65	65	An Act relating to the state Medicaid program;
66	66	requiring the Oklahoma Health Care Authority to
67	67	provide certain reimbursement to hospita ls under
68	68	specified conditions; directing the Authority to seek
69	69	certain federal approval; providing for codification;
70	70	providing an effective date; and declaring an

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 5025.1 of Title 63, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. The Oklahoma Health Care Authority shall provide Medicaid
82	82	reimbursement to a hospital at one hundred percent (100%) of the
83	83	statewide average nursing facility per diem rate for an individual
84	84	if the individual:
85	85	1. Is enrolled in the state Medicaid program;
86	86	2. Has been admitted as an inpatient to such hospital;
87	87	3. No longer requires acute inpatient care and discharge
88	88	planning as described in 4 2 C.F.R., Section 482.43;

140	140	4. Requires nursing facility level of care upon discharge; and
141	141	5. Is unable to be transferred to a nursing facility due to a
142	142	lack of nursing facility beds available to the individual or, in
143	143	cases where the transfer requires a guardian, because the court has
144	144	not appointed a guardia n.
145	145	B. Reimbursement for services under this section shall be
146	146	subject to federal approval. The Authority shall seek any fede ral
147	147	approval necessary to implement the provisions of this section.
148	148	SECTION 2. This act shall become effective July 1, 2025.
149	149	SECTION 3. It being immediately necessary for the preservation
150	150	of the public peace, health or saf ety, an emergency is hereby
151	151	declared to exist, by reason whereof this act shall take effect and
152	152	be in full force from and after its passage and approval.
