7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 2 O.S. 20 21, Section 10-9.5, as
8181 amended by Section 1, Chapter 372, O.S.L. 2024 (2 O.S. Supp. 2024,
8282 Section 10-9.5), is amended to read as follows:
8383 Section 10-9.5. A. The State Board of Agriculture shall
8484 provide the necessary forms and applications for any person desiring
8585 or required to register a poultry feeding operation or expanding
8686 operation.
8787 B. The application to register to operate a new or previously
8888 unregistered poultry feeding operation or expanding operation shall
8989 contain, at a minimum, the following inf ormation:

141141 1. Name and address of the owner and operator of the facility;
142142 2. Name and address of the poultry feeding operation;
143143 3. Number and type of poultry housed or confined;
144144 4. Name and address of the integrator whose poultry will be
145145 raised by the poultry feeding operation;
146146 5. A diagram or map and legal description showing g eographical
147147 location of the facility on which the perimeters of the facility are
148148 designated, location of waters of the state, including, but not
149149 limited to, drainage from the fac ility, poultry waste storage
150150 facilities, and land -application sites owned or leased by the
151151 applicant or which the applicant has contracted with for the
152152 application of poultry waste;
153153 6. A copy of the Nutrient Management Plan, or proof of
154154 application for such plan, Best Management Practices or any other
155155 plans authorized by the Oklaho ma Department of Agriculture, Food,
156156 and Forestry;
157157 7. A statement of ownership.
158158 a. If the applicant is a corporation, the name and
159159 address of the corporation and the name and add ress of
160160 each officer and registered agent of the corporation
161161 shall be included in the application.
162162 b. If the applicant is a partnership or other legal

216216 (10%) or more shall be included in the statement.
217217 c. The information contained i n the statement of
218218 ownership shall be public information and shall be
219219 available upon request from the Board;
220220 8. In order to be considered a resident of this state for
221221 purposes of registration, all registered owners and operators of the
222222 facility shall provide proof of state residency for at least two (2)
223223 years immediately preceding the date of application. Sufficient
224224 documentation of proof of residency shall include a combination of
225225 the following:
226226 a. an unexpired state-issued driver license,
227227 b. an unexpired state-issued identification card,
228228 c. a utility bill preceding the date of application,
229229 excluding cellular telephone and Internet bills,
230230 d. a residential property deed to proper ty in this state,
231231 and
232232 e. a rental agreement preceding the date of application
233233 for residential property located in this state .
234234 The name on the application shall be reflected on all
235235 documentation requested in this paragraph ;
236236 9. The name and address of the p erson having day-to-day control
237237 of the operation, if such person is not the ap plicant and is acting
238238 as agent for the applicant;

290290 9. 10. An environmental history from the past three (3) years
291291 of any poultry feeding operation established and operated by the
292292 applicant or any other operation with common ownership in this state
293293 or any other state;
294294 10. 11. Environmental awards or citations received or pollution
295295 prevention or voluntary remediation efforts undertaken by the
296296 applicant; and
297297 11. 12. Any other information or records required by the
298298 Department for purposes of implementing the O klahoma Registered
299299 Poultry Feeding Operations Act or rules promulgated pursuant
300300 thereto.
301301 C. In addition to other penalties as may be imposed by law, any
302302 person who knowingly mak es any false statement, representation, or
303303 certification in, omits material data from, or tampers with any
304304 application for registration shall, upon conviction, be guilty of a
305305 misdemeanor and may be subject to a fine not more than Ten Thousand
306306 Dollars ($10,000.00) for each such violation.
307307 D. The owner of a poultry feeding operation shall be
308308 responsible for sending written notification to the Department upon
309309 changing integrators.
310310 E. For a transfer of registration to a new owner, the new owner
311311 shall register the operation pursuant to the rules of the
312312 Department.

364364 F. 1. All operators of poultry feeding operations and poultry
365365 waste applicators shall attend educational courses on poultry waste
366366 handling. All such operators and applicators shall attend
367367 educational training on poultry waste management as provided by
368368 Oklahoma State Universi ty through the Cooperative Extension Service.
369369 All current and new operators and applicators shall receive the
370370 initial nine (9) hours of training in the first year and two (2)
371371 hours of continuing education every year until the operator or
372372 applicator has received a total of nineteen (19) hours of training.
373373 Any operator or applicator may attend more hours than is required;
374374 however, those hours shall not be carried forward. Upon re ceiving
375375 the nineteen (19) required hours, the operator or applicator shall
376376 be required to receive two (2) hours of continuing education every
377377 three (3) years. The Cooperative Extension Service shall develop
378378 the educational training course to aid in certif ication. Curricula
379379 for the training course will include the Cooperative Extension
380380 Service waste management facts series and record books or their
381381 current equivalent. Courses for poultry waste management shall
382382 include the following topics:
383383 a. environmental process relevant to protecting water
384384 quality in poultry production,
385385 b. basic handling systems to manage poultry waste from
386386 all types of poultry operations,

438438 c. nutrient management, including sampling procedures,
439439 application rate determination, equipment c alibration,
440440 and record-keeping systems,
441441 d. relevant laws and rules applicable to poultry waste
442442 management in this state, and
443443 e. any other related subject as determined by Oklahoma
444444 State University in consultation with the Department.
445445 2. At the completion of each course, the operator or applicator
446446 shall receive a certification verif ying completion. The
447447 certificates shall be kept on site for five (5) years.
448448 3. Failure to obtain the initial nine -hour training and any
449449 continuing education as provided in this subsection shall be deemed
450450 a violation of the Oklahoma Registered Poultry Feeding Operations
451451 Act for operators and the Oklahoma Poultry Waste Applicators
452452 Certification Act for applicators.
453453 4. All operators or applicators shall meet the educational
454454 requirements of this section no later than December 31 of each year.
455455 5. All operators and applicators are solely responsible for
456456 obtaining and maintaining all educational requirements established
457457 pursuant to the provisions of this subsection.
458458 G. No integrator shall enter into any contract with an operator
459459 of a poultry feeding operation who is not in compliance with the
460460 education requirements of subsection F of this section.

512512 SECTION 2. AMENDATORY 2 O.S. 2021, Section 20 -45, is
513513 amended to read as follows:
514514 Section 20-45. A. The State Board of Agriculture shall ca use
515515 to be prepared and available, for any person desiring or required to
516516 apply for a license to operate a new or previously unlicensed animal
517517 feeding operation, the necessary for ms and applications.
518518 B. The application for a license to operate a new or previously
519519 unlicensed animal feeding operation shall contain, as a minimum, the
520520 following information:
521521 1. Name and address of the owner and operator of the facility;
522522 2. Name and address of the animal feeding operation;
523523 3. Capacity in animal units, and numb er and type of animals
524524 housed or confined;
525525 4. A diagram or map and legal description showing geographical
526526 location of the facility on which the perimeters of the facility are
527527 designated, location of waters of the state, including, but not
528528 limited to, drainage from the facility, animal waste storage
529529 facilities and land application sites owned or leased by the
530530 applicant;
531531 5. A copy of the Pollution Prevention Plan containing an Ani mal
532532 Waste Management Plan, Best Management Practices, or such other plan
533533 authorized by the Oklahoma Concentrated Animal Feeding Operations
534534 Act and approved by the Department;

586586 6. A copy of the written waiver by an adjacent property owner
587587 to the facility releasing specified setback requirements as provided
588588 by Section 44 of the Oklahoma Concentrated Animal Feeding Operations
589589 Act; and
590590 7. In order to be considered a resident of this state for
591591 purposes of licensure, all licensed owners and operators of the
592592 facility shall provide proof of state residency for at least two (2)
593593 years immediately preceding the date of application. Sufficient
594594 documentation of proof of residency shall include a combination of
595595 the following:

607607 Department of Agriculture, Food, and Forestry to administer the
608608 provisions of the Oklahoma Concentrated Animal Feeding Operations
609609 Act and rules promulgated pursuant thereto.

661661 C. 1. An application for renewal of a license to operate an
662662 animal feeding operation shall be considered to be pr operly filed
663663 when the Department has received a completed renewal application and
664664 payment of fees from the applicant.
665665 2. If the application for renewal is denied, written
666666 notification of the denial and an opportunity for an administrative
667667 hearing on the denial shall be given to the applicant by the
668668 Department. The notification shall set forth the reasons for the
669669 denial, steps necessary to meet the requirements for issuance of the
670670 renewal license and the opportunity for the applicant to request an
671671 administrative hearing.
672672 D. For transfer of a license to a new owner or operator, the
673673 following conditions shall be met:
674674 1. The new owner or operator shall submit to the Department a
675675 transfer application, attaching any change of conditions resulting
676676 from the transfer of ownership or operation;
677677 2. After receipt of the information required, the Department
678678 shall review the information, and within sixty (60) days, issue
679679 approval or denial of the transfer. Transfer of a license shall be
680680 denied only if:
681681 a. the new owner or operator cannot comply with the
682682 requirements of transfer,

734734 b. the Department finds a material or substantial change
735735 in conditions since the issuance of the original
736736 license to operate the animal feeding operation,
737737 c. failure of the new owner or operat or to meet any other
738738 conditions or requirements for compliance established
739739 by the Department pursuant to the Oklahoma
740740 Concentrated Animal Feeding Operations Act and rules
741741 promulgated pursuant thereto, or
742742 d. the new owner or operator has failed to meet the
743743 requirements of Section 48 of the Oklahoma
744744 Concentrated Animal Feeding Operati ons Act 20-61 of
745745 this title; and
746746 3. If a transfer is denied, written notification of the denial
747747 and an opportunity for an administrative hearing on the denial shall
748748 be given to the applicant for a transfer license by the Department.
749749 The notification shall set forth the reasons for the denial, steps
750750 necessary to meet the requirements for a transfer license, and the
751751 opportunity for the applicant to request an administrative hearin g;
752752 and
753753 4. Proof of residency provisions pursuant to paragraph 7 of
754754 subsection B of this section.
755755 E. Any suspension or revocation or nonrenewal of a license

808808 Operations Act by the Board shall be m ade in accordance with Section
809809 48 of this act 20-61 of this title.
810810 F. In addition to other information required for issuance of a
811811 new or transfer license, an application for a new or transfer
812812 license for a concentrated animal feeding operation shall conta in
813813 the following information:
814814 1. a. A statement of ownership.
815815 (1) If the applicant is a firm or partnership, the
816816 name and address of each member thereof shall be
817817 included in the application.
818818 (2) If the applicant is a corporation, the name and
819819 address of the corporation and the name and
820820 address of each officer and registered agent of
821821 the corporation shall be included in the
822822 application.
823823 (3) If the applicant is a partnership or other legal
824824 entity, the name and address of each partner and
825825 stockholder with an o wnership interest of ten
826826 percent (10%) or more shall be included in the
827827 statement.
828828 b. The information contained in the statement of
829829 ownership shall be public information and shall be
830830 available upon request from the Board;

882882 2. The name and address of the ma nagement, if the management is
883883 not the applicant and is acting as agent for the applicant;
884884 3. a. An environmental history from the past three (3) years
885885 of any concentrated animal or swine feeding operation
886886 established and operated by the applicant or any o ther
887887 operation with common ownership in this state or any
888888 other state. The en vironmental history shall include
889889 but not be limited to all citations, administrative
890890 orders or penalties, civil injunctions or other civil
891891 actions, criminal actions, past, curre nt and ongoing,
892892 taken by any person, agency or court relating to
893893 noncompliance with any environmental law, rule, agency
894894 order, or court action relating to the operation of an
895895 animal or swine feeding operation.
896896 b. A copy of all records relating to the envir onmental
897897 history required by this paragraph shall accompany the
898898 application.
899899 c. Noncompliance with a final agency order or final order
900900 or judgment of a court of record which has been set
901901 aside by a court on appeal of the final order or
902902 judgment shall not b e considered a final order or
903903 judgment for the purposes of this subsection;

958958 5. Any other information or records requir ed by the Department
959959 for purposes of implementing the Oklahoma Concentrated An imal
960960 Feeding Operations Act or rules promulgated pursuant thereto.
961961 G. 1. In addition to other penalties as may be imposed by law,

964964 application for a license, or notice relating to the determination
965965 of affected property owners, shall, upon conviction thereof, be
966966 guilty of a misdemeanor and may be s ubject to a fine of not more
967967 than Ten Thousand Dollars ($10,000.00) for each s uch violation. In
968968 addition, the Department shall deny licensure to the applicant or
969969 may require submission of a new application.
970970 2. The responsibility for ensuring that all aff ected property
971971 owners are notified pursuant to the provisions of this section shall
972972 be upon the applicant.
973973 SECTION 3. This act shall become effective November 1, 2025.
