71 | 64 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

104 | 96 | | Corrections which expired within the last three (3) years during the |

105 | 97 | | person’s term of imprisonment , shall have the expiration date of his |
---|
106 | 98 | | or her driver license extended for a period of six (6) months after |
---|
107 | 99 | | he or she is released from the custody of the Department of |
---|
108 | 100 | | Corrections. Upon release from custody, Service Oklahoma shall mail |
---|
109 | 101 | | a replacement driver license to an address provided by the person. |
---|
110 | 102 | | B. Service Oklahoma and the Department of Corrections shall |
---|
111 | 103 | | enter into a data-sharing agreement to facilitate the exchange of |
---|
112 | 104 | | necessary data to carry out the provisio ns of this section. |
---|
113 | 105 | | C. Service Oklahoma and the Department of Corre ctions are |
---|
114 | 106 | | authorized to promulgate rules and procedures to implement the |
---|
115 | 107 | | provisions of this section. |
---|
116 | 108 | | SECTION 2. AMENDATORY 47 O.S. 2021, Section 6 -212, as |
---|
117 | 109 | | amended by Section 73, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2024, |
---|
118 | 110 | | Section 6-212), is amended to read as follows: |
---|
119 | 111 | | Section 6-212. A. Service Oklahoma shall not assess and |
---|
120 | 112 | | collect multiple reinstatement fees when reinstating the driving |
---|
121 | 113 | | privilege of any person having more than one suspension or |
---|
154 | 145 | | 2. Require any person having more than one suspension or |
---|
155 | 146 | | revocation affecting the person ’s driving privilege to meet the |
---|
156 | 147 | | statutory requirements for each action as a condition precedent to |
---|
157 | 148 | | the reinstatement of any driving privilege. Provided, however, |
---|
158 | 149 | | reinstatement fees shall not be cumulative, and a single |
---|
159 | 150 | | reinstatement fee, as pro vided for in subsection C of this section, |
---|
160 | 151 | | shall be paid for all suspensions or revocations as shown by Service |
---|
161 | 152 | | Oklahoma’s records at the time of reinstatement. |
---|
162 | 153 | | C. Whenever a person ’s privilege to operate a motor vehicle is |
---|
163 | 154 | | suspended or revoked pursuant to any provision as authorized by the |
---|
164 | 155 | | Oklahoma Statutes, the license or privilege to operate a motor |
---|
165 | 156 | | vehicle shall remain under suspension or revocation and shall not be |
---|
166 | 157 | | reinstated until: |
---|
167 | 158 | | 1. The expiration of each such revocation or suspension order; |
---|
168 | 159 | | 2. The person has paid to Service Oklahoma: |
---|
169 | 160 | | a. if such privilege is suspended or revoked pursuant to |
---|
170 | 161 | | Section 1115.5 of Title 22 of the Oklahoma Statutes or |
---|
171 | 162 | | pursuant to any provisions of this t itle, except as |
---|
172 | 163 | | provided in subparagraph b of this paragraph, a |
---|
205 | 195 | | 205.1, 7-612, 753, 754 or 761 of th is title or |
---|
206 | 196 | | pursuant to subsection A of Section 7 -605 of this |

215 | 205 | | of Two Hundred Dollars ($200.00) to be deposited |

216 | 206 | | into the Trauma Care Assistance Revolving Fund |
---|
217 | 207 | | created in Section 1 -2530.9 of Title 63 of the |
---|
218 | 208 | | Oklahoma Statutes, for each suspension or |
---|
219 | 209 | | revocation as shown by the records of Service |
---|
220 | 210 | | Oklahoma, and |
---|
221 | 211 | | (2) in addition to any other fees required by this |
---|
222 | 212 | | section, if such privilege is suspended or |
---|
223 | 213 | | revoked pursuant to an arrest on or after |
---|
256 | 245 | | provisions of Section 3 -460 of Title 43A of the |
---|
257 | 246 | | Oklahoma Statutes; and |
---|
258 | 247 | | 3. The person has paid to Service Oklahoma a single |
---|
259 | 248 | | reinstatement fee of , beginning on July 1, 2013, and any year |
---|
260 | 249 | | thereafter, Twenty-five Dollars ($25.00). |
---|
261 | 250 | | Service Oklahoma shall notify the license holder within three (3) |
---|
262 | 251 | | days of reinstatement that the license holder shall apply for a new |
---|
263 | 252 | | driver license pursuant to subsection A of Section 6-209 of this |
---|
264 | 253 | | title. |
---|
265 | 254 | | D. Service Oklahoma is hereby authorized to shall enter into |
---|
266 | 255 | | agreements with persons whose license to operate a motor vehicle or |
---|
267 | 256 | | commercial motor vehicle has been suspended or revoked, for issuance |
---|
268 | 257 | | of a provisional license subject to any restrictions imposed by law |
---|
269 | 258 | | or a court order. The provisional license would allow such persons |
---|
270 | 259 | | to drive from 6:00 a.m. to 11:59 p.m. Driving privileges for a |
---|
271 | 260 | | provisional license are limited from 12:00 a.m. to 5:59 a.m. to |
---|
272 | 261 | | driving: |
---|
273 | 262 | | 1. Between their place of residence and their place of |
---|
274 | 263 | | employment or potential employm ent; |
---|
307 | 295 | | 5. Between their place of residence and a place of worship; or |
---|
308 | 296 | | 6. Between their place of residence and any court -ordered |
---|
309 | 297 | | treatment program, |
---|
310 | 298 | | with the condition that such persons pay a minimum total of Five |
---|
311 | 299 | | Dollars ($5.00) per month toward the satisfaction of outstanding |
---|
312 | 300 | | fees, including, but not limited to, provisional license fees, |
---|
313 | 301 | | warrant fees, court costs or fees, driver license or commercial |
---|
314 | 302 | | driver license reinstatement fees. Service Oklahoma may suspend or |
---|
315 | 303 | | revoke a provisional license pursuant to this section if the person |
---|
316 | 304 | | fails to honor the payment plan. The person may re -enroll in the |
---|
317 | 305 | | provisional driver license program. |
---|
318 | 306 | | E. Any person convicted of an offense specified in paragraph 1, |
---|
319 | 307 | | 4, or 8 of subsection A of Section 6-205 of this title shall not be |
---|
320 | 308 | | eligible for a provisional license. |
---|
321 | 309 | | F. Any violation of law by the person holding the provisional |
---|
322 | 310 | | license that would result in the suspension or revocation of a |
---|
323 | 311 | | driver license, except for the failure to pay fines, fees, or other |
---|
324 | 312 | | financial obligations if the person is participating in a payment |
---|
325 | 313 | | plan, shall result in the revocation of the provisional license. |
---|
357 | 344 | | G. H. A person with a suspended driver license shall not have |
---|
358 | 345 | | to take a driver license test to be eligible for a provis ional |
---|
359 | 346 | | license;, provided, the suspended license has not expired. |
---|
360 | 347 | | H. I. The Department of Corrections shall provide inmates with |
---|
361 | 348 | | relevant documentation to obtain a provisional license as provided |
---|
362 | 349 | | in subsection D of this section before being released from c ustody. |
---|
363 | 350 | | The Department of Corrections shall develop rules and proce dures |
---|
364 | 351 | | necessary to implement the provisions of this subsection. |
---|
365 | 352 | | J. Service Oklahoma shall develop rules and procedures |
---|
366 | 353 | | necessary to implement the provisions of this section except as |
---|
367 | 354 | | otherwise provided by this title. |
---|
368 | 355 | | I. Effective July 1, 2002, and for |
---|
369 | 356 | | K. For each fiscal year thereafter: |
---|
370 | 357 | | 1. Two Hundred Fifty Thousand Dollars ($250,000.00) of all |
---|
371 | 358 | | monies collected each month pursuant to this section shall be |
---|
372 | 359 | | apportioned as provided in Sect ion 1104 of this title, except as |
---|
373 | 360 | | otherwise provided in this section ; and |
---|
374 | 361 | | 2. Except as otherwise provided in this section, all other |
---|
375 | 362 | | monies collected in excess of Two Hundred Fifty Thousand Dollars |
---|
408 | 394 | | Section 513.3. A. When any inmate shall be d ischarged from an |
---|
409 | 395 | | institution of the Department of Corrections and t he intended |
---|
410 | 396 | | residence designated by the inmate is within this state, the |
---|
411 | 397 | | Department of Corrections shall provide the inmate with relevant |
---|
412 | 398 | | documentation to assist the inmate in obtaining po st-release |
---|
413 | 399 | | employment and shall coordinate with the Department of Public Safety |
---|
414 | 400 | | Service Oklahoma to provide a REAL ID Noncompliant Identification |
---|
415 | 401 | | Card if the inmate does not have a current state -issued |
---|
416 | 402 | | identification card or driver license. |
---|
417 | 403 | | B. 1. Within nine (9) months prior to the release of an inmate |
---|
418 | 404 | | from custody, the Department of Corrections shall identify whether |
---|
419 | 405 | | the inmate has a current form of state identification and begin the |
---|
420 | 406 | | process of gathering the documentation required for the issuance of |
---|
421 | 407 | | a REAL ID Noncompliant Identification Card pursuant to Section 6 - |
---|
422 | 408 | | 105.3 of Title 47 of the Oklahoma Statutes. If an inmate has any |
---|
423 | 409 | | valid form of a state -issued identification card or driver license, |
---|
424 | 410 | | the inmate may avail himself or herself of the provisions of this |
---|
425 | 411 | | section. |
---|
459 | 444 | | 3. The provisions of this section shall apply only to inmates |
---|
460 | 445 | | who may receive a state -issued identification card pursuant to |
---|
461 | 446 | | Section 1550.42 of Title 21 of the Okl ahoma Statutes. |
---|
462 | 447 | | C. For purposes of assisting an inmate in obtaining post- |
---|
463 | 448 | | release employment, the Department of Corrections shall provide the |
---|
464 | 449 | | inmate with the following documentation: |
---|
465 | 450 | | 1. A copy of the vocational training record of the inmate, if |
---|
466 | 451 | | applicable; |
---|
467 | 452 | | 2. A copy of the work record of the inmate, if applicable; |
---|
468 | 453 | | 3. A certified copy of the birth certificate of the inmate, if |
---|
469 | 454 | | obtainable; |
---|
470 | 455 | | 4. A Social Security card or a replacement Social Security card |
---|
471 | 456 | | of the inmate, if obtainable; |
---|
472 | 457 | | 5. A resume that inclu des any trade learned by the inmate and |
---|
473 | 458 | | the proficiency at that trad e by the inmate; and |
---|
474 | 459 | | 6. Documentation that the inmate has completed a practice job |
---|
475 | 460 | | interview. |
---|
510 | 494 | | 2. Inmates releasing to medica l parole or discharging from a |
---|
511 | 495 | | prison infirmary setting; |
---|
512 | 496 | | 3. Inmates releasing from a Department of Corrections Mental |
---|
513 | 497 | | Health Unit; |
---|
514 | 498 | | 4. Inmates releasing to the custody of another jurisdic tion on |
---|
515 | 499 | | a warrant or detainer; |
---|
516 | 500 | | 5. Inmates returning to community supervision from an |
---|
517 | 501 | | intermediate revocation facility; and |
---|
518 | 502 | | 6. Inmates that the Department determines would be physically |
---|
519 | 503 | | or mentally unable to return to the workforce upon release from |
---|
520 | 504 | | incarceration. |
---|
521 | 505 | | E. The Department of Corrections is authorized to promulg ate |
---|
522 | 506 | | rules and procedures to implement the provisions of this section. |
---|
523 | 507 | | SECTION 4. This act shall become effective July 1, 2026. |
