7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -4-401, is
8181 amended to read as follows:
8282 Section 1-4-401. A. The provisions of the Oklahoma Discovery
8383 Code and the Rules for District Courts of Oklahoma do not apply to
8484 juvenile proceedings except as provided by this section.
8585 B. The court may order the parties to exchange informa tion that
8686 is not work product and not privileged, including:
8787 1. The assessment and investigation records of the Department
8888 of Human Services; provided, all information that identifies the
8989 reporter of alleged child abuse or neglect shall be redacted;

141141 2. Law enforcement reports;
142142 3. Any video or audio recording of an interview with the child
143143 alleged to be deprived;
144144 4. Any exhibit any party intends to introduce at trial; and
145145 5. The names of any witnesses any party may call and a synopsis
146146 of the expected testimony.
147147 C. The court may in its discretion enter a scheduling order,
148148 order mediation, and conduct status and settlement conferences as
149149 needed during deprived proceedings.
150150 D. All information produced, exchanged, or used during the
151151 pendency of the deprive d action is confidential and shall be subject
152152 to a protective order. The disclosure or use of the information for
153153 any other purpose is prohibited except as permitted by law For
154154 purposes of this section:
155155 1. “Confidential record” includes, but is not limit ed to, any
156156 study, plan, recommendation, assessment, report, or other
157157 information describing the history, diagnosis, condition, care,
158158 treatment, or custody regarding a child, or safety analysis records
159159 that have been prepared and obtained in response to a r eport of
160160 alleged child abuse or neglect and include assessment reports and
161161 any other reports to the district attorney with all supporting
162162 documentation attached and any addendums ;
163163 2. “Party” means:
164164 a. a parent or legal guardian ,

217217 c. the guardian ad litem, if any ; and
218218 3. “Record” means any written or printed documen t, paper, form,
219219 log, report, file, or note and any film, photograph, audio tape
220220 recording, visual tape recording, or computer tape or disk, or
221221 information entered into and maint ained in an automated or
222222 computerized information system.
223223 C. 1. There shall be a rebuttable presumption that full
224224 disclosure of information to the parties in juvenile proceedings is
225225 in the best interests of the child. Such presumption may only be
226226 rebutted by a preponderance of the evidence.
227227 2. Unless the court, by a preponderance of the evidence, finds
228228 such disclosure is not in the best interests of the child, the court
229229 shall enter an order which discloses to all parties in the case all
230230 records that are necessary and relevant to the court ’s determination
231231 of the best interests of the child, including any records and
232232 documents from the Department of Human Services, law enforcement,
233233 any state agency, or any private organization with information
234234 relevant to the juvenile proceedings. The court order shall be of
235235 the nature of a protecti ve order, prohibiting the parties in the
236236 juvenile proceedings from disclosing the records to third parties,
237237 and any information that identifies the reporter of alleged child
238238 abuse or neglect shall be redacted.

290290 D. The disclosure shall include all records as defined by
291291 Section 1-6-102 of this title including, but not limited to:
292292 1. Written or printed documents;
293293 2. Papers, logs, and reports, including safety analysis
294294 reports;
295295 3. Files and case notes;
296296 4. Medical records, including any psychological evaluat ions or
297297 assessments;
298298 5. Forensic interviews, including any transcripts or notes
299299 related to these interviews;
300300 6. Films, photographs, and audio or visual tape recordings;
301301 7. Handwritten or handprinted notes;
302302 8. Any and all evidence provided by collateral references or
303303 individuals responsible for the child ’s welfare;
304304 9. Information entered into and maintained in automated or
305305 computerized information systems, specifically Kids I ntegrated Data
306306 System (KIDS) and OnBase;
307307 10. All communication within the Depa rtment of Human Services
308308 regarding the case, including, but not limited to, Microsoft Teams
309309 communications, e-KIDS system entries, and O nBase documentation;
310310 11. Any and all cor respondence related to investigations of
311311 child abuse or neglect allegations;

363363 12. Records of any assessments, safety plans, or case
364364 management documents prepared in response to child abuse and neglect
365365 allegations;
366366 13. All communication between the Departm ent of Human Services
367367 and the parties, law enforcement, medical professionals, and any
368368 other third party relevant to the juvenile proceeding;
369369 14. Documentation of any services provided or referrals made to
370370 the family or child involved;
371371 15. Records of any home visits, observations, or interactions
372372 with the child or his or her family;
373373 16. Documentation of any case reviews or meetings held
374374 regarding the child’s case;
375375 17. All KIDS contact entries and any and all O nBase records
376376 related to the case, or the eq uivalent information systems ’ entries
377377 and records;
378378 18. Text messages and email s exchanged between Department of
379379 Human Services personnel concerning the case;
380380 19. Phone records and call logs pertaining to communications
381381 related to the case;
382382 20. Any exhibit any party intends to introduce at trial; and
383383 21. The names of any witnesses any party may call and a
384384 synopsis of the expected testimony.
385385 E. In addition to the court ’s order from paragraph 2 of
386386 subsection C of this section , the court may also , in its discretion,
