6849 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6950 SECTION 1. NEW LAW A new section of law to be codified
7051 in the Oklahoma Statutes as Section 93 of Title 73, unless there is
7152 created a duplication in n umbering, reads as follows:
53+The Department of Public Safety shall create a security plan for
54+the State Capitol Building and grounds. The plan shall be submitted
55+to the State Capitol Preservation Commission. An updated plan shall
56+be submitted every three (3) years.

98-The Department of Public Safety shall create a security plan for
99-the State Capitol Building and grounds. The plan sha ll be submitted

105-SECTION 2. AMENDATORY 73 O.S. 2021, Section 176, is
106-amended to read as follows:
10789 Section 176. A. There shall be established created within the
10890 Legislative Service Bureau the position of a permanent legislative
10991 liaison committee, composed of three (3) members from each house,
11092 appointed by the President Pro Tempore and Speaker, respectiv ely
11193 Capitol Liaison to the State Capitol Preservation Commission . The
11294 legislative liaison committee will Capitol Liaison shall keep the
11395 Legislature properly advised as to the activities of the Oklahoma
11496 Capitol Improvement Authority and the Office of Manag ement and
11597 Enterprise Services by making such reports as they deem the Capitol

148-committee created by this section Capitol Liaison. The Oklahoma
149-Capitol Improvement Authority and the Office of Management and
150-Enterprise Services shall notify the membership of the legisl ative
151-liaison committee Capitol Liaison in advance of any meeting in which
152-official or formal action is to be taken by furnishing the p roposed
153-agenda in writing at least twenty -four (24) hours in advance of such
154-meeting.
155-B. The Oklahoma Capitol Improvemen t Authority and the Office of

159142 C. All proposals for enhancement, modification, preservation,
160143 or restoration of the State Capitol Building and grounds shall be
161144 submitted to the Capitol Liaison. The Capitol Liaison shall submit
162145 all proposals to the State Capitol Preservation Commission for
163146 approval.
164147 D. All proposals for changes in overall allocation in the State
165148 Capitol Building or parking shall be submitted to the Capitol
166149 Liaison. The Capitol Liaison shall submit all proposals to the
167150 State Capitol Preservation Commission for approval, as defined by
168151 Sections 15.1 and 15.3 of this title.
169152 E. The Capitol Liaison shall be the primary liaison for all
170153 tenants that occupy space in the State Capitol Building.

197-SECTION 3. AMENDATORY 73 O.S. 2021, Section 345, is
198-amended to read as follows:
199-Section 345. A. In addition to any other authorizat ion
200-provided by law, the Oklahoma Capitol Improvement Authority is
201-authorized to issue obligations to acquire real property, together
202-with improvements located thereon, and personal property to
203-construct improvements to real property and to provide funding for
204-repairs, refurbishments and improvements to real and personal
205-property of the State Capitol Building in a total amount not to
206-exceed One Hundred Twenty Million Dollars ($120,000,000.00). The
207191 funds shall be used for the renovation, repair and remodeling of the
208192 State Capitol Building.
209193 B. The Authority may hold title to the property and
210194 improvements until such time as any obligations issued for this
211195 purpose are retired or defeased and may lease the property and
212196 improvements to the Office of Management and Enterprise Services.
213197 Upon final redemption or defeasance of the obligations created
214198 pursuant to this secti on, title to the proper ty and improvements
215199 shall be transferred from the Oklahoma Capitol Improvement Authority
216200 to the Office of Management and Enterprise Services.
217201 C. For the purposes of paying the costs for construction of the
218202 real property and improvem ents, and providing funding for the
219203 project authorized in subsection A of this section, and for the
220204 purpose authorized in subsection D of this section, the Authority is
205+hereby authorized to borrow monies on the credit of the income and
206+revenues to be deriv ed from the leasing of such property and
207+improvements and, in anticipation of the collection of such income
208+and revenues, to issue negotiable obligations in a total amount not
209+to exceed One Hundred Twenty Million Dollars ($120,000,000.00)
210+whether issued in one or more series. The Authority is authorized
211+to capitalize interest on the obligations issued pursuant to this
212+section for a period of not to exceed one (1) year from the date of
213+issuance. For subsequent fiscal years, it is the intent of the

257242 Enterprise Services sufficient monies to make rental payments for
258243 the purpose of retiring the obligations created pursuant to this
259244 section. To the extent funds are available from the proceeds of the
260245 borrowing authorized by this subsection, the Oklahoma Capitol
261246 Improvement Authority shall provide for the payment of professional
262247 fees and associated costs related to the project authorized in
263248 subsection A of this section.
264249 D. The Authority may issue obligation s in one or more series
265250 and in conjunction with other issues of the Authority. The
266251 Authority is authorized to hire bond counsel, financial consultants,
267252 and such other professionals as it may deem necessary to provide for
268253 the efficient sale of the obligati ons and may utilize a portion of
269254 the proceeds of any borrowing to create such reserves as may be
255+deemed necessary and to pay costs associated with the issuance and
256+administration of such obligations.
257+E. The obligations authorized under this section may be sold at
258+either competitive or negotiated sale, as determined by the
259+Authority, and in such form and at such prices as may be authorized
260+by the Authority. The Authority may enter into agreements with such
261+credit enhancers and liquidity providers as may be determined
262+necessary to efficiently market the obligations. The obligations
263+may mature and have such provisions for redemption as shall be
264+determined by the Authority, but in no event shall the final

296-deemed necessary and to pay costs associated with the issuance and
297-administration of such obligations.
298-E. The obligations authorized under this section may be sold at
299-either competitive or negotiated sale, as determined by the
300-Authority, and in such form and at such prices as may be authorized
301-by the Authority. The Authority may enter into agreements with such
302-credit enhancers and liquidity providers as may be determined
303-necessary to efficiently market the obligations. The obligations
304-may mature and have such provisions for redemption as shall be
305-determined by the Authority, but in no event shall the final
306292 maturity of such obligations occur later than ten (10) years from
307293 the first principal maturity date.
308294 F. Any interest earnings on funds or accounts created for the
309295 purposes of this section may be utilized as partial payment of the
310296 annual debt service or for the purposes directed by the Authority.
311297 G. The obligations issued under this section, the transfer
312298 thereof and the interest earned on such obligations , including any
313299 profit derived from the sale thereof, shall not be subject to
314300 taxation of any kind by the State of Oklahoma this state, or by any
315301 county, municipality or political subdivision therein.
316302 H. The Authority may direct the investment of all monies in any
317303 funds or accounts created in connection with the offering of the
318304 obligations authorized under this section. Such investments shall
319305 be made in a manner consistent with the investment guidelines of the
306+State Treasurer. The Authority may place additional restrictions on
307+the investment of such monies if necessary to enhance the
308+marketability of the obligations.
309+I. There is hereby created a State Capit ol Repair Expenditure
310+Oversight Committee. The proceeds from the sale of obligations
311+issued pursuant to the provisions of this section and Section 1 of
312+Enrolled House Bill No. 3168 of the 2nd Session of the 55th Oklahoma
313+Legislature that are needed for re pairs to the interior and exterior
314+of the State Capitol shall be subject to the approval of the State
315+Capitol Repair Expenditure Oversight Committee; provided, however,

346-State Treasurer. The Authority may place additional restrictions on
347-the investment of such monies if necessary to enhance the
348-marketability of the obligations.
349-I. There is hereby created a State Capitol Repair Expenditure
350-Oversight Committee. The proceeds from the sale of obligations
351-issued pursuant to the provisions of this section and Sectio n 1 of
352-Enrolled House Bill No. 3168 of the 2nd Session of the 55th Oklahoma
353-Legislature that are needed for repairs to the interior and exterior
354-of the State Capitol shall be subject to the approval of the State
355-Capitol Repair Expenditure Oversight Committ ee; provided, however,
356343 the expenditure of those proceeds shall be subject to a request for
357344 proposal process.
358345 The Committee shall be c omposed of nine (9) members as follows:
359346 1. Three persons to be appointed by the Governor, one of whom
360347 shall serve as chair of the Committee;
361348 2. Three legislators to be appointed by the Speaker of the
362349 House of Representatives, two o f whom shall be members of the
363350 majority political party and one of whom shall be a member of the
364351 minority political party; and
365352 3. Three legislators to be appointed by the President Pro
366353 Tempore of the Senate, two of whom shall be members of the majority
367354 political party and one o f whom shall be a member of the minority
368355 political party. Five members of the Committee shall constitute a
369356 quorum and the vote of five members shall be necessary for any
357+action taken by the Committee. The Committee shall be staffed by
358+employees of the Office of Management and Enterprise Services. The
359+Committee shall be subject to the Oklahoma Open Meeting Act.
360+J. The Committee shall deliver a preliminary plan for the
361+renovation, repair and remodeling of the State Capitol to the
362+Director of the Office of Management and Enterprise Services no
363+later than December 31, 2014. The preliminary plan shall include
364+the following components:
365+1. Establishment of the Office of Management and Enterprise
366+Services’ goal and criteria for use by th e vendor; and

396-action taken by the Committee. The Committee shall be staffed by
397-employees of the Office of Management and Enterprise Services. The
398-Committee shall be subject to the Oklahoma Open Meeting Act.
399-J. The Committee shall deliver a preliminary plan for the
400-renovation, repair and remodeling of the State Capitol to the
401-Director of the Office of M anagement and Enterprise Services no
402-later than December 31, 2014. The preliminary plan shall include
403-the following components:
404-1. Establishment of the Office of Management and Enterprise
405-Services’ goal and criteria for use by the vendor; and
406394 2. Selection criteria for the design -build team vendor to be
407395 selected through a Request For Proposal process.
408396 K. Following receipt of the preliminary plan as approved by the
409397 Committee, the Office of Management and Enterprise Services shall
410398 solicit Requests For Pr oposals to select the vendor for the project.
411399 L. The Committee shall deliver a final plan to the Director of
412400 the Office of Management and Enterprise Services no later than June
413401 30, 2015. The final plan shall include the following c omponents:
414402 1. Approval of the final scope of work developed by the vendor;
415403 and
416404 2. Approval of the project phasing developed by the vendor.
417405 M. Following delivery of the final plan, the Committee shall
418406 continue to oversee the expenditure of proceeds from the sale of
419407 obligations issued pursuant to the provisions of this section and
408+Section 1 of Enrolled House Bill No. 3168 of the 2nd Session of the
409+55th Legislature, until completion of the renovation, repair and
410+remodeling of the State Capitol. The Committ ee may also propose and
411+approve amendments to the plan as it deems appropriate.
412+N. The Director of the Office of Management and Enterprise
413+Services shall have responsibility to substantially implement the
414+plan as presented by the Committee; provided, the President Pro
415+Tempore of the Senate or the Speaker of the House of Representatives
416+shall approve all proposed designs related to renovation, repair and
417+remodeling of space within the State Capitol Building under the

446-Section 1 of Enrolled House Bill No. 3168 of the 2nd Session of the
447-55th Legislature, until completion of the renovation, repair and
448-remodeling of the State Capitol. The Committee may also propose and

450-N. The Director of the Office of Management and Enterprise
451-Services shall have responsibility to substantially implement the
452-plan as presented by the Committee; provided, the President Pro
453-Tempore of the Senate or the Speaker of the House of Representatives
454-shall approve all proposed designs related to renovation, repai r and
455-remodeling of space within the State Capitol Building under the
456445 management and control of the Legislatur e and allocated to that
457446 officer’s house of the Legislature pursuant to the provisions of
458447 Section 15.1 of this title, and any subsequent changes to such
459448 plans. Joint approval of the President Pro Tempore of the Senate
460449 and the Speaker of the House of Repres entatives shall be requ ired
461450 for such plans for space under the management and control of the
462451 Legislature and not allocated to a specific house of the
463452 Legislature. Such approval shall be in writing.
464453 O. Insofar as they are not in conflict with the provisio ns of
465454 this section, the provisions of Section 151 et seq. of this title
466455 shall apply to this section.
467456 SECTION 4. AMENDATORY 74 O.S. 2021, Section 4101, is
468457 amended to read as follows:
458+Section 4101. As used in Sections 4101 through 4108 4110.1 of
459+this title:
460+1. “Public areas” means those areas in the State Capitol
461+Building open to the general public for general visitation; and
462+2. “Art” means fine art of museum quality representing the
463+highest quality of art objects available to inc lude paintings,
464+murals, graphic arts, art photography and sculpture, aesthetically
465+aligned with recognized values, created by the conscious use of
466+skill and creative imagination ;
467+3. “Design standards” means a document that is produced for the
468+purpose of guiding review of propos ed alterations to the State

495-Section 4101. As used in Sections 4101 through 4108 4110.1 of
496-this title:
497-1. “Public areas” means those areas in the State Capitol
498-Building open to the general public for general visitation; and
499-2. “Art” means fine art of museum quality representing the
500-highest quality of art objects available to include paintings,
501-murals, graphic arts, art photography and sculpture, aesthetically
502-aligned with recognized values, created by the conscious use of
503-skill and creative imagination ;
504-3. “Design standards” means a document that is produced for the
505-purpose of guiding review of proposed alterations to the State
506496 Capitol Building, grounds, and Governor ’s Mansion. Design standards
507497 shall establish the acceptable level of finishes for the historic
508498 fabrics, features, and materials in use in the State Capitol
509499 Building, and specify alterations which, if followed, will provide
510500 compatible design;
511501 4. “Enhancement” means an increase or improvement upon the
512502 quality, value, or extent of the original design intent of the State
513503 Capitol Building, grounds, or Governor ’s Mansion;
514504 5. “Grounds” means all land surrounding the State Capitol
515505 Building and bordered by Lincoln Boulevard;
516506 6. “Maintenance” means keeping spaces, structures, and
517507 infrastructure in proper operating condition in a routine,
518508 scheduled, or anticipated fashion to p revent failure or degradation;
509+7. “Modification” means any change to an existing physical
510+attribute of the State Capitol Building, grounds, or Governor ’s
511+Mansion;
512+8. “Preservation” means the act or process of applying measures
513+necessary to sustain the ex isting form, integrity, and materials of
514+a historic property including preliminary measures to protect and
515+stabilize the property, and focusing upon the ongoing maintenance
516+and repair of historic materials and features, rather than extensive
517+replacement and new construction; and
518+9. “Restoration” means the act or process of accurately
519+depicting the form, features, and character of the State Capitol

559550 SECTION 5. AMENDATORY 74 O.S. 2021, Section 4102, as

10591060 15. OMES shall collaborate with the Department of
10601061 Transportation for all maintenance, upkeep, and access to all
10611062 parking lots on the grounds of the State Capitol Building.
10621063 B. The Office of Management and Enterprise Services shall
10631064 employ all staff and consultants necessary to perform the duties of
10641065 OMES including, but not limited to, a licensed architect.
