206 | 314 | | 1. All samples are poured only from original sealed packaging; |

207 | 315 | | 2. Any alcoholic beverages remaining in unsealed packaging used |
---|
208 | 316 | | to provide samples, excluding spirits, are poured out by the end of |
---|
209 | 317 | | the day; |

243 | 375 | | which includes tastings, for employees who are licensed to sell such |

244 | 376 | | beverages on the licensed premises in such contai ners to consumers |

245 | 377 | | for off-premises consumption only. Alcoholic beverages for training |

---|

248 | 380 | | 2. All such tastings shall be consumed on licensed premises of |
---|
249 | 381 | | the licensee authorized to host the tastings or at a location other |
---|
250 | 382 | | than the licensed premises, and under the direct supervision of the |
---|
251 | 383 | | licensee. Samples shall be poured by a licensee who is lawfully |
---|
252 | 384 | | permitted to serve alcoholic beverages on the licensed premise s in |
---|
253 | 385 | | such containers to consumers for off -premises consumption only in |
---|
254 | 386 | | this state. Tastings shall be restricted to employees who are |
---|
255 | 387 | | twenty-one (21) years of age or older. Par ticipation in tastings |
---|
256 | 388 | | for educational purposes may be required by an employer; however, |
---|
257 | 389 | | the choice to taste or consume alcoholic beverages shall always be |
---|
258 | 390 | | voluntary. No employee may be required to taste or consume alcohol |
---|
259 | 391 | | at tastings as a condition of em ployment. |
---|
260 | | - | 3. An educational tasting of beer may consist of not more than |
---|
261 | | - | six separate individual beers of not more than two (2) ounces each, |
---|

304 | 460 | | not wish to consume the alcoholic beverage shall be allowed to spit |
---|
305 | 461 | | the beverage into a cup for disposal. Employees may participate in |
---|
306 | 462 | | educational tastings before, during, or after regular business hours |
---|
307 | 463 | | unless otherwise prohibited by law. All licensees serving samples |
---|
308 | 464 | | of beer shall ensure that all samples are poured only from original |
---|
309 | 465 | | sealed packaging and any alcoholic beverages remaining in unsealed |
---|
310 | 466 | | packaging used to provide samples, excluding spirits and wine, are |
---|
345 | 525 | | resealed samples of wine and spirits in their vehic les. Beer, wine, |
---|
346 | 526 | | and spirits samples shall not be considered withdrawn from the |
---|
347 | 527 | | inventory of the beer distributor or wine and spirits wholesaler for |

348 | 528 | | purposes of the collection of the excise tax on beer, wine, and |
---|
349 | 529 | | spirits. Tastings offered to licensees by wine and spirits |
---|
350 | 530 | | wholesalers and beer distributors shall not be deemed discrimination |
---|
351 | 531 | | or an inducement under Section 3 -123 of this title. |
---|
352 | 532 | | G. Retail spirits, retail wine, and r etail beer licensees shall |
---|
353 | 533 | | be authorized to sell such beverages on the licensed premises in |
---|
354 | 534 | | such containers to consumers for off -premises consumption. |
---|
355 | 535 | | SECTION 2. AMENDATORY 37A O.S. 2021, Section 2 -110, as |

412 | | - | made available to a specific patron or patrons by the |
---|
413 | | - | mixed beverage licensee, and |
---|
414 | | - | b. spirits in their original packages to be consumed in |
---|
415 | | - | the club suite are provided exclusively by the mixed |
---|
416 | | - | beverage licensee. |

455 | 683 | | C. Sales and service of mixed beverages by holders of mixed |

456 | 684 | | beverage licenses of an Entertainment District Tenant Party shall be |

457 | 685 | | limited to the premises of an Entertainment D istrict. For purposes |
---|
458 | 686 | | of this subsection, premises may be defined as the designated area |
---|
459 | 687 | | of an Entertainment District as defined in Section 2393 of Title 68 |
---|
460 | 688 | | of the Oklahoma Statutes. |

507 | 759 | | F. Holders of a mixed beverage license with a licensed premises |

508 | 760 | | on a business establishment that meets the classification of a golf |

509 | 761 | | course or country club pursuant to the most recently adopted North |

510 | 762 | | American Industry Classification System (NAICS) may also sell beer |
---|
