SENATE BILL 203 	By: Thompson 
 
 
 
 
 
AS INTRODUCED 
 
An Act relating to the state Medicaid program; 
requiring the Oklahoma Health Care Authority to 
provide certain reimbursement to hospita ls under 
specified conditions; directing the Authority to seek 
certain federal approval; providing for codification; 
providing an effective date; and declaring an 
emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 5025.1 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
A.  The Oklahoma Health Care Authority shall provide Medicaid 
reimbursement to a hospital at one hundred percent (100%) of the 
statewide average nursing facility per diem rate for an individual 
if the individual: 
1.  Is enrolled in the state Medicaid program; 
2.  Has been admitted as an inpatient to such hospital; 
3.  No longer requires acute inpatient care and discharge 
planning as described in 4 2 C.F.R., Section 482.43;

4.  Requires nursing facility level of care upon discharge; and 
5.  Is unable to be transferred to a nursing facility due to a 
lack of nursing facility beds available to the individual or, in 
cases where the transfer requires a guardian, because the court has 
not appointed a guardia n. 
B.  Reimbursement for services under this section shall be 
subject to federal approval.  The Authority shall seek any fede ral 
approval necessary to implement the provisions of this section. 
SECTION 2.  This act shall become effective July 1, 2025. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or saf ety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
