7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.14, as
7777 last amended by Section 1, Chapt er 342, O.S.L. 2024 (63 O.S. Supp.
7878 2024, Section 427.14), is amended to read as follows:
7979 Section 427.14. A. There is hereby created the medical
8080 marijuana business license, whic h shall include the following
8181 categories:
8282 1. Medical marijuana commercial grower;
8383 2. Medical marijuana processor;
8484 3. Medical marijuana dispensary;
8585 4. Medical marijuana transporter; and
8686 5. Medical marijuana testing laboratory.

138138 B. The Oklahoma Medical Marijuana Authority, with the aid of
139139 the Office of Management and Enterprise S ervices, shall develop a
140140 website for medical marijuana business applications.
141141 C. The Authority shall make available on its website in an
142142 easy-to-find location, applications for a medical marijuana
143143 business.
144144 D. 1. The annual, nonrefundable fee for a medical marijuana
145145 transporter license shall be Two Thousand Five Hundred Dollars
146146 ($2,500.00).
147147 2. The initial, nonrefundable fee for a medical marijuana
148148 commercial grower license sha ll be calculated based upon the total
149149 amount of square feet of canopy or acres the grower estimates will
150150 be harvested, transferred, or sold for the year. The annual,
151151 nonrefundable license fee shall be based upon the total amount of
152152 square feet of canopy o r acres harvested, transferred, or sold by
153153 the grower during the previous twelve (12) months. The amount of
154154 the fees shall be determined as follows:
155155 a. For an indoor, greenhouse, or light deprivation
156156 medical marijuana grow facility:
157157 (1) Tier 1: Up to ten thousand (10,000) square feet
158158 of canopy, the fee shall be Two Thousand Five

362362 (8) Tier 8: If the amount of acreage exceeds fifty
363363 (50) acres, the fee shall be Fifty Thousand
364364 Dollars ($50,000.00) plus an additional Two
365365 Hundred Fifty Dollars ($250.00) per acre.
366366 c. For a medical marijuana commercial grower that has a
367367 combination of both indoor and outdoor growing
368368 facilities at one location, the medical marijuana
369369 commercial grower shall be required to obtain a
370370 separate license from the Authority for each type of
371371 grow operation and shall be subject to the licensing
372372 fees provided for in subparagra phs a and b of this
373373 paragraph.
374374 d. As used in this paragraph:
375375 (1) “canopy” means the total surface area within a
376376 cultivation area that is dedicated to the
377377 cultivation of flowering marijuana plants. The
378378 surface area of the plant canopy must be
379379 calculated in square feet and measured and must
380380 include all of the area within the boundaries
381381 where the cultivation of the flowering marijuana
382382 plants occurs. If the surface of the plant
383383 canopy consists of noncontiguous areas, each
384384 component area must be separated by i dentifiable

437437 used in the cultivation area, the surface area of
438438 each tier or shelf must be included in
439439 calculating the area of the pl ant canopy.
440440 Calculation of the area of the plant canopy may
441441 not include the areas within the cultivation area
442442 that are used to cultivate immature marijuana
443443 plants and seedlings, prior to flowering, and
444444 that are not used at any time to cultivate mature
445445 marijuana plants. If the flowering plants are
446446 vertically grown in cylinders, the square footage
447447 of the canopy shall be measured by the
448448 circumference of the cylinder multiplied by the
449449 total length of the cylinder,
450450 (2) “greenhouse” means a structure located ou tdoors
451451 that is completely covered by a material that
452452 allows a controlled level of light transmission,
453453 and
454454 (3) “light deprivation” means a structure that has
455455 concrete floors and the ability to manipulate
456456 natural light.
457457 3. The initial, nonrefundable fee for a medical marijuana
458458 processor license shall be Two Thousand Five Hundred Doll ars

512512 previous twelve (12) months as follows:
513513 a. Tier 1: The transfer or sale of zero (0) to ten
514514 thousand (10,000) pounds of biomass or the production,
515515 transfer, or sale of up to one hundred (100) liters of
516516 cannabis concentrate, whichever is greater, the annual
517517 fee shall be Two Thousand Five Hundred Dollars
518518 ($2,500.00),
519519 b. Tier 2: The transfer or sale of ten thousand one
520520 (10,001) pounds to fifty thousand (50,000) pounds of
521521 biomass or the production, transfer, or sale of one
522522 hundred one (101) to three hundred fifty (350) liters
523523 of cannabis concentrate, which ever is greater, the
524524 annual fee shall be Five Thousand Dollars ($5,000.00),
525525 c. Tier 3: The transfer or sale of fifty thousand one
526526 (50,001) pounds to one hundred fifty thousand
527527 (150,000) pounds of biomass or the production,
528528 transfer, or sale of three hundr ed fifty-one (351) to
529529 six hundred fifty (650) liters of cannabis
530530 concentrate, whichever is greater, the annual fee
531531 shall be Ten Thousand Dollars ($10,000.00),
532532 d. Tier 4: The transfer or sale of one hundred fifty
533533 thousand one (150,001) pounds to three hund red
534534 thousand (300,000) pounds of biomass or the

587587 (651) to one thousand (1,000) liters of cannabis
588588 concentrate, whichever is greater, the annual fee
589589 shall be Fifteen Thousand Dollars ($15,000.00), and
590590 e. Tier 5: The transfer or sale of more than three
591591 hundred thousand one (300,00 1) pounds of biomass or
592592 the production, transfer, or sale in excess of one
593593 thousand one (1,001) liters of cannabis concentrate,
594594 the annual fee shall be Twenty Thousand Dollars
595595 ($20,000.00).
596596 For purposes of this paragraph only, if the cannabis concentrate
597597 is in nonliquid form, every one thousand (1,000) grams of
598598 concentrated marijuana shall be calculated as one (1) liter of
599599 cannabis concentrate.
600600 4. The initial, nonrefundable fee f or a medical marijuana
601601 dispensary license shall be Two Thousand Five Hundred D ollars
602602 ($2,500.00). The annual, nonrefundable license fee for a medical
603603 marijuana dispensary license shall be calculated at ten percent
604604 (10%) of the sum of twelve (12) calendar months of the combined
605605 annual state sales tax and state excise tax of the dispensary during
606606 the previous twelve (12) months. The minimum fee shall be not less
607607 than Two Thousand Five Hundred Dollars ($2,500.00) and the maximum
608608 fee shall not exceed Ten Thou sand Dollars ($10,000.00) Four Thousand
609609 Five Hundred Dollars ($4,500.00) .

661661 5. The annual, nonrefundable license fee for a medical
662662 marijuana testing laboratory shall be Twenty Thousand Dollars
663663 ($20,000.00).
664664 E. All applicants seeking licensure or licensure renewal as a
665665 medical marijuana business shall comply with the following general
666666 requirements:
667667 1. All applications for licenses and registrations authorized
668668 pursuant to this section shall be made upon forms prescribed by the
669669 Authority;
670670 2. Each application shall identify the city or county in which
671671 the applicant seeks to obtain lice nsure as a medical marijuana
672672 business;
673673 3. Applicants shall submit a complete application to the
674674 Authority before the application may be accepted or considered;
675675 4. All applications shall be complete and accurate in every
676676 detail;
677677 5. All applications shall include all attachments or
678678 supplemental information required by the forms supplied by the
679679 Authority;
680680 6. All applications for a transporter license, initial
681681 dispensary license, initial processor license, or laboratory license
682682 shall be accompanied by a ful l remittance for the whole amount of
683683 the license fee as set forth in subsection D of this section. All

736736 and renewal dispensary applications shall be accompanied by a
737737 remittance of a fee of Two Thousand Five Hundred Dollars
738738 ($2,500.00). The Authority shall invoice license applicants, if
739739 applicable, for any additional licensing fees owed pursuant to
740740 subsection D of this section prior to approval of a license
741741 application. License fees are no nrefundable;
742742 7. All applicants shall be approved for licensing review that,
743743 at a minimum, meet the following criteria:
744744 a. twenty-five (25) years of age or older,
745745 b. if applying as an individual, proof that the applicant
746746 is a resident of this state pursuant to paragraph 11
747747 of this subsection,
748748 c. if applying as an entity, proof that seventy -five
749749 percent (75%) of all members, managers, executive
750750 officers, partners, board members or any other form of
751751 business ownership are residents of this state
752752 pursuant to paragraph 11 of this subsection,
753753 d. if applying as an individual or entity, proof that the
754754 individual or entity is registered to conduct business
755755 in this state,
756756 e. disclosure of all ownership interests pursuant to the
757757 Oklahoma Medical Marijuana and Patient Protection Act,

810810 f. proof that the medical marijuana business, medical
811811 marijuana research facility, medical marijuana
812812 education facility and medical marijuana waste
813813 disposal facility applicant or licensee has not been
814814 convicted of a nonviolent felony in the last two (2)
815815 years, or any other felony conviction within the last
816816 five (5) years, is not a current inmate in the custody
817817 of the Department of Corrections, or currently
818818 incarcerated in a jail or corrections facility.
819819 Upon reasonable suspicion that a medical marijuana business licensee
820820 is illegally growing, processing, transferring, selling, disposing,
821821 or diverting marijuana, the Authority, the Oklahoma State Bureau of
822822 Narcotics and Dangerous Drugs Control, the Oklahoma State Bureau of
823823 Investigation (OSBI), or the Attorney General may subpoena documents
824824 necessary to establish the personal identifying information of all
825825 owners and individuals with any ownership interest in the b usiness;
826826 8. There shall be no limit to the number of medical marijuana
827827 business licenses or categories that an individual or entity can
828828 apply for or receive, although each application and each category
829829 shall require a separate application, application fee , or license
830830 fee. A commercial grower, processor and dispensary, or any
831831 combination thereof, are authorized to share the same address or
832832 physical location, subject to the restrictions set forth in the
833833 Oklahoma Medical Marijuana and Patient Protection Act;

885885 9. No medical marijuana business premises is permitted to have
886886 multiple licenses of the same type pursuant to the licensing
887887 requirements of this section, excluding the following:
888888 a. a commercial grower with a combination of an indoor or
889889 outdoor growing facility on one parcel of land,
890890 b. a licensed medical marijuana processor used by
891891 multiple licensees, and
892892 c. a licensed medical marijuana business that has an
893893 approved application by the Authority while the new
894894 business seeks registration from the Oklahoma State
895895 Bureau of Narcotics and Dangerous Drugs Control
896896 pursuant to Section 2 of this act;
897897 10. All applicants for a medical marijuana business license,
898898 research facility license or education facility license authorized
899899 by the Oklahoma Medical Marijuana and Patient Protection Act, or for
900900 a renewal of such license, shall undergo a nati onal fingerprint-
901901 based background check conducted by the Oklahoma State Bureau of
902902 Investigation within thirty (30) days prior to the application for
903903 the license, including:
904904 a. individual applicants applying on their own behalf,
905905 b. individuals applying on behalf of an entity,
906906 c. all principal officers of an entity, and
907907 d. all owners of an entity as defined by the Oklahoma
908908 Medical Marijuana and Patient Protection Act;

960960 11. All applicable fees charged by the OSBI are the
961961 responsibility of the applicant and sha ll not be higher than fees
962962 charged to any other person or industry for such background checks;
963963 12. In order to be considered a resident of this state for
964964 purposes of a medical m arijuana business application, all applicants
965965 shall provide proof of state residency for at least two (2) years
966966 immediately preceding the date of application or five (5) years of
967967 continuous state residency during the preceding twenty -five (25)
968968 years immediately preceding the date of application. Sufficient
969969 documentation of proof of residency shall include a combination of
970970 the following:
971971 a. an unexpired state-issued driver license,
972972 b. a state-issued identification card,
973973 c. a utility bill preceding the date of application,
974974 excluding cellular telephone and Internet bills,
975975 d. a residential property deed to property in this state,
976976 and
977977 e. a rental agreement preceding the date of application
978978 for residential property located in this state.
979979 Applicants that were issu ed a medical marijuana business license
980980 prior to August 30, 2019, are hereby e xempt from the two-year or
981981 five-year Oklahoma residence requirement mentioned above;
982982 13. All license applicants shall be required to submit a
983983 registration with the Oklahoma Stat e Bureau of Narcotics and

10371037 14. All applicants shall establish their identity through
10381038 submission of a color copy or digital image of one of the following

10401040 a. front of a state-issued driver license,
10411041 b. front of a state-issued identification card,
10421042 c. a United States passport or other photo identification
10431043 issued by the United States government, or
10441044 d. a tribal identification card approved for
10451045 identification purposes by the Department of Public
10461046 Safety;
10471047 15. All applicants shall submit an applicant photograph; and
10481048 16. All applicants for a medical marijuana business license
10491049 seeking to operate a commercial growing operation shall file along
10501050 with their application a bond as prescribed in Section 427.26 of
10511051 this title.
10521052 F. The Authority shall r eview the medical marijuana business
10531053 application; approve, reject, or deny the application; and send the
10541054 approval, rejection, denial, or status -update letter to the
10551055 applicant in the same method the application was submitted to the
10561056 Authority within ninety (90) business days of receipt of the
10571057 application.

11091109 G. 1. The Authority shall review the medical marijuana
11101110 business applications, conduct all investigations, inspections, and
11111111 interviews, and collect all license and application fees before
11121112 approving the application.
11131113 2. Approved applicants shall be issued a medical marijuana
11141114 business license for the specific category applied under, which
11151115 shall act as proof of their approved status. Rejection and denial
11161116 letters shall provide a reason for the rejection or denial.
11171117 Applications may only be rejected or denied based on the applicant
11181118 not meeting the standards set forth in the provisions of the
11191119 Oklahoma Medical Marijuana and Patient Protec tion Act and Sections
11201120 420 through 426.1 of this title, improper completion of the
11211121 application, unpaid license or application fees, or for a reason
11221122 provided for in the Oklahoma Medical Marijuana and Patient
11231123 Protection Act and Sections 420 through 426.1 of t his title. If an
11241124 application is rejected for failure to provide required information,
11251125 the applicant shall have thirty (30) days to submit the required
11261126 information for reconsideration. Unless the Authority determines
11271127 otherwise, an application that has bee n resubmitted but is still
11281128 incomplete or contains errors that are not clerical or typographical
11291129 in nature shall be denied.
11301130 3. Status-update letters shall provide a reason for delay in
11311131 either approval, rejection or denial should a situation arise in

11851185 4. Approval, rejection, denial or status -update letters shall
11861186 be sent to the applicant in the same method the application was
11871187 submitted to the Authority.
11881188 H. A license for a medical marijuana business, medical
11891189 marijuana research facility, medi cal marijuana education facility or
11901190 medical marijuana waste disposal facility shall not be issued to or
11911191 held by:
11921192 1. A person until all required fees have been paid;
11931193 2. A person who has been convicted of a nonviolent felony
11941194 within two (2) years of the date of application, or within five (5)
11951195 years for any other felony;
11961196 3. A corporation, if the criminal history of any of its
11971197 officers, directors or stockholders indicates that the o fficer,
11981198 director or stockholder has been convicted of a nonviolent felony
11991199 within two (2) years of the date of application, or within five (5)
12001200 years for any other felony;
12011201 4. A person under twenty -five (25) years of age;
12021202 5. A person licensed pursuant to th is section who, during a
12031203 period of licensure, or who, at the time of application, has failed
12041204 to:
12051205 a. file taxes, interest or penalties due related to a
12061206 medical marijuana business, or

12591259 medical marijuana bus iness;
12601260 6. A sheriff, deputy sheriff, police officer or prosecuting
12611261 officer, or an officer or employee of the Authority or municipality;
12621262 7. A person whose authority to be a caregiver, as defined in
12631263 Section 427.2 of this title, has been revoked by the Auth ority; or
12641264 8. A person who was involved in the management or operations of
12651265 any medical marijuana business, medical marijuana research facility,
12661266 medical marijuana education facility or medical marijuana waste
12671267 disposal facility that, after the initiation of a disciplinary
12681268 action, has had a medical marijuana license revoked, not renewe d, or
12691269 surrendered during the five (5) years preceding submission of the
12701270 application and for the following violations:
12711271 a. unlawful sales or purchases,
12721272 b. any fraudulent acts, fals ification of records or
12731273 misrepresentation to the Authority, medical marijuana
12741274 patient licensees, caregiver licensees or medical
12751275 marijuana business licensees,
12761276 c. any grossly inaccurate or fraudulent reporting,
12771277 d. threatening or harming any medical marijuana patient,
12781278 caregiver, medical practitioner or employee of the
12791279 Authority,
12801280 e. knowingly or intentionally refusing to permit the
12811281 Authority access to premises or records,

13331333 f. using a prohibited, hazardous substance for processing
13341334 in a residential area,
13351335 g. criminal acts relating to the operation of a medical
13361336 marijuana business, or
13371337 h. any violations that endanger public health and safety
13381338 or product safety.
13391339 I. In investigating the qualifications of an applicant or a
13401340 licensee, the Authority and municipalities may ha ve access to
13411341 criminal history record information furnished by a criminal justi ce
13421342 agency subject to any restrictions imposed by such an agency.
13431343 J. The failure of an applicant or licensee to provide the
13441344 requested information by the Authority deadline may be grounds for
13451345 denial of the application.
13461346 K. All applicants and licensees shall submit information to the
13471347 Authority in a full, faithful, truthful and fair manner. The
13481348 Authority may recommend denial of an application where the applicant
13491349 or licensee made mis statements, omissions, misrepresentations or
13501350 untruths in the application or in connection with the background
13511351 investigation of the applicant. This type of conduct may be grounds
13521352 for administrative action against the applicant or licensee. Typos
13531353 and scrivener errors shall not be grounds for denial.
13541354 L. A licensed medical marijuana business premises shall be
13551355 subject to and responsible for compliance with applicable provisions
13561356 consistent with the zoning where such business is located as

14121412 M. All medical marijuana business, medical marij uana research
14131413 facility, medical marijuana education facility and medical marijuana
14141414 waste disposal facility licensees shall pay the relevant licensure
14151415 fees prior to receiving licensure to operate.
14161416 N. A medical marijuana business, medical marijuana research
14171417 facility, medical marijuana education facility or medical marijuana
14181418 waste disposal facility that attempts to renew its license after the
14191419 expiration date of the license shall pay a late renewal fee of Five
14201420 Hundred Dollars ($500.00) per week that the licens e is expired.
14211421 Late renewal fees are nonrefundable. A license that has been
14221422 expired for more than sixty (60) calendar days shall not be renewed.
14231423 Only license renewal applications submitted at least sixty (60)
14241424 calendar days prior to the expiration date sh all be considered
14251425 timely submitted and subject to the provisions of subsection F of
14261426 this section. A medical marijuana business license shall remain
14271427 unexpired during the pendency of the application for renewal
14281428 provided that such application was timely subm itted. The Authority
14291429 shall allow renewal applications to be submitted at least one
14301430 hundred twenty (120) calendar days prior to the expiration date of a
14311431 medical marijuana business license.

14831483 O. Except as provided by this section, immediately upon
14841484 expiration of a license, any medical marijuana business, medical
14851485 marijuana research faci lity, medical marijuana education facility,
14861486 or medical marijuana waste disposal facility shall cease all
14871487 possession, transfer, or sale of medical marijuana or medical
14881488 marijuana products. Any continued possession, sale, or transfer
14891489 shall subject the business owners and operators to felony
14901490 prosecution pursuant to the Uniform Controlled Dangerous Substances
14911491 Act.
14921492 P. A medical marijuana business license holder shall require
14931493 all individuals employed under his or her license to be issued a
14941494 credential pursuant to the provisions of Section 427.14b of this
14951495 title prior to employment.
14961496 Q. An original medical marijuana business license issued on or
14971497 after June 26, 2018, by the Authority, for a medical marijuana
14981498 commercial grower, a medical marijuana processor or a medical
14991499 marijuana dispensary shall be deemed to have been grandfathered into
15001500 the location on the date the original license was first issued for
15011501 purposes of determining the authority o f the business to conduct and
15021502 continue the same type of business at that locat ion under a license
15031503 issued by the Authority, except as may be provided in Sections 425
15041504 and 426.1 of this title. Any change in ownership after the original
15051505 medical marijuana busi ness license has been issued by the Authority
15061506 shall be construed by the Authority to be a continuation of the same

15631563 municipal compliance provisions of Section 426.1 of this title.
15641564 R. A medical marijuana business license holder shall require
15651565 all individuals employed under their license to be issued a
15661566 credential pursuant to the provisions of Section 427.14b of this
15671567 title prior to employment.
15681568 S. The Executive Director of the Authority may p romulgate rules
15691569 to implement the provisions of this section including, but not
15701570 limited to, required application materials to be submitted by the
15711571 applicant and utilized by the Authority to determine medical
15721572 marijuana business licensing fees pursuant to this section.
15731573 SECTION 2. This act shall become effective November 1, 2025.
