70	70	missions; providing for codification; and providing

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 72.1 of Title 44, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. This section shall be known and may be cited as t he “Defend
82	82	the Guard Act”.
83	83	B. For the purposes of this section:
84	84	1. “Active duty combat” means performing the following services
85	85	in the active federal military service of the United States:
86	86	a. participation in an armed conflict,
87	87	b. performance of a hazard ous service in a foreign state,

140	140	c. performance of a duty through an instrum entality of
141	141	war; and
142	142	2. “Official declaration of war ” means an official declaration
143	143	of war made by the United States Congress pursuant to Article I,
144	144	Section 8, Clause 11 of the United States Constitution.
145	145	C. Notwithstanding any other provision of The Oklahoma Military
146	146	Code, the Oklahoma National Guard and any member thereof shall not
147	147	be released from the state into active duty combat unless the United
148	148	States Congress has passed an official declaration of war or has
149	149	taken an official action pursuant to Art icle I, Section 8, Clause 15
150	150	of the United States Constitution to explicitly call forth the
151	151	Oklahoma National Guard and any member thereof for the enumerated
152	152	purposes to expressl y execute the laws of the Union, repel an
153	153	invasion, or suppress an insurrection. The Governor shall take all
154	154	actions necessary to comply with the requirements of this section.
155	155	D. Nothing in this act shall limit or prohibit the Governor
156	156	from consenting to the deployment of any Oklahoma National Guard
157	157	member under the provisions of Title 32, United States Code, defense
158	158	support for civil authority missions within the United States or
159	159	United States territories.
160	160	SECTION 2. This act shall becom e effective November 1, 2025.
