medical marijuana research
10591040 facility, medical marijuana education facility or medical ma rijuana
10601041 waste disposal facility that attempts to renew its license after the
10611042 expiration date of the license shall pay a late renewal fee of Five
10621043 Hundred Dollars ($500.00) per week that the license is expired.
10631044 Late renewal fees are nonrefundable. A licens e that has been
10641045 expired for more than sixty (60) calendar days shall not be renewed.
10651046 Only license renewal applications submitted at least sixty (60)
10661047 calendar days prior to the expiration date shall be considered
10671048 timely submitted and subject to the provisi ons of subsection F of
10681049 this section. A medical marijuana business license shall remain
10691050 unexpired during the pendency of the application for renewal
10701051 provided that such application was timely submitted. The Authority
10711052 shall allow renewal applications to be submitted at least one
10721053 hundred twenty (120) calendar days prior to the expiration date of a
10731054 medical marijuana business license.
10741055 O. Except as provided by this section, immediately upon
10751056 expiration of a license, any medical marijuana business, medical
10761057 marijuana research facility, medical marijuana education facility,
10771058 or medical marijuana waste disposal facility shall cease all

11081088 prosecution pursuant to the Uniform Controlled Dangero us Substances

11101090 P. A medical marijuana business license holder shall require
11111091 all individuals employed under his or her license to be issued a
11121092 credential pursuant to the provisions of Section 427.14b of this
11131093 title prior to employment.
11141094 Q. An original medical marijuana business license issued on or
11151095 after June 26, 2018, by the Authority, for a medical marijuana
11161096 commercial grower, a medical marijuana pro cessor or a medical
11171097 marijuana dispensary shall be deemed to have been grandfathered into
11181098 the location on the date the original license was first issued for
11191099 purposes of determining the authority of the business to conduct and
11201100 continue the same type of busin ess at that location under a license
11211101 issued by the Authority, except as may be provided in Sections 425
11221102 and 426.1 of this title. Any change in ownership after the original
11231103 medical marijuana business license has been issued by the Authority
11241104 shall be construed by the Authority to be a continuation of the same
11251105 type of business originally licensed at that locati on. Nothing
11261106 shall authorize the Authority to deny issuance or renewal of a
11271107 license or transfer of license due to a change in ownership for the
11281108 same business location previously licensed, except when a revocation

11661145 marijuana business licensing fees pursuant to this section.
11671146 SECTION 3. This act shall become effective November 1, 2025.
