75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 26 O.S. 2021, Section 14 -115.4, is
77	77	amended to read as follows:
78	78	Section 14-115.4. A. 1. A registered voter may apply for an
79	79	in-person absentee ballot at a location designated by the secretary
80	80	of the county election board from :
81	81	a. 8 a.m. to 6 p.m. on the Thursday and Friday fourteen
82	82	calendar days immediately preceding any election
83	83	conducted by a county election board ,
84	84	b. 8 a.m. to 2 p.m. on the Saturday immediately preceding
85	85	a General Election, Primary Election, Runoff Primary
86	86	Election or Presidential Preferential Primary Election

143	143	2. As part of the application for an in -person absentee ballot
144	144	such registered voter shall swear or affirm that the voter has not
145	145	voted a regular mail absentee ballot and that the voter will not
146	146	vote at the regular polling place in the election for which the in -
147	147	person absentee ballot is requested.
148	148	3. The secretary of the cou nty election board in counties with
149	149	twenty-five thousand (25,000) or more regi stered voters, or with an
150	150	area in excess of one thousand five hundred (1,500) square miles,
151	151	may designate more than one location as an in -person absentee
152	152	polling place for an ele ction, subject to the approval of and
153	153	pursuant to the procedures prescribed by the Secretary of the State
154	154	Election Board.
155	155	B. 1. The voter also shall provide proof of identity as
156	156	defined in Section 7 -114 of this title. If the voter declines to or
157	157	is unable to produce proof of identity, the voter may sign a
158	158	statement under oath, in a form approved by the Secretary of the
159	159	State Election Board, swearing or affirming that the person is the
160	160	person identified on the precinct registry, and shall be allowed to

214	214	2. False swearing or affirming under oath shall be punishable
215	215	as a felony as provided in Section 16 -103 of this title, and the
216	216	penalty shall be distinctly set forth on the face of the s tatement.
217	217	C. One or more absentee voting boards shall be on duty at the
218	218	in-person absentee polling place on the days and during the hours
219	219	set forth in subsection A of this section. If the secretary of a
220	220	county election board receives an application from a registered
221	221	voter requesting to vote by in -person absentee ballot , the secretary
222	222	shall cause to be implemented the following procedures:
223	223	1. An absentee voting board shall provide to each registered
224	224	voter who applies for an in -person absentee ballot appro priate
225	225	ballots and materials as may be necessary to vote;
226	226	2. The voter must s ign an in-person absentee voter record, and
227	227	the signature of the voter on such record must be certified by both
228	228	members of the absentee voting board, except that the secretary of
229	229	the county election board and one other member of the absentee
230	230	voting board may certify the signature of another member of the
231	231	absentee voting board;
232	232	3. The voter must mark the ballots of the voter in the manner
233	233	provided by law in the presence of the abs entee voting board, but in
234	234	such a manner as to make it impossible for any pers on other than the
235	235	voter to ascertain how such ballots are marked. Insofar as is

287	287	possible, the voting procedure shall be the same as if the voter
288	288	were casting a vote in person at a precinct;
289	289	4. The voter shall then deposit the ballot in a voting device
290	290	designated for in-person absentee voting by the secretary of the
291	291	county election board;
292	292	5. When the in-person polling place is closed on each day of
293	293	in-person absentee voting , the in-person absentee voting board
294	294	shall, without obtaining a printout of result s, remove the
295	295	electronic results storage media from the voting device and seal
296	296	ballots counted that day in a transfer case which shall be secured
297	297	by the sheriff of the county in the same manner as provided in
298	298	Section 8-110 of this title. The electronic results storage media
299	299	shall be sealed in a container prescribed by the Secretary of the
300	300	State Election Board. The sheriff shall secure the sealed
301	301	electronic results storage media container and return it to the in -
302	302	person absentee voting board no later than 7 :45 a.m. on the next day
303	303	of in-person absentee voting or to the secretary of the county
304	304	election board at the time of the county election board meeting to
305	305	count absentee ballots on election day; and
306	306	6. If there is a malfunction in such a way that the electronic
307	307	results storage media used for in -person absentee voting will not
308	308	function, the sheriff is authorized to return the transfer cases
309	309	containing in-person absentee ballots to the county election board
310	310	to be recounted as provided in Section 7 -134.1 of this title.
