49 | 52 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 1054, is |
---|
50 | 53 | | amended to read as follows: |

51 | 54 | | Section 1054. The f ollowing terms, wherever used or referred to |
---|
52 | 55 | | in this act the Oklahoma Housing Authorities Act , shall have the |
---|
53 | 56 | | following respective meanings, unless a different meaning clearly |
---|
54 | 57 | | appears from the context: |
---|
55 | 58 | | (a) 1. “Authority” means any public body corporate an d politic |
---|
56 | 59 | | created by this act. the Oklahoma Housing Authorities Act; |
---|
57 | 60 | | (b) 2. “City” means any incorporated city or town in the |
---|
58 | 61 | | state.; |
---|
59 | 62 | | 3. “County” means any county in the state .; |
---|
88 | 92 | | legislative authority customarily imposed on the city council, and, |
---|
89 | 93 | | in the case of a county, the board of county commissioners .; |
---|
90 | 94 | | (d) 5. “Mayor” means the mayor of the city or the officer |
---|
91 | 95 | | thereof charged with t he duties customarily imposed on the mayor or |
---|
92 | 96 | | executive head of a cit y.; |
---|
93 | 97 | | (e) 6. “Clerk” means the city clerk or the county clerk, as the |
---|
94 | 98 | | case may be.; |
---|
95 | 99 | | (f) 7. “Area of operation” means: |
---|
96 | 100 | | (1) a. in the case of an authority of a city, the city and |
---|
97 | 101 | | the area within one (1) mile of the territorial |
---|
98 | 102 | | boundaries thereof, except that the area of operation |
---|
99 | 103 | | of an authority of any city shall not include any area |
---|
100 | 104 | | which lies within the territorial boundaries of some |
---|
101 | 105 | | other city;, |
---|
102 | 106 | | (2) b. in the case of an authority of a cou nty, all of the |
---|
103 | 107 | | county for which it is created :. Provided, that a |
---|
104 | 108 | | county authority shall not undertake any project |
---|
105 | 109 | | within the boundaries of any city unless a resolution |
---|
106 | 110 | | shall have been adopted by the governing body of the |
---|
107 | 111 | | city and by any authority which s hall have been |
---|
108 | 112 | | theretofore established and authorized to exercise its |
---|
109 | 113 | | powers in the city declaring that there is need for |
---|
138 | 143 | | which an authority already es tablished is operating |
---|
139 | 144 | | without the consent by resolution of the autho rity |
---|
140 | 145 | | already operating therein ., and |
---|
141 | 146 | | c. in the case of an authority of a city or of a county |
---|
142 | 147 | | and only for the purpose of constructi on or |
---|
143 | 148 | | rehabilitation projects, beginning on the effectiv e |
---|
144 | 149 | | date of this act, anywhere within this state; |
---|
145 | 150 | | provided, such city or county housing authority has |
---|
146 | 151 | | consulted with the city, county or counties, and all |
---|
147 | 152 | | other active and duly certified city and county |
---|
148 | 153 | | housing authorities, if any, where the project or |
---|
149 | 154 | | projects are located; |
---|
150 | 155 | | (g) 8. “Federal government” includes means the United States of |
---|
151 | 156 | | America, the Public Housing Administration United States Department |
---|
152 | 157 | | of Housing and Urban Development , or any other agency or |
---|
153 | 158 | | instrumentality, corporate or otherwise, of the U nited States of |
---|
154 | 159 | | America.; |
---|
155 | 160 | | (h) 9. “Slum” means any area where dwellings predominate which |
---|
156 | 161 | | by reason of dilapidation ,; overcrowding,; faulty arrangement or |
---|
157 | 162 | | design,; lack of ventilation, light, or sanitary facilities ,; or any |
---|
158 | 163 | | combination of these factors, ar e detrimental to safety, health , and |
---|
159 | 164 | | morals.; |
---|
188 | 194 | | (1) a. to demolish, clear, or remove buildings from any |
---|
189 | 195 | | slum area;, |
---|
190 | 196 | | (2) b. to provide or assist in pro viding (by any suitable |
---|
191 | 197 | | method, including, but not limited to: rental; sale |
---|
192 | 198 | | of individual units in single or multifamily |
---|
193 | 199 | | structures under a conventional, condominium, or |
---|
194 | 200 | | cooperative sales contract; lease -purchase agreement; |
---|
195 | 201 | | loans; or subsidizing of rental s or charges for |
---|
196 | 202 | | housing projects located within the territorial |
---|
197 | 203 | | boundaries of the authority of a city or county but |
---|
198 | 204 | | excluding the expanded area of operation as defined in |
---|
199 | 205 | | subparagraph c of paragraph 7 of this section ) decent, |
---|
200 | 206 | | safe, and sanitary urban or r ural dwellings, |
---|
201 | 207 | | apartments, or other living accommodations for persons |
---|
202 | 208 | | of low income;, or |
---|
203 | 209 | | (3) c. to accomplish a combination of the foregoing |
---|
204 | 210 | | subparagraphs a and b of this paragraph . Such work or |
---|
205 | 211 | | undertaking may include buildings, land, equipment, |
---|
206 | 212 | | facilities, and other real or personal property for |
---|
207 | 213 | | necessary, convenient , or desirable appurtenances; |
---|
208 | 214 | | streets, sewers, water service, utilities, parks, site |
---|
209 | 215 | | preparation, and landscaping; and facilities for |
---|
238 | 245 | | project” housing project or “project” project also may |
---|
239 | 246 | | be applied to the planning of the buildings and |
---|
240 | 247 | | improvements, the acquisition of property or any |
---|
241 | 248 | | interest therein, the demolition of existing |
---|
242 | 249 | | structures, the construction, reconstruction, |
---|
243 | 250 | | rehabilitation, alteration , or repair of the |
---|
244 | 251 | | improvements and all other work in connection |
---|
245 | 252 | | therewith; and the term shall include all other real |
---|
246 | 253 | | and personal property and all tangible or intangible |
---|
247 | 254 | | assets held or used in connectio n with the housing |
---|
248 | 255 | | project.; |
---|
249 | 256 | | (j) 11. “Persons of low income ” shall mean means persons or |
---|
250 | 257 | | families who lack the amount of income which is necessary (as |
---|
251 | 258 | | determined by the authority undertaking the housing project) to |
---|
252 | 259 | | enable them, without financial assistanc e, to live in decent, safe , |
---|
253 | 260 | | and sanitary dwellings, without overcrowd ing,; however, the local |
---|
254 | 261 | | housing authority shall not exceed the guidelines in establishing |
---|
255 | 262 | | incomes set forth by the United States Department of Housing and |
---|
256 | 263 | | Urban Development.; |
---|
257 | 264 | | (k) 12. “Bonds” means any bonds, notes, interim certificates, |
---|
258 | 265 | | debentures, or other obligations issued by an authority pursuant to |
---|
259 | 266 | | this act. the Oklahoma Housing Authorities Act; |
---|
288 | 296 | | appurtenant thereto, or used in co nnection therewith, and every |
---|
289 | 297 | | estate, interest, and right, legal or equitable , therein including |
---|
290 | 298 | | terms for years.; |
---|
291 | 299 | | (m) 14. “Obligee of an authority ” or “obligee” includes means |
---|
292 | 300 | | any bondholder, agent or trustee for any bondholder, or lessor |
---|
293 | 301 | | demising to the authority property used in connection with a |
---|
294 | 302 | | project, or any assignee or assignees of such lessor ’s interest or |
---|
295 | 303 | | any part thereof, and the federal government when it is a party to |
---|
296 | 304 | | any contract with the authority .; |
---|
297 | 305 | | (n) 15. “Persons engaged in national defe nse activities” means |
---|
298 | 306 | | persons in the Armed Forces of the United States ;, employees of the |
---|
299 | 307 | | Department of Defense ;, and workers engaged or to be engaged in |
---|
300 | 308 | | activities connected with nationa l defense. The term also includes |
---|
301 | 309 | | the families of the persons, employees, and workers who reside with |
---|
302 | 310 | | them.; |
---|
303 | 311 | | (o) 16. “Major disaster” means any flood, drought, fire, |
---|
304 | 312 | | hurricane, tornado, earthquake, storm, or other catastrophe which, |
---|
305 | 313 | | in the determination of the governing body, is of sufficient |
---|
306 | 314 | | severity and magnitude to war rant the use of available resources of |
---|
307 | 315 | | the federal, state, and local governments to alleviate the damage, |
---|
308 | 316 | | hardship, or suffering caused thereby .; and |
---|
