6256 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
6357 SECTION 1. NEW LAW A new section of law not to be
6458 codified in the Oklahoma Statutes reads as follows:
6559 This act shall be known and may be cited as the “Emerson Kate
6660 Cole Act”.

95-Section 1-116.3. A. Notwithstanding the provisions of Section
96-1-116.2 of this title, the board of education of each school
97-district shall adopt a policy on or before September 1, 2008, that
9892 permits the self-administration of inhaled asthma medication by a
9993 student for treatment of asthma, the self -administration of
10094 anaphylaxis medication by a student for treatment of anaphylaxis ,
10195 and the self-administration of replacement pancreatic enzymes by a
10296 student for treatment of cystic fibrosis. The policy shall require:
10397 1. The parent or legal guardian of the student to authorize in
10498 writing the student’s self-administration of medication;
10599 2. The parent or legal guardian of the student to provide to
106100 the school a written statement from the physician treating the
107101 student that the student has asthma, anaphylaxis , or cystic fibrosis
108102 and is capable of, and has been instructed in the proper method of,
109103 self-administration of medication;
110104 3. The parent or legal guardian of the student to provide to
111105 the school an emergency supply of the student ’s medication to be
112106 administered pursuant to the provisions of Section 1 -116.2 of this
113107 title;
114108 4. The school district to i nform the parent or legal guardian
115109 of the student, in writing, that the school district and its
116110 employees and agents shall incur no liability as a result of any
117111 injury arising from the self -administration of medication by the
118112 student; and

145-5. The parent or legal guardian of the student to sign a
146-statement acknowledging that the school district shall incur no
147141 liability as a result of any injury arising from the self -
148142 administration of medication by the student.
149143 B. The school board of education of each school district that
150144 elects to stock Epinephrine injectors or inhalers shall amend the
151145 policy identified in subsection A of this section.
152146 1. The amended policy for Epinephrine injectors shall require:
153147 a. the school district to inform the parent or legal
154148 guardian of each student, in writing, that a school
155149 nurse or school employee trained by a health care
156150 professional or trained in correlation with the State
157151 Department of Health ’s Diabetes Management Annual
158152 School Training Program annual diabetes management
159153 training may administer, with parent or legal guardian
160154 permission but without a health care provider order,
161155 an Epinephrine injection to a student whom the school
162156 nurse or trained school employee in good faith
163157 believes is having an anaphylactic reaction,
164158 b. a waiver of liability executed by a parent or legal
165159 guardian to be on file with the school district prior
166160 to the administration of an Epinephrine injection
167161 pursuant to subparagraph a of this paragraph 1 of this
168162 subsection, and

195189 c. the school district to designat e the employee
196190 responsible for obtaining the Epineph rine injectors at
197191 each school site.
198192 2. The amended policy for inhalers shall require:
199193 a. the school district to inform the parent or legal
200194 guardian of each student, in writing, that a school
201195 nurse or school employee trained by a health care
202196 professional may administer an inhaler to a student
203197 whom the school nurse or trained school employee in
204198 good faith believes is having respiratory distress,
205199 b. the school district to designate the employee
206200 responsible for obtaining the inhalers and spacers or
207201 holding chambers at each school site, and
208202 c. the school district to notify the parent or legal
209203 guardian of a student after administration of an
210204 inhaler.
211205 C. The school district and its employees and agents shall incur
212206 no liability as a result of any injury arising pu rsuant to the
213207 discharge or nondischarge of the powers provided for pursuant to
214208 subparagraph a of paragraphs 1 and 2 of subsection B of this
215209 section.
216210 D. A licensed physician who has prescriptive authority may
217211 write a prescription for Epinephrine injectors and inhalers and
218212 spacers or holding chambers to the school district in the name of

245239 the district as a body corporate specified in Section 5 -105 of this
246240 title which shall be maintained at each school site. Such physician
247241 shall incur no liability as a result of any injury arising from the
248242 use of the Epinephrine injectors or the inhalers and spacers or
249243 holding chambers.
250244 E. The school district may maintain at each school a minimum of
251245 two Epinephrine injectors and two inhalers with spacers or holding
252246 chambers in a secure location. Provided, however, that nothing in
253247 this section shall be construed as creating or imposing a duty on a
254248 school district to maintain Epinephrine injectors or inhalers with
255249 spacers or holding chambers at a school site or sites.
256250 F. In the event a student is believed to be having an
257251 anaphylactic reaction or respiratory distress, a school employee
258252 shall contact 911 as soon as possible. If Epinephrine is
259253 administered to a student, a school employee shall contact 911 as
260254 soon as possible. Th e school district shall notify the parent or
261255 legal guardian of any student who experiences a possible allergic
262256 reaction as soon as possible.
263257 G. The State Board of Education, in consultation with the State
264258 Board of Health, shall develop model policies whic h school districts
265259 may use in compliance with this section. The model policies shall
266260 include, at a minimum, required annual training for teachers and
267261 school employees who are directly responsible for stu dents on the
268262 topics of food allergies, recognizing a naphylaxis, and instruction

295289 on how to administer Epinephrine. The training shall be completed
296290 before the school year begins or upon hiring the teacher or school
297291 employee. Documentation certifying completion of the required
298292 training shall be retained in t he personnel file for the teacher or
299293 school employee. The training may be provided online or in person
300294 by the school nurse or a recognized food allergy and anaphylaxis
301295 training program.
302296 H. The State Board of Education, in consultation with the State
303297 Board of Health, shall promulgate rules to implement this section.
304298 I. As used in this section:
305299 1. “Medication” means a metered dose inhaler or a dry powder
306300 inhaler to alleviate asthmatic symptoms, prescribed by a physician
307301 and having an individual label, an anaphylaxis medication used to
308302 treat anaphylaxis including but not limited to Epinephrine injectors
309303 prescribed by a physician and having an individual label, or
310304 replacement pancreatic enzymes prescribed b y a physician and having
311305 an individual label; and
312306 2. “Self-administration” means a student’s use of medication
313307 pursuant to prescription or written direction from a physician .;
314308 3. “Respiratory distress ” means the perceived or actual
315309 presence of coughing, wheezing , or shortness of breath; and
316310 4. “Inhaler” means a device that delivers a bronchodilator to
317311 alleviate symptoms of respiratory distress that is manufactured in
318312 the form of a metered -dose inhaler or dry-powder inhaler and that

345339 may include a spacer o r holding chamber that attaches to the inhaler
346340 to improve the delivery of the bronchodilator.
347341 J. The permission for self -administration of asthma,
348342 anaphylaxis, or replacement pancreatic enzyme medication is
349343 effective for the school year for which it is granted and shall be
350344 renewed each subsequent school ye ar upon fulfillment of the
351345 requirements of this section.
352346 K. A student who is permitted to self -administer asthma,
353347 anaphylaxis, or replacement pancreatic enzyme medication pursuant to
354348 this section shall b e permitted to possess and use a prescribed
355349 inhaler, anaphylaxis medication including but not limited to an
356350 Epinephrine injector, or replacement pancreatic enzyme medication at
357351 all times.
358352 SECTION 3. This act shall become effective July 1, 2025.
359353 SECTION 4. It being immediate ly necessary for the preservation
360354 of the public peace, health, or safety, an emergency is hereby
361355 declared to exist, by reason whereof this act shall take effect and
362356 be in full force from and after its pas sage and approval.
