83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. AMENDATORY 30 O.S. 2021, Section 1 -114, is
85	85	amended to read as follows:
86	86	Section 1-114. A. In all cases the court making the
87	87	appointment of a guardian has ex clusive jurisdiction to control such
88	88	guardian in the management and dispositio n of the person and
89	89	property of the ward.

141	141	B. The court has jurisdiction over guardianship proceedings,
142	142	and has the following powers, which must be exercised in the manner
143	143	prescribed by statute, to:
144	144	1. Appoint and remove guardians for minors and for
145	145	incapacitated and partially incapacitated persons;
146	146	2. Compel any applicant for guardian for a proposed ward
147	147	diagnosed with a neurological condition such as Alzheimer ’s disease,
148	148	dementia, or other similar developmental disability to complete
149	149	prerequisite training;
150	150	3. Issue and revoke letters of guardianship;
151	151	3. 4. Control the conduct of guardians with regard to the care
152	152	and treatment provided to their wards;
153	153	4. 5. Control the conduct of guardians with regard to the
154	154	management of the financial resources of their wards, including , but
155	155	not limited to, the power to:
156	156	a. compel guardians to submit plans, reports, inventories
157	157	and accountings to the court,
158	158	b. compel payment and delivery by g uardians of property
159	159	belonging to their wards,
160	160	c. order the payment of debts, the sale of property, and
161	161	order and regulate the distribution of property which
162	162	has been placed under the control or management of a
163	163	guardian, and
164	164	d. settle the accounts of guard ians;

216	216	5. 6. Appoint appraisers of the property of wards;
217	217	6. 7. Compel the attendance of witnesses and the production of
218	218	documents and property;
219	219	7. 8. After a petition has been filed for appointment of a
220	220	guardian for a minor, make or modify any temporary order of
221	221	guardianship during the progress of the proceedings that would be in
222	222	the best interest of the ward. Any such temporary order may be
223	223	entered ex parte with written notice sent to all parties directing
224	224	them to appear before the court, at a time and place therein
225	225	specified, not more than twenty (20) days from the time of making
226	226	such order, to show cause why the order should not be granted for
227	227	temporary guardianship; and
228	228	8. 9. Exercise all powers conferred by the Oklahoma
229	229	Guardianship and Conservator ship Act, Section 1-101 et seq. of this
230	230	title, and to make such orders as may be necessary for the exercise
231	231	of said such powers.
232	232	C. The chief judge of each district court shall establish by
233	233	court rule a system for:
234	234	1. The filing of guardianship and conse rvatorship cases and
235	235	records which distinguish them from probate cases; and
236	236	2. Monitoring the filing of annual reports and inventories
237	237	required by this title for the purpose of assuring that the court
238	238	will be notified of annual reports as they fall due an d whether or
239	239	not said such reports are filed.

291	291	SECTION 2. AMENDATORY 30 O.S. 2021, Section 3 -104, is
292	292	amended to read as follows:
293	293	Section 3-104. A. The following priorities shall guide the
294	294	selection by the court of a guardian or l imited guardian of an
295	295	incapacitated or partially incapacitated person from among those
296	296	eligible:
297	297	1. The individual or individuals nominated by the subject of
298	298	the proceeding pursuant to Section 3 -102 of this title;
299	299	2. The current guardian or limited guard ian appointed or
300	300	recognized by the appropriate court of any other jurisdiction in
301	301	which the incapacitated or partially incapacitated person resides;
302	302	3. An individual nominated by the will or by other writing of a
303	303	deceased parent, spouse, or an adult child who was serving as the
304	304	guardian or limited guardian of the subject of the proceeding;
305	305	4. The spouse of the subject of the proceeding;
306	306	5. An adult child of the subject of the proceeding;
307	307	6. A parent of the subject of the proceeding;
308	308	7. A sibling of the subject of the proceeding;
309	309	8. Any individual approved by the court with whom the subject
310	310	of the proceeding has been living for more than six (6) months prior
311	311	to the filing of the petition. Provided , that any owner, operator,
312	312	administrator or employee of a facility subject to the provisions of
313	313	the Nursing Home Care Act, the Residential Home Care Act or the
314	314	Group Homes for the Developmentally Disabled or Physically

366	366	Handicapped Persons Act Persons with Developmental or Physical
367	367	Disabilities Act shall not be appointed guardian or limited guardian
368	368	of a resident of such facility unless the owner, operator,
369	369	administrator or employee is the spouse of the resident, or a
370	370	relative of the resident within the second degree of consanguinity
371	371	and is otherwise eligible fo r appointment; or
372	372	9. If applicable, an individual volunteer qualified for
373	373	appointment as a guardian of a veteran pursuant to the Veterans
374	374	Volunteer Guardianship Act.
375	375	B. When the guardian or limited guardian of an incapacitated or
376	376	partially incapacitated person is the guardian of property only, the
377	377	court may appoint an organization which is eligible to manage the
378	378	financial resources of an individual and has fiduciary powers, or
379	379	its successor in interest, when:
380	380	1. Such organization is nominated by the subj ect of the
381	381	proceeding pursuant to Section 3 -102 of this title;
382	382	2. Such organization is nominated by a person eligible to make
383	383	such nomination pursuant to Section 3 -103 of this title; or
384	384	3. The appointment of such organization is in the best interest
385	385	of the subject of the proceeding.
386	386	C. The court shall make reasonable inquiry to d etermine whether
387	387	the person or organization proposed to serve as the guardian or
388	388	limited guardian of an incapacitated or partially incapacitated
389	389	person is suitable and will exerc ise the powers and carry out the

441	441	duties and responsibilities of guardian or limited guardian in the
442	442	best interest of the ward. For any guardianship for which the court
443	443	orders completion of training pursuant to paragraph 2 of subsection
444	444	B of Section 1-114 of this title, the court shall require
445	445	verification or attestation of completi on of prerequisite training
446	446	specific to the needs of the ward to be filed in the case or
447	447	submitted to the court prior to appointment of the guardian, unless
448	448	waived by the court. The court shall also inquire of the proposed
449	449	guardian of the person of the ward as to how the guardian proposes
450	450	to provide for the care of the ward, and of the proposed guardian of
451	451	the estate of the ward as to how the guardian proposes to manage the
452	452	property of the ward and to provide for the ward ’s financial care.
453	453	The court shall make such orders with respect thereto as the court
454	454	deems to be for the best interest of the ward.
455	455	D. A public agency shall not be appointed to serve as guardian
456	456	for an adult except as provided in Section 1415 of Title 10 and
457	457	Section 10-108 of Title 43A of the Oklahoma Statutes.
458	458	SECTION 3. AMENDATORY 30 O.S. 2021, Section 3 -111, is
459	459	amended to read as follows:
460	460	Section 3-111. A. At the hearing on the pet ition the court
461	461	shall determine whether or not it is necessary to appoint a gu ardian
462	462	of the person, property or both. If a guardian is needed, the court
463	463	shall determine:

515	515	1. When a general or limited guardian of the person of the
516	516	subject of the proceeding is requested, the essential requirements
517	517	for the health and safety of the subject of the proceeding and the
518	518	skills and knowledge necessary to meet those requirements;
519	519	2. When a general or limited guardian of the property of the
520	520	subject of the proceeding is requested, the type and amount of the
521	521	financial resources of the subject of the proceeding, the essential
522	522	requirements for managing the financial resources and the skills and
523	523	knowledge necessary to manage the financial resources;
524	524	3. The nature and exte nt of the incapacity of the subject of
525	525	the proceeding, if any; and
526	526	4. Whether by clear and convincing evidence the subject of the
527	527	proceeding is an incapacitated or partially incapacitated person.
528	528	B. If after a full hearing and examination upon such petit ion,
529	529	the court finds by clear and convincing evidence that the subject of
530	530	the proceeding is an incapacitated or partially incapacitated
531	531	person, the court shall determine the extent of the incapacity and
532	532	the feasibility of less restrictive alternatives to g uardianship to
533	533	meet the needs of the subject of the proceeding. Upon such
534	534	determination, the court may:
535	535	1. Dismiss the action if the court finds that less restrictive
536	536	alternatives to guardianship are feasible and adequate to meet the
537	537	needs of the subject of the proceeding; or

589	589	2. Appoint a guardian or limited guardian who has completed any
590	590	prerequisite training specific to the needs of the ward ordered
591	591	pursuant to paragraph 2 of subsection B of Section 1 -114 of this
592	592	title, unless waived by the court . An order making such an
593	593	appointment shall include a specific finding that it was established
594	594	by clear and convincing evidence that the identified needs of the
595	595	subject of the proceeding require a guardianship instead of less
596	596	restrictive alternatives.
597	597	C. Guardianship for an incapacitated person shall be:
598	598	1. Used only as is necessary to promote and protect the well -
599	599	being of the person and his or her property;
600	600	2. Designed to encourage the development of maximum self -
601	601	reliance and independence of the person; and
602	602	3. Ordered only to the extent required by the actual mental,
603	603	physical and adaptive limitations of the person.
604	604	SECTION 4. AMENDATORY 30 O.S. 2021, Section 3 -112, is
605	605	amended to read as follows:
606	606	Section 3-112. A. Whenever the cour t finds the subject of the
607	607	proceeding to be an incapacitated person the court shall appoint:
608	608	1. A general guardian of the person; and
609	609	2. As the court determines to be necessary and appropriate, a
610	610	guardian of the property of the ward.

662	662	B. Whenever the cou rt finds the subject of the proceeding to be
663	663	a partially incapacitated person the court shall appoint, as
664	664	necessary and appropriate for said the person:
665	665	1. A limited guardian of the person; or
666	666	2. A general or a limited guardian of the property of said the
667	667	person; or
668	668	3. A limited guardian of the person and a general or limited
669	669	guardian of the property of said the person.
670	670	C. The court may appoint the same or separate persons to serve
671	671	as guardian or limited guardian of the person and guardian or
672	672	limited guardian of the property of a ward.
673	673	D. Unless waived by the court, any person who is to serve as a
674	674	guardian or limited guardian of the person or the property of a ward
675	675	whom the court finds to be an incapacitated or partially
676	676	incapacitated adult due to a dia gnosed neurological condition such
677	677	as Alzheimer’s disease, dementia, or other similar developmental
678	678	disability shall submit verification or attestation of completion of
679	679	prerequisite training. Such training shall be specific to assisting
680	680	persons with Alzheimer’s disease, dementia, or similar neurological
681	681	conditions including , but not limited to, understanding Alzheimer ’s
682	682	disease, communication techniques, and resources available for care
683	683	if the ward is over sixty (60) years of age, or earlier if the
684	684	person is diagnosed with such a condition.
