9292 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18 -200.1, as
9393 amended by Section 1, Chapter 280, O.S.L. 2023 (70 O.S. Supp. 2024,

146146 Section 18-200.1. A. Beginning with the 2022-2023 2026-2027
147147 school year, and each school year thereafter, each school district
148148 shall have its initial allocation of State Aid calculated based on
149149 the state dedicated revenues actually collected during the p receding
150150 fiscal year, the adjusted assessed valuation of the preceding year,
151151 and the weighted average daily membership (ADM) for the school
152152 district based on the first nine (9) weeks of the preceding current
153153 school year. Each school district shall submit the following data
154154 based on the first nine (9) weeks, to be used in the calcul ation of
155155 the average daily membership of the school district:
156156 1. Student enrollment by grade level;
157157 2. Pupil category counts; and
158158 3. Transportation supplement data.
159159 On or before December 30, the State Department of Education
160160 shall determine each school district ’s current year allocation
161161 pursuant to subsection D of this section. The State Department of
162162 Education shall complete an audit, using procedures established by
163163 the Department, of the student enrollment by grade level data, pupil
164164 category counts, and transportation supplement data to be used in
165165 the State Aid Formula pursuant to subsection D of this section by
166166 December 1 and by January 15 shall notify each school district o f
167167 the district’s final State Aid allocation for the current school
168168 year. The January payment of State Aid and each subsequent payment
169169 for the remainder of the school year shall be based on the final

221221 State Aid allocation as calculated in subsection D of th is section.
222222 Except for reductions made due to the assessment of penalties by the
223223 State Department of Education according to law, the January payment
224224 of State Aid and each subsequent payment for the remainder of the
225225 school year shall not decrease by an amo unt more than the amount
226226 that the current chargeable revenue increases for that district.
227227 B. The State Department of Education shall retain not less than
228228 one and one-half percent (1 1/2%) of the total funds appropriated
229229 for financial support of schools, t o be used to make midyear
230230 adjustments in State Aid and which shall be reflecte d in the final
231231 allocations. If the amount of appropriated funds, including the one
232232 and one-half percent (1 1/2%) retained, remaining after January 1 of
233233 each year is not sufficie nt to fully fund the final allocations, the
234234 Department shall recalculate each school district ’s remaining
235235 allocation pursuant to subsection D of this section using the
236236 reduced amount of appropriated funds.
237237 C. On and after July 1, 1997, the amount of State Aid each
238238 district shall receive shall be the sum of the Foundation Aid, the
239239 Salary Incentive Aid, and the Transportation Supplement, as adjusted
240240 pursuant to the provisions of subsection G of this section and
241241 Section 18-112.2 of this title; provided, no di strict having per
242242 pupil revenue in excess of three hundred percent (300%) of the
243243 average per pupil revenue of all districts shall receive any State
244244 Aid or Supplement in State Aid.

296296 The July calculation of per pupil revenue shall be determined by
297297 dividing the district’s second preceding year ’s total weighted
298298 average daily membership ( ADM) for the first nine (9) weeks of the
299299 current school year into the district’s preceding year’s total
300300 revenues excluding federal revenue, insurance loss payments,
301301 reimbursements, recovery of overpayments and refunds, unused
302302 reserves, prior expenditures recovered, prior year surpluses, and
303303 less the amount of any transfer fees paid in that year.
304304 The December calculation of per pupil revenue shall be
305305 determined by dividing the dist rict’s preceding year’s total
306306 weighted average daily membership (ADM) for the first nine (9) weeks
307307 of the current school year into the district’s preceding year’s
308308 total revenues excluding federal revenue, insurance loss payments,
309309 reimbursements, recovery o f overpayments and refunds, unused
310310 reserves, prior expenditures recovered, prior year surpluses, and
311311 less the amount of any transfer fees paid in that year.
312312 D. For the 1997-98 school year, and each school year
313313 thereafter, Foundation Aid, the Transportatio n Supplement, and
314314 Salary Incentive Aid shall be calculated as follows:
315315 1. Foundation Aid shall be determined by subtracting the amount
316316 of the Foundation Program Income from the cost of the Foundation
317317 Program and adding to this difference the Transportatio n Supplement.
318318 a. The Foundation Program shall be a district ’s higher

373373 determined by the provisions of subsec tion A of
374374 Section 18-201.1 of this title and paragraphs 1, 2, 3,
375375 and 4 of subsection B of Section 18 -201.1 of this
376376 title, multiplied by the Base Foundation Support
377377 Level. However, for the portion of weighted
378378 membership derived from nonresident, transferre d
379379 pupils enrolled in online courses, the Foundation
380380 Program shall be a district ’s weighted average daily
381381 membership of the preceding school year or the first
382382 nine (9) weeks of the current school year, whichever
383383 is greater, as determined by the provisions o f
384384 subsection A of Section 18 -201.1 of this title and
385385 paragraphs 1, 2, 3, and 4 of subsection B of Section
386386 18-201.1 of this title, multiplied by the Base
387387 Foundation Support Level .
388388 b. The Foundation Program Income shall be the sum of the
389389 following:
390390 (1) The the adjusted assessed valuation of the
391391 current school year of the school district, minus
392392 the previous year protested ad valorem tax
393393 revenues held as prescribed in Section 2884 of
394394 Title 68 of the Oklahoma Statutes, multiplied by

446446 the mills levied pursuant to subsection (c) of
447447 Section 9 of Article X of the Oklahoma
448448 Constitution, if appl icable, as adjusted in
449449 subsection (c) of Section 8A of Article X of the
450450 Oklahoma Constitution. For purposes of this
451451 subsection, the “adjusted assessed valuation of
452452 the current school year” shall be the adjusted
453453 assessed valuation on which tax revenues are
454454 collected during the current school year, and
455455 (2) Seventy-five seventy-five percent (75%) of the
456456 amount received by the school district from the
457457 proceeds of the county levy duri ng the preceding
458458 fiscal year, as levied pursuant to subsection (b)
459459 of Section 9 of Article X of the Oklahoma
460460 Constitution, and
461461 (3) motor vehicle collections, and
462462 (4) gross production tax, and
463463 (5) state apportionment, and
464464 (6) R.E.A. tax.
465465 The items listed in divisions (3), (4), (5), and (6)
466466 of this subparagraph shall consist of the amounts
467467 actually collected from such sources during the
468468 preceding fiscal year calculated on a per capita basis

522522 2. The Transportation Supplement shall be equal to the average
523523 daily haul times the per capita allowance times the appropriate
524524 transportation factor.
525525 a. The average daily haul shall be the number of children
526526 in a district who are legally transported and who live
527527 one and one-half (1 1/2) miles or more from school.
528528 b. The per capita allowance shall be determined using the

675675 b. Divide the district’s adjusted assessed valuation of
676676 the current school year minus the previous year ’s
677677 protested ad valorem tax revenues held as prescribed
678678 in Section 2884 of Title 68 of the Oklahoma Statutes,
679679 by one thousand (1,000) and subtract the quotient from
680680 the product of subparagra ph a of this paragraph. The
681681 remainder shall not be less than zero (0).
682682 c. Multiply the number of mills levied for general fund
683683 purposes above the fifteen (15) mills required to
684684 support Foundation Aid pursuant to division (1) of
685685 subparagraph b of paragraph 1 of this subsection, not
686686 including the county four -mill levy, by the remainder
687687 of subparagraph b of this paragraph. The product
688688 shall be the Salary Incentive Aid of the distri ct.
689689 E. By June 30, 1998, the State Department of Education shall
690690 develop and the Department and all school districts shall have
691691 implemented a student identification system which is consistent with
692692 the provisions of subsections C D and D E of Section 3111 of Title
693693 74 of the Oklahoma Statutes. The student identification system

745745 shall be used specifically for the purpose of reporting enrollment
746746 data by school sites and by school districts, the administration of
747747 the Oklahoma School Testing Program Act, the col lection of
748748 appropriate and necessary data pursuant to the Oklahoma Educational
749749 Indicators Program, determining student enrollment, establishing a
750750 student mobility rate, allocation of the State Aid Formula, and
751751 midyear adjustments in funding for student gro wth. This enrollment
752752 data shall be submitted to the State Department of Education in
753753 accordance with rules promulgated by the State Board of Education.
754754 Funding for the development, implementation, personnel training, and
755755 maintenance of the student identi fication system shall be set out in
756756 a separate line item in the allocation sec tion of the appropriation
757757 bill for the State Board of Education for each year.
758758 F. 1. In the event that ad valorem taxes of a school district
759759 are determined to be uncollectible because of bankruptcy, clerical
760760 error, or a successful tax protest, and the amount of such taxes
761761 deemed uncollectible exceeds Fifty Thousand Dollars ($50,000.00) or
762762 an amount greater than twenty -five percent (25%) of ad valorem taxes
763763 per tax year, or the v aluation of a district is lowered by order of
764764 the State Board of Equalization, the school district’s State Aid,
765765 for the school year that such ad valorem taxes are calculated in the
766766 State Aid Formula, shall be determined by subtracting the net
767767 assessed valuation of the property upon which taxes were deemed
768768 uncollectible from the assessed valuation of the school district and

820820 the state. Upon request of the local board of education, it shall
821821 be the duty of the county assessor to certify to the Director of
822822 Finance of the State Department of Education the net assessed
823823 valuation of the pro perty upon which taxes were determined
824824 uncollectible.
825825 2. In the event that the amount of funds a school district
826826 receives for reimbursement from the Ad Valorem Reimbursement Fun d is
827827 less than the amount of funds claimed for reimbursement by the
828828 school district due to insufficiency of funds as provided in Section
829829 193 of Title 62 of the Oklahoma Statutes, then the school district ’s
830830 assessed valuation for the school year that such a d valorem
831831 reimbursement is calculated in the State Aid Formula shall be
832832 adjusted accordingly.
833833 G. 1. Notwithstanding the provisions of Section 18 -112.2 of
834834 this title, a school district shall have its State Aid reduced by an
835835 amount equal to the amount of c arryover in the general fund of the
836836 district as of June 30 of the preceding fiscal year, that is in
837837 excess of the following standards for two (2) consecutive years:

901901 2. By February 1 the State Department of Education shall send
902902 by certified mail, with return receipt requested, to each school
903903 district superintendent, auditor, and regional accreditation officer
904904 a notice of and calculation sheet refl ecting the general fund
905905 balance penalty to be assessed against that school dis trict.
906906 Calculation of the general fund balance penalty shall not include
907907 federal revenue. Within thirty (30) days of receipt of this written
908908 notice the school district shall su bmit to the Department a written
909909 reply either accepting or protesting the penalty to be assessed
910910 against the district. If protesting, the school district shall
911911 submit with its reply the reasons for rejecting the calculations and
912912 documentation supporting t hose reasons. The Department shall review
913913 all school district penalty protest documentation and notify each
914914 district by March 15 of its finding and the final penalty to be
915915 assessed to each district. General fund balance penalties shall be
916916 assessed to all school districts by April 1.
917917 3. Any school district which receives proceeds from a tax
918918 settlement or a Federal Emergency Management Agency settlement

970970 during the last two (2) months of the preceding fiscal year shall be
971971 exempt from the penalties assessed in this subsection, if the
972972 penalty would occur solely as a result of receiving funds from the
973973 tax settlement.
974974 4. Any school district which receives an increase in State Aid
975975 because of a change in Foundation Aid and/or Salary Incentive Aid
976976 factors during the last two (2) months of the preceding fiscal year
977977 shall be exempt from the penalties assessed in this subsection, if
978978 the penalty would occur solely as a result of receiving funds from
979979 the increase in State Aid.
980980 5. If a school district does not receive F oundation Aid and/or
981981 Salary Incentive Aid during the preceding fiscal year, th e State
982982 Board of Education may waive the penalty assessed in this subsection
983983 if the penalty would result in a loss of more than forty percent
984984 (40%) of the remaining State Aid to be allocated to the school
985985 district between April 1 and the remainder of the school year and if
986986 the Board determines the penalty will cause the school district not
987987 to meet remaining financial obligations.
988988 6. Any school district which receives gross produc tion revenue
989989 apportionment during the 2002 -2003 school year or in any subseque nt
990990 school year that is greater than the gross production revenue
991991 apportionment of the preceding school year shall be exempt from the
992992 penalty assessed in this subsection, if the p enalty would occur

10461046 7. Beginning July 1, 2003, school districts that participate in
10471047 consolidation or annexation pursuant to the provisions of t he
10481048 Oklahoma School Consolidation and Annexation Act shall be exempt
10491049 from the penalty assessed in this subsection for the school year in
10501050 which the consolidation or annexation occurs and for the next three
10511051 (3) fiscal years.
10521052 8. Any school district which rece ives proceeds from a sales tax
10531053 levied by a municipality pursuant to Section 22 -159 of Title 11 of
10541054 the Oklahoma Statutes or proceeds from a sales tax levied by a
10551055 county pursuant to Section 1370 of Title 68 of the Oklahoma Statutes
10561056 during the 2003-2004 school year or the 2004-2005 school year shall
10571057 be exempt from the penalties assesse d in this subsection, if the
10581058 penalty would occur solely as a result of receiving funds from the
10591059 sales tax levy.
10601060 9. Any school district which has an amount of carryover in the
10611061 general fund of the district in excess of the limits established in
10621062 paragraph 1 of this subsection during the fiscal years beginning
10631063 July 1, 2020, July 1, 2021, July 1, 2022, and July 1, 2023, shall
10641064 not be assessed a general fund balance penalty as provided for in
10651065 this subsection.

11221122 districts that initially start early childhood instruction at a
11231123 school site. School districts that desire such advanced funding
11241124 shall make application to the State Department of Education no later
11251125 than September 15 of each year and advanced funding shall be awarded
11261126 to the approved distri cts no later than October 30. The advanced
11271127 funding shall not exceed the per pupil amount of State Aid as
11281128 calculated in subsection D of this section per anticipated Head
11291129 Start eligible student. The total amount of advanced funding shall
11301130 be proportionately reduced from the monthly payments of the
11311131 district’s State Aid payments during the last six (6) months of the
11321132 same fiscal year.
11331133 I. 1. Beginning July 1, 1996, the Oklahoma Tax C ommission,
11341134 notwithstanding any provision of law to the contrary, shall report
11351135 monthly to the State Department of Education the monthly
11361136 apportionment of the following information:
11371137 a. the assessed valuation of property,
11381138 b. motor vehicle collections,

12841284 weighted calculation for a statewide virtual charter school
12851285 experiencing a significant decline in membership shall be based on

20992099 SECTION 3. NEW LAW A new section of law to be codified
21002100 in the Oklahoma Statutes as Section 18 -201.2 of Title 70, unless
21012101 there is created a duplication in numbering, reads as follows:
21022102 A. The State Department of Educ ation shall administer a
21032103 transitional grant program to provide transition gran ts to public
21042104 school districts in this state that receive a five percent (5%)
21052105 reduction in State Aid allocations between the 2025 -2026 school year
21062106 and the 2026-2027 school year. Grants shall be provided subject to
21072107 availability of funding.
21082108 B. By December 31, 2026, the Department shall electronically
21092109 submit a report to the Governor, the President Pro Tempore of the
21102110 Senate, and the Speaker of the House of Representatives a report
21112111 evaluating:
21122112 1. The financial impact of the funding reforms implemented
21132113 pursuant to Sections 18-200.1 and 18-201.1 of Title 70 of the
21142114 Oklahoma Statutes in the 2026-2027 school year;
