77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.5, as
79	79	last amended by Section 2, Chapter 116, O.S.L. 2024 (51 O.S. Supp.
80	80	2024, Section 24A.5), is amended to r ead as follows:
81	81	Section 24A.5. All records of public bodies and public
82	82	officials shall be open to any person for inspection, copying, or
83	83	mechanical reproduction during regular business hours; provided:
84	84	1. The Oklahoma Open Records Act, Sections 24A.1 thr ough 24A.30
85	85	24A.34 of this title, does not apply to records specifically
86	86	required by law to be kept confidential including:
87	87	a. records protected by a state evidentiary privilege
88	88	such as the attorney -client privilege, the work

151	151	941 of Title 63 of the Oklahoma Statutes tha t may be
152	152	hearsay, preliminary unsubstantiated investigation -
153	153	related findings, or confidential medical information,
154	154	e. any test forms, question banks and answer keys
155	155	developed for state licensure examinations, but
156	156	specifically excluding test preparation mat erials or
157	157	study guides,
158	158	f. last names, addresses, Social Security numbers or ta x
159	159	identification numbers, and proof of identification
160	160	submitted to the Oklahoma Lottery Commission by
161	161	persons claiming a lottery prize,
162	162	g. unless public disclosure is required b y other laws or
163	163	regulations, vehicle movement records of the Oklahoma

227	227	facility owned or operated by the Oklahoma Tourism and
228	228	Recreation Department to obtain any service at the
229	229	facility or by a purchaser of a pr oduct sold by or
230	230	through the Oklahoma Tourism and Recreation
231	231	Department,
232	232	k. a Department of Defense Form 214 (DD Form 214) filed
233	233	with a county clerk, including any DD Form 214 filed
234	234	before July 1, 2002,
235	235	l. except as provided for in Section 2 -110 of Title 47 of
236	236	the Oklahoma Statutes:
237	237	(1) any record in connection with a Motor Vehicle
238	238	Report issued by the Department of Public Safety,

298	298	an agency or entity of the state or a political
299	299	subdivision to obtain licensure under the laws of this
300	300	state or a political subdivision that contains an
301	301	applicant’s personal address, personal phone number,
302	302	personal email address, any government -issued
303	303	identification numbers, or other contact information ;
304	304	provided, however, lists of persons licensed, the
305	305	existence of a license of a person, or a business or
306	306	commercial address, or other business or commercial
307	307	information disclosable under state law submitted with
308	308	an application for licensure shall be public record,
309	309	unless the business or commercial address is the same
310	310	as the applicant’s personal address, except when the
311	311	applicant permits in writing the disclosure of the
312	312	address,

365	365	conducted by the State Department of Health into
366	366	violations of the Long -Term Care Administrator
367	367	Licensing Act under Title 63 of the Oklahoma Statutes,

369	369	o. documents, evidence, materials, records, reports,
370	370	complaints, or other information in the possession or
371	371	control of the Attorney General or Insurance
372	372	Department pertaining to an evaluation, examination,
373	373	investigation, or review made pursuant to the
374	374	provisions of the Patient ’s Right to Pharmacy Choice
375	375	Act, the Pharmacy Audit Integrity Act, or Sections 357
376	376	through 360 of Title 59 of the Oklahoma Statutes;
377	377	2. All Social Security numbers included in a reco rd may be
378	378	confidential regardless of the person ’s status as a public employee
379	379	or private individual and may be redacted or deleted prior to
380	380	release of the record by the public b ody;
381	381	3. Any reasonably segregable portion of a record containing
382	382	exempt material shall be provided after deletion of the exempt
383	383	portions; provided however, the Department of Public Safety shall
384	384	not be required to assemble for the requesting person specifi c
385	385	information, in any format, from driving records relating to any
386	386	person whose name and date of birth or whose driver license number
387	387	is not furnished by the requesting person.

439	439	The Oklahoma State Bureau of Investigation shall not be required
440	440	to assemble for the requesting person any criminal history records
441	441	relating to persons whose names, dates of birth, and other
442	442	identifying information required by the Oklahoma State Bureau of
443	443	Investigation pursuant to administrative rule are not furnished by
444	444	the requesting person;
445	445	4. Any request for a record which contains individual records
446	446	of persons, and the cost of copying, reproducing or certifying each
447	447	individual record is otherwise prescribed by state law, the cost may
448	448	be assessed for each individual record, or po rtion thereof requested
449	449	as prescribed by state law. Otherwise, a public body may charge a
450	450	fee only for recovery of the reasonable, direct costs of record
451	451	copying, or mechanical reproduction. Notwithstanding any state or
452	452	local provision to the contrary, i n no instance shall the record
453	453	copying fee exceed twenty -five cents ($0.25) per page for records
454	454	having the dimensions of eight and one -half (8 1/2) by fourteen (14)
455	455	inches or smaller, or a maximum of One Dollar ($1.00) per copied
456	456	page for a certified copy . However, if the request:
457	457	a. is solely for commercial purpose, or
458	458	b. would clearly cause excessive disruption of the
459	459	essential functions of the public body,
460	460	then the public body may charge a reasonable fee to recover the
461	461	direct cost of record search and copying; however, publication in a
462	462	newspaper or broadcast by news media for new s purposes shall not

515	515	purpose and charges for providing copies of electronic data to the
516	516	news media for a news purp ose shall not exceed the direct cost of
517	517	making the copy. The fee charged by the Department of Public Safety
518	518	for a copy in a computerized format of a record of the Department
519	519	shall not exceed the direct cost of making the copy unless the fee
520	520	for the record is otherwise set by law.
521	521	Any public body establishing fees under this act shal l post a
522	522	written schedule of the fees at its principal office and with the
523	523	county clerk.
524	524	In no case shall a search fee be charged when the release of
525	525	records is in the public in terest, including, but not limited to,
526	526	release to the news media, scholars, authors and taxpayers seeking
527	527	to determine whether those entrusted with the affairs of the
528	528	government are honestly, faithfully, and competently performing
529	529	their duties as public se rvants.
530	530	The fees shall not be used for the purpose of discouraging
531	531	requests for information or as obstacles to disclosure of requested
532	532	information;
533	533	5. The land description tract index of all recorded instruments
534	534	concerning real property required to be kep t by the county clerk of
535	535	any county shall be available for inspection or copying in
536	536	accordance with the provisions of the Oklahoma Open Records Act;

589	589	reproduced for the purpose of sale of the information;
590	590	6. A public body must provide prompt, reasonable access to its
591	591	records but may establish reasonable procedures which protect the
592	592	integrity and organization of its records and to prevent excessive
593	593	disruptions of its essential functions. A del ay in providing access
594	594	to records shall be limited solely to the time required for
595	595	preparing the requested documents and the avoidance of excessive
596	596	disruptions of the public body ’s essential functions. If a records
597	597	request cannot be completed within ten ( 10) business days of the
598	598	request, a person designated pursuant to paragraph 7 o f this section
599	599	shall provide written notice to the requestor indicating the reason
600	600	for the delay and specifying a date within a reasonable time when
601	601	the information requested wi ll be available for inspection or
602	602	duplication. In no event may production of a current request for
603	603	records be unreasonably delayed until after completion of a prior
604	604	records request that will take substantially longer than the current
605	605	request. Any public body which makes the requested records
606	606	available on the Internet shall meet the obligation of providing
607	607	prompt, reasonable access to its records as required by this
608	608	paragraph; and
609	609	7. A public body shall designate certain persons who are
610	610	authorized to release records of the public body for inspection,
611	611	copying, or mechanical reproduction. At least one person shall be
