7777 BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new sect ion of law to be codified
7979 in the Oklahoma Statutes as Section 85.22A of Title 74, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. Any competitive bid su bmitted to this state or contract
8282 executed by the state for an acquisition under the Oklahoma Central
8383 Purchasing Act shall contain a written verification that the vendor
8484 agrees to:
8585 1. Submit an annual written affidavit to the Office of
8686 Management and Enterprise Services (OMES) disclosing any financial
8787 improprieties of individuals e mployed by the vendor as executives,
8888 officers, or directors, and of any individuals who invest in the

140140 vendor. The first affidavit shall be submitted with the bid for an
141141 acquisition, and subsequent affidavits shall be submitted annually
142142 on January 1 for each year thereafter ; and
143143 2. Undergo an annual review of the vendor ’s financial
144144 information if deemed necessary by OMES.
145145 B. In the event that an affidavit submitted pursuant to
146146 paragraph 1 of subsection A of this section affirms the existence of
147147 financial impropriety within the vendor ’s staff or investors, OMES
148148 shall conduct an annual review of the vendor ’s financial practices,
149149 compliance with state regulations, financial integrit y, and any
150150 other factors as deemed necessary by OMES.
151151 C. For the purposes of this section, “financial impropriety ”
152152 means any dishonest, illegal, or unethical activity that can lead to
153153 a loss of money, including, but not limited to, fraud, corruption,
154154 money laundering, mismanagement, abuse of authority, theft,
155155 embezzlement, and brib ery.
156156 SECTION 2. This act shall become effective November 1, 2025.
