5748 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5849 SECTION 1. NEW LAW A new section of law not to be
5950 codified in the Oklahoma Statutes reads as follows:
6051 A. It is the intent of the Legislature to ensure educational
6152 excellence in this state by making informed decisions in support of
6253 students in this state, their education, and the future
6354 contributions they will make to the workforce.
6455 B. The Legislature finds that a resp onsible government ensures
6556 that taxpayer dollars are expe nded in the manner directed by the
57+Legislature and are providing a return on investment for Oklahoma ’s
58+future.
59+C. To protect the hard-earned dollars of taxpayers in this
60+state, the Legislature must be able to comprehensively evaluate
61+student and workforce data to make decisions and reforms where

95-C. To protect the hard-earned dollars of taxpayers in this
96-state, the Legislature must be able to comprehensively evaluate
97-student and workforce data to make decisions and reforms where
9888 necessary while safeguarding the confidential information of
9989 Oklahomans.
10090 SECTION 2. NEW LAW A new section of law to be codified
10191 in the Oklahoma Statutes as Section 3 -180 of Title 70, unless there
10292 is created a duplication in numbering, reads as follows:
10393 A. There is hereby created the Oklahoma Education and Workforce
10494 Efficiency Data System (EDS) as a secure system for the de -
10595 identification, exchange, and matching of education and workforce
10696 data among approved entities. The purpose of the EDS shall be to
10797 provide state agencies, legislators, and other approved users with
10898 access to de-identified data on early childhood education,
10999 elementary and secondary education, workforce training, and
110100 employment outcomes to improve education and workforce outcomes and
111101 increase the return on investment for taxpayer funds .
112102 B. The EDS shall have the ability to:
113103 1. Access, ingest, integrate, and transform a variety of data
114104 types to and from the Oklahoma Workforce Commission, the Oklahoma
115105 Department of Career and Technology Education, the State Department
116106 of Education, the Oklahoma Employment Security Commission (OESC),
107+the Oklahoma State Regents for Higher Education, the Regional
108+University System of Oklahoma (RU SO), the Office of Educational
109+Quality and Accountability (OEQA), and any other agency that
110+collects critical employment or education data;

144-the Oklahoma State Regents for Higher Education, the Regional
145-University System of Oklahoma (RUSO), the Office of Educational
146-Quality and Accountability (OEQA), and any other agency that
147-collects critical employment or education data;
148137 2. Be designed to allow additional agencies to integrate t heir
149138 data in the future;
150139 3. Implement identity management capabilities to create unique
151140 identifiers to restrict personally identifiable information while
152141 linking early childhood education, elementary and secondary
153142 education, postsecondary education, and w orkforce data;
154143 4. Enable data governance, auditing, and tracking of data edits
155144 and changes by authorized users;
156145 5. Support advanced analytics capabilities including, but not
157146 limited to, artificial intelligence, machine learning, forecasting,
158147 and data mining, as well as the use of business intelligence tools
159148 such as data visualization and dashboards; and
160149 6. Ensure compliance with the Family Educational Rights and
161150 Privacy Act of 1974 (FERPA), the Student Data Accessibility,
162151 Transparency and Accountability Act of 2013, and other applicable
163152 privacy laws.
164153 C. The EDS shall not:
165154 1. Serve the same purpose as the state student identification
166155 system required by subsection E of Section 18 -200.1 of Title 70 of
167156 the Oklahoma Statutes;
157+2. Directly report data to fede ral agencies; provided, however,
158+state agencies participating in the EDS may use matched data from
159+the EDS to fulfill federally mandated reporting requirements
160+including, but not limited to, compliance with the Workforce

195-2. Directly report data to federal agencies; provided, however,
196-state agencies participating in the EDS may use matched data from
197-the EDS to fulfill federally mandated reporting requirements
198-including, but not limited to, compliance with the Workforce
199187 Innovation and Opportunity Act, the Carl D. Perkins Career and
200188 Technical Education Act of 2006 as reauthorized by the Strengthening
201189 Career and Technical Education for the 21st Century Act, the
202190 Workforce Data Quality Initiative, and other workforce - and
203191 education-related federal grant progra ms. Any data used for such
204192 purposes shall be de -identified or aggregated before submission,
205193 unless federal law explicitly requires otherwise ; or
206194 3. Collect personal data including, but not limited to, the
207195 religion of an individual and his or her parent o r legal guardian;
208196 the political affiliation of an individual and his or her parent or
209197 legal guardian; the health insurance status of an individual and his
210198 or her parent or legal guardian; and medical information relating to
211199 an individual and his or her par ent or legal guardian.
212200 D. The EDS shall provide controlled access to approved external
213201 partners including researchers or vendors, ensuring compliance with
214202 privacy protections. Data access shall be granted through a formal
215203 data-sharing agreement submitted to the Efficiency Data System
216204 Governance Council created pursuant to Section 3 of this act, with
217205 guidelines on usage and restrictions to safeguard personally
218206 identifiable information.

249236 A. There is hereby created the Efficiency Data System
250237 Governance Council to oversee the development, implementation, and
251238 operation of the Oklahoma Education and Workforce Efficien cy Data
252239 System (EDS) created pursuant to Section 2 of this act. The Council
253240 may create committees, as needed, to delegate and carry out its
254241 duties.
255242 B. The Council shall be comprised of nine (9) vot ing members as
256243 follows:
257244 1. The Executive Director of the Oklahoma Workforce Commission,
258245 or his or her designee;
259246 2. The Chancellor of Higher Education, or his or her designee;
260247 3. The Director of the Oklahoma Department of Career and
261248 Technology Education, or his or her designee;
262249 4. The Superintendent of Public Instruction, or his or her
263250 designee;
264251 5. The Executive Director of the Oklahoma Employment Security
265252 Commission, or his or her designee;
266253 6. The Executive Director of the Office of Educational Qualit y
267254 and Accountability, or his or her designee;
268255 7. The Chief Executive Officer of the Regional University
269256 System of Oklahoma (RUSO), or his or her designee;
257+8. One data privacy and security expert who is familiar with
258+the Family Educational Rights and Priv acy Act of 1974 (FERPA), the
259+Health Insurance Portability and Accountability Act (HIPAA) of 1996,

297-8. One data privacy and security expert who is familiar with
298-the Family Educational Rights and Privacy Act of 1974 (FERPA), the
299-Health Insurance Portability and Accountability Act (HIPAA) of 1996,
300286 and national privacy standards, appointed by the Commission for
301287 Educational Quality and Accountability; and
302288 9. One member of the public with expertise in wor kforce or
303289 education policy, data analysis, or government efficiency , appointed
304290 by the Governor.
305291 C. The Efficiency Data System Governance Council may include
306292 non-voting members from additional state agencies, institutions of
307293 higher education, or stakeholde r groups as needed to provide
308294 subject-matter expertise.
309295 D. The Efficiency Data System Governance Council shall:
310296 1. Oversee all aspects of data governance including approving
311297 data access policies, privacy standards, and data -sharing
312298 agreements;
313299 2. Identify and prioritize critical data elements and datasets
314300 for initial integration in the system by June 30, 2026;
315301 3. Outline a process to approve and onboard new agencies to the
316302 EDS;
317303 4. Select a vendor for the development and maintenance of the
318304 EDS, ensuring the vendor meets the system requirements and technical
319305 specifications approved by the Efficiency Data System Governance
320306 Council by June 30, 2026. F unding and procurement responsibilities
307+shall be assigned to the Commission for Educational Quality and
308+Accountability, with the EDS housed within the Office of Educational
309+Quality and Accountability;

348-shall be assigned to the Commission for Educational Quality and
349-Accountability, with the EDS housed within the Office of Educational
350-Quality and Accountability;
351336 5. Electronically submit an annual progress report to the
352337 Governor, the President Pro Tempore of the Senate, and the Speaker
353338 of the House of Representatives summ arizing the progress of the EDS,
354339 completed milestones, ne xt steps, challenges, and recommendations
355340 for improvements. The first report shall be submitted by June 30,
356341 2026; and
357342 6. Ensure the EDS is operational and includes critical datasets
358343 no later than June 30, 2027.
359344 E. By June 30, 2026, each agency participating in the EDS shall
360345 enter into a data-sharing agreement with the Efficiency Data System
361346 Governance Council. The agreement shall include:
362347 1. Data-sharing protocols;
363348 2. Data elements shared;
364349 3. Data elements requested;
365350 4. Roles and responsibilities fo r the participating agency and
366351 the Council; and
367352 5. Privacy and security standards.
368353 F. The EDS shall be funded through:
369354 1. State appropriations provided to the Office of Educational
370355 Quality and Accountability for the specific purpose of procuring and
371356 maintaining the EDS;
357+2. Federal grants including, but not limited to, funding
358+opportunities from the Workforce Data Quality Initiative or other
359+federal programs;

399-2. Federal grants including, but not limited to, funding
400-opportunities from the Workforce Data Quality Initiative or other
401-federal programs;
402386 3. Cost-sharing agreements or user fee s approved by the
403387 Efficiency Data System Governance Counc il; and
404388 4. Public or private sources, provided such funds are
405389 consistent with the purpose and goal of the EDS.
406390 G. The Commission for Educational Quality and Accountability
407391 may promulgate rules to i mplement the provisions of this act.
408392 SECTION 4. This act shall become effective July 1, 2025.
409393 SECTION 5. It being immediately necessary for the preservation
410394 of the public peace, health, or safety, an emergency is hereby
411395 declared to exist, by reason whereof this act shall take ef fect and
412396 be in full force from and after its passage and approval.
