44	66		defining terms; prohibiting certain act; providing
45	67		for penalty; requiring deposit of fee in certain
46	68		fund; providing for codification; and providing an

53	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	76		SECTION 1. NEW LAW A new section of law to be codified
55	77		in the Oklahoma Statutes as Sectio n 1248 of Title 21, unless there
56	78		is created a duplication in numbering, reads as follows:
57	79		A. As used in this section:
58	80		1. “Marijuana” shall have the same meaning as provided in
59	81		Section 2-101 of Title 63 of the Oklahoma Statutes;
60	82		2. “Motor vehicle” shall have the same meaning as provided in
61	83		Section 1-134 of Title 47 of the Oklahoma Statutes; and
62	84		3. “Vapor products” shall have the same meaning as provided in
63	85		Section 1-229.12 of Title 63 of the Oklahoma Statutes.
	86	+	B. It shall be unlawful for any person to k nowingly smoke
	87	+	tobacco or marijuana or use a vapor product in a motor vehicle while

91		-	B. It shall be unlawful for any person to knowingly smoke
92		-	tobacco or marijuana or use a vapor product in a motor vehicle while
93	139		in the presence of a minor. Any person in violation of the
94	140		provisions of this section shall be assessed a fine not less than
95	141		Fifty Dollars ($50.00) nor more than One Hundr ed Dollars ($100.00)
96	142		which shall be deposited into the Tobacco Prevention and Cessation
97	143		Revolving Fund established pursuant to Section 1 -105d of Title 63 of
98	144		the Oklahoma Statutes.
99	145		SECTION 2. This act shall become effective November 1, 2025 .
