77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 3241.21 of Title 63, unless
80	80	there is created a duplication in numbering, reads as follows:
81	81	A. There is hereby created the Maternity Care Pilot Program,
82	82	which shall be administered by the State Department of Health.
83	83	Through the pilot program, the Department shall select one hospital
84	84	to receive a one-time grant of Five Million Dollars ($5,000,000.00)
85	85	to support the addition of labor and de livery services at the
86	86	hospital.
87	87	B. The hospital selected by the Department shall:
88	88	1. Be licensed by the Department;

140	140	2. Be designated as a critical access hospital by the Cent ers
141	141	for Medicare and Medicaid Services (CMS) ;
142	142	3. Be organized as a charitable hospital that is exempt from
143	143	taxation under Section 501(c)(3) of the Internal Revenue Code of
144	144	1986, as amended;
145	145	4. Be owned by a municipality, county, or municipal or county
146	146	public trust;
147	147	5. Have been profitable for the two (2) consecutive years
148	148	immediately prior to application for the pilot program;
149	149	6. Not currently offer labor and delivery services;
150	150	7. Have space available to house a labor and delivery unit; and
151	151	8. Have at least one Certified Nurse -Midwife (CNM) on staff.
152	152	C. The Department shall develop an application process and
153	153	scoring criteria for evaluating applicants based on the
154	154	qualifications specified in subsection B of this section . The
155	155	Department shall review ap plicants and shall select the highest -
156	156	scoring hospital for the pilot program g rant award.
157	157	D. The hospital awarded the pilot program grant under this
158	158	section may only use grant funds for:
159	159	1. Staffing costs for an obstetrics team including salary and
160	160	benefits;
161	161	2. Acquisition of essential equipment and supplies including,
162	162	but not limited to, medical instruments; and

214	214	3. Educational classes related to maternal and infant health
215	215	including, but not limited to, childbirth education, breastfeeding
216	216	education, newborn care, and postpartum care.
217	217	Grant funds shall not be used for construction or renovation
218	218	costs.
219	219	E. The State Commissioner of Health may promulgate rules as
220	220	necessary to implement this section.
221	221	SECTION 2. This act shall become effectiv e July 1, 2025.
222	222	SECTION 3. It being immediately necessary for the preservation
223	223	of the public peace, health or safety, an emergency is hereby
224	224	declared to exist, by reason whereof this act shall take effect and
225	225	be in full force from and afte r its passage and approval.
