5389 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5490 SECTION 1. AMENDATORY 37A O.S. 2021, Section 2 -109, as
5591 amended by Section 2, Chapter 90, O.S.L. 2024 (37A O.S. Supp. 2024,
5692 Section 2-109), is amended to read as follows:
5793 Section 2-109. A. A retail spirits license shall authorize the
5894 holder thereof:
59-1. To purchase wine or spirits from a wine and spirits
60-wholesaler;
61-2. To purchase beer from a beer distributor or from the holder
62-of a small brewer self -distribution license;
63-3. To sell same on the licensed premises in such containers to
64-consumers for off-premises consumption only and not for resale;

146+1. To purchase wine or spirits from a wine and spirits

148+2. To purchase beer from a beer distributor or from the holder
149+of a small brewer self -distribution license;
150+3. To sell same on the licensed premises in such containers to
151+consumers for off-premises consumption only and not for resale;
92152 provided, spirits, wine and beer may be sold to charitable
93153 organizations that are holders of charitable alcoholic beverage
94154 auction or charitable alcoholic beverage event licenses; and
95155 4. To host alcoholic beverage tastings consistent with
96156 subsections D and E of this section.
97157 B. A retail wine license shall authorize the holder thereof:
98158 1. To purchase wine from a wine and spirits wholesaler;
99159 2. To purchase wine from a small farm winemaker who is permitt ed
100160 and has elected to self -distribute as provided in Article XXVIII -A
101161 of the Oklahoma Constitution;
102162 3. To sell same on the licensed premises in such containers to
103163 consumers for off-premises consumption only and not for resale;
104164 provided, wine may be sold t o charitable organizations that are
105165 holders of charitable alcoholic beverage au ction or charitable
106166 alcoholic beverage event licenses; and
107167 4. To host an alcoholic beverage tasting, consistent with
108168 subsections D and E of this section.
109-Provided, no holder of a retail wine license may sell wine with
110-alcohol beverage volum e in excess of fifteen percent (15%).
111-C. A retail beer license shall authorize the holder thereof:
112-1. To purchase beer from a beer distributor;
113-2. To purchase beer from the holder of a small brewer self -

147231 4. To host alcoholic beverage tastings consistent with
148232 subsections D and E of this section.
149233 Provided, no holder of a retail beer license may sell a malt
150234 beverage with alcohol bevera ge volume in excess of fifteen percent
151235 (15%).
152236 D. All tastings conducted under this section shall:
153237 1. Be conducted under the direct supervision of the licensee
154238 authorized to host the tasting;
155239 2. Be poured by any ABLE Commission licensee lawfully permitte d
156240 to serve alcoholic beverages, provided no wine or spirits
157241 wholesaler, beer distributor or employee of a wine or spirits
158242 wholesaler or beer distributor shall be allowed to pour samples for
159243 tastings;
160-3. Use alcoholic beverages purchased by the licensee authorized
161-to host the tastings from a licensed wine and spirits w holesaler,
162-beer distributor, self -distributor, small brewer or self -
163-distributing winery authorized to sell the same, a nd the licensee
164-shall pay the applicable taxes on the alcoholic beverages purchased;

295+3. Use alcoholic beverages purchased by the licensee au thorized
296+to host the tastings from a licensed wine and spirits wholesaler,
297+beer distributor, self-distributor, small brewer or self -
298+distributing winery authorized to sell the same, and the licensee
299+shall pay the applicable taxes on the alcoholic beverages purchased;
192300 provided, the licensee may only provide samples of alcoholic
193301 beverages that its license is authorized to sell;
194302 4. Be restricted to persons twenty -one (21) years of age or
195303 older;
196304 5. Be limited to no more than one (1) fluid ounce of spirits,
197305 two (2) fluid ounces of wine or three (3) fluid ounces of beer per
198306 consumer per day; and
199307 6. Be consumed on the licensed premises of the licensee
200308 authorized to host the tastings or at a location other than the
201309 licensed premises, provided no samples served on the licensed
202310 premises shall be permitted to be removed from the licensed
203311 premises.
204312 E. All licensees authorized to serve samples pursuant to
205313 subsection D of this section shall ensure that:
206314 1. All samples are poured only from original sealed packaging;
207315 2. Any alcoholic beverages remaining in unsealed packaging used
208316 to provide samples, excluding spirits, are poured out by the end of
209317 the day;
210-3. No more than six (6) bottles of alcohol ic beverages are
211-unsealed at any given time; and
212-4. No person shall remove any samples from the licensed premises
213-or location where the t asting has occurred.
214-F. 1. Retail spirits, retail wine, and retail beer licensees
215-shall be authorized to host educational alcoholic beverage training,

369+3. No more than six (6) bottles of alcoholic beverages are
370+unsealed at any given time; and
371+4. No person shall remov e any samples from the licensed premises
372+or location where the tasting has occurred.
373+F. 1. Retail spirits, retail wine, and retail beer licensees
374+shall be authorized to host educational alcoholic beverage training,
243375 which includes tastings, for employees who are licensed to sell such
244376 beverages on the licensed premises in such contai ners to consumers
245377 for off-premises consumption only. Alcoholic beverages for training
246378 purposes may be provided by wine and spirits wholesaler licensees
247379 and beer distributor lic ensees.
248380 2. All such tastings shall be consumed on licensed premises of
249381 the licensee authorized to host the tastings or at a location other
250382 than the licensed premises, and under the direct supervision of the
251383 licensee. Samples shall be poured by a licensee who is lawfully
252384 permitted to serve alcoholic beverages on the licensed premise s in
253385 such containers to consumers for off -premises consumption only in
254386 this state. Tastings shall be restricted to employees who are
255387 twenty-one (21) years of age or older. Par ticipation in tastings
256388 for educational purposes may be required by an employer; however,
257389 the choice to taste or consume alcoholic beverages shall always be
258390 voluntary. No employee may be required to taste or consume alcohol
259391 at tastings as a condition of em ployment.
260-3. An educational tasting of beer may consist of not more than
261-six separate individual beers of not more than two (2) ounces each,
262-served together at one time. No employe e may sample more than a
263-total of twelve (12) fluid ounces of beer per day. An educational
264-tasting of wine may consist of not more than s ix separate individual
265-wines of not more than one (1) ounce each, served together at one
266-time. No employee may sample more than a total of six (6) fluid

443+3. An educational tasting of beer may consist of not more than
444+six separate individual beers of not more than two (2) ounces each,
445+served together at one time. No employee may sample more than a
446+total of twelve (12) fluid ounces of beer per day . An educational
447+tasting of wine may consist of not more than six separate individual
448+wines of not more than one (1) ounce each, served together at one
449+time. No employee may sample more than a total of six (6) fluid
294450 ounces of wine per day. An educationa l tasting of spirits shall
295451 consist of not more than three separate individual s pirits of not
296452 more than one-half (0.5) ounce each, served together at one time.
297453 No employee may sample more than a total of one and one -half (1.5)
298454 fluid ounces of spirits per d ay. No employee may sample more than a
299455 total of twelve (12) ounces of beer, six (6) ounces of wine, or one
300456 and one-half (1.5) ounces of spirits per day. Only one type of
301457 alcoholic beverage of beer, wine, or spirits shall be allowed at any
302458 education training tasting. No combination tasting shall be
303459 allowed. Employees who choose to taste an alcoholic beverage but do
304460 not wish to consume the alcoholic beverage shall be allowed to spit
305461 the beverage into a cup for disposal. Employees may participate in
306462 educational tastings before, during, or after regular business hours
307463 unless otherwise prohibited by law. All licensees serving samples
308464 of beer shall ensure that all samples are poured only from original
309465 sealed packaging and any alcoholic beverages remaining in unsealed
310466 packaging used to provide samples, excluding spirits and wine, are
311-poured out by the end of the day. No more than six bottles of
312-alcoholic beverages may be unsealed at any given time during a
313-tasting. All packaging containing samples of wine and spirits shall
314-be clearly marked as a sample and any unused por tions of the sample
315-of wine or spirits shall be resealed and retained by the wine and
316-spirits wholesaler for use at the next tasting authorized in this
317-paragraph. Wine and spirits wholesaler employees may transport any

519+alcoholic beverages may be unsealed at any given time during a
520+tasting. All packaging containing samples of wine an d spirits shall
521+be clearly marked as a sample and any unused portions of the sample
522+of wine or spirits shall be resealed and retained by the wine and
523+spirits wholesaler for use at the next tasting authorized in this
524+paragraph. Wine and spirits wholesaler employees may transport any
345525 resealed samples of wine and spirits in their vehic les. Beer, wine,
346526 and spirits samples shall not be considered withdrawn from the
347527 inventory of the beer distributor or wine and spirits wholesaler for
348528 purposes of the collection of the excise tax on beer, wine, and
349529 spirits. Tastings offered to licensees by wine and spirits
350530 wholesalers and beer distributors shall not be deemed discrimination
351531 or an inducement under Section 3 -123 of this title.
352532 G. Retail spirits, retail wine, and r etail beer licensees shall
353533 be authorized to sell such beverages on the licensed premises in
354534 such containers to consumers for off -premises consumption.
355535 SECTION 2. AMENDATORY 37A O.S. 2021, Section 2 -110, as
356536 last amended by Section 1, Chapter 417, O.S.L. 2024 (37A O.S. Supp.
357537 2024, Section 2-110), is amended to read as follows:
358538 Section 2-110. A. A mixed beverage license shall authorize the
359539 holder thereof:
360-1. To purchase alcohol, spirits, beer and/or wine in retail
361-containers from the holder of a wine and spirits wholesaler and beer
362-distributor license as specifically provided by law;
363-2. To sell, offer for sale and possess mixed beverages for on -
364-premises consumption only, provided:
365-a. the holder of a mixed beverage license issued for an
366-establishment which is also a restaurant may purchase
367-wine directly from a winemaker and beer directly from
368-a small brewer who is permitted and has elected to

591+1. To purchase alcohol, spirits, beer and/or wine in retail
592+containers from the holder of a wine and spirits wholesaler and beer
593+distributor license as spec ifically provided by law;
594+2. To sell, offer for sale and possess mixed beverages for on -
595+premises consumption only, provided:
596+a. the holder of a mixed beverage license issued fo r an
597+establishment which is also a restaurant may purchase
598+wine directly from a winemaker and beer directly from
599+a small brewer who is permitted and has elected to
396600 self-distribute as provided in Article XXVIII -A of the
397601 Oklahoma Constitution, and
398602 b. the holder of a mixed beverage license that is also a
399603 holder of a retail wine license or retail beer license

402606 wine or beer, according to the license held, fo r off-
403607 premises consumption, subject to the limitations of
404608 the retail wine license or retail beer license; and
405609 3. To sell spirits in their original packages for consumption
406610 on its premises under the following conditions:
407611 a. spirits in their original packag es shall remain and be
408612 consumed in the club suite of a mixed beverage
409613 licensee and may not be removed from the club suite if
410614 not consumed in their entirety at or before the
411-conclusion of the period for which the club suite was
412-made available to a specific patron or patrons by the
413-mixed beverage licensee, and
414-b. spirits in their original packages to be consumed in
415-the club suite are provided exclusively by the mixed
416-beverage licensee.
417-B. Sales and service of mixed beverages by holders of mixed
418-beverage licenses shall be limited to the licensed premises of the
419-licensee unless the holder of the mixed beverage license also

667+made available to a specific patron or patrons by the
668+mixed beverage licensee, and
669+b. spirits in their original packages to be consumed in
670+the club suite are provided exclusively by the mixed
671+beverage licensee.
672+B. Sales and service of mixed beverages by holders of mixed
673+beverage licenses shall be limited to the licensed premises of the
674+licensee unless the holde r of the mixed beverage license also
447675 obtains a caterer license or a mixed beverage/caterer combination
448676 license, or if the holder of a mixed beverage license is an
449677 Entertainment District Tenant Party as defined in Section 2393 of
450678 Title 68 of the Oklahoma Statutes. A mixed beverage license shall
451679 only be issued in counties of this state where the sale of alcoholic
452680 beverages by the individual drink for on -premises consumption has
453681 been authorized. A separate license shall be required for each
454682 place of business.
455683 C. Sales and service of mixed beverages by holders of mixed
456684 beverage licenses of an Entertainment District Tenant Party shall be
457685 limited to the premises of an Entertainment D istrict. For purposes
458686 of this subsection, premises may be defined as the designated area
459687 of an Entertainment District as defined in Section 2393 of Title 68
460688 of the Oklahoma Statutes.
461-D. Holders of a mixed beverage license shall not be prohibited
462-from obtaining and holding a retail beer license or retail wine
463-license or both a retail beer license and retail wine license ; nor
464-shall the Alcoholic Beverage Laws Enforcement (ABLE) Commis sion
465-promulgate any rule that prevents a holder of a mixed beverage
466-license from operating within the premises of, or immediately
467-adjacent to, a retail wine or retail beer license ; provided, that
468-each holder qualifies and maintains the qualifications for each
469-license held as set forth in this title and the rules promulgated by
470-the Alcoholic Beverage Laws Enforcement (ABLE) Commission.

740+D. Holders of a mixed beverage license shall not be prohibited

498750 E. Upon application, a mixed beverage license shall be issued
499751 for any place of business functioning as a motion picture theater,
500752 as defined by Section 1 -103 of this title. Provided, that upon
501753 proof of legal age to consume alcohol, every patron being served
502754 alcoholic beverages shall be required to wear a wrist bracelet or
503755 receive a hand stamp identifying the patron as being of legal age to
504756 consume alcohol. This requirement shall only apply inside a motion
505757 picture theater auditorium where individuals under the legal age to
506758 consume alcohol are allowed.
507759 F. Holders of a mixed beverage license with a licensed premises
508760 on a business establishment that meets the classification of a golf
509761 course or country club pursuant to the most recently adopted North
510762 American Industry Classification System (NAICS) may also sell beer
511763 in sealed original packages for on -premises consumption. Such

512815 holders’ sales of more than two sealed original packages to one
513816 person at one time for on-premises consumption shall not be
514817 considered an unlawful inducemen t to stimulate consumption of
515818 alcoholic beverages under the Oklahoma Alcoholic Beverage Control
516819 Act, and patrons may remove sealed original packages from the
517820 licensed premises.
518821 SECTION 3. This act shall become effective November 1, 2025.
