101151 SECTION 1. NEW LAW A new section of law to be codified
102152 in the Oklahoma Statutes as Section 35.10 of Title 62, unless there
103153 is created a duplica tion in numbering, reads as follows:
104-A. 1. On and after the effe ctive date of this act, all state

105155 agencies shall be responsible for their information technology
106-services. Provided, however, all cybersecurity duties shall be
107-maintained by the Information Services Division of the Office of
108-Management and Enterprise Services.
109-2. The Information Services Division of the Office of

111158 agency all data, records, and other information r egarding the

113-effective date of this act. The Chief Information Officer of this

117164 B. Each state agency shall submit an electronic report to the
118165 Governor and the Chief Information Officer annually, not later than
119166 December 31 of each calendar year, detailing the status of the
120-information technology services rendered to the agency and any other
121-information as deemed necessary by the Governor and the Chief

159231 A. The procedure for requisitioning items for county offices
160232 shall be as follows:
161233 1. The requesting department shall prepare a requisition form
162234 in triplicate. The requisition shall contain any specifications for
163235 an item as deemed necessary by the requesting department. The form
164236 shall be prescribed by the State Auditor and Inspector;
165237 2. The requesting department shall retain a copy of the
166238 requisition and forward the original requis ition and a copy to the
167239 county purchasing agent; and
168240 3. Upon receipt of the requisition, the county purchasing
169241 agent, within two (2) working days, shall begin the bidding and
170242 purchasing process as provided for in this section. Nothing in this
171243 section shall prohibit the transfer of supplies, materials, or

204301 1. The county purchasing agent shall request written

270392 one time in a newspaper of general circulation in the county.

304451 bids or electronic bids shall be determined pursuant to an
305452 affirmative vote of the board of count y commissioners. Whenever any
306453 prospective supplier or vendor dealing in or li sting for sale any
307454 particular item or article required to be purchased or acquired by
308455 sealed bids fails to enter or offer a sealed bid for three
309456 successive bid solicitations, the name of the supplier or vendor may
310457 be dropped from the mailing lists of the board of county
311458 commissioners;
312459 3. The sealed bids received from vendors and the state contract
313460 price received from the applicable Purchasing Division of the Office
314461 of Management and Enterprise Services shall be given to the county
315462 clerk by the county purch asing agent. The county clerk shall
316463 forward the sealed bids and state contract price, if any, to the
317464 board of county commissioners;
318465 4. The board of county commissioners, in an open meeting, shall
319466 open the sealed bids and compare them to the state contract price.
320467 The board of county commissioners shall select the lowest and best
321468 bid based upon, if applicable, the availability of material and

354526 bid was not considered to be the lowest and best bid, the reason for
355527 such conclusion shall be recorded. Whenever the board of county
356528 commissioners rejects the written recommendation of the
357529 requisitioning official pertaining t o a special item, the reasons
358530 for the rejection shall be entered in their minutes and stated in a
359531 letter to the requisitioning official and county purchasing agent;
360532 5. The county purchasing agent shall notify the successful
361533 bidders and shall maintain a copy of the notification. The county
362534 purchasing agent shall prepare and maintain a vendors list
363535 specifying the successful bidders and shall notify each county
364536 officer of the list. The county purchasing agent may remove any
365537 vendor from such list who refuses to provide goods or services as
366538 provided by contract if the removal is authorized by the board of
367539 county commissioners. The county purchasing agent may make
368540 purchases from the successful bidders for a price at or below the
369541 bid price. If a vendor who is the low bidder cannot or will not
370542 sell goods or services as required by a county bid contract, the
371543 county purchasing agent may make a one -time purchase from the next

403600 6. When bids have been solicited as provided for by law and no
404601 bids have been received, the procedure shall be as follows:
405602 a. the county purchasing agent shall determine if
406603 potential vendors are willing to commit to a firm
407604 price for a reduced period of time, and, if such is
408605 the case, the bid procedure described in this
409606 subsection shall be followed,
410607 b. if vendors are not willing to commit to a firm price
411608 for a reduced period, the purchasing agent shall
412609 solicit and record at least three quo tes of current
413610 prices available to the county and authorize the
414611 purchase of goods or services based on the lowest and
415612 best quote as it becomes necessary to acquire such
416613 goods or services. The quotes shall be recorded on a
417614 form prescribed by the State Audi tor and Inspector and
418615 shall be attached to the purchase order and filed with
419616 the county clerk’s copy of the purchase order. Any
420617 time the lowest quote was not considered to be the
421618 lowest and best quote, the reason for this conclusion

462684 telecommunication goods and services used by a county shall be as
463685 follows:
464686 1. The county purchasing agent shall prepare a purchase order
465687 in quadruplicate and submit it with a copy of the requisition to the
466688 county clerk;
467689 2. The county clerk shall then encumber the amount stated on
468690 the purchase order and assign a sequential number to the purchase

27424112 H. 1. The State Purchasing Director may develop and test new
27434113 contracting policies, procedures and innovations that hold potential
27444114 for making state procurement more effe ctive and efficient and
27454115 identify, and make recommendations to the Legislature of, any
27464116 appropriate changes in law. Such development and testing, proof of
27474117 concept, pilot project or other similar test shall not be considered
27484118 an acquisition subject to the Okl ahoma Central Purchasing Act.
27494119 2. The State Purchasing Director is authorized to explore and
27504120 investigate cost savings in energy, resource usage and maintenance
27514121 contracts and to identify and negotiate contract solutions
27524122 including, but not limited to, pilot projects to achieve cost
27534123 savings for this state.

28424262 a bid or similar offer is confidential and reject all requests to
28434263 disclose the informa tion so designated.
28444264 K. The State Purchasing Director may utilize and authorize
28454265 state agencies to utilize reverse auctions to obtain acquisitions.
28464266 L. Prior to the award of a con tract to a supplier, the State
28474267 Purchasing Director shall verify, pursuant to applicable provisions
28484268 of law, that the supplier is eligible to do business in this state
28494269 by confirming registration with the Secretary of State and franchise
28504270 tax payment status pu rsuant to Sections 1203 and 1204 of Title 68 of
28514271 the Oklahoma Statutes. The pr ovisions of this subsection shall be
28524272 applicable only if the contract amount is Two Hundred Fifty Thousand
28534273 Dollars ($250,000.00) or greater.

28884333 N. The acquisition threshold amount applicable to an
28894334 acquisition made pursuant to this act the Oklahoma Central
28904335 Purchasing Act or associated rules shall not apply to state agency
28914336 purchases; provided, the State Purchasing Director determines the
28924337 agency has subject matter experts on staff having the specialized
28934338 expertise to purchase goods or services, the agency possesses the
28944339 necessary legal and procurement staff to procure and monitor the
28954340 contracts and provided the Director of the Office of Management and
28964341 Enterprise Services shall certify that the proposed purchase do es
28974342 not conflict with consolidated statewide spend initiatives.
28984343 1. Nothing in this subsection shall give an agency authority to
28994344 issue statewide, multistate or multigovernmental contracts.
29004345 2. Agencies making purchases pursuant to this subsection shall:
29014346 a. be responsible for contracts awarded pursuant to this
29024347 subsection, which includ es, but may not be limited to,
29034348 contract management, protest costs, all costs

29364406 Central Purchasing Division, on a quarterly basis.
29374407 3. Purchases made in accordance with this subsection shall be
29384408 made pursuant to rules authorized by this section.
29394409 O. The State Purchasing Director, with approval by the Director
29404410 of the Office of Management and Enterprise Services, is authorized
29414411 to make use of any state labo ratories for the tests and analyses
29424412 authorized in this section wherever practicable and to use private
29434413 laboratories or the laboratories of another government agency if it
29444414 is impracticable to use state laboratories. The State Purchasing
29454415 Director is further authorized to cooperate in test and analysis
29464416 programs or agreements with othe r states or the United States
29474417 government and to accept federal funds and funds donated by private
29484418 endowments or foundations for the purpose of participation in such
29494419 testing programs.
29504420 P. The State Purchasing Director shall require all contractors
29514421 or subcontractors who have entered into a contract with a public
29524422 employer to submit an affidavit that the contractor or subcontractor
29534423 is in compliance with the provisions of Section 1313 of Title 25 of

29834478 1. The contractor or subcontractor shall be liable for an
29844479 administrative penalty of Five Thous and Dollars ($5,000.00) for the
29854480 first offense, which shall increase by Two Thousand Dollars
29864481 ($2,000.00) for each subsequent offense; and
29874482 2. The public employer or the Office of Management and
29884483 Enterprise Services may terminate the contract with the contrac tor
29894484 or subcontractor.
29904485 SECTION 11. REPEALER 62 O.S. 2021 , Sections 34.11.8,
29914486 34.12, as amended by Section 2, Chapter 74, O.S.L. 2022, 34.13,
29924487 34.15, 34.19, 34.20, 34.21, 34.22, 34.26, 34.28, 34.30, 34.33, 35.1,
29934488 35.2, 35.3, 35.4, 35.5, 3 5.6, 35.6.1, 35.6.2, 35.7, 35.8, and 35.9
29944489 (62 O.S. Supp. 2024, Section 34.12) , are hereby repealed.
29954490 SECTION 12. This act shall become effective July 1, 2025.
29964491 SECTION 13. It being immediately necessary for the preservation
29974492 of the public peace, health or safety, an emergency is hereby
29984493 declared to exist, by reason whereof this act shall take effect and
29994494 be in full force from and after its passage and approval.
