8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 30 O.S. 2021, Section 1 -114, is
8585 amended to read as follows:
8686 Section 1-114. A. In all cases the court making the
8787 appointment of a guardian has ex clusive jurisdiction to control such
8888 guardian in the management and dispositio n of the person and
8989 property of the ward.

141141 B. The court has jurisdiction over guardianship proceedings,
142142 and has the following powers, which must be exercised in the manner
143143 prescribed by statute, to:
144144 1. Appoint and remove guardians for minors and for
145145 incapacitated and partially incapacitated persons;
146146 2. Compel any applicant for guardian for a proposed ward
147147 diagnosed with a neurological condition such as Alzheimer ’s disease,
148148 dementia, or other similar developmental disability to complete
149149 prerequisite training;
150150 3. Issue and revoke letters of guardianship;
151151 3. 4. Control the conduct of guardians with regard to the care
152152 and treatment provided to their wards;
153153 4. 5. Control the conduct of guardians with regard to the
154154 management of the financial resources of their wards, including , but
155155 not limited to, the power to:
156156 a. compel guardians to submit plans, reports, inventories
157157 and accountings to the court,
158158 b. compel payment and delivery by g uardians of property
159159 belonging to their wards,
160160 c. order the payment of debts, the sale of property, and
161161 order and regulate the distribution of property which
162162 has been placed under the control or management of a
163163 guardian, and
164164 d. settle the accounts of guard ians;

216216 5. 6. Appoint appraisers of the property of wards;
217217 6. 7. Compel the attendance of witnesses and the production of
218218 documents and property;
219219 7. 8. After a petition has been filed for appointment of a
220220 guardian for a minor, make or modify any temporary order of
221221 guardianship during the progress of the proceedings that would be in
222222 the best interest of the ward. Any such temporary order may be
223223 entered ex parte with written notice sent to all parties directing
224224 them to appear before the court, at a time and place therein
225225 specified, not more than twenty (20) days from the time of making
226226 such order, to show cause why the order should not be granted for
227227 temporary guardianship; and
228228 8. 9. Exercise all powers conferred by the Oklahoma
229229 Guardianship and Conservator ship Act, Section 1-101 et seq. of this
230230 title, and to make such orders as may be necessary for the exercise
231231 of said such powers.
232232 C. The chief judge of each district court shall establish by
233233 court rule a system for:
234234 1. The filing of guardianship and conse rvatorship cases and
235235 records which distinguish them from probate cases; and
236236 2. Monitoring the filing of annual reports and inventories
237237 required by this title for the purpose of assuring that the court
238238 will be notified of annual reports as they fall due an d whether or
239239 not said such reports are filed.

291291 SECTION 2. AMENDATORY 30 O.S. 2021, Section 3 -104, is
292292 amended to read as follows:
293293 Section 3-104. A. The following priorities shall guide the
294294 selection by the court of a guardian or l imited guardian of an
295295 incapacitated or partially incapacitated person from among those
296296 eligible:
297297 1. The individual or individuals nominated by the subject of
298298 the proceeding pursuant to Section 3 -102 of this title;
299299 2. The current guardian or limited guard ian appointed or
300300 recognized by the appropriate court of any other jurisdiction in
301301 which the incapacitated or partially incapacitated person resides;
302302 3. An individual nominated by the will or by other writing of a
303303 deceased parent, spouse, or an adult child who was serving as the
304304 guardian or limited guardian of the subject of the proceeding;
305305 4. The spouse of the subject of the proceeding;
306306 5. An adult child of the subject of the proceeding;
307307 6. A parent of the subject of the proceeding;
308308 7. A sibling of the subject of the proceeding;
309309 8. Any individual approved by the court with whom the subject
310310 of the proceeding has been living for more than six (6) months prior
311311 to the filing of the petition. Provided , that any owner, operator,
312312 administrator or employee of a facility subject to the provisions of
313313 the Nursing Home Care Act, the Residential Home Care Act or the
314314 Group Homes for the Developmentally Disabled or Physically

366366 Handicapped Persons Act Persons with Developmental or Physical
367367 Disabilities Act shall not be appointed guardian or limited guardian
368368 of a resident of such facility unless the owner, operator,
369369 administrator or employee is the spouse of the resident, or a
370370 relative of the resident within the second degree of consanguinity
371371 and is otherwise eligible fo r appointment; or
372372 9. If applicable, an individual volunteer qualified for
373373 appointment as a guardian of a veteran pursuant to the Veterans
374374 Volunteer Guardianship Act.
375375 B. When the guardian or limited guardian of an incapacitated or
376376 partially incapacitated person is the guardian of property only, the
377377 court may appoint an organization which is eligible to manage the
378378 financial resources of an individual and has fiduciary powers, or
379379 its successor in interest, when:
380380 1. Such organization is nominated by the subj ect of the
381381 proceeding pursuant to Section 3 -102 of this title;
382382 2. Such organization is nominated by a person eligible to make
383383 such nomination pursuant to Section 3 -103 of this title; or
384384 3. The appointment of such organization is in the best interest
385385 of the subject of the proceeding.
386386 C. The court shall make reasonable inquiry to d etermine whether
387387 the person or organization proposed to serve as the guardian or
388388 limited guardian of an incapacitated or partially incapacitated
389389 person is suitable and will exerc ise the powers and carry out the

441441 duties and responsibilities of guardian or limited guardian in the
442442 best interest of the ward. For any guardianship for which the court
443443 orders completion of training pursuant to paragraph 2 of subsection
444444 B of Section 1-114 of this title, the court shall require
445445 verification or attestation of completi on of prerequisite training
446446 specific to the needs of the ward to be filed in the case or
447447 submitted to the court prior to appointment of the guardian, unless
448448 waived by the court. The court shall also inquire of the proposed
449449 guardian of the person of the ward as to how the guardian proposes
450450 to provide for the care of the ward, and of the proposed guardian of
451451 the estate of the ward as to how the guardian proposes to manage the
452452 property of the ward and to provide for the ward ’s financial care.
453453 The court shall make such orders with respect thereto as the court
454454 deems to be for the best interest of the ward.
455455 D. A public agency shall not be appointed to serve as guardian
456456 for an adult except as provided in Section 1415 of Title 10 and
457457 Section 10-108 of Title 43A of the Oklahoma Statutes.
458458 SECTION 3. AMENDATORY 30 O.S. 2021, Section 3 -111, is
459459 amended to read as follows:
460460 Section 3-111. A. At the hearing on the pet ition the court
461461 shall determine whether or not it is necessary to appoint a gu ardian
462462 of the person, property or both. If a guardian is needed, the court
463463 shall determine:

515515 1. When a general or limited guardian of the person of the
516516 subject of the proceeding is requested, the essential requirements
517517 for the health and safety of the subject of the proceeding and the
518518 skills and knowledge necessary to meet those requirements;
519519 2. When a general or limited guardian of the property of the
520520 subject of the proceeding is requested, the type and amount of the
521521 financial resources of the subject of the proceeding, the essential
522522 requirements for managing the financial resources and the skills and
523523 knowledge necessary to manage the financial resources;
524524 3. The nature and exte nt of the incapacity of the subject of
525525 the proceeding, if any; and
526526 4. Whether by clear and convincing evidence the subject of the
527527 proceeding is an incapacitated or partially incapacitated person.
528528 B. If after a full hearing and examination upon such petit ion,
529529 the court finds by clear and convincing evidence that the subject of
530530 the proceeding is an incapacitated or partially incapacitated
531531 person, the court shall determine the extent of the incapacity and
532532 the feasibility of less restrictive alternatives to g uardianship to
533533 meet the needs of the subject of the proceeding. Upon such
534534 determination, the court may:
535535 1. Dismiss the action if the court finds that less restrictive
536536 alternatives to guardianship are feasible and adequate to meet the
537537 needs of the subject of the proceeding; or

589589 2. Appoint a guardian or limited guardian who has completed any
590590 prerequisite training specific to the needs of the ward ordered
591591 pursuant to paragraph 2 of subsection B of Section 1 -114 of this
592592 title, unless waived by the court . An order making such an
593593 appointment shall include a specific finding that it was established
594594 by clear and convincing evidence that the identified needs of the
595595 subject of the proceeding require a guardianship instead of less
596596 restrictive alternatives.
597597 C. Guardianship for an incapacitated person shall be:
598598 1. Used only as is necessary to promote and protect the well -
599599 being of the person and his or her property;
600600 2. Designed to encourage the development of maximum self -
601601 reliance and independence of the person; and
602602 3. Ordered only to the extent required by the actual mental,
603603 physical and adaptive limitations of the person.
604604 SECTION 4. AMENDATORY 30 O.S. 2021, Section 3 -112, is
605605 amended to read as follows:
606606 Section 3-112. A. Whenever the cour t finds the subject of the
607607 proceeding to be an incapacitated person the court shall appoint:
608608 1. A general guardian of the person; and
609609 2. As the court determines to be necessary and appropriate, a
610610 guardian of the property of the ward.

662662 B. Whenever the cou rt finds the subject of the proceeding to be
663663 a partially incapacitated person the court shall appoint, as
664664 necessary and appropriate for said the person:
665665 1. A limited guardian of the person; or
666666 2. A general or a limited guardian of the property of said the
667667 person; or
668668 3. A limited guardian of the person and a general or limited
669669 guardian of the property of said the person.
670670 C. The court may appoint the same or separate persons to serve
671671 as guardian or limited guardian of the person and guardian or
672672 limited guardian of the property of a ward.
673673 D. Unless waived by the court, any person who is to serve as a
674674 guardian or limited guardian of the person or the property of a ward
675675 whom the court finds to be an incapacitated or partially
676676 incapacitated adult due to a dia gnosed neurological condition such
677677 as Alzheimer’s disease, dementia, or other similar developmental
678678 disability shall submit verification or attestation of completion of
679679 prerequisite training. Such training shall be specific to assisting
680680 persons with Alzheimer’s disease, dementia, or similar neurological
681681 conditions including , but not limited to, understanding Alzheimer ’s
682682 disease, communication techniques, and resources available for care
683683 if the ward is over sixty (60) years of age, or earlier if the
684684 person is diagnosed with such a condition.

736736 E. A list of approved training programs s hall be maintained by
737737 the Department of Human Services. Programs not included on the list
738738 must be submitted for approval to the Department prior to
739739 guardianship determination.
740740 SECTION 5. This act shall become effective November 1, 2025.
