8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY Section 1, Chapter 289, O.S.L.
8585 2023 (70 O.S. Supp. 2024, Section 18-114.15), is amended to read as

8787 Section 18-114.15. A. Beginning with the 2023-2024 2025-2026

458458 B. 1. When determining the Minimum Salary Schedule minimum
459459 salary schedule, “fringe benefits” shall mean all or part of
460460 retirement benefits, excluding the contributions made pursuant to
461461 subsection A of Section 17 -108.1 of Title 70 of the Oklahoma
462462 Statutes this title and the flexible benefit allowance pursuant to
463463 Section 26-105 of Title 70 of the Oklahoma Statutes this title from
464464 the flexible benefit allowance funds disbursed by the State Board of
465465 Education and the State Board of Career and Technology Education

517517 pursuant to Section 26 -104 of Title 70 of the Oklahoma Statutes this

519519 2. If a school district intends to provide re tirement benefits
520520 to a teacher such that the teacher ’s salary would be less than the
521521 amounts set forth in the minimum salary schedule specified in
522522 subsection A of this section, the district shall be required to
523523 provide written notification to the teacher p rior to his or her
524524 employment or, if already employed by the district, no late r than
525525 thirty (30) days prior to the date the district elects to provide
526526 retirement benefits such that the teacher ’s salary would be less
527527 than the minimum salary schedule.
528528 C. Any of the degrees referred to in this section shall be from
529529 a college recognized by the State Board of Education. The Board
530530 shall accept teaching experience from out -of-state school districts
531531 that are accredited by the State Board of Education or appropria te
532532 state accrediting agency for the districts. The Board shall accept
533533 teaching experience from out -of-country schools that are accredited
534534 or otherwise endorsed by the appropriate national or regional
535535 accrediting or endorsement authority. Out -of-country certification
536536 documentation in a language other than English shall be analyzed by
537537 an educational credential evaluation service in accordance with
538538 industry standards and guidelines and approved by the State
539539 Department of Education. The person seeking to hav e credit granted
540540 for out-of-country teaching experience shall be responsible f or all

592592 costs of the analysis by a credential evaluation service. The Board
593593 shall accept teaching experience from primary and secondary schools
594594 that are operated by the United St ates Department of Defense or are
595595 affiliated with the United States Department of State.
596596 D. For the purpose of state salary increments and retirement,
597597 no teacher shall be granted credit for more than five (5) years of
598598 active duty in the military service o r out-of-state or out-of-
599599 country teaching experience as a certified teacher or its
600600 equivalent. Nothing in this section shall prohibit boards of
601601 education from crediting more years of experience on district salary
602602 schedules than those allowed for state pur poses.
603603 E. The State Board of Education shall recognize, for purposes
604604 of certification and salary increments, all the years of experience
605605 of a:
606606 1. Certified teacher who teaches in the educational program of
607607 the Department of Corrections, beginning with fi scal year 1981;
608608 2. Vocational rehabilitation counselor under the Department o f
609609 Human Services if the counselor was employed as a certified teacher
610610 by the State Department of Education when the Division of Vocational
611611 Rehabilitation was transferred from the State Board of Career and
612612 Technology Education or the State Board of Education to the Oklahoma
613613 Public Welfare Commission on July 1, 1968;
614614 3. Vocational rehabilitation counselor which were completed
615615 while employed by the Department of Human Services if su ch counselor

667667 was certified as a teacher or was eligible for certification as a
668668 teacher in Oklahoma;
669669 4. Certified teacher which were completed while employed by the
670670 Child Study Center located at University Hospital, if the teacher
671671 was certified as a teache r in Oklahoma; and
672672 5. Certified school psychologist or psychometrist which were
673673 completed while employed as a doctoral intern, psychological
674674 assistant, or psychologist with any agency of the State of Oklahoma
675675 if the experience primarily involved work with persons of school- or
676676 preschool-age and if the person was, at the time the ex perience was
677677 acquired, certified as, or eligible for certification as, a school
678678 psychologist or psychometrist.
679679 F. The provisions of this section shall not apply to teachers
680680 who have entered into postretirement employment with a public school
681681 in Oklahoma and are still receiving a monthly retirement benefit.
682682 G. If a person employed as certified personnel, as defined in
683683 Section 26-103 of Title 70 of the Oklahoma Statutes this title, by a
684684 school district during the 2022-2023 2024-2025 school year was
685685 receiving a salary above the step level indicated by the State
686686 Minimum Salary Schedule state minimum salary schedule for the 2022-
687687 2023 2024-2025 school year, the person shall receive a s alary
688688 increase amount equal to the amount indicated in subsection A of
689689 this section for the step level indicated for the person, provided

741741 they remain employed by the same district, unless the hours or the
742742 duties of the certified personnel are reduced propo rtionately.
743743 H. If a school district does not receive Foundation or Salary
744744 Incentive Aid pursuant to Section 18 -200.1 of Title 70 of the
745745 Oklahoma Statutes, funds shall be allocated by the State Board of
746746 Education to implement the salary increases indicated in subsection
747747 A of this section.
748748 I. Persons employed as classroom instructional employees of
749749 technology center school districts supervised by the State Board of
750750 Career and Technology Education shall receive a salary increase
751751 amount equal to the amount in dicated in subsection A of this section
752752 for the step level indicated for the p erson, provided they remain
753753 employed by the same technology center school district, unless the
754754 hours or the duties of the classroom instructional employees are
755755 reduced proportionately.
756756 J. Persons employed as correctional teachers or vocational
757757 instructors by the Department of Corrections pursuant to Section
758758 510.6a of Title 57 of the Oklahoma Statutes or persons employed as
759759 teachers by the Office of Juvenile Affairs shall receive a salary
760760 increase amount equal to the amount indicated in subsection A of
761761 this section for the step level indicated for the person, provided
762762 they remain employed by the same Department of Corrections or Office
763763 of Juvenile Affairs facility, unless the hours or the duties of the

817817 K. Persons employed as teachers by the State Department of
818818 Rehabilitation Services shall receive a salary increase amount equal
819819 to the amount indicated in subsection A of this section for the step
820820 level indicated for the pe rson, provided they remain employed by the
821821 State Department of Rehabilitation Services, unless the hours or the
822822 duties of the teachers are reduced proportionately.
823823 SECTION 2. This act shall become effective July 1, 2025.
824824 SECTION 3. It being immediately necessary for the preservation
825825 of the public peace, health or safety, an emergency is hereby
826826 declared to exist, by reason whereof this act shall ta ke effect and
827827 be in full force from and after its passage and approval.
