86	86	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1279, is

149	149	provisions of the Oklahoma Self -Defense Act may be subject to an
150	150	administrative violation as provided in Section 1280 of this title
151	151	shall not apply to a person acting in self -defense or to a home or
152	152	business owner in defense o f the owner’s private property.
153	153	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1280, is
154	154	amended to read as follows:

157	157	Any person violating the provisions of Section 1279 of this
158	158	title shall, upon convicti on, be guilty of a misdemeanor punishable
159	159	by a fine of not less than One Hund red Dollars ($100.00) nor more
160	160	than One Thousand Dollars ($1,000.00) and shall be imprisoned ,
161	161	imprisonment in the county jail for a period not less than three (3)
162	162	nor more than to exceed twelve (12) months. Any person convicted of
163	163	violating the provisions of Section 1279 of this title after having
164	164	been issued a handgun license pursuant to the provisions of the
165	165	Oklahoma Self-Defense Act shall have the handgun license revoked and
166	166	shall be liable for an administrative fine of Fifty Dollars ($50.00)
167	167	upon a hearing and determination by the Oklahoma State Bureau of

226	226	A. It shall be unlawful for any person to willfully or without
227	227	lawful cause point a shotgun, rifle or pistol, firearm or any other
228	228	deadly weapon, whether loaded or not, at any another person or
229	229	persons for the purpose of threatening or with the intention of
230	230	discharging the firearm or with any malice or for any purpose of
231	231	injuring, either through physical injury or mental or emotional
232	232	intimidation or for purposes of whimsy, humor or prank, or in anger
233	233	or otherwise, but not to include the pointing of shotguns, rifles or
234	234	pistols except by law:
235	235	1. A person who can legally own or possess a weapon pursuant to
236	236	the provisions of Section 1272 of this title:
237	237	a. during an act of self -defense, or
238	238	b. in defense of private property, located on any
239	239	premises, owned, rented, leased, or occupied by
240	240	permission of the property owner;
241	241	2. A person in the defensive display of a firearm or other
242	242	deadly weapon, as provided for in Section 1289.25 of this title;

300	300	5. Members of the state military forces in the performance of

302	302	6. Members of the federal military reserve and active military

308	308	program or on film, or in defense of any person, one ’s home or

310	310	B. Any person convicted of a violation of the provisions of
311	311	this section shall be punished as prov ided in Section 1289.17 of
312	312	this title.
313	313	Any person convicted of a violation of the provisions of this
314	314	section after having been issued a handgun license pursuant to the
315	315	Oklahoma Self-Defense Act shall have the license revoked and shall

374	374	PHYSICAL OR DEADLY FORCE AGAINST INTRUDER
375	375	A. The Legislature hereby recognizes that the citizens of the
376	376	State of Oklahoma this state have a right to expect absolute safety
377	377	within their own homes, places of business or, places of worship, or
378	378	occupied premises and have the right to establish policies regarding
379	379	the possession of weapons on property pursuant to the provisions of
380	380	Section 1290.22 of this title.
381	381	B. A person, regardless of offic ial capacity or lack of
382	382	official capacity, within a place of worship or a person, an owner,
383	383	manager, or employee of a business is presumed to have held a
384	384	reasonable fear of imminent peril of death or great bodily harm to
385	385	himself or herself or another when using defensive force that is
386	386	intended or likely to cause death or great bodi ly harm to another
387	387	if:
388	388	1. a. The the person against whom the defensive force was
389	389	used was in the process of unlawfully and forcefully
390	390	entering, or had unlawfully and forcibly ente red, a
391	391	dwelling, residence, occupied vehicle, place of
392	392	business or, place of worship, or any other occupied

445	445	attempting to remove another against the will of that
446	446	person from the dwelling, residence, occupied ve hicle,
447	447	place of business or, place of worship., or any other
448	448	occupied premises, and
449	449	b. The the person who uses defensive force knew or had
450	450	reason to believe that an unlawful and forcible entry
451	451	or unlawful and forcible act on the occupied premises
452	452	was occurring or had occurred; or
453	453	2. The person who uses defensive force knew or had a reasonable
454	454	belief that the person against whom the defensive force was used
455	455	entered or was attempting to enter into a dwelling, residence,
456	456	occupied vehicle, place of business or, place of worship, or any
457	457	other occupied premises for the purpose of committ ing a forcible
458	458	felony, as defined in Section 733 of this title, and that the
459	459	defensive force was necessary to prevent the commission of the
460	460	forcible felony.
461	461	C. The presumption se t forth in subsection B of this section
462	462	does not apply if:
463	463	1. The person against whom the defensive force is used has the
464	464	right to be in or is a lawful resident of the dwelling, residence,
465	465	or vehicle, or any other occupied premises such as an owner, lesse e,
466	466	or titleholder, and there is not a protective order from domestic

519	519	contact against that person;
520	520	2. The person or persons sought to be removed are children or
521	521	grandchildren, or are otherwis e in the lawful custody or under the
522	522	lawful guardianship, of, the person against whom the defensive force
523	523	is used; or
524	524	3. The person who uses defensive force is engaged in an
525	525	unlawful activity or is using the dwelling, residence, occupied
526	526	vehicle, place of business or, place of worship, or any other
527	527	occupied premises to further an unlawful activity.
528	528	D. A person who is not engaged in an unlawful activity and who
529	529	is attacked in any other place where he or she has a right to be has
530	530	no duty to retreat and has the right to stand his or her ground and
531	531	meet force with force, including deadly force, if he or she
532	532	reasonably believes it is necessary to do so to prevent death or
533	533	great bodily harm to himself or herself or another or to prevent the
534	534	commission of a forci ble felony.
535	535	E. A person who unlawfully and by force enters or attempts to
536	536	enter the dwelling, residence, occupied vehicle of another person,
537	537	place of business or, place of worship, or any other occupied
538	538	premises is presumed to be doing so with the intent to commit an
539	539	unlawful act involving force or violence.
540	540	F. A person who uses defensive force, as permitted pursuant to
541	541	the provisions of subsections A, B, D and E of this section, is

594	594	prosecution and civil action for the use of such defensive force.
595	595	As used in this subsection, the term “criminal prosecution ” includes
596	596	charging or prosecuting the defendant.
597	597	G. A law enforcement agency may use standard procedures for
598	598	investigating the use of defensive force, but the law enforcement
599	599	agency may not arrest the person for using defensive force unless it
600	600	determines that there is probable cause that the defensive force
601	601	that was used was unlawful.
602	602	H. The court shall award reasonable attorney fees, c ourt costs,
603	603	compensation for loss of income, and all expenses incurred by the
604	604	defendant in defense of any civil action brought by a plaintiff if
605	605	the court finds that the defendant is immune from prosecution as
606	606	provided in subsection F of this section.
607	607	I. The provisions of this section and the provisions of the
608	608	Oklahoma Self-Defense Act shall not be construed to require any
609	609	person using a weapon pursuant to the provisions of this section to
610	610	be licensed in any manner.
611	611	J. A person pointing a weapon at a perp etrator in self-defense
612	612	or in order to thwart, stop , or deter a forcible felo ny or attempted
613	613	forcible felony shall not be deemed found guilty of committing a
614	614	criminal act.
615	615	K. 1. The defensive display of a firearm or other deadly
616	616	weapon by a person shall not be a criminal act if a reasonable

670	670	attempted use of unlawful physical or deadly force by another or in
671	671	defense of private property, located on any premises, owned, rented,
672	672	leased, or occupied by per mission of the property owner.
673	673	2. The provisions of this subsection shall not apply to a
674	674	person who:
675	675	a. intentionally provokes another person to use or
676	676	attempt to use unlawful ph ysical or deadly force, or
677	677	b. uses a firearm during the commission of an unlawful
678	678	act involving force or violence.
679	679	3. The provisions of this subsection shall not be construed to
680	680	require the defensive display of a firearm or any other deadly
681	681	weapon before the use of defensive force or the threat of defensive
682	682	force by a person who i s justified in the use or threatened use of
683	683	defensive force.
684	684	L. As used in this section:
685	685	1. “Defensive display of a firearm ” includes but is not limited
686	686	to:
687	687	a. verbally informing another person that the person
688	688	possesses or has available a firearm or other deadly
689	689	weapon,
690	690	b. exposing or displaying a firearm or any other deadly
691	691	weapon in a manner that a reasonable person would

752	752	thwart, stop, or deter a forcible felony or attempted forcible
753	753	felony;
754	754	2. 3. “Dwelling” means a building or conve yance of any kind,
755	755	including any attached porch, whether the building or conv eyance is
756	756	temporary or permanent, mobile or immobile, which has a roof over
757	757	it, including a tent, and is designed to be occupied by people;
758	758	4. “Occupied premises” means any premises occupied by an owner,
759	759	tenant, lessee, guest , or authorized user of the premises, including
760	760	their agents;
761	761	3. 5. “Place of worship” means:
762	762	a. any permanent building, structure, facility , or office
763	763	space owned, leased, rented , or borrowed, on a full -
764	764	time basis, when used for worship services,
765	765	activities, and business of the congr egation, which

830	830	SECTION 5. It being immediately necessary for the preservation
831	831	of the public peace, health or safety, an emergency is hereby
832	832	declared to exist, by reason whereof this act shall take effect and
833	833	be in full force from and after its passage and approval.
