8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 12 O.S. 2021, Section 1823, is
8585 amended to read as follows:
8686 Section 1823. Any district court, by agreement of the parties,
8787 may refer any civil case, including any domestic relations ca se, any
8888 eviction case, or any portion thereof for mediation. A referral to
8989 mediation may be made at any time while a civil case is pending.

144144 SECTION 2. NEW LAW A new section of law to be codified
145145 in the Oklahoma Statutes as Section 137 of Title 41, un less there is
146146 created a duplication in numbering, reads as follows:
147147 A. If a landlord retaliates against a tenant because the tenant
148148 exercised the tenant ’s rights granted by law or because of the
149149 tenant’s complaint to an appropriate agency as to ability of a
150150 dwelling, and if the tenant is not in default as to the payment of
151151 rent, the landlord may not recover possession of a dwelling in any
152152 action or proceeding, cause the tenant to quit involuntarily,
153153 increase the rent, or decrease any services offered by th e landlord
154154 within one hundred eighty (180) days of any of the circumstances
155155 described in paragraphs 1 through 5 of this subsection. In each
156156 instance, the one-hundred-eighty-day period shall run from the
157157 latest applicable date:
158158 1. After the date upon whic h the tenant, in good faith, has
159159 given notice of a suspected bed bug infestation, has made a
160160 complaint, orally or in writing in either a physical or electronic
161161 format, to the landlord regarding tenantability, or has requested
162162 orally or in writing the landl ord make a repair to an item for which
163163 the landlord is responsible;
164164 2. After the date upon which the tenant, in good faith, has
165165 filed a written complaint either physically or in an electronic

217217 format, or an oral complaint which is registered or otherwise
218218 recorded in writing, with an appropriate agency, of which the
219219 landlord has notice, for the purpose of obtaining correction of a
220220 condition relating to tenantability;
221221 3. After the date of an inspection or issuance of a citation
222222 resulting from a complaint des cribed in paragraph 2 of this
223223 subsection of which the landlord did not have no tice;
224224 4. After the filing of appropriate documents commencing a
225225 judicial or arbitration proceeding involving the issue of
226226 tenantability; or
227227 5. After entry of judgment or the si gning of an arbitration
228228 award, if any, when in the judicial proceeding or arbitration the
229229 issue of tenantability is determined adversely to the landlord.
230230 B. A tenant may not invoke the provisions of subsection A of
231231 this section more than once in any twelv e-month period.
232232 C. Notwithstanding subsection A of this section, a landlord m ay
233233 recover possession of a dwelling and perform any of the other acts
234234 described in subsection A of this section within the period
235235 prescribed therein, if the notice of termination , rent increase, or
236236 other act, and any pleading or statement of issues in an
237237 arbitration, if any, states the ground upon which the landlord, in
238238 good faith, seeks to recover possession, increase rent, or perform
239239 any other acts described in subsection A of t his section.

291291 D. Any landlord or agent of a landlord who violates the
292292 provisions of this section shall be liable to the tenant in a civil
293293 action for:
294294 1. Actual damages sustained by the tenant;
295295 2. Punitive damages in an amount not less than One Hundred
296296 Dollars ($100.00) nor more than Two Thousand Dollars ($2,000.00) for
297297 each retaliatory act where the landlord or landlord ’s agent has been
298298 guilty of fraud, oppression, or malice with respect to such act; and
299299 3. Court costs and reasonable attorney fees.
300300 SECTION 3. NEW LAW A new section of law to be codified
301301 in the Oklahoma Statutes as Section 138 of Title 41, unless there is
302302 created a duplication in numbering, reads as follows:
303303 Any municipality with more than one hundred thousand (100,0 00)
304304 residents according to the latest Federal Decennial Census shall
305305 maintain a list of code violations for rental properties within the
306306 municipality limits. The list shall include the name of the
307307 property owner, the date of the code violation, the specif ic
308308 municipal code violated, and any fine or penalty issued to the
309309 property owner. The list shall be maintained on the municipality ’s
310310 website and made available to the public.
311311 SECTION 4. This act shall become effective November 1, 2025.
