4851 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4952 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1054, is
5053 amended to read as follows:
5154 Section 1054. The f ollowing terms, wherever used or referred to
5255 in this act the Oklahoma Housing Authorities Act , shall have the
5356 following respective meanings, unless a different meaning clearly
5457 appears from the context:
5558 (a) 1. “Authority” means any public body corporate an d politic
5659 created by this act. the Oklahoma Housing Authorities Act;
5760 (b) 2. “City” means any incorporated city or town in the
5861 state.;
5962 3. “County” means any county in the state .;
60-(c) 4. “Governing body” means, in the case of a city, the
61-council or other governing body of the city in which is vested

90+(c) 4. “Governing body” means, in the case of a city, the
91+council or other governing body of the city in which is vested
8892 legislative authority customarily imposed on the city council, and,
8993 in the case of a county, the board of county commissioners .;
9094 (d) 5. “Mayor” means the mayor of the city or the officer
9195 thereof charged with t he duties customarily imposed on the mayor or
9296 executive head of a cit y.;
9397 (e) 6. “Clerk” means the city clerk or the county clerk, as the
9498 case may be.;
9599 (f) 7. “Area of operation” means:
96100 (1) a. in the case of an authority of a city, the city and
97101 the area within one (1) mile of the territorial
98102 boundaries thereof, except that the area of operation
99103 of an authority of any city shall not include any area
100104 which lies within the territorial boundaries of some
101105 other city;,
102106 (2) b. in the case of an authority of a cou nty, all of the
103107 county for which it is created :. Provided, that a
104108 county authority shall not undertake any project
105109 within the boundaries of any city unless a resolution
106110 shall have been adopted by the governing body of the
107111 city and by any authority which s hall have been
108112 theretofore established and authorized to exercise its
109113 powers in the city declaring that there is need for
110-the county authority to exercise its powers within
111-that city. No authority shall operate in any area in

141+the county authority to exercise its powers within
142+that city. No authority shall operate in any area in
138143 which an authority already es tablished is operating
139144 without the consent by resolution of the autho rity
140145 already operating therein ., and
141146 c. in the case of an authority of a city or of a county
142147 and only for the purpose of constructi on or
143148 rehabilitation projects, beginning on the effectiv e
144149 date of this act, anywhere within this state;
145150 provided, such city or county housing authority has
146151 consulted with the city, county or counties, and all
147152 other active and duly certified city and county
148153 housing authorities, if any, where the project or
149154 projects are located;
150155 (g) 8. “Federal government” includes means the United States of
151156 America, the Public Housing Administration United States Department
152157 of Housing and Urban Development , or any other agency or
153158 instrumentality, corporate or otherwise, of the U nited States of
154159 America.;
155160 (h) 9. “Slum” means any area where dwellings predominate which
156161 by reason of dilapidation ,; overcrowding,; faulty arrangement or
157162 design,; lack of ventilation, light, or sanitary facilities ,; or any
158163 combination of these factors, ar e detrimental to safety, health , and
159164 morals.;
160-(i) 10. “Housing project” or “project” means any work or
161-undertaking on contiguous or noncontiguous sites:

192+(i) 10. “Housing project” or “project” means any work or
193+undertaking on contiguous or noncontiguous sites:
188194 (1) a. to demolish, clear, or remove buildings from any
189195 slum area;,
190196 (2) b. to provide or assist in pro viding (by any suitable
191197 method, including, but not limited to: rental; sale
192198 of individual units in single or multifamily
193199 structures under a conventional, condominium, or
194200 cooperative sales contract; lease -purchase agreement;
195201 loans; or subsidizing of rental s or charges for
196202 housing projects located within the territorial
197203 boundaries of the authority of a city or county but
198204 excluding the expanded area of operation as defined in
199205 subparagraph c of paragraph 7 of this section ) decent,
200206 safe, and sanitary urban or r ural dwellings,
201207 apartments, or other living accommodations for persons
202208 of low income;, or
203209 (3) c. to accomplish a combination of the foregoing
204210 subparagraphs a and b of this paragraph . Such work or
205211 undertaking may include buildings, land, equipment,
206212 facilities, and other real or personal property for
207213 necessary, convenient , or desirable appurtenances;
208214 streets, sewers, water service, utilities, parks, site
209215 preparation, and landscaping; and facilities for
210-administrative, community, health, recreational,
211-welfare, or other purposes. The term “housing

243+administrative, community, health, recreational,
244+welfare, or other purposes. The term “housing
238245 project” housing project or “project” project also may
239246 be applied to the planning of the buildings and
240247 improvements, the acquisition of property or any
241248 interest therein, the demolition of existing
242249 structures, the construction, reconstruction,
243250 rehabilitation, alteration , or repair of the
244251 improvements and all other work in connection
245252 therewith; and the term shall include all other real
246253 and personal property and all tangible or intangible
247254 assets held or used in connectio n with the housing
248255 project.;
249256 (j) 11. “Persons of low income ” shall mean means persons or
250257 families who lack the amount of income which is necessary (as
251258 determined by the authority undertaking the housing project) to
252259 enable them, without financial assistanc e, to live in decent, safe ,
253260 and sanitary dwellings, without overcrowd ing,; however, the local
254261 housing authority shall not exceed the guidelines in establishing
255262 incomes set forth by the United States Department of Housing and
256263 Urban Development.;
257264 (k) 12. “Bonds” means any bonds, notes, interim certificates,
258265 debentures, or other obligations issued by an authority pursuant to
259266 this act. the Oklahoma Housing Authorities Act;
260-(l) 13. “Real property” includes means all lands, including
261-improvements and fixtures thereon, and property of any nature

294+(l) 13. “Real property” includes means all lands, including
295+improvements and fixtures t hereon, and property of any nature
288296 appurtenant thereto, or used in co nnection therewith, and every
289297 estate, interest, and right, legal or equitable , therein including
290298 terms for years.;
291299 (m) 14. “Obligee of an authority ” or “obligee” includes means
292300 any bondholder, agent or trustee for any bondholder, or lessor
293301 demising to the authority property used in connection with a
294302 project, or any assignee or assignees of such lessor ’s interest or
295303 any part thereof, and the federal government when it is a party to
296304 any contract with the authority .;
297305 (n) 15. “Persons engaged in national defe nse activities” means
298306 persons in the Armed Forces of the United States ;, employees of the
299307 Department of Defense ;, and workers engaged or to be engaged in
300308 activities connected with nationa l defense. The term also includes
301309 the families of the persons, employees, and workers who reside with
302310 them.;
303311 (o) 16. “Major disaster” means any flood, drought, fire,
304312 hurricane, tornado, earthquake, storm, or other catastrophe which,
305313 in the determination of the governing body, is of sufficient
306314 severity and magnitude to war rant the use of available resources of
307315 the federal, state, and local governments to alleviate the damage,
308316 hardship, or suffering caused thereby .; and
309-(p) 17. “State public body” means any city, county, municipal
310-corporation, commission, district, authority, agency, subdivision,
311-or public body of the state.

344+(p) 17. “State public body” means any city, county, municipal
