75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2021, Section 5060, i s
77	77	amended to read as follows:
78	78	Section 5060. A. Where practicable and in acco rdance with
79	79	state and federal law , and except as provided by subsection B of
80	80	this section, the state Medicaid program shall not contract with an
81	81	out-of-state medical provider for treatment that is available from
82	82	one or more providers licensed and practicing in the State of
83	83	Oklahoma this state.
84	84	B. Laboratory analysis or diagnostic processing services that
85	85	are not directly offered by a provider licensed and practicing in
86	86	this state may be reimbursed to an out -of-state laboratory for that
87	87	service only.

139	139	C. The Oklahoma Health Care Authority shall seek any federal
140	140	approval necessary to implement the provisions of this section.
