7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.5, as
7979 last amended by Section 2, Chapter 116, O.S.L. 2024 (51 O.S. Supp.
8080 2024, Section 24A.5), is amended to r ead as follows:
8181 Section 24A.5. All records of public bodies and public
8282 officials shall be open to any person for inspection, copying, or
8383 mechanical reproduction during regular business hours; provided:
8484 1. The Oklahoma Open Records Act, Sections 24A.1 thr ough 24A.30
8585 24A.34 of this title, does not apply to records specifically
8686 required by law to be kept confidential including:
8787 a. records protected by a state evidentiary privilege
8888 such as the attorney -client privilege, the work

149149 d. information in the files of the Board of Medicolegal
150150 Investigations obtained pursuant to Sections 940 and
151151 941 of Title 63 of the Oklahoma Statutes tha t may be
152152 hearsay, preliminary unsubstantiated investigation -
153153 related findings, or confidential medical information,
154154 e. any test forms, question banks and answer keys
155155 developed for state licensure examinations, but
156156 specifically excluding test preparation mat erials or
157157 study guides,
158158 f. last names, addresses, Social Security numbers or ta x
159159 identification numbers, and proof of identification
160160 submitted to the Oklahoma Lottery Commission by
161161 persons claiming a lottery prize,
162162 g. unless public disclosure is required b y other laws or
163163 regulations, vehicle movement records of the Oklahoma

216216 the Authority’s electronic toll collection system,
217217 h. personal financial information, credit reports, or
218218 other financial data obtaine d by or submitted to a
219219 public body for the purpose of evaluating credit
220220 worthiness, obtaining a license, permit, or for the
221221 purpose of becoming qualified to contract with a
222222 public body,
223223 i. any digital audio/video recordings of the toll
224224 collection and safeg uarding activities of the Oklahoma
225225 Transportation Authority,
226226 j. any personal information provided by a guest at any
227227 facility owned or operated by the Oklahoma Tourism and
228228 Recreation Department to obtain any service at the
229229 facility or by a purchaser of a pr oduct sold by or
230230 through the Oklahoma Tourism and Recreation
231231 Department,
232232 k. a Department of Defense Form 214 (DD Form 214) filed
233233 with a county clerk, including any DD Form 214 filed
234234 before July 1, 2002,
235235 l. except as provided for in Section 2 -110 of Title 47 of
236236 the Oklahoma Statutes:
237237 (1) any record in connection with a Motor Vehicle
238238 Report issued by the Department of Public Safety,

291291 Oklahoma Statutes, or
292292 (2) personal information within driver records, as
293293 defined by the Driver’s Privacy Protection Act,
294294 18 U.S.C., Sections 2721 through 272 5, which are
295295 stored and maintained by the Department of Public
296296 Safety,
297297 m. any portion of any document or information provided to
298298 an agency or entity of the state or a political
299299 subdivision to obtain licensure under the laws of this
300300 state or a political subdivision that contains an
301301 applicant’s personal address, personal phone number,
302302 personal email address, any government -issued
303303 identification numbers, or other contact information ;
304304 provided, however, lists of persons licensed, the
305305 existence of a license of a person, or a business or
306306 commercial address, or other business or commercial
307307 information disclosable under state law submitted with
308308 an application for licensure shall be public record,
309309 unless the business or commercial address is the same
310310 as the applicant’s personal address, except when the
311311 applicant permits in writing the disclosure of the
312312 address,

364364 n. an investigative file obtained during an investigation
365365 conducted by the State Department of Health into
366366 violations of the Long -Term Care Administrator
367367 Licensing Act under Title 63 of the Oklahoma Statutes,
368368 or
369369 o. documents, evidence, materials, records, reports,
370370 complaints, or other information in the possession or
371371 control of the Attorney General or Insurance
372372 Department pertaining to an evaluation, examination,
373373 investigation, or review made pursuant to the
374374 provisions of the Patient ’s Right to Pharmacy Choice
375375 Act, the Pharmacy Audit Integrity Act, or Sections 357
376376 through 360 of Title 59 of the Oklahoma Statutes;
377377 2. All Social Security numbers included in a reco rd may be
378378 confidential regardless of the person ’s status as a public employee
379379 or private individual and may be redacted or deleted prior to
380380 release of the record by the public b ody;
381381 3. Any reasonably segregable portion of a record containing
382382 exempt material shall be provided after deletion of the exempt
383383 portions; provided however, the Department of Public Safety shall
384384 not be required to assemble for the requesting person specifi c
385385 information, in any format, from driving records relating to any
386386 person whose name and date of birth or whose driver license number
387387 is not furnished by the requesting person.

439439 The Oklahoma State Bureau of Investigation shall not be required
440440 to assemble for the requesting person any criminal history records
441441 relating to persons whose names, dates of birth, and other
442442 identifying information required by the Oklahoma State Bureau of
443443 Investigation pursuant to administrative rule are not furnished by
444444 the requesting person;
445445 4. Any request for a record which contains individual records
446446 of persons, and the cost of copying, reproducing or certifying each
447447 individual record is otherwise prescribed by state law, the cost may
448448 be assessed for each individual record, or po rtion thereof requested
449449 as prescribed by state law. Otherwise, a public body may charge a
450450 fee only for recovery of the reasonable, direct costs of record
451451 copying, or mechanical reproduction. Notwithstanding any state or
452452 local provision to the contrary, i n no instance shall the record
453453 copying fee exceed twenty -five cents ($0.25) per page for records
454454 having the dimensions of eight and one -half (8 1/2) by fourteen (14)
455455 inches or smaller, or a maximum of One Dollar ($1.00) per copied
456456 page for a certified copy . However, if the request:
457457 a. is solely for commercial purpose, or
458458 b. would clearly cause excessive disruption of the
459459 essential functions of the public body,
460460 then the public body may charge a reasonable fee to recover the
461461 direct cost of record search and copying; however, publication in a
462462 newspaper or broadcast by news media for new s purposes shall not

514514 constitute a resale or use of a record for trade or commercial
515515 purpose and charges for providing copies of electronic data to the
516516 news media for a news purp ose shall not exceed the direct cost of
517517 making the copy. The fee charged by the Department of Public Safety
518518 for a copy in a computerized format of a record of the Department
519519 shall not exceed the direct cost of making the copy unless the fee
520520 for the record is otherwise set by law.
521521 Any public body establishing fees under this act shal l post a
522522 written schedule of the fees at its principal office and with the
523523 county clerk.
524524 In no case shall a search fee be charged when the release of
525525 records is in the public in terest, including, but not limited to,
526526 release to the news media, scholars, authors and taxpayers seeking
527527 to determine whether those entrusted with the affairs of the
528528 government are honestly, faithfully, and competently performing
529529 their duties as public se rvants.
530530 The fees shall not be used for the purpose of discouraging
531531 requests for information or as obstacles to disclosure of requested
532532 information;
533533 5. The land description tract index of all recorded instruments
534534 concerning real property required to be kep t by the county clerk of
535535 any county shall be available for inspection or copying in
536536 accordance with the provisions of the Oklahoma Open Records Act;

588588 provided, however, the index shall not be copied or mechanically
589589 reproduced for the purpose of sale of the information;
590590 6. A public body must provide prompt, reasonable access to its
591591 records but may establish reasonable procedures which protect the
592592 integrity and organization of its records and to prevent excessive
593593 disruptions of its essential functions. A del ay in providing access
594594 to records shall be limited solely to the time required for
595595 preparing the requested documents and the avoidance of excessive
596596 disruptions of the public body ’s essential functions. If a records
597597 request cannot be completed within ten ( 10) business days of the
598598 request, a person designated pursuant to paragraph 7 o f this section
599599 shall provide written notice to the requestor indicating the reason
600600 for the delay and specifying a date within a reasonable time when
601601 the information requested wi ll be available for inspection or
602602 duplication. In no event may production of a current request for
603603 records be unreasonably delayed until after completion of a prior
604604 records request that will take substantially longer than the current
605605 request. Any public body which makes the requested records
606606 available on the Internet shall meet the obligation of providing
607607 prompt, reasonable access to its records as required by this
608608 paragraph; and
609609 7. A public body shall designate certain persons who are
610610 authorized to release records of the public body for inspection,
611611 copying, or mechanical reproduction. At least one person shall be
