5958 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6059 SECTION 1. NEW LAW A new section of law to be codified
6160 in the Oklahoma Statutes as Section 803 of Title 17, unless there is
6261 created a duplication in numbering, reads as follows:
6362 A. Not later than ninety (90) days after the effective date of
6463 this act, the Corporation Commission shall start the p rocess to
6564 engage an outside consulting firm to conduct a technical and legal

9391 feasibility study on nuclear energy generation in this state. This
9492 engagement shall be exempt from the state procurement process under
9593 Section 85.1 et seq. of Title 74 of the Okl ahoma Statutes and follow
9694 the Corporation Commission process to retain expert witnesses on
9795 behalf of the agency to ensure the ability to timely conduct the
9896 study and complete the requirements of this section. The consulting
9997 firm shall be well-established in the nuclear industry.
10098 B. The feasibility study shall evaluate and consider:
10199 1. Advantages and disadvantages of generating nuclear energy in
102100 this state, including, but not limited to, the economic and
103101 environmental impacts;
104102 2. Methods to maximize exis ting workforce and products made in
105103 this state for the construction of nuclear energy generation
106104 facilities;
107105 3. Design characteristics, including recommendations for design
108106 specification and site selection;
109107 4. Environmental and ecological impacts;
110108 5. Land and siting criteria, including specific geographic
111109 areas that are best suited for new nuclear generation, as well as
112110 cities near military bases that may use new nuclear electric
113111 generation to meet the military resiliency requirements of 10
114112 U.S.C., Section 2920;
115113 6. Safety criteria;
116114 7. Engineering and cost -related information;

144141 8. Small modular nuclear reactor and microreactors capability;

146143 9. Socioeconomic factors, including, but not limited to:
147144 a. workforce education, training, and development,
148145 b. local and state tax base,
149146 c. supply chain capability,
150147 d. permanent and temporary job creation,
151148 e. timeline for development, including areas of potential
152149 efficiencies, and potential leveraging of existing
153150 facilities within this state,
154151 f. literature review of studies that have assessed the
155152 potential impact of nuclear energy generation, and
156153 g. policy recommendations to support nuclear energy
157154 generation, including a survey of federal programs to
158155 financially assist the development of a nuclear
159156 project in this state.
160157 C. The Corporation Commission in conjunction with retail
161158 electric suppliers and municipally owned electric utilities shall
162159 cooperate in providing information relevant to the feasibility
163160 study, providing for reasonable safeguards to protect confidenti al
164161 information.
165162 D. Not later than nine (9) months after the effective date of
166163 this act, the Corporation Commission shall electronically deliver
167164 the feasibility study findings to the President Pro Tempore of the

197193 E. In the event the Corporation Commission is unable to hire a
198194 consultant to complete the report, the Commission is authorized to
199195 conduct a notice of inquiry and utilize the information received
200196 from the stakeholders in conjunction with a consulting firm to
201197 reduce the cost of gathering information for the purpose of the
202198 study and report.
203199 SECTION 2. It being immediately necessary for the preservation
204200 of the public peace, health or safety, a n emergency is hereby
205201 declared to exist, by reason whereof this act shall take effect and
206202 be in full force from and after its passage and approval.
