6183 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6284 SECTION 1. NEW LAW A new section of law to be codified
6385 in the Oklahoma Statutes as Section 158 of Title 17, unless there is
6486 created a duplication in numbering, reads as follow s:
6587 A. As used in this act:
6688 1. “Advanced nuclear reactor s” means nuclear reactor s,
6789 including small modular reactors or any necessary ancillary
6890 facilities or structures, that are authorized by the United States

96142 Nuclear Regulatory Commission and the Department of Environmental
97143 Quality as prescribed in Section 2 of this act; and
98144 2. “Retire” means the closure of or the complete and permanent
99145 cessation of operations at an electric ge neration facility.
100146 B. 1. If an electric utility doing business in this state
101147 elects to retire a coal -fired electric generation facility, the
102148 utility shall submit a written notice and report to the Corporation
103149 Commission, in the form and manner prescribed by the Commission, of
104150 the retirement and disclose any preliminary plans regarding the
105151 replacement of the coal -fired electric generation facility. The
106152 notice and report shall include a cost study of replacement options
107153 for the coal-fired electric generati on facility.
108154 2. The electric utility shall prioritize the replacement of the
109155 coal-fired electric generation facility with an advanced nuclear
110-reactor or a natural gas -powered electric generation facility. If
111-the utility does not intend t o replace the facility with an advanced
112-nuclear reactor or a natural gas -powered electric gene ration
113-facility, the utility shall submit in writing the reasoning and
114-evidence supporting the findings of the utility. The Corporation
115-Commission shall issue a final order approving or disapproving the
116-replacement option submitted for a retiring coal -fired electric
117-generation facility.

147-electric generation facility or other means, the utility shall
148-comply with the provisions of Section 2 of this act.
149217 D. The Corporation Commission shall promulgate rules to
150218 effectuate the provisions of this section.
151219 SECTION 2. NEW LAW A new section of law to be codified
152220 in the Oklahoma Statutes as Section 2 -7-501 of Title 27A, unless
153221 there is created a duplicat ion in numbering, reads as follows:
154222 A. For the purposes of this section, “qualified entity” or
155223 “entity” means an entity that has complied with federal and state
156224 requirements for constructing a nuclear power plant and has had its
157225 application approved by th e Department of Environmental Quality
158226 pursuant to this section. An entity that seeks to construct a
159227 nuclear power plant in this state shall be deemed a qualified entity
160228 under this section provided that the entity follows the regulations
161229 and guidance of the United States Nuclear Regulatory Commission and
162230 is granted the necessary lic enses under 10 C.F.R., Part 50.
163231 B. The Department of Environmental Quality and the Corporation
164232 Commission shall promulgate rules in accordance with federal
165233 regulations for the p urpose of creating a regulatory environment for
166234 a qualifying entity to construct a nuclear power plant.
167235 C. 1. An entity seeking to construct a nuclear power plant
168236 under this section shall also construct a facility, either at the
169237 plant location or within the same five-digit zip code of the
238+proposed plant location, with sufficient c apacity to receive the
239+spent fuel from the plant.

197-proposed plant location, with sufficient capacity to receive the
198-spent fuel from the plant.
199291 2. An entity seeking to construct a nuclear power plant under
200292 this section shall, in a form to be prescribed by the Department,
201293 submit a letter of intent to construct the plant and facility and an
202294 application for approval of the construction. The application shall
203295 include but not be limited to:
204296 a. the projected dates for beginning and completing
205297 construction,
206298 b. the location of the proposed nuclear power plant and
207299 facility,
208300 c. copies of any applications, c orrespondence, or forms
209301 submitted in accordance with the requirements of the
210302 United States Nuclear Regulatory Commission ,
211303 d. any statistics or information conveying the cost -
212304 effectiveness, efficiency, and energy -saving potential
213305 of the proposed facility , and
214306 e. any other information deemed necessary by the
215307 Department for approval.
216308 D. The Department shall promulgate any rules necessary to
217309 effectuate the provisions of this section.
218310 SECTION 3. This act shall become effective November 1, 2025.
