8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 74 O.S. 2021, Sect ion 902, as last
8787 amended by Section 1, Chapter 280, O.S.L. 2024 (74 O.S. Supp. 2024,
8888 Section 902), is amended to read as follows:
8989 Section 902. As used in Section 901 et seq. of this title:
9090 (1) “System” means the Oklahoma Public Employees Retirement
9191 System as established by Section 901 et seq. of this title and as it
9292 may hereafter be amended ;

144144 (2) “Accumulated contributions ” means the sum of all
145145 contributions by a member to the System which shall be credited to
146146 the member’s account;
147147 (3) “Act” means Sections Section 901 to 932, inclusive, et seq.
148148 of this title;
149149 (4) “Actuarial equivalent” means a deferred income benefit of
150150 equal value to the accumulated deposits or benefits when computed
151151 upon the basis of the actuarial tables in use by the System;
152152 (5) “Actuarial tables” means the actuarial tables approved and
153153 in use by the Board at any given time;
154154 (6) “Actuary” means the actuary or firm of actuaries employed
155155 by the Oklahoma Public Employees Retirement System Board of Trustees
156156 at any given time;
157157 (7) “Beneficiary” means any person named by a member to receive
158158 any benefits as provided for by Section 901 et seq. of this title.
159159 If there is no beneficiary living at the time of a member employee’s
160160 death, the member’s estate shall be the beneficiary;
161161 (8) “Board” means the Oklahoma Public Employees Retirement
162162 System Board of Trustees;
163163 (9) “Compensation” means all salary and wages, as defined by
164164 the Board of Trustees, including amounts deferred under deferred
165165 compensation agreements entered into between a member a nd a
166166 participating employer, but exclusive of payment for overtime,
167167 payable to a member of the System for personal services performed

219219 for a participating employer but shall not include compensation or
220220 reimbursement for traveling, or moving expenses, or any compensation
221221 in excess of the maximum compensation level, provided:
222222 (a) For compensation for service prior to January 1, 1988,
223223 the maximum compensation level shall be Twenty -five
224224 Thousand Dollars ($25,000.00) per annum.
225225 For compensation for service on or after January 1,
226226 1988, through June 30, 1994, the maximum compensation
227227 level shall be Forty Thousand Dollars ($40,000.00) per
228228 annum.
229229 For compensation for service on or after July 1, 1994,
230230 through June 30, 1995, the maximum compensation level
231231 shall be Fifty Thousand Dollars ($50,000.00) per
232232 annum; for compensation for service on or after July
233233 1, 1995, through June 30, 1996, the maximum
234234 compensation level shall be Sixty Thousand Dollars
235235 ($60,000.00) per annum; for compensation for service
236236 on or after July 1, 1996, through June 30, 1997, the
237237 maximum compensation level shall be Seventy T housand
238238 Dollars ($70,000.00) per annum; and for compensation
239239 for service on or after July 1, 1997, through June 30,
240240 1998, the maximum compensation level shall be Eighty
241241 Thousand Dollars ($80,000.00) per annum. For

294294 there shall be no maximum compensation level for
295295 retirement purposes.
296296 (b) Compensation for retirement purposes shall include any
297297 amount of elective salary reduction un der Section 457
298298 of the Internal Revenue Code of 1986 , as amended, and
299299 any amount of nonelective salary reduction under
300300 Section 414(h) of the Internal Revenue Code of 1986 ,
301301 as amended.
302302 (c) Notwithstanding any provision to the contrary, the
303303 compensation taken into account for any employee in
304304 determining the contribution or benefit accruals for
305305 any plan year is limited to the annual compensation
306306 limit under Section 401(a)(17) of the federal Internal
307307 Revenue Code of 1986, as amended.
308308 (d) Current A current appointed members member of the
309309 Oklahoma Tax Commission whose salary is
310310 constitutionally limited and is less than the highest
311311 salary allowed by law for his or her position shall be
312312 allowed, within ninety (90) days from March 21, 2001,
313313 to make an election to use the highest salary allowed
314314 by law for the position to which the member was
315315 appointed for the purposes of making contributions and
316316 determination of retirement benefits. Such election
317317 shall be irrevocable and be in writing. Reappointment

369369 to the same office shall not permit a new election.
370370 Members appointed to the Oklahoma Tax Comm ission after
371371 the March 21, 2001, shall make such election, pursuant
372372 to this subparagraph, within ninety (90) days of
373373 taking office;
374374 (10) “Credited service” means the sum of part icipating service,
375375 prior service and elected service;
376376 (11) “Dependent” means a parent, child, or spouse of a member
377377 who is dependent upon the member for at least one -half (1/2) of the
378378 member’s support;
379379 (12) “Effective date” means the date upon which the System
380380 becomes effective by operation of law;
381381 (13) “Eligible employer” means the state and any county, county
382382 hospital, city or town, conservation districts, circuit engineering
383383 districts, and any public or private trust in which a county, cit y,
384384 or town participates and is the primary beneficiary, is to be an
385385 eligible employer for the purpose of Section 901 et seq. of this
386386 title only, whose employees are covered by Social Security and are
387387 not covered by or eligible for another retirement plan authorized
388388 under the laws of this state which is in operation on the initial
389389 entry date. Emergency medical service districts may join the System
390390 upon proper application to the Board. Provided, affiliation by a
391391 county hospital shall be in the form of a resolution adop ted by the
392392 board of control.

444444 (a) If a class or several classes of employees of any
445445 above-defined employers are covered by Social Security
446446 and are not covered by or eligible for and will not
447447 become eligible for another retirement plan authorized
448448 under the laws of this state, which is in operation on
449449 the effective date May 6, 1963, such employer shall be
450450 deemed an eligible employer, but only with respect to
451451 that class or those classes of employees as defined in
452452 this section.
453453 (b) A class or several classes of employees who are
454454 covered by Social Security and are not covered by or
455455 eligible for and will not become eligible for another
456456 retirement plan authorized under the laws of this
457457 state, which is in operation on the effective date May
458458 6, 1963, and when the qualifications for employment in
459459 such class or classes are set by state law; and w hen
460460 such class or classes of employees are employed by a
461461 county or municipal government pursuant to such
462462 qualifications; and when the services provided by such
463463 employees are of such nature that they qualify for
464464 matching by or contributions from state or federal
465465 funds administered by an agency of state government
466466 which qualifies as a participating employer, then the
467467 agency of state government administering the state or

519519 federal funds shall be deemed an eligible employer,
520520 but only with respect to that class or those classes
521521 of employees as defined in this subsection; provided,
522522 that the required contributions to the retirement plan
523523 may be withheld from the contributions of state or
524524 federal funds administered by the state agency and
525525 transmitted to the System on the same basis as the
526526 employee and employer contributions are transmitted
527527 for the direct employees of the state agency. The
528528 retirement or eligibility for retirement under the
529529 provisions of law providing pensions for service as a
530530 volunteer firefighter shall not render any person
531531 ineligible for participation in the benefits provided
532532 for in Section 901 et seq. of this title. An employee
533533 of any public or private trust in which a coun ty,
534534 city, or town participates and is the primary
535535 beneficiary shall be deemed to be an eligible employee
536536 for the purpose of Section 901 et seq. of this title
537537 only.
538538 (c) All employees of the George Nigh Rehabilitation
539539 Institute who elected to retain membersh ip in the
540540 System, pursuant to Section 913.7 of this title, shall
541541 continue to be eligible employees for the purposes of

594594 Rehabilitation Institute shall be considered a
595595 participating employer only for such e mployees.
596596 (d) All employees of CompSource Mutual Insurance Company
597597 who retain membership in the Oklahoma Public Employees
598598 Retirement System pursuant to Section 913.9 of this
599599 title shall continue to be eligible employees for the
600600 purposes of the Oklahoma Pub lic Employees Retirement
601601 System. CompSource Mutual Insurance Company shall be
602602 considered a participating employer only for such
603603 employees.
604604 (e) All employees of a successor organization, as defined
605605 by Section 5-60.12 of Title 2 of the Oklahoma
606606 Statutes, who retain membership in the Oklahoma Public
607607 Employees Retirement System pursuant to Section 5 -
608608 60.35 of Title 2 of the Oklahoma Statutes shall
609609 continue to be eligible employees for the purposes of
610610 the Oklahoma Public Employees Retirement System. A
611611 successor organization shall be considered a
612612 participating employer only for such emplo yees.
613613 (f) A participating employer of the Teachers ’ Retirement
614614 System of Oklahoma, who has one or more employees who
615615 have made an election pursuant to enabling legislation
616616 to retain membership in the System as a result of
617617 change in administration, shall be considered a

670670 Employees Retirement System only for such employees;
671671 (14) “Employee” means any officer or employee of a
672672 participating employer, whose employment is not seasonal or
673673 temporary and whose employment requires at least one thousand
674674 (1,000) hours of work per year and whose salary or wage is equal to
675675 the hourly rate of the monthly minimum wage for state employees.
676676 For those eligible employers outlined in Section 910 of this title,
677677 the rate shall be equal to the hourly rate of the monthly minimum
678678 wage for that employer. Each employer, whose minimum wage is less
679679 than the state’s minimum wage, shall inform the System of the
680680 minimum wage for that employer. This notification shall be by
681681 resolution of the gov erning body.
682682 (a) Any employee of the county extension agents who is not
683683 currently participating in the Teachers ’ Retirement
684684 System of Oklahoma shall be a member of this System.
685685 (b) Eligibility shall not include any employee who is a
686686 contributing member of the United States Civil Service
687687 Retirement System.
688688 (c) It shall be mandatory for an officer, appointee , or
689689 employee of the office of district attorney to become
690690 a member of this System if he or she is not currently
691691 participating in a county retirement syst em. Provided
692692 further, that if an officer, appointee , or employee of

745745 participating in such county retirement system, he or
746746 she is ineligible for this System as long as he or she
747747 is eligible for such county retirement system. Any
748748 eligible officer, appointee , or employee of the office
749749 of district attorney shall be given credit for prior
750750 service as defined in this section. The provisions
751751 outlined in Section 917 of this title shall apply to
752752 those employees who have previously withdrawn their
753753 contributions.
754754 (d) Eligibility shall also not include any officer or
755755 employee of the Oklahoma Employment Security
756756 Commission, except for those officer s and employees of
757757 the Commission electing to transfer to this System
758758 pursuant to the provisions of Section 910.1 of this
759759 title or any other class of officers or employees
760760 specifically exempted by the laws of this state,
761761 unless there be is a consolidation as provided by
762762 Section 912 of this title. Employees of the Oklahoma
763763 Employment Security Commission who are ineligible for
764764 enrollment in the Oklahoma Employment Security
765765 Commission Retirement Plan, that was in effect on
766766 January 1, 1964, shall become member s of this System.

818818 (e) Any employee employed by the Legislative Service
819819 Bureau, Senate, or House of Representatives for the
820820 full duration of a regular legislative session shall
821821 be eligible for membership in the System regardless of
822822 classification as a tempo rary employee and may
823823 participate in the System during the regular
824824 legislative session at the option of the employee.
825825 For purposes of this subparagraph, the determination
826826 of whether an employee is employed for the full
827827 duration of a regular legislative se ssion shall be
828828 made by the Legislative Service Bureau if such
829829 employee is employed by the Legislative Service
830830 Bureau, the Senate if such employee is employed by the
831831 Senate, or by the House of Representatives if such
832832 employee is employed by the House of Rep resentatives.
833833 Each regular legislative session during which the
834834 legislative employee or an employee of the Legislative
835835 Service Bureau participates full time shall be counted
836836 as six (6) months of full -time participating service.
837837 (i) Except as otherwise pro vided by this
838838 subparagraph, once a temporary session employee
839839 makes a choice to participate or not, the choice
840840 shall be binding for all future legislative
841841 sessions during which the employee is employed.

893893 (ii) Notwithstanding the provisions of division (i) o f
894894 this subparagraph, any employee, who is eligible
895895 for membership in the Syste m because of the
896896 provisions of this subparagraph and who was
897897 employed by the Senate or House of
898898 Representatives after January 1, 1989, may file
899899 an election, in a manner specified by the Board,
900900 to participate as a member of the System prior to
901901 September 1, 1989.
902902 (iii) Notwithstanding the provisions of division (i) of
903903 this subparagraph, a temporary legislative
904904 session employee who elected to become a member
905905 of the System may withdra w from the System
906906 effective the day such employee elected to
907907 participate in the System upon written request to
908908 the Board. Any such request must be received by
909909 the Board prior to October 1, 1990. All employee
910910 contributions made by the temporary legislativ e
911911 session employee shall be returned to the
912912 employee without interest within four (4) months
913913 of receipt of the written request.
914914 (iv) A member of the System who did not initially
915915 elect to participate as a member of the System
916916 pursuant to this subparagraph s hall be able to

969969 legislative session e mployee for periods of
970970 service performed prior to the date upon which
971971 the person became a member of the System if:
972972 a. the member files an election with the System
973973 not later than December 31, 2000, to
974974 purchase the prior service; and
975975 b. the member makes payment to the System of
976976 the actuarial cost of the service credit
977977 pursuant to subsection A of Section 913.5 of
978978 this title. The provisions of Section 913.5
979979 of this title shall be app licable to the
980980 purchase of the service credit, including
981981 the provisions for de termining service
982982 credit in the event of incomplete payment
983983 due to cessation of payments, death,
984984 termination of employment , or retirement,
985985 but the payment may extend for a period not
986986 to exceed ninety-six (96) months;
987987 (15) “Entry date” means the date on which an eligible employer
988988 joins the System. The first entry date pursuant to Section 901 et
989989 seq. of this title shall be January 1, 1964;

10411041 (16) “Executive Director” means the managing officer of the
10421042 System employed by the Board under Section 901 et seq. of this
10431043 title;
10441044 (17) “Federal Internal Revenue Code ” means the federal Internal
10451045 Revenue Code of 1954 or 1986, as amended, and as applicable to a
10461046 governmental plan as in effect on Ju ly 1, 1999;
10471047 (18) “Final average compensation ” means the average annual
10481048 compensation, including amounts deferred under deferred compensation
10491049 agreements entered into between a member and a participating

11341134 participating and/or prior service, as follows:
11351135 (a) during the following periods, including the beginning

18721872 (33) “Service-connected disability benefits ” means military

18751875 United States Department of Veterans Affair s or the Armed Forces of

18771877 (34) “Elected official” means a person elected to a state
18781878 office in the legislative or executive branch of state government or
18791879 a person elected to a county office for a definite number of years
18801880 and shall include an individual who is appointed to fill the
18811881 unexpired term of an elected state official;
18821882 (35) “Elected service” means the period of service as an
18831883 elected official;
18841884 (36) “Limitation year” means the year used in applying the
18851885 limitations of Section 415 of t he Internal Revenue Code of 1986, as
18861886 amended, which year shall be the calendar year; and

19391939 means those persons hired by the Grand River Dam Authority on or

19431943 enforcement functions as part of their regularly assigned duties and
19441944 responsibilities on a full -time basis. With respect to any public

19471947 benefits from previous participation within the Oklahoma Public
19481948 Employees Retirement System or the Oklahoma Law Enforcement

19501950 SECTION 2. AMENDATORY 74 O.S. 2021, Section 915, as
19511951 amended by Section 2, Chapter 280, O.S.L. 2024 (74 O.S. Supp. 2024,
19521952 Section 915), is amended to read as follows:

20142014 (2) Effective January 1, 2004, except as otherwise provided for
20152015 elected officials in Section 913.4 of this t itle and except for
20162016 those members making contributions pursuant to paragraphs (b), (c),
20172017 (d), (e) and, (f), and (g) of subsection (1) of Section 919.1 of
20182018 this title, any member who shall retire shall be entitled to receive
20192019 an annual retirement benefit equal to two and one-half percent (2
20202020 1/2%) of the member’s final average compensation as determined
20212021 pursuant to paragraph (18) of Section 902 of this title, multiplied
20222022 by the number of full years of participating service after January
20232023 1, 2004, that have been cr edited to the member in accordance with
20242024 the provisions of Section 913 of this title and only for those full
20252025 years of participating service for which contributions have been
20262026 made pursuant to paragraph (g) (h) of subsection (1) of Section
20272027 919.1 of this title. The two and one-half percent (2 1/2%)
20282028 multiplier shall not apply to purchased service, purchased or
20292029 granted military service , or transferred service. In order to
20302030 receive the two and one -half percent (2 1/2%) multiplier in
20312031 computing retirement benefits, an active member shall make an
20322032 irrevocable written election to pay the contri butions pursuant to
20332033 paragraph (g) (h) of subsection (1) of Section 919.1 of this title.
20342034 The two and one-half percent (2 1/2%) multiplier pursuant to this
20352035 paragraph shall not app ly to additional years of service credit

20972097 retirement date shall be no less than Thirteen
20982098 Thousand Eight Hundred Dollars ($13,800.00) per annum,
20992099 b. and who had at least fifteen (15) but not more than
21002100 nineteen (19) years of credited service within the
21012101 System as of the member ’s retirement date shall be no
21022102 less than Six Thousand Nine Hundred Dollars
21032103 ($6,900.00) per annum, or
21042104 c. and who had less than fifteen (15) years of credited
21052105 service within the System as of the member ’s
21062106 retirement date shall not be eligible for any minimum
21072107 amount of final average compensation and the member ’s
21082108 final average compensation shall be the final average
21092109 compensation as defined by paragraph (18) of Section

21702170 of retirement and who retires on or before June 30, 2000, sh all be
21712171 entitled to receive an annual retirement benefit equal to two and
21722172 one-half percent (2 1/2%) of the final average compensation of the
21732173 member not to exceed Twenty -five Thousand Dollars ($25,000.00) and
21742174 two percent (2%) of the final average salary in e xcess of Twenty-
21752175 five Thousand Dollars ($25,000.00) but not exceeding the maximum
21762176 compensation level as provided in paragraph (9) of Section 902 of
21772177 this title, multiplied by the number of years of service as a
21782178 correctional officer or a probation and parole officer; provided,
21792179 any years accrued prior to July 1, 1990, as a correctional officer
21802180 or a probation and parole officer by a member who is employed as a
21812181 correctional officer or a probation and parole officer on July 1,
21822182 1990, shall be calculated for retirem ent purposes at two and one -
21832183 quarter percent (2 1/4%) of the final average compensation of the
21842184 member not to exceed Twenty -five Thousand Dollars ($25,000.00) and

22512251 benefits for each year of full -time-equivalent participating service
22522252 as a correctional or a probation and parole officer a fter July 1,
22532253 1990, computed on two and one -half percent (2 1/2%) of the final
22542254 average compensation based upon those years as a correctional
22552255 officer or a probation and parole officer. Provided , further, any
22562256 fugitive apprehension agent shall be entitled to receive benefits as
22572257 outlined in this act Section 901 et seq. of this title for service
22582258 as a fugitive apprehension agent prior to July 1, 2002, only upon
22592259 payment to the System of the employee contributions which would have
22602260 been paid if such fugitive apprehe nsion agent had been covered by

23252325 correctional officer, a probation and parole officer , or a fugitive
23262326 apprehension agent, and any years in excess of twenty (20) years as
23272327 such an officer or agent, or years credited to the member in
23282328 accordance with the provisions of Section 913 of this title, shall
23292329 be calculated for retirement purposes at two percent (2%) of the
23302330 final average compensation of the member multiplied by the number of
23312331 years of such service. For purposes of this paragraph, “final
23322332 average compensation ” shall be determined by computing the average
23332333 annual salary, in the manner prescribed by paragraph (18) of Section

23962396 average compensation ” Final average compensation shall be determined
23972397 by computing the average annual salary for the highest five (5) of
23982398 the last ten (10) years of participating service immediately
23992399 preceding retirement or termination of employment, with respect to
24002400 members whose first participating service occurs on or after July 1,
24012401 2013.
24022402 (7) Any member who is a correctional officer, a probation and
24032403 parole officer, or a fugitive apprehension agent who has at least
24042404 five (5) years of service as a correctional officer, a probation and
24052405 parole officer, or a fugitive apprehension agent who is in suc h
24062406 position on June 30, 2004, or who is hired after June 30, 2004, in
24072407 such position, and who receives a promotion or change in job
24082408 classification after June 30, 2004, to another position in the
24092409 Department of Corrections, and who is employed by the Departmen t of
24102410 Corrections at the time of retirement and who retires on or after

24752475 902 of this title, for the highest three (3) years of the last ten
24762476 (10) years of participating servi ce immediately preceding retirement
24772477 or termination of employment for all years of service performed by
24782478 such member with the Department. “Final average compensation ” Final
24792479 average compensation shall be determined by computing the average
24802480 annual salary for the highest five (5) of the last ten (10) years of
24812481 participating service immediately preceding retirement or
24822482 termination of employment, with respect to members whose first
24832483 participating service occurs on or after July 1, 2013.

25502550 officer, a fugitive apprehension agent , or a Grand River Dam public
25512551 safety officer. For purposes of this paragraph, “final average
25522552 compensation” shall be determined by computing the average annual
25532553 salary, in the manner prescribed by paragraph (18) of Section 902 of
25542554 this title, for the highest three (3) years o f the last ten (10)
25552555 years of participating service immediately preceding retirement or
25562556 termination of employment for all years of service performed by such
25572557 member, both for years of service performed as a correctional
25582558 officer, probation and parole officer , or fugitive apprehension
25592559 agent, or years of service performed as a Grand Rive r Dam public

26262626 (9) Any member who is:
26272627 a. initially on or after July 1, 2002, employed as a
26282628 firefighter for the Oklahoma Military Department of
26292629 the State of Oklahoma and who retires on or after the
26302630 member’s normal retirement date shall be entitled to
26312631 receive an annual retirement benefit equal to two and
26322632 one-half percent (2 1/2%) of the final average
26332633 compensation of the member multiplied by the number of
26342634 years of service in such service,

32303230 purchased under this subparagraph division cause
32313231 the member to receive a retirement benefit for

32893289 c. For purposes of paragraph (10) this paragraph, “final

32933293 years of service performed as a deputy sheriff or
32943294 county jailer not in excess of twenty (20) years, and
32953295 for years of service performed in excess of twenty
32963296 (20) years, whether as a deputy sheriff or county
32973297 jailer.
32983298 (11) Upon death of a retiree, there shall be paid to his or her
32993299 beneficiary an amount equal to the excess, if any, of his or her
33003300 accumulated contributions over the sum of all retirement benefit
33013301 payments made.
33023302 (12) Such annual retirement benefits shall be paid in equal
33033303 monthly installments, except that the Board may provid e for the
33043304 payment of retirement benefits which total less than Two Hundred
33053305 Forty Dollars ($240.00) a year on other than a monthly basis.
33063306 (13) Pursuant to the rules established by the Board, a retiree
33073307 receiving monthly benefits from the System may authoriz e warrant
33083308 deductions for any products currently offered to active state

33613361 Insurance and Benefits Board , provided that product is offered to
33623362 state retirees as a group and has a minimum partic ipation of five
33633363 hundred state retirees. The System has no responsibility for the
33643364 marketing, enrolling or administration of such products, but shall
33653365 retain a processing fee of two percent (2%) of the gross deductions
33663366 for the products. Retirement benefit d eductions shall be made for
33673367 membership dues for any statewide association for which payroll
33683368 deductions are authorized pursuant to subsection B of Section 34.70
33693369 of Title 62 of the Oklahoma Statutes for retired members of any
33703370 state-supported retirement syste m, upon proper authorization given
33713371 by the member to the board from which the m ember or beneficiary is
33723372 currently receiving retirement benefits.
33733373 B. A member shall be considered disabled if such member
33743374 qualifies for the payment of Social Security disability benefits, or
33753375 the payment of benefits pursuant to the Railroad Retirement Act of
33763376 1974, Section 231 et seq. of Title 45 of the United States Code, and
33773377 shall be eligible for benefits hereunder upon proof of such
33783378 disability, provided such member is an active r egularly scheduled
33793379 employee with a participating employer at the time of injur y or
33803380 inception of illness or disease resulting in subsequent
33813381 certification of eligibility for Social Security disability benefits
33823382 by reason of such injury, illness or disease, providing provided
33833383 such disability is certified by the Social Security Administration
33843384 within one (1) year after the last date physically on the job and

34433443 participating service. The member shall submit to the Oklahoma
34443444 Public Employees Retirement System the Social Security Award Notice
34453445 or the Railroad Retirement Award Notice certifying the date of
34463446 entitlement for disability benefits, as issued by the Social
34473447 Security Administration, United States Department of Health and
34483448 Human Services or the Railroad Retirement Board. Disability
34493449 benefits shall become effective on the date of entitlement as
34503450 established by the Social Security Administration or the Railroad
34513451 Retirement Board, but not before the first day of the month
34523452 following removal from the payroll, whichever is later, and final
34533453 approval by the Oklahoma Public Employees Retirement System.
34543454 Benefits shall be based upon length of service and compen sation as
34553455 of the date of disability, without actuarial reduction because of
34563456 commencement prior to the normal retirement date. The only optional
34573457 form of benefit payment available for disability benefits is Option
34583458 A as provided for in Section 918 of this title. Option A must be
34593459 elected in accordance with the provisions of Section 918 of this

35113511 title. Benefit payments shall cease upon the member ’s recovery from

35153515 the member returns to employment within the System , credited service
35163516 to the date of disability shall be restored, and future benefits
35173517 shall be determined accordingly.
35183518 C. A member who incurred a disability pursuant to subsection B
35193519 of this section on or after July 1, 1999, and who has retired from
35203520 the System with an early retir ement benefit pending certification
35213521 from the Social Security Administration or the Railroad Retirement
35223522 Board shall receive a retirement benefit not less than the
35233523 disability retirement benefit provided by subsection B of this
35243524 section once the System receive s a Social Security Award Notice or a
35253525 Railroad Retirement Award Notice pursuant to subsection B of this
35263526 section and a completed Application application for Disability
35273527 Benefits disability benefits. In addition, such member shall
35283528 receive the difference, if any, between the early retirement benefit
35293529 and the disability benefit from the date the Social Security
35303530 Administration or the Railroad Retirement Board establishes
35313531 disability entitlement.
35323532 D. Any actively participating member of the System on or after
35333533 July 1, 1998, except for those employees provided in subparagraph
35343534 (e) of paragraph (14) of Section 902 of this title, whose employment

35963596 employment during the last ten (10) years immediately preceding
35973597 termination or retirement shall not be eligible for the
35983598 annualization provisions contained herein. The Board of Trustees
35993599 shall promulgate such administrative rules as are necessary to
36003600 implement the provisions of this subsection.
36013601 SECTION 3. AMENDATORY 74 O.S. 2021, Section 916.3, as
36023602 amended by Section 3, Chapter 280, O.S.L. 2024 (74 O.S. Supp. 2024,

36723672 System, and who is killed or mortally wounded during the performan ce
36733673 of the member’s duties for the participating county on or after
36743674 November 1, 2024;
36753675 4. Law enforcement agent certified by the Council on Law
36763676 Enforcement Education and Training (CLEET) and employed by the
36773677 Department of Human Services Office of Inspector General, and who is
36783678 killed or mortally wounded on or after the effective date of this
36793679 act, during the performance of his or her duties for the Department ;
36803680 and
36813681 5. Resident Care Specialist employed by the Office of Juvenile
36823682 Affairs who is killed or mortally wounded on or after the effective
36833683 date of this act, during the performance of his or her duties for

38173817 System, the Oklahoma Law Enforcement Retirement System, or the
38183818 Oklahoma Public Employees Retirement System. The surviving spouse
38193819 of more than one member shall elect which member ’s benefits he or
38203820 she will receive.
38213821 E. In addition to the pension above provided for, if said such
38223822 member leaves one or more children under the age of eighteen (18)
38233823 years or under the age of twenty -two (22) years if the child is
38243824 enrolled full-time in and is regularly attending a public or private
38253825 school or any institution of higher education, Four Hundred Dollars
38263826 ($400.00) a month shall be pa id to the surviving spouse or to the
38273827 person having the care and custody of such child or children if
38283828 there is no surviving spouse or if the surviving spouse dies and
38293829 until each child reaches the age of eighteen (18) years or reaches
38303830 the age of twenty-two (22) years if the child is enrolled full -time
38313831 in and is regularly attending a p ublic or private school or any
38323832 institution of higher education.
38333833 F. The pension benefit provided in this section shall be made
38343834 prospectively only from the effective date of this act July 1, 2000.

38863886 The benefits shall be payable beginning the later of the first day

38883888 dies from a mortal wound, as provided in this section, or the
38893889 effective date of this act July 1, 2000.
38903890 G. The Board of the Oklahoma Public Employees Retirement System
38913891 Board of Trustees shall promulgate such rules as are necessary to
38923892 implement the provisions of this section.
38933893 SECTION 4. AMENDATORY 74 O.S. 2021, Section 919.1, as
38943894 amended by Section 4, Chapter 280, O.S.L. 2024 (74 O.S. Supp. 2024,
38953895 Section 919.1), is amended to read as follows:
38963896 Section 919.1. (1) Employee contributions to the Oklahoma
38973897 Public Employees Retirement System shall be:
38983898 (a) for employees except as otherwise pro vided in
38993899 paragraphs (b), (c), (d), (e), (f) , and (g), and (h)
39003900 of this subsection: beginning July 1, 2006, and
39013901 thereafter, three and one -half percent (3.5%) (3 1/2%)
39023902 of allowable annual compensation;
39033903 (b) for correctional officers and probation and parole
39043904 officers employed by the Department of Corrections:

39783978 (d) for firefighters of the Oklahoma Military Department

39823982 Oklahoma Military Department of the State of Oklahoma

41224122 paragraph (a) of this subsection.
41234123 (2) Contributions shall be deducted by e ach state agency by the
41244124 participating employer for such benefits as the Oklahoma Public
41254125 Employees Retirement System Board of Trustees is authorized to
41264126 administer as provided for by law. Employee and employer
41274127 contributions shall be remitted monthly, or as the Board may
41284128 otherwise provide, to the Executive Director for deposit in the
41294129 Oklahoma Public Employees Retirement Fund.
41304130 (3) Each participating employer shall pick up under the
41314131 provisions of Section 414(h)(2) of the Internal Revenue Code of
41324132 1986, as amended, and pay the contribution which the member is
41334133 required by law to make to the System for all compensation earned

41864186 are designated as member contributions, such contributions shall be
41874187 treated as contributions being paid by the participating employer in
41884188 lieu of contributions by the member in determining tax treatment
41894189 under the Internal Revenue Code of 1986 , as amended, and such picked
41904190 up contributions shall not be includable in the gross income of the
41914191 member until such amounts are distributed or made available to the
41924192 member or the beneficiary of the member. The member, by the terms
41934193 of this System, shall not have any o ption to choose to receive the
41944194 contributions so picked up directly and the picked up contributions
41954195 must be paid by the participating employer to the System.
41964196 Member contributions which are picked up shall be treated in the
41974197 same manner and to the same extent as member contributions made
41984198 prior to the date on which member contributions were picked up by
41994199 the participating employer. Member contributions so picked up shall
42004200 be included in gross salary for purposes of determining benefits and
42014201 contributions under th e System.
42024202 The participating employer shall pay the member contributions
42034203 from the same source of funds used in paying salary to the member,
42044204 by effecting an equal cash reduction in gross salary of the member.
42054205 (4) By September 1, 1989, the System shall refun d the
42064206 accumulated employee contributions of any member who elects to
42074207 retain the member’s membership in the Teachers ’ Retirement System of
42084208 Oklahoma, in accordance with Section 17 -104 of Title 70 of the

42634263 SECTION 5. AMENDATORY 74 O.S. 2021, Section 935.2, is
42644264 amended to read as follows:
42654265 Section 935.2. A. The Oklahoma Public Employees Retirement
42664266 System (System) shall establish a defined contribution system for
42674267 those persons who first become employed in a full-time equivalent
42684268 full-time-equivalent position or a position which is less than full -
42694269 time but more than half-time position and which qualifies for
42704270 employee benefits, including , but not limited to, health insurance
42714271 and leave time by any participating employer of the System, as
42724272 defined by paragraph (25) of Section 902 of this title, on or after
42734273 November 1, 2015. Any person first licensed by the State Department
42744274 of Rehabilitation Services as a vending stand operator or managing
42754275 operator on or after November 1, 2015, as defined by Section 929 of
42764276 this title, shall be eligible for participation in the de fined
42774277 contribution system.
42784278 B. The provisions of subsection A of this section and the
42794279 provisions of this act the Retirement Freedom Act shall not be
42804280 applicable to employees who are initially employed in the positions
42814281 described in division (i), (ii), (iii), or (iv), (v), (vi), (vii),
42824282 or (viii) of subparagraph (d) of paragraph (24) of Section 902 of
42834283 this title, district attorneys, assistant district attorneys or

43364336 of a county, county elected o fficials, county hospital, city or
43374337 town, conservation district, circuit engineering district, and any
43384338 public or private trust in which a county, city or town participates
43394339 and is the primary beneficiary.
43404340 C. An employee described by subsection A of this sec tion shall
43414341 become a participant in the defined contribution system and the
43424342 employee shall not accrue any service credit in the Oklahoma Public
43434343 Employees Retirement System as established pursuant to Section 901
43444344 et seq. of this title.
43454345 D. Employees who parti cipate in the defined contribution system
43464346 shall be deemed to begin service in the defined contribution system
43474347 on the first day of the month following employment.
43484348 E. An employee who begins participating in the defined benefit
43494349 plan on or after November 1, 2 015, in one of the positions described
43504350 in subsection B of this section, shall continue to participate in
43514351 the defined benefit plan only as long as he or she continues to be
43524352 employed in a position described in subsection B of this section.
43534353 F. Any employee employed on or after November 1, 2015, by the
43544354 Legislative Service Bureau, State Senate or House of Representatives
43554355 for the full duration of a regular legislative session shall be
43564356 eligible for membership only in the defined contribution system
43574357 regardless of classification as a temporary employee. The temporary
43584358 session employee may pa rticipate in the defined contribution system
