9191 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9292 SECTION 1. NEW LAW A new se ction of law to be codified
9393 in the Oklahoma Statutes as Section 11 -203 of Title 70, unless there
9494 is created a duplication in numbering, reads as follows:

147147 1. “Library” means a school library, media program, classroom
148148 library, or any other collection of books or other materials, print
149149 or digital, that are maintained by a school district or charter
150150 school or its employees for use by students and that do not qualify
151151 as textbooks approved by the State Textbook Committee pursuant to
152152 Sections 16-101 through 16-124 of Title 70 of the Oklahoma Statutes;
153153 2. “School library” means the library maintained by a school
154154 district or charter school for use by students;
155155 3. “Pornographic” means:
156156 a. depictions or descriptions of sexual conduct whi ch are
157157 patently offensive as found by the average person
158158 applying contemporar y community standards, considering
159159 the youngest age of students with access to the
160160 material,
161161 b. materials that, taken as a whole, have as the dominant
162162 theme an appeal to prurient interest in sex as found
163163 by the average person applying contemporary community
164164 standards, and
165165 c. a reasonable person would find the material, taken as
166166 a whole, lacks serious literary, artistic,
167167 educational, political, or scientific purposes or
168168 values considering the youngest age of students with
169169 access to the material; and

221221 4. “Sexualized content” means material that is not strictly
222222 pornographic but otherwise contains excessive sexual material in
223223 light of the educational value of the material and in light o f the
224224 youngest age of students with access to the material.
225225 B. By October 1, 2025, and by every October 1 thereafter, each
226226 school district and charter school shall submit to the State
227227 Department of Education a complete listing of all books and other
228228 materials available in its school library. To fulfill the
229229 requirement of this sub section, a school district or charter school
230230 superintendent may submit an attestation that the public online
231231 school library catalog or catalogs contain a complete and accurate
232232 list of books and other materials accompanied by the website for
233233 accessing the relevant catalog or catalogs.
234234 C. A library in a school district or charter school shall be
235235 prohibited from having any pornographic materials or sexualized
236236 content accessible to st udents under the age of eighteen (18).
237237 D. Each school district and charter s chool shall have a written
238238 policy for reviewing the educational suitability and age -appropriate
239239 nature of any material in a library and for receiving and responding
240240 to complaints regarding books and other materials in libraries.
241241 E. Nothing in this section shall prohibit a student from
242242 reading, owning, possessing, or discussing any book obtained without
243243 the assistance or encouragement of a school district or charter
244244 school, its employees, or its libraries; provided, however, nothing

296296 in this section shall be construed to allow a student to bring
297297 pornographic material or sexualized content on the grounds of a
298298 school district or charter school.
299299 F. 1. The parent or legal guardian of a student enrolled in a
300300 school district or charter school may report suspected violations of
301301 the provisions of this section to the State Department of Education.
302302 The report shall include a written complaint summarizing the alleged
303303 violation including the t ime, date, and location of the alleged
304304 violation and the identity of any pers on involved. The report shall
305305 include a copy of any complaint submitted to the school district or
306306 charter school and any related response.
307307 2. Within fourteen (14) business days of receiving a report
308308 pursuant to this subsection, the State Department of Education shall
309309 notify the school district or charter school of the alleged
310310 violation and provide an opportunity to respond.
311311 3. The State Department of Education shall conduct an
312312 investigation to determine whether a violation occurred. The
313313 Department shall notify the parent or legal guardian who submitted
314314 the report and the school district or charter school of the results
315315 of the investigation.
316316 4. If the Department determines a vio lation occurred, the
317317 school district or charter school shall have fourteen (14) business
318318 days to request a hearing before the State Board of Education. The
319319 Board shall review the alleged violation, the results of the

371371 Department’s investigation, and the re sponse from the school
372372 district or charter school and vote on whether to upho ld the
373373 Department’s determination.
374374 5. If the State Board of Education votes to uphold the State
375375 Department of Education ’s determination, the Board is authorized to
376376 report a school district or charter school as deficient on the
377377 accreditation report for noncompliance with the provisions of this
378378 section. Upon a finding of noncompliance with the provisions of
379379 subsections B and C of this section by the State Board of Education,
380380 the noncompliant school district or charter school shall receive a
381381 five percent (5%) reduction in state funding for the fiscal year
382382 following the fiscal year of noncompliance.
383383 G. The State Board of Education shall promulgate rules to
384384 implement the provisions of this section.
385385 SECTION 2. This act shall become effective July 1, 2025.
386386 SECTION 3. It being immediately necessary for the preservation
387387 of the public peace, health, or safety, an emergency is hereby
388388 declared to exist, by re ason whereof this act shall take effect and
389389 be in full force from and after i ts passage and approval.
