6565 An Act relating to the state Medicaid program;

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 5025.1 of Title 63, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. The Oklahoma Health Care Authority shall provide Medicaid
8282 reimbursement to a hospital at one hundred percent (100%) of the
8383 statewide average nursing facility per diem rate for an individual
8484 if the individual:
8585 1. Is enrolled in the state Medicaid program;
8686 2. Has been admitted as an inpatient to such hospital;
8787 3. No longer requires acute inpatient care and discharge
8888 planning as described in 4 2 C.F.R., Section 482.43;

140140 4. Requires nursing facility level of care upon discharge; and
141141 5. Is unable to be transferred to a nursing facility due to a
142142 lack of nursing facility beds available to the individual or, in
143143 cases where the transfer requires a guardian, because the court has
144144 not appointed a guardia n.
145145 B. Reimbursement for services under this section shall be
146146 subject to federal approval. The Authority shall seek any fede ral
147147 approval necessary to implement the provisions of this section.
148148 SECTION 2. This act shall become effective July 1, 2025.
149149 SECTION 3. It being immediately necessary for the preservation
150150 of the public peace, health or saf ety, an emergency is hereby
151151 declared to exist, by reason whereof this act shall take effect and
152152 be in full force from and after its passage and approval.
