4577 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4678 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.13, as
4779 last amended by Section 25, Chapter 182, O.S.L. 2024 (63 O.S. Supp.
4880 2024, Section 427.13), is amended to read as follows:
4981 Section 427.13. A. All medical marijuana and medical marijuana
5082 products shall be purchased solely from a state -licensed medical
5183 marijuana business, and shall not be purchased from any out -of-state
5284 providers.
5385 B. 1. The Oklahoma Medical Marijuana Authority shall have
5486 oversight and auditing responsibilities to ensu re that all marijuana
5587 being grown in this state is accounted for and shall implement an
5688 inventory tracking system. Pursuant to these duties, the Authority
57-shall require that each medical marijuana business, medical
58-marijuana research facility, medical marijuana education facility
59-and medical marijuana waste disposal facility keep records for every
60-transaction with another medical marijuana business, patient or

140+shall require that ea ch medical marijuana business, medical
141+marijuana research facility, medical marijuana education facility
142+and medical marijuana waste disposal facility keep records for every
143+transaction with another medical marijuana business, patient or
88144 caregiver. Inventory shall be tracked and updated after each
89145 individual sale and reported to the Authority.
90146 2. The inventory tracking system licensees use shall allow for
91147 integration of other seed -to-sale systems and, at a minimum, shall
92148 include the following:
93149 a. notification of when marijuana seeds and clones are
94150 planted,
95151 b. notification of when marijuana plants are harvested
96152 and destroyed,
97153 c. notification of when marijuana is transported, sold,
98154 stolen, diverted or lost,
99155 d. a complete inventory of all marijuana, seeds, pl ant
100156 tissue, clones, plants, usable marijuana or trim,
101157 leaves and other plant ma tter, batches of extract, and
102158 marijuana concentrates,
103159 e. all samples sent to a testing laboratory, an unused
104160 portion of a sample returned to a licensee, all
105161 samples utilized by licensee for purposes of
106162 negotiating a sale, and
107163 f. all samples used for quality testing by a licensee.
108-3. Each medical marijuana business, medical marijuana research
109-facility, medical marijuana education facility and medical marijuana
110-waste disposal facility shall d evelop written standard operating
111-procedures outlining the manner in which it operates as presc ribed

215+3. Each medical marijuana business, medical marijuana research
216+facility, medical marijuana education facility and medical marijuana
217+waste disposal facility shall develop written standard operating
218+procedures outlining the manner i n which it operates as prescribed
139219 by the Authority and shall use a seed -to-sale tracking system or
140220 integrate its own seed -to-sale tracking system with the seed -to-sale
141221 tracking system established by the Authority in accordance with the
142222 limitations set forth herein.
143223 4. These records shall include, but not be limited to, the
144224 following:
145225 a. the name and license number of the medical marijuana
146226 business that cultivated, manufactured o r sold the
147227 medical marijuana or medical marijuana product,
148228 b. the address and phone number of the medical marijuana
149229 business that cultivated, manufactured or sold the
150230 medical marijuana or medical marijuana product,
151231 c. the type of product received during th e transaction,
152232 d. the batch number of the marijuana plant used,
153233 e. the date of the transaction,
154234 f. the total spent in dollars,
155235 g. all point-of-sale records,
156236 h. marijuana excise tax records, and
157-i. any additional information as may be reasonably
158-required by the Executi ve Director of the Oklahoma
159-Medical Marijuana Authority.
160-5. All inventory tracking records ret ained by a medical
161-marijuana business, medical marijuana research facility, medical
162-marijuana education facility or medical marijuana waste disposal

288+i. any additional information as may be reasonably
289+required by the Executive Director of the Oklahoma
290+Medical Marijuana Authority.
291+5. All inventory tracking records retained by a medical
292+marijuana business, medical marijuana research facility, medical
293+marijuana education facility or medical marijuana waste disposal
190294 facility containing medical marijuana patient or caregiver
191295 information shall comply with all relevant state and federal laws
192296 including, but not limited to, the Health Insurance Portability and
193297 Accountability Act of 1996 (HIPAA).
194298 C. The seed-to-sale inventory tracking system shall include:
195299 1. A software infrastructure that provides maximum flexibility
196300 for the exchange of data between the Authority and medical marijuana
197301 business licensees;
198302 2. Capabilities that allow the medical marijuana business
199303 licensees to submit data to the Authority directly through an
200304 application program interface (API), data interchange service tool,
201305 or by other means or technology acceptable to the Authority ;
202306 3. Automated reporting for inventory and point of sale
203307 discrepancies; and
204308 4. Technology for payments, sales, and tax collection.
205309 SECTION 2. This act shall become effective November 1, 2025.
