8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 2 -7-501 of Title 27A, unless
8484 there is created a duplication in numbering, reads as follows:
8585 A. This act shall be known and may be cited as the “Oklahoma
8686 Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Act ”.
8787 B. As used in the Oklahoma Perfluoroalkyl and Polyflu oroalkyl
8888 Substances (PFAS) Act:
8989 1. “AFFF” means aqueous film-forming foam containing

142142 2. “AFFF waste” means AFFF, diluted AFFF, and water or soil
143143 contaminated with AFFF containing intentionally added PFAS with a
144144 concentration greater than one part per billion, which is abandoned,
145145 discarded, disposed, destroyed, or stored pending disposal or
146146 destruction; and
147147 3. “PFAS” means perfluoroalkyl and polyfluoroa lkyl substances.
148148 SECTION 2. NEW LAW A new section of l aw to be codified
149149 in the Oklahoma Statutes as Section 2 -7-502 of Title 27A, unless
150150 there is created a duplication in numbering, reads as follows:
151151 A. Subject to subsection B of t his section, the following
152152 protected passive receivers of perfluoroalkyl and polyfluoroalkyl
153153 substances (PFAS) that provide essential services shall not be
154154 civilly liable to this state for costs arising from a release of
155155 PFAS to the environment:
156156 1. A public water system, as defined in Section 1401 of the
157157 federal Safe Drinking Water Act, 42 U.S.C., Section 300f;
158158 2. A publicly or privately owned or operated treatment works,
159159 as defined in Section 212 of the Federal Water Pollution Control
160160 Act, 33 U.S.C., Section 1292, or the owner of a site where biosolids
161161 generated from a treatment works or a permitted municipal wastewater
162162 lagoon, as defined by the administrative rules of the Department of
163163 Environmental Quality, are applied;

215215 3. A municipality to which a per mit is issued for stormwater
216216 discharges under Section 402 of the Federal Water Pollution Control
217217 Act, 33 U.S.C., Section 1342;
218218 4. A political subdivision of this state acting as a wholesale
219219 water agency;
220220 5. A contractor performing the management or dispo sal
221221 activities described in subsection B of this section for an entity
222222 described in paragraphs 1 through 4 of this subsection;
223223 6. An entity with a fire suppression system installed or
224224 otherwise in use, in accordance with applicable federal, state, and
225225 local fire codes, that uses aqueous film -forming foam (AFFF)
226226 containing PFAS;
227227 7. A sponsor of the civilian portion of a joint -use airport or
228228 a shared-use airport which releases PFAS as a result of the use of
229229 AFFF pursuant to, and carried out in accordance wi th, Federal
230230 Aviation Administration standards and guidance on the use of the
231231 substances; and
232232 8. An owner or operator of a solid waste management facility,
233233 as defined in Section 1004 of the Solid Waste Disposal Act, 42
234234 U.S.C., Section 6903, to the extent t hat the facility received
235235 routine municipal solid waste, including commercial solid waste
236236 containing incidental amounts of PFAS.
237237 B. The exemption from liability contained in subsection A of
238238 this section shall not apply if the release of PFAS resulted from a

290290 material violation of relevant and applicable federal, state, or
291291 other legal requirements or standards related to the management,
292292 storage, transport, conveyance, treatment, discharge, and disposal
293293 of PFAS, or of commonly accepted engineering standards i n existence
294294 at the time that the activity is carried out.
295295 C. Nothing in this section shall preclude liability for damages
296296 or costs associated with the release of PFAS by a protected passive
297297 receiver of PFAS if the protected passive receiver act s with gross
298298 negligence or willful misconduct in the discharge, disposal,
299299 management, conveyance, or storage of PFAS.
300300 SECTION 3. NEW LAW A new section of law to be codified
301301 in the Oklahoma Statutes as Section 2 -7-503 of Title 27A, unless
302302 there is created a duplication in numbering, reads as follows:
303303 A. 1. The Environmental Quality Board shall promulgate rules
304304 related to the receipt, storage, treatment, and disposal of
305305 perfluoroalkyl and polyfluoroalkyl substances (PFAS) in this state,
306306 including rules related to a waste exclusion plan.
307307 2. Rules promulgated under subsection A of this section shall
308308 require that any person accepting aqueous film -forming foam (AFFF)
309309 waste for storage, treatment, or disposal prove to the Department
310310 that the manner of such storage, treatment, or disposal is
311311 protective of human health and the environment. The Department
312312 shall establish criteria and guidelines for determinations under
313313 this subsection.

365365 B. 1. The Board shall establish a schedule of fees, pursuant
366366 to Section 2-3-402 of Title 27A of the Oklahoma Statutes and the
367367 Administrative Procedures Act, for the application to dispose, and
368368 for disposal of, AFFF waste at a facility in this state.
369369 2. Any fees established pursuant to this subsection shall be in
370370 lieu of any tonnage fees assessed to the holder of a permit by the
371371 Department for solid or hazardous waste disposal. The fees shall be
372372 deposited into the Department of Environmental Quality Revolving
373373 Fund.
374374 SECTION 4. NEW LAW A new sectio n of law to be codified
375375 in the Oklahoma Statutes as Section 2 -7-504 of Title 27A, unless
376376 there is created a duplication in numbering, reads as follows:
377377 A. A person or entity seeking to receive, store, treat, or
378378 dispose of more than two hundred (200) pound s of aqueous film-
379379 forming foam (AFFF) waste per day shall submit an applicatio n to the
380380 Department of Environmental Quality and receive authorization for
381381 such action. The Department, in the exercise of its reasonable
382382 discretion, may waive specific requirem ents of this act or rules
383383 where there is no feasible alternative to the storage, treatment, or
384384 disposal at issue and the action does not result in a greater risk
385385 to human health and the environment. Prior to the promulgation of
386386 rules in Section 3 of this act, the Department may authorize the
387387 continuation of activities under this su bsection if it determines

439439 that the activities will be conducted in a manner that is
440440 sufficiently protective of human health and the environment.
441441 B. Nothing in this section shall relieve the manufacturer of
442442 perfluoroalkyl and polyfluoroalkyl substances (PFAS) containing
443443 material from liability related to the storage, treatment, or
444444 disposal of PFAS waste.
445445 C. 1. AFFF waste generated in or transported from another
446446 state shall maintain the same classification or characterization it
447447 would receive in the state of origin, unless such classification or
448448 characterization is less protective of human health and the
449449 environment than the classification or characterization it would
450450 have received if generated in this state.
451451 2. If AFFF waste generated in or transported from another state
452452 is banned from disposal in the state of origin, then the waste is
453453 similarly banned from disposal in Oklahoma , unless the AFFF waste is
454454 effectively banned from di sposal in the state of origin due to a
455455 lack of permitted hazardous waste landf ills within the state. If
456456 the AFFF waste is effectively banned from disposal in the state of
457457 origin due to a lack of permitted hazardous waste landfills within
458458 the state, then the AFFF waste may be disposed of in landfills
459459 permitted under the Oklahoma Hazardous Waste Management Act pursuant
460460 to Section 2-7-101 et seq. of Title 27A of the Oklahoma Statutes.
461461 SECTION 5. It being immediately necessary for the preserva tion
462462 of the public peace, health or safety, an emergency is hereby
