8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1279, is

157157 Any person violating the provisions of Section 1279 of this
158158 title shall, upon convicti on, be guilty of a misdemeanor punishable
159159 by a fine of not less than One Hund red Dollars ($100.00) nor more
160160 than One Thousand Dollars ($1,000.00) and shall be imprisoned ,
161161 imprisonment in the county jail for a period not less than three (3)
162162 nor more than to exceed twelve (12) months. Any person convicted of
163163 violating the provisions of Section 1279 of this title after having
164164 been issued a handgun license pursuant to the provisions of the
165165 Oklahoma Self-Defense Act shall have the handgun license revoked and
166166 shall be liable for an administrative fine of Fifty Dollars ($50.00)

225225 Except for an act of self -defense, it
226226 A. It shall be unlawful for any person to willfully or without
227227 lawful cause point a shotgun, rifle or pistol, firearm or any other
228228 deadly weapon, whether loaded or not, at any another person or
229229 persons for the purpose of threatening or with the intention of
230230 discharging the firearm or with any malice or for any purpose of
231231 injuring, either through physical injury or mental or emotional
232232 intimidation or for purposes of whimsy, humor or prank, or in anger
233233 or otherwise, but not to include the pointing of shotguns, rifles or
234234 pistols except by law:
235235 1. A person who can legally own or possess a weapon pursuant to
236236 the provisions of Section 1272 of this title:
237237 a. during an act of self -defense, or
238238 b. in defense of private property, located on any
239239 premises, owned, rented, leased, or occupied by
240240 permission of the property owner;
241241 2. A person in the defensive display of a firearm or other
242242 deadly weapon, as provided for in Section 1289.25 of this title;

294294 3. Law enforcement authorities in the performance of their
295295 duties, armed;
296296 4. Armed security guards licensed by the Council on Law
297297 Enforcement Education and Training pursuant to the Oklahoma Security
298298 Guard and Private Investigator Act in the performance of their
299299 duties, members;
300300 5. Members of the state military forces in the performance of
301301 their duties, members;
302302 6. Members of the federal military reserve and active military
303303 components in the performance of their duties , or any federal;
304304 7. Federal government law enforcement officer officers in the
305305 performance of any duty, their duties; or in
306306 8. Any person during the performance of a play on s tage, while
307307 participating in a rodeo, or when participating in a television
308308 program or on film, or in defense of any person, one ’s home or
309309 property project.
310310 B. Any person convicted of a violation of the provisions of
311311 this section shall be punished as prov ided in Section 1289.17 of
312312 this title.
313313 Any person convicted of a violation of the provisions of this
314314 section after having been issued a handgun license pursuant to the
315315 Oklahoma Self-Defense Act shall have the license revoked and shall
316316 be subject to an admi nistrative fine of One Thousand Dollars

374374 PHYSICAL OR DEADLY FORCE AGAINST INTRUDER
375375 A. The Legislature hereby recognizes that the citizens of the
376376 State of Oklahoma this state have a right to expect absolute safety
377377 within their own homes, places of business or, places of worship, or
378378 occupied premises and have the right to establish policies regarding
379379 the possession of weapons on property pursuant to the provisions of
380380 Section 1290.22 of this title.
381381 B. A person, regardless of offic ial capacity or lack of
382382 official capacity, within a place of worship or a person, an owner,
383383 manager, or employee of a business is presumed to have held a
384384 reasonable fear of imminent peril of death or great bodily harm to
385385 himself or herself or another when using defensive force that is
386386 intended or likely to cause death or great bodi ly harm to another
387387 if:
388388 1. a. The the person against whom the defensive force was
389389 used was in the process of unlawfully and forcefully
390390 entering, or had unlawfully and forcibly ente red, a
391391 dwelling, residence, occupied vehicle, place of
392392 business or, place of worship, or any other occupied

444444 premises or if that person had removed or was
445445 attempting to remove another against the will of that
446446 person from the dwelling, residence, occupied ve hicle,
447447 place of business or, place of worship., or any other
448448 occupied premises, and
449449 b. The the person who uses defensive force knew or had
450450 reason to believe that an unlawful and forcible entry
451451 or unlawful and forcible act on the occupied premises
452452 was occurring or had occurred; or
453453 2. The person who uses defensive force knew or had a reasonable
454454 belief that the person against whom the defensive force was used
455455 entered or was attempting to enter into a dwelling, residence,
456456 occupied vehicle, place of business or, place of worship, or any
457457 other occupied premises for the purpose of committ ing a forcible
458458 felony, as defined in Section 733 of this title, and that the
459459 defensive force was necessary to prevent the commission of the
460460 forcible felony.
461461 C. The presumption se t forth in subsection B of this section
462462 does not apply if:
463463 1. The person against whom the defensive force is used has the
464464 right to be in or is a lawful resident of the dwelling, residence,
465465 or vehicle, or any other occupied premises such as an owner, lesse e,
466466 or titleholder, and there is not a protective order from domestic

518518 violence in effect or a written pretrial supervision order of no
519519 contact against that person;
520520 2. The person or persons sought to be removed are children or
521521 grandchildren, or are otherwis e in the lawful custody or under the
522522 lawful guardianship, of, the person against whom the defensive force
523523 is used; or
524524 3. The person who uses defensive force is engaged in an
525525 unlawful activity or is using the dwelling, residence, occupied
526526 vehicle, place of business or, place of worship, or any other
527527 occupied premises to further an unlawful activity.
528528 D. A person who is not engaged in an unlawful activity and who
529529 is attacked in any other place where he or she has a right to be has
530530 no duty to retreat and has the right to stand his or her ground and
531531 meet force with force, including deadly force, if he or she
532532 reasonably believes it is necessary to do so to prevent death or
533533 great bodily harm to himself or herself or another or to prevent the
534534 commission of a forci ble felony.
535535 E. A person who unlawfully and by force enters or attempts to
536536 enter the dwelling, residence, occupied vehicle of another person,
537537 place of business or, place of worship, or any other occupied
538538 premises is presumed to be doing so with the intent to commit an
539539 unlawful act involving force or violence.
540540 F. A person who uses defensive force, as permitted pursuant to
541541 the provisions of subsections A, B, D and E of this section, is

593593 justified in using such defensive force and is immune from criminal
594594 prosecution and civil action for the use of such defensive force.
595595 As used in this subsection, the term “criminal prosecution ” includes
596596 charging or prosecuting the defendant.
597597 G. A law enforcement agency may use standard procedures for
598598 investigating the use of defensive force, but the law enforcement
599599 agency may not arrest the person for using defensive force unless it
600600 determines that there is probable cause that the defensive force
601601 that was used was unlawful.
602602 H. The court shall award reasonable attorney fees, c ourt costs,
603603 compensation for loss of income, and all expenses incurred by the
604604 defendant in defense of any civil action brought by a plaintiff if
605605 the court finds that the defendant is immune from prosecution as
606606 provided in subsection F of this section.
607607 I. The provisions of this section and the provisions of the
608608 Oklahoma Self-Defense Act shall not be construed to require any
609609 person using a weapon pursuant to the provisions of this section to
610610 be licensed in any manner.
611611 J. A person pointing a weapon at a perp etrator in self-defense
612612 or in order to thwart, stop , or deter a forcible felo ny or attempted
613613 forcible felony shall not be deemed found guilty of committing a
614614 criminal act.
615615 K. 1. The defensive display of a firearm or other deadly
616616 weapon by a person shall not be a criminal act if a reasonable

669669 protect himself, herself , or another person against the use or
670670 attempted use of unlawful physical or deadly force by another or in
671671 defense of private property, located on any premises, owned, rented,
672672 leased, or occupied by per mission of the property owner.
673673 2. The provisions of this subsection shall not apply to a
674674 person who:
675675 a. intentionally provokes another person to use or
676676 attempt to use unlawful ph ysical or deadly force, or
677677 b. uses a firearm during the commission of an unlawful
678678 act involving force or violence.
679679 3. The provisions of this subsection shall not be construed to
680680 require the defensive display of a firearm or any other deadly
681681 weapon before the use of defensive force or the threat of defensive
682682 force by a person who i s justified in the use or threatened use of
683683 defensive force.
684684 L. As used in this section:
685685 1. “Defensive display of a firearm ” includes but is not limited
686686 to:
687687 a. verbally informing another person that the person
688688 possesses or has available a firearm or other deadly
689689 weapon,
690690 b. exposing or displaying a firearm or any other deadly
691691 weapon in a manner that a reasonable person would

752752 thwart, stop, or deter a forcible felony or attempted forcible

754754 2. 3. “Dwelling” means a building or conve yance of any kind,
755755 including any attached porch, whether the building or conv eyance is
756756 temporary or permanent, mobile or immobile, which has a roof over
757757 it, including a tent, and is designed to be occupied by people;
758758 4. “Occupied premises” means any premises occupied by an owner,
759759 tenant, lessee, guest , or authorized user of the premises, including
760760 their agents;
761761 3. 5. “Place of worship” means:
762762 a. any permanent building, structure, facility , or office
763763 space owned, leased, rented , or borrowed, on a full -
764764 time basis, when used for worship services,
765765 activities, and business of the congr egation, which

826826 either temporarily or permanently or is visiting as an invited

828828 5. 7. “Vehicle” means a conveyance of any kind, whether or not
829829 motorized, which is designed to transport people or property.
830830 SECTION 5. It being immediately necessary for the preservation
831831 of the public peace, health or safety, an emergency is hereby
832832 declared to exist, by reason whereof this act shall take effect and
833833 be in full force from and after its passage and approval.
