8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, as
8383 last amended by Section 1, Chapter 442, O.S.L. 2024 (47 O.S. Supp.
8484 2024, Section 1104), is amended to read as follows:
8585 Section 1104. A. Unless otherwise provided by law, all fees,
8686 taxes, and penalties collected or r eceived pursuant to the Oklahoma
8787 Vehicle License and Registration Act or Secti on 1-101 et seq. of
8888 this title shall be apportioned and distributed monthly by the
8989 Oklahoma Tax Commission in accordance with this section. Service
9090 Oklahoma shall provide to the Oklahoma Tax Commission monthly

142142 reports of motor vehicle collection information, including, but not
143143 limited to, motor vehicle monthly apportionment information,
144144 refunds, canceled vouchers, waste tire collections, organ donor
145145 program amounts, driver licens e records, prorate amounts, and sales
146146 tax amounts. The reports shall be deliv ered electronically pursuant
147147 to the current calendar year apportionment disbursement schedule
148148 provided to Service Oklahoma by the Oklahoma Tax Commission on or
149149 before December 1st annually.
150150 One percent (1%) of fees collected shall be apportioned to the
151151 Licensed Operator Performance Fund created in Section 3 -106 of this
152152 title, in accordance with the applicable metrics determined by
153153 Service Oklahoma.
154154 B. 1. The following percentage s of the monies referred to in
155155 subsection A of this section shall be apportion ed to the various
156156 school districts in accordance with paragraph 2 of this subsection:
157157 a. from October 1, 2000, until June 30, 2001, thirty -five
158158 and forty-six one-hundredths percent (35.46%),
159159 b. for the year beginning July 1, 2001, and ending June
160160 30, 2002, thirty-five and ninety-one one-hundredths
161161 percent (35.91%),
162162 c. for the year beginning July 1, 2002, through the year
163163 ending on June 30, 2015, thirty -six and twenty one-

227227 apportioned in any fiscal year pursuant to this
228228 subparagraph exceed the total amount apportioned for
229229 the fiscal year ending on June 30, 2015. Any amounts
230230 in excess of such limi tation shall be placed to the
231231 credit of the Rebuilding Oklahoma Access and Driver
232232 Safety Municipal Improvements for Roads and Bridges
233233 Fund created in Section 1521 2 of Title 69 of the
234234 Oklahoma Statutes this act.
235235 2. The monies apportioned pursuant to subpa ragraphs a through e
236236 of paragraph 1 of this subsection shall be apportioned to the
237237 various school districts so that each district shall receive an
238238 amount based upon the proportion that each district ’s average daily
239239 attendance bears to the total average dai ly attendance of those

291291 districts entitled to receive funds pursuant to this section as
292292 certified by the State Department of Education.
293293 Each district’s allocation of funds shall be remitted to the
294294 county treasurer of the county wherein the administrative
295295 headquarters of the district are located.
296296 No district shall be eligible for the funds herein provided
297297 unless the district makes an ad valorem tax levy of fifteen (15)
298298 mills and maintains nine (9) years of instruction and pursuant to
299299 the rules of the State Bo ard of Education, is authorized to maintain
300300 ten (10) years of instruction.
301301 C. The following percentages of the monies referred to in
302302 subsection A of this section shall be remitted to the State
303303 Treasurer to be credited to the General Revenue Fund of the St ate
304304 Treasury:
305305 1. From October 1, 2000, until June 30, 2001, forty -five and
306306 ninety-seven one-hundredths percent (45.97%);
307307 2. For the year beginning July 1, 2001, and ending June 30,
308308 2002, forty-five and twenty-nine one-hundredths percent (45.29%);
309309 3. For the year beginning July 1, 2002, and for the subsequent
310310 fiscal years ending June 30, 2007, forty -four and eighty-four one-
311311 hundredths percent (44.84%);
312312 4. For the year beginning July 1, 2007, and ending June 30,

381381 Treasurer to be credited to the State Transportation Fund:
382382 1. From October 1, 2000, until June 30, 2001, thirty one -
383383 hundredths percent (0.30%);
384384 2. For the year beginning July 1, 2001, through the year ending
385385 on June 30, 2015, thirty -one one-hundredths percent (0.31%);
386386 3. For the year begi nning July 1, 2015, through the year ending
387387 on June 30, 2019, thirty -one one-hundredths percent (0.31%), but in
388388 no event shall the amount apportioned in any fiscal year pursuant to

448448 ending on June 30, 2015. Any amounts in excess of such limitation
449449 shall be placed to the credit of the Rebuilding Oklahoma Access and
450450 Driver Safety Municipal Improvements for Roads and Bridges Fund
451451 created in Section 1521 2 of Title 69 of the Oklahoma Statutes this
452452 act.
453453 E. 1. The following percentages o f the monies referred to in
454454 subsection A of this section shall be apportioned to the various
455455 counties as set forth in paragraph 2 of this subsection:
456456 a. from October 1, 2000, until June 30, 2001, seven and
457457 nine one-hundredths percent (7.09%),
458458 b. for the year beginning July 1, 2001, and ending June
459459 30, 2002, seven and eighteen one -hundredths percent
460460 (7.18%),
461461 c. for the year beginning July 1, 2002, through the year
462462 ending on June 30, 2015, seven and twenty -four one-

524524 subsequent years, seven and twenty -four one-hundredths
525525 percent (7.24%), but in no event shall the amount
526526 apportioned in fiscal years 2019 thro ugh 2024 pursuant
527527 to this subparagraph exceed the total amount
528528 apportioned for the fiscal year ending on June 30,
529529 2015, and in no event shall the amount apportioned in
530530 fiscal year 2026 and subsequent fiscal years exceed
531531 the amount apportioned for the fiscal year ending on
532532 June 30, 2025. Any amounts in excess of such
533533 limitation shall be placed to the credit of the
534534 Rebuilding Oklahoma Access and Driver Safety Municipal
535535 Improvements for Roads and Bridges Fund created in
536536 Section 1521 2 of Title 69 of the Oklah oma Statutes

589589 2. The monies apportioned pursuant to subparagraphs a through e
590590 of paragraph 1 of this subsection shall be apportioned as follows:
591591 forty percent (40%) of such sum shall be distributed to the various
592592 counties in that proportion which the county road mileage of each
593593 county bears to the entire state road mileage as certified by the
594594 Transportation Commission and the remaining sixty percent (60%) of
595595 such sum shall be distributed to the various counties on the basis
596596 which the population a nd area of each county bears to the total
597597 population and area of the state. The population shall be as shown
598598 by the last Federal Decennial Census or the most recent annual
599599 estimate provided by the United States Bureau of the Census. The
600600 funds shall be used for the purpose of constructing and maintaining
601601 county highways; provided, however, the county treasurer may deposit
602602 so much of the funds in the sinking fund as may be necessa ry for the
603603 retirement of interest and annual accrual of indebtedness created b y
604604 the issuance of county or township bonds for road purposes. Such
605605 deposits to the sinking fund shall not exceed forty percent (40%) of
606606 the funds allocated to a county pursuant to this paragraph.
607607 F. 1. The following percentages of the monies referred to in
608608 subsection A of this section shall be remitted to the county
609609 treasurers of the respective counties and by them deposited in a
610610 separate special revenue fund to be used by the county commissioners
611611 in accordance with paragraph 2 of this subsection:

676676 the fiscal year ending on June 30, 2015. Any amounts
677677 in excess of such limitation shall be placed to the
678678 credit of the General Revenue Fund, and
679679 e. for the year beginning July 1, 2019, and all
680680 subsequent years, two and fifty -nine one-hundredths
681681 percent (2.59%), but in no event shall the amount
682682 apportioned in fiscal years 2019 through 2 024 pursuant
683683 to this subparagraph exceed the total amount
684684 apportioned for the fiscal year ending on June 30,

743743 Section 1521 2 of Title 69 of the Oklahoma S tatutes
744744 this act.
745745 2. The monies apportioned pursuant to subparagraphs a throu gh e
746746 of paragraph 1 of this subsection shall be used for the primary
747747 purpose of matching federal funds for the construction of federal
748748 aid projects on county roads, or constructi ng and maintaining county
749749 or township highways and permanent bridges of such counties. The
750750 distribution of monies apportioned by this paragraph shall be made
751751 upon the basis of the current formula based upon road mileage, area
752752 and population as related to county road improvement and maintenance
753753 costs. Provided, however, the Departm ent of Transportation may
754754 update the formula factors from time to time as necessary to account
755755 for changing conditions.
756756 G. 1. The following percentages of the monies referred t o in
757757 subsection A of this section shall be transmitted by the Tax
758758 Commission to the various counties as set forth in paragraph 2 of
759759 this subsection:
760760 a. from October 1, 2000, until June 30, 2001, three and
761761 fifty-five one-hundredths percent (3.55%),

829829 percent (3.62%), but in no event shall the amount
830830 apportioned in fiscal years 2019 through 2024 pursuant
831831 to this subparagraph exceed the total amount
832832 apportioned for the fiscal year ending on June 30,
833833 2015, and in no event shall the amount apportioned in
834834 fiscal year 2026 and subsequent fiscal years exceed
835835 the amount apportioned for the fisc al year ending on

893893 2. The monies apportioned pursuant to subparagraphs a through e
894894 of paragraph 1 of this subsection shall be transmitted to the
895895 various counties on the bas is of a formula to be developed by the
896896 Department of Transportation. Such for mula shall be similar to that
897897 currently used for the distribution of the County Bridge Program
898898 funds Improvements for Roads and Bridges Fund, but also taking into
899899 consideration the effect of terrain and traffic volume as related to
900900 county road improvement and maintenance costs. Provided, however,
901901 the Department of Transportation may update the formula factors from
902902 time to time as necessary to account for changing conditions. The
903903 funds shall be transmitted to the various county treasurers to be
904904 deposited in the county highway fund of their respective counties.
905905 H. 1. The following percentages of the monies referred to in
906906 subsection A of this section shall be apportioned to the va rious
907907 counties as set forth in paragraph 2 of this subsection:
908908 a. from October 1, 2000, until June 30, 2001, eighty -one
909909 one-hundredths percent (0.81%),
910910 b. for the year beginning July 1, 2001, and ending June

971971 the fiscal year ending on June 30, 2015. Any amounts
972972 in excess of such limitation shall be placed to the
973973 credit of the General Revenue Fund, and
974974 e. for the year beginning July 1, 2019, and all
975975 subsequent years, eighty -three one-hundredths percent
976976 (0.83%), but in no event shall the amount apportioned
977977 in any fiscal year pursuant to this subparagraph
978978 exceed the total amount apportioned for the fiscal
979979 year ending on June 30, 2015. Any amounts in excess
980980 of such limitation shall be placed to the credit of
981981 the Rebuilding Oklahoma Access and Driver Safety
982982 Municipal Improvements for Roads and Bridges Fund

10431043 I. 1. The following percentages of the moni es referred to in
10441044 subsection A of this section shall be apportioned to the var ious
10451045 cities and incorporated towns as set forth in paragraph 2 of this
10461046 subsection:
10471047 a. from October 1, 2000, until June 30, 2001, three and
10481048 four one-hundredths percent (3.04%),
10491049 b. for the year beginning July 1, 2001, and ending June

11251125 2. The monies apportioned pursuant to subparagraphs a through e
11261126 of paragraph 1 of this subsect ion shall be apportioned to the
11271127 various cities and incorporated towns based up on the proportion that
11281128 each city or incorporated town ’s population bears to the total
11291129 population of all cities and incorporated towns in the state. Such
11301130 funds shall be remitted to the various county treasurers for
11311131 allocation to the various cities and incorporated towns. All such
11321132 funds shall be used for the construction, maintenance, repair,
11331133 improvement, and lighting of streets and alleys. Provided, however,
11341134 the governing board of any city or town may, with the approval of
11351135 the county excise board, transfe r any surplus funds to the general

11951195 2. For the year beginning July 1, 2001, and ending June 30,
11961196 2002, one and twenty -three one-hundredths percent (1.23%); and
11971197 3. For the year beginning July 1, 2002, and all subsequent
11981198 years, one and twenty -four one-hundredths percent (1.24%).
11991199 K. Three one-hundredths of one percent (3/100 of 1%) (.03%) of
12001200 the monies referred to in subsection A of this section shall be
12011201 remitted to the State Treasurer to be credited to the Wildlife
12021202 Conservation Fund. Seventy -five percent (75%) of the funds shall be
12031203 used for fish habitat restoration a nd twenty-five percent (25%) of
12041204 the funds shall be used in the fish hatchery s ystem for fish
12051205 production.
12061206 L. 1. For the year beginning July 1, 2007, and ending June 30,
12071207 2008, five percent (5%) of monies referred to in subsection A of
12081208 this section shall be remitted to the State Treasurer to be credited
12091209 to the County Improvements for Roads and Bridges Fund as created in
12101210 Section 507 of Title 69 of the Oklahoma Statutes.

12721272 4. For the period beginning January 1, 2013 , and ending June
12731273 30, 2013, fifteen and fifty one -hundredths percent (15.50%) of
12741274 monies referred to in subsection A of this section shall be remitted
12751275 to the State Treasurer to be credited to the County Improvements for
12761276 Roads and Bridges Fund as created in Section 507 of Title 69 of the
12771277 Oklahoma Statutes.
12781278 5. For the year beginning July 1, 2013, and ending June 30,
12791279 2014, eighteen percent (18%) of monies referred to in subsection A
12801280 of this section shall be remitted to the State Treasurer to be

16521652 O. Notwithstanding any other provisions of this section, for
16531653 the fiscal year beginning July 1, 2003, the first One Hundred
16541654 Thousand Dollars ($100,000.00) of the monies collected or received
16551655 by the Tax Commission pursuant to the registration of motorcycles
16561656 and mopeds in this state shall be placed to the credit of the

17091709 SECTION 2. NEW LAW A new section of law to be codified
17101710 in the Oklahoma Statutes as Section 508 of Title 69, unless there is
17111711 created a duplication in numbering, reads as follows:
17121712 A. There is hereby created in the State Treasury a revolving
17131713 fund to be known as the “Municipal Improvements for Roads and
17141714 Bridges Fund”. The fund shall be a continuing fund, not subject to
17151715 fiscal year limitations, and shall consist of all appropriations and
17161716 transfers made by the Legislature and the apportionments made
17171717 pursuant to Section 1104 of Title 47 of the Oklahoma Statutes . All
17181718 monies accruing to the credit of the fund are hereby appr opriated
17191719 and may be budgeted and expended beginning with the fiscal year
17201720 ending June 30, 2026, and each fiscal year thereafter pursuant to
17211721 subsection B of this section. Expenditures from the fund shall be
17221722 made upon warrants issued by the State Treasurer a gainst claims
17231723 filed as prescribed by law with the Director of the Office of
17241724 Management and Enterprise Services for approval and payment.
17251725 B. The funds apportioned pursuant to Section 1104 of Title 47
17261726 of the Oklahoma Statutes shall be distributed in equal amounts to
17271727 the various Transportation Commission districts. The funds shall be
17281728 used for the sole purpose of construction or reconstruction of
17291729 municipal roads or bridges within municipalities that are of the
17301730 highest priority as defined by the Transportation Commission.
17311731 Municipalities may accumulate annual funding for a period of up to
17321732 five (5) years for a specific project, with such funding to be held

17851785 project. The Transportation Commission sha ll promulgate rules for
17861786 the administration of the process and the development of criteria
17871787 for determining the level of priority for projects and include such
17881788 projects in a five-year construction plan that will be updated
17891789 annually. Projects in the five -year construction plan shall be
17901790 contracted as provided by law and awarded by the Transportation
17911791 Commission.
17921792 C. The fund shall be invested in any instruments that are
17931793 authorized by law for investments by the State Treasurer and the
17941794 interest earned by any inve stment of monies from the fund shall be
17951795 credited to the fund which shall earn the same, if there is any
17961796 unexpended balance of such fund to which to credit the interest.
17971797 The interest credited pursuant to this subsection shall be expended
17981798 pursuant to this section.
17991799 SECTION 3. This act shall become effective July 1, 2025.
18001800 SECTION 4. It being immediately necessary for the preservation
18011801 of the public peace, health or safety, an emergency is hereby
18021802 declared to exist, by reason whe reof this act shall take effect and
18031803 be in full force from and after its passag e and approval.
