5385 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5486 SECTION 1. NEW LAW A new section of law to be codified
5587 in the Oklahoma Statutes as Section 1085.66 of Title 82, unless
5688 there is created a duplication in numbering, reads as follows:
5789 A. 1. The Oklahoma Water Resources Board shall establish an
5890 Oklahoma Water Infrastructure Loan Program. The program shall be
5991 utilized to:
60-a. finance the development of water infrastructure
61-improvements through low-interest loans and grants to
62-municipalities, rural water districts, and other
63-eligible entities for approved water infrastructure
64-projects, and

92148 b. provide technical assistance and adm inistrative
93149 expense support for water infrastructure project
94150 implementation.
95151 2. Approved water infrastructure projects shall include, but
96152 not be limited to:
97153 a. the construction, repair, and rehabilitation of water
98154 treatment plants, pipelines, and storage facilities,
99155 b. projects to ensure water quality and conservation, and
100156 c. other projects deemed necessary by the Board to
101157 address current and future water needs.
102158 B. The Board shall promulgate rules for project eligibility,
103159 application procedures, and fund disbursement.
104160 C. 1. The Board shall submit an annual report electronically
105161 to the President Pro Tempore of the Senate, the Speaker of the House
106162 of Representatives, and the Governor, detailing the following:
107163 a. fund revenues and expenditures,
108164 b. projects financed and the current status of such
109165 projects,
110166 c. future funding needs and recommendations, and
111-d. any other information deemed necessary for inclusion
112-by the Board or its staff.
113-2. The program shall be subject to an annual independent audit
114-of expenditures from the fund.

142222 SECTION 2. NEW LAW A new section of law to be codified
143223 in the Oklahoma Statutes as Section 1085.67 of Title 82, unless
144224 there is created a duplication in numbering, reads as follows:
145225 A. 1. There is hereby creat ed in the State Treasury a
146226 revolving fund for the Oklahoma Water Resources Board to be
147227 designated the “Oklahoma Water Infrastructure Revolving Fund ”. The
148228 fund shall be a continuing fund, not subject to fiscal year
149229 limitations, and shall consist of all mon ies received by the Board
150230 from the sources prescribed in subsection B of this section provided
151231 for the purpose of funding water infrastructure projects as
152232 prescribed by this act. All monies accruing to the credit of the
153233 fund are hereby appropriated and ma y be budgeted and expended by the
154234 Board for the purpose provided for in this act. Expenditures from
155235 the fund shall be made upon warrants issued by the State Treasurer
156236 against claims filed as prescribed by law with the Director of the
157237 Office of Management and Enterprise Services for approval and
158238 payment. The Board may enter into contracts with financial
159239 institutions and execute such instruments as may be necessary to
160240 hold and disseminate program funds in accordance with applicable
161241 regulations and Board pol icies.
162-2. Notwithstanding any other provisions of law, income and
163-investment return on fund principal and interest income and
164-repayment of principal on loans made from the balance of the fund

293+2. Notwithstanding any other provisions of law, income and
294+investment return on fund principal and interest income and

296+shall accrue to the fund.
193297 3. Not less than ten percent (10%) o f the fund’s annual revenue
194298 shall be allocated to projects in rural or unde rserved communities,
195299 as determined by the Board.
196300 B. Monies deposited to the fund shall include, but not be
197301 limited to:
198302 1. Proceeds derived from the sale of surplus water from stat e-
199303 owned water resources. Provided:
200304 a. all proceeds from the sale of state -owned water shall
201305 be deposited into the fund within thirty (30) days of
202306 receipt, and
203307 b. the sale of water under this section shall not violate
204308 existing water rights agreements ;
205309 2. Fees collected from the leasing of state -owned water rights
206310 or usage agreements;
207311 3. Grants, donations, or contributions from federal, state, or
208312 private entities; and
209313 4. Interest and investment returns generated from fund
210314 balances.
211315 SECTION 3. It being immediately necessary for the preservation
212316 of the public peace, health or safety, an emergency is hereby
