81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1692.1, is
83	83	amended to read as follows:
84	84	Section 1692.1. As used in this act:
85	85	A. “Cockfight” or “cockfighting” is a fight between birds,
86	86	whether or not fitted with artificial spurs, knives, or gaffs, and
87	87	whether or not bets or wagers are made on th e outcome of the fight ,
88	88	and includes any training fight in which birds are inte nded or
89	89	encouraged to attack or fight with one another .

141	141	B. “Equipment used for training or handling a fighting bird ”
142	142	includes knives or gaffs, cages, pens, feeding apparatuses, training
143	143	pens and other related devices and equipment, and is hereby declared
144	144	contraband and subject to seizure.
145	145	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1692.2, is
146	146	amended to read as follows:
147	147	Section 1692.2. Every person who willfully instigates or
148	148	encourages any is actively participating in a cockfight, upon
149	149	conviction, shall be guilty of a felony misdemeanor. The penalty
150	150	for a violation of this section shall be as provided in Section 8 of
151	151	this act 1692.8 of this title .
152	152	SECTION 3. AMENDATORY 21 O.S. 2021, Section 1692.3, is
153	153	amended to read as follows:
154	154	Section 1692.3. Every person who keeps or provides any pit,
155	155	building, or other place, or knowingly provides any equipment or
156	156	facilities to be used in permitting any cockfight, upon conviction,
157	157	shall be guilty of a felony misdemeanor. The penalty for a
158	158	violation of this section shall be as provided in Section 8 of this
159	159	act 1692.8 of this title .
160	160	SECTION 4. AMENDATORY 21 O.S. 20 21, Section 1692.4, is
161	161	amended to read as follows:
162	162	Section 1692.4. Every person who does any act or performs any
163	163	service in the furtherance of or to facilitate any cockfight,
164	164	referees a cockfight upon conviction, shall be guilty of a felony

217	217	by this section include, b ut are not limited to: promoting or
218	218	refereeing of birds at a cockfight, advertising a cockfight, or
219	219	serving as a stakes holder of any money wagered on any cockfight.
220	220	The penalty for a violation of this section shall be as provided in
221	221	Section 8 of this act 1692.8 of this title .
222	222	SECTION 5. AMENDATORY 21 O.S. 2021, Section 1692.8, is
223	223	amended to read as follows:
224	224	Section 1692.8. A. Every person who is gui lty of a felony
225	225	under any of the provisions of Sections 2, 3, 4, or 5 of this a ct
226	226	shall be punished by imprisonment in the state penitentiary for not
227	227	less than one (1) year nor more than ten (10) years, or shall be
228	228	fined not less than Two Thousand Dollars ($2,000.00) nor more than
229	229	Twenty-five Thousand Dollars ($25,000.00), or by both such fine and
230	230	imprisonment.
231	231	B. Every person who upon conviction is guilty of any of the
232	232	provisions of Section 6 of this act Sections 1692.2, 1692.3, and
233	233	1692.4 of this title shall be punished by imprisonment in the county
234	234	jail for not more than one (1) y ear, or shall be guilty of a
235	235	misdemeanor and fined not more than Five Hundred Dollars ($500.00) ,
236	236	or by both such fine and imprisonment . Upon a second conviction,
237	237	the person shall be guilty of a misdemeanor punishable by
238	238	imprisonment in the county jail for not more than one (1) year, by a
239	239	fine not more than Two Thousand Five Hundred Dollars ($2,500.00) , or

292	292	conviction, the person shall be guilty of a felony punishable by
293	293	imprisonment in the custody of the Department of Corrections for not
294	294	more than two (2) years or by a fine not less than Five Thousand
295	295	Dollars ($5,000.00), or by both su ch imprisonment and fine.
296	296	SECTION 6. REPEALER 21 O.S. 2021, Sections 1692.5,
297	297	1692.6, and 1692.7, are hereby repealed.
298	298	SECTION 7. This act shall become effective November 1, 2025.
