7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 28 O.S. 2021, Section 153, as
8181 amended by Section 2, Chapter 237, O.S.L. 2022 (28 O.S. Supp. 2024,
8282 Section 153), is amended to read as follows:
8383 Section 153. A. The clerks of the courts shall collect as
8484 costs in every criminal case for each offense of which the defendant
8585 is convicted, irrespective of whether or not the sentence is
8686 deferred, the following flat charges and no more, except for
8787 standing and parking violations and for charges otherwise provided
8888 for by law, which fee shall cover docketing of the case, filing of

294294 B. In addition to the amount collected pursuant to paragraphs 2
295295 through 6 of subsection A of this section, the sum of Six Dollars
296296 ($6.00) shall be assessed and credited to the Law Library Fund
297297 pursuant to Section 1201 et seq . of Title 20 of the Oklahoma
298298 Statutes.
299299 C. In addition to the amount collected pursuant to subsection A
300300 of this section, the sum of Twenty Dollars ($20.00) shall be
301301 assessed and collected in every traffic case for each offense other
302302 than for driving under the influence of alcohol or other
303303 intoxicating substance; the sum of Thirty Dollars ($30.00) shall be
304304 assessed and collected in every misdemeanor case for each offense;
305305 the sum of Thirty Dollars ($30.00) shall be assessed and collected
306306 in every misdemeanor case for each offense for driving under the
307307 influence of alcohol or other intoxicating substance; the sum of
308308 Fifty Dollars ($50.00) shall be assessed and collected in every
309309 felony case for each offense; and the sum of Fifty Dollars ($50.00)
310310 shall be assessed and collected in every felony case for each
311311 offense for driving under the influence of alcohol or other
312312 intoxicating substance.

364364 D. In addition to the amounts collected purs uant to subsections
365365 A and B of this section, the sum of Twenty -five Dollars ($25.00)
366366 shall be assessed and credited to the Oklahoma Court Information
367367 System Revolving Fund created pursuant to Section 1315 of Title 20
368368 of the Oklahoma Statutes.
369369 E. In addition to the amount collected pursuant to paragraphs 1
370370 through 6 of subsection A of this section, the sum of Ten Dollars
371371 ($10.00) shall be assessed and credited to the Sheriff ’s Service Fee
372372 Account in the county in which the conviction occurred for the
373373 purpose of enhancing existing or providing additional courthouse
374374 security.
375375 F. In addition to the amounts collected pursuant to paragraphs
376376 1 through 6 of subsection A of this section, the sum of Three
377377 Dollars ($3.00) shall be assessed and credited to the Office of the
378378 Attorney General Victim Services Unit.
379379 G. In addition to the amounts collected pursuant to paragraphs
380380 1 through 6 of subsection A of this section, the sum of Three
381381 Dollars ($3.00) shall be assessed and credited to the Child Abuse
382382 Multidisciplinary Account. This Such fee shall not be used for
383383 purposes of hiring or employing any law enforcement officers.
384384 H. In addition to the amount collected pursuant to paragraphs 5
385385 and 6 of subsection A of this section, the sum of Fifteen Dollars
386386 ($15.00) shall be assessed in every misdemeanor or felony case for
387387 each offense of driving under the influence of alcohol or other

439439 intoxicating substance and credited to the Oklahoma Impaired Driver
440440 Database Revolving Fund created pursuant to Section 11 -902d of Title
441441 47 of the Oklahoma Statutes.
442442 I. Prior to conviction, parties in criminal cases sha ll not be
443443 required to pay, advance, or post security for the issuance or
444444 service of process to obtain compulsory attendance of witnesses.
445445 J. The amounts to be assessed as court costs upon filing of a
446446 case shall be those amounts above-stated stated in paragraph 3 or 4
447447 of subsection A and subsections B, C, D and E of this section.
448448 K. The fees collected pursuant to this section shall be
449449 deposited into the court fund, except the fol lowing:
450450 1. A court clerk issuing a misdemeanor warrant is entitled to
451451 ten percent (10%) of the sheriff ’s service fee, provided for in
452452 paragraph 9 of subsection A of this section, collected on a warrant
453453 referred to the contractor for the misdemeanor warran t notification
454454 program governed by Sections 514.4 and 514.5 of Title 19 of the
455455 Oklahoma Statutes. This Such ten-percent sum shall be deposited
456456 into the issuing Court Clerk ’s Revolving Fund, created pursuant to
457457 Section 220 of Title 19 of the Oklahoma Statu tes, of the court clerk
458458 issuing the warrant with the balance of the sheriff ’s service fee to
459459 be deposited into the Sheriff ’s Service Fee Account, created
460460 pursuant to the provisions of Section 514.1 of Title 19 of the
461461 Oklahoma Statutes, of the sheriff in th e county in which service is
462462 made or attempted. Otherwise, the sheriff ’s service fee, when

514514 collected, shall be deposited in its entirety into the Sheriff ’s
515515 Service Fee Account of the sheriff in the county in which service is
516516 made or attempted;
517517 2. The sheriff’s fee provided for in Section 153.2 of this
518518 title;
519519 3. The witness fees p aid by the district attorney pursuant to
520520 the provisions of Section 82 of this title which, if collected by
521521 the court clerk, shall be transferred to the district attorney ’s
522522 office in the county where witness attendance was required. Fees
523523 transferred pursuant to this paragraph shall be deposited in the
524524 district attorney’s maintenance and operating expense account;
525525 4. The fees provided for in subsection C of this section shall
526526 be forwarded to the District Attorneys Council Revolving Fund to
527527 defray the costs of prosecution; and
528528 5. The following amounts of the fees provided for in paragraphs
529529 2, 3, 5, and 6 of subsection A of this section, when collected,
530530 shall be deposited in the Tra uma Care Assistance Revolving Fund,
531531 created pursuant to the provisions of Section 1 -2530.9 of Title 63
532532 of the Oklahoma Statutes:
533533 a. Ten Dollars ($10.00) of the Ninety-eight-Dollar
534534 ninety-eight-dollar fee provided for in paragraph 2 of
535535 subsection A of this section,

587587 b. Ten Dollars ($10.00) of the Ninety-three-Dollar
588588 ninety-three-dollar fee provided for in paragraph 3 of
589589 subsection A of this section,
590590 c. One Hundred Dollars ($100.00) of the Four-Hundred-
591591 Thirty-three-Dollar four-hundred-thirty-three-dollar
592592 fee provided for in paragraph 5 of subsection A of
593593 this section, and
594594 d. One Hundred Dollars ($100.00) of the Four-Hundred-
595595 Thirty-three-Dollar four-hundred-thirty-three-dollar
596596 fee provided for in paragraph 6 of subsection A of
597597 this section.
598598 L. As used in this s ection, “convicted” means any final
599599 adjudication of guilt, whether pursuant to a plea of guilty or nolo
600600 contendere or otherwise, and any deferred judgment or suspended
601601 sentence.
602602 M. A court clerk may accept in payment for any fee, fine,
603603 forfeiture payment, cost, penalty assessment or other charge or
604604 collection to be assessed or collected by a court clerk pursuant to
605605 this section a nationally recognized credit card or debit card or
606606 other electronic payment method as provided in paragraph 1 of
607607 subsection B of Section 151 of this title.
608608 N. Upon receipt of payment of fines and costs for offenses
609609 charged prior to July 1, 1992, the court clerk shall apportion and
610610 pay Thirteen Dollars ($13.00) per conviction to the court fund.

662662 SECTION 2. This act shall become effective July 1, 2025.
663663 SECTION 3. It being immediately necessary for the preservation
664664 of the public peace, health or safety, an emergency is hereby
665665 declared to exist, by reason whereof this act shall take effect and
666666 be in full force from and after its passage and approval.
