8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be codified
8585 in the Oklahoma Statutes as Section 2 -10-411 of Title 27A, unless
8686 there is created a duplicatio n in numbering, reads as follows:
8787 A. As used in this section:
8888 1. “Biosolids” means solids separated from liquids during the
8989 wastewater treatment process which are treated physically and
9090 chemically to produce a semisolid, nutrient -rich product;

142142 2. “Perfluoroalkyl and polyfluoroalkyl substances ” or “PFAS”
143143 means non-polymeric perfluoroalkyl and polyfluoroalkyl substances
144144 that contain at least two sequential, fully fluorinated carbon
145145 atoms, excluding gases and volatile liquids;
146146 3. “Sewage sludge” means the residual, semi-solid material that
147147 is produced as a byproduct of sewage by mun icipal, commercial, or
148148 industrial wastewater treatment plants; and
149149 4. “Septage” means a fluid mixture of untreated and partially
150150 treated sewage solids, liquids, and sludge of hu man or domestic
151151 origin, which is removed from a septic tank .
152152 B. Notwithstanding any other provision of law, and except as
153153 provided in subsection C of this section, no person in this state
154154 shall:
155155 1. Apply to or spread on any land of this state:
156156 a. sludge generated from a municipal, commercial, or
157157 industrial wastewater treatment pla nt,
158158 b. compost material that included in its production
159159 sludge generated from a municipal, commercial, or
160160 industrial wastewater treatment plant or septage, or
161161 c. any other product or material that is intended for use
162162 as a fertilizer, soil amendment, topsoil replacement,
163163 mulch, or other similar agricultural purpose that is
164164 derived from or contains sludge generated from a

218218 2. Sell or distribute in this state:
219219 a. compost material that included in its production
220220 sludge generated from a municipal, commercial, or
221221 industrial wastewater treatment plant or septage , or
222222 b. any other product or material that is inte nded for use
223223 as a fertilizer, soil amendment, topsoil replacement,
224224 mulch, or other similar agricultural purpose that is
225225 derived from or contains sludge generated from a
226226 municipal, commercial, or industrial wastewater
227227 treatment plant or septage .
228228 C. The prohibitions in subsection B of this section shall not
229229 apply to:
230230 1. The disposal or placement of materials described in
231231 subsection B of this section at a lined and monitored solid waste
232232 landfill;
233233 2. The land application of or the sale or distribution of
234234 compost material or other agricultural product derived from or
235235 containing residuals generated as a result of the processing or
236236 cultivation of food, food waste, crops , or vegetative material ; the
237237 brewing of malt liquor ; the fermenting of wine or hard cider ; or the
238238 distilling of spirits, including, but not limited to, blueberries,
239239 apples, grapes, potatoes, seaweed, fish and seafood, and spent grain

291291 or malt. Provided, the exemption under this subsection shall only
292292 apply if the agricultural product is not cultivated in soil
293293 previously treated with biosolids and that such product is not mixed
294294 with sludge from a municipal , commercial, or industrial wastewater
295295 treatment plant, septage, sewage , or sanitary wastewater prior to or
296296 during land application or during the production of the agricultural
297297 product;
298298 3. The land application, sale, or dist ribution of compost
299299 material or agricultural product or material derived from or
300300 containing sludge resulting from the production of precipitated
301301 calcium carbonate; and
302302 4. The land application, sale, or distribution of compost
303303 material or other agricultural product or material derived from or
304304 containing manure from animals, zoos, or other agricultural sources.
305305 D. The Department of Environmental Quality shall have
306306 jurisdiction to enforce the provisions of this section as they
307307 pertain to land application or spreading of materials described
308308 under this section. The Oklahoma Department of Agriculture, Food ,
309309 and Forestry shall have jurisdiction to enforce the provisions of
310310 this section regarding agricultural materials. The Departments
311311 shall enter into a memorandum of understanding to effectively
312312 enforce the provisions of this section .

364364 SECTION 2. NEW LAW A new section of law to be codified
365365 in the Oklahoma Statute s as Section 2-10-412 of Title 27A, unless
366366 there is created a duplication in n umbering, reads as follows:
367367 A. The Department of Environmental Quality shall assess, study,
368368 and develop a long-term plan for the purposes of prohibiting the
369369 land application of septage in this state. The plan shall include,
370370 but not be limited to:
371371 1. Identification of the available capacity at wastewater
372372 treatment plants or other treatment or disposal facilities in this
373373 state to manage septage that is land -applied prior to the e ffective
374374 date of this act;
375375 2. Determination of the capacity anticipated to be necessary to
376376 manage septage following the prohibition of land application in this
377377 state;
378378 3. Development of recommendations to support and fund
379379 additional management capacity, i f necessary; and
380380 4. Development of recommendations concerning a framework for
381381 the long-term prohibition of land application in this state.
382382 B. The Department shall submit an electronic report to the
383383 President Pro Tempore of the Senate, the Speaker of the House of
384384 Representatives, the Governor, and the relevant legislative
385385 committee chairs overseeing environment and natural resources not
386386 later than February 1, 2026. The report shall include any suggested
387387 legislative implementations resulting from the study .

439439 SECTION 3. NEW LAW A new section of law to be codified
440440 in the Oklahoma Statutes as Section 2 -10-413 of Title 27A, unless
441441 there is created a duplication in numbering, reads as follows:
442442 A. The Oklahoma Department of Agriculture, Fo od, and Forestry
443443 shall develop a plan to protect agricultural producers who ar e
444444 impacted by perfluoroalkyl and polyfluoroalkyl substances (PFAS)
445445 contamination from the land application or spreading of:
446446 1. Sludge generated from a municipal, commercial, or industrial
447447 wastewater treatment plant;
448448 2. Compost material that included in its production sludge
449449 generated from a municipal, commercial, or industrial wastewater
450450 treatment plant; or
451451 3. Any other product or material that is intended for use as a
452452 fertilizer, soil amendment, topsoil replacement, mulch, or other
453453 similar agricultural purpose that is derived from or contains sludge
454454 generated from a municipal, commercial, or industrial wastewater
455455 treatment plant or septage.
456456 B. The Department shall work directl y with impacted
457457 agricultural producers to identify sources of contamination and
458458 institute best practices for immediate and successful PFAS removal,
459459 remediation, and recovery, including any necessary surveys and
460460 testing.
461461 C. The Department shall submit a re port to the Legislature on
462462 the total cost of PFAS removal, remediation, and re covery under this

514514 section. Upon the convening of the next legislative session, the
515515 reported amount shall be included in the general appropriations bill
516516 for the upcoming fiscal y ear.
517517 SECTION 4. It being immediately necessary for the preservation
518518 of the public peace, health or safety, an emergency is hereby
519519 declared to exist, by reason whereof this act shall take effect and
520520 be in full force from and after its passa ge and approval.
