42	43		An Act relating to eminent domain; amending 27 O.S.
43	44		2021, Section 7, which relates to eminent domain for
44	45		light, heat, or power by electricity or gas;
45	46		clarifying applicability of provisions to certain
46	47		entities; prohibiting use of eminent domain for
47	48		certain facilities; requiring authorization by
48	49		Corporation Commission for exercise of eminent domain
49	50		by certain entities for spe cified purpose; and

56	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	58		SECTION 1. AMENDATORY 27 O.S. 2021, Section 7, is
58	59		amended to read as follows:
59	60		Section 7. A. Except as otherwise provided in t his section,
60	61		any person, firm, or corporation organized under the laws of this
61	62		state, or authorized to do business in this state , to furnish light,
62	63		heat, or power by electricity or natural gas, or any other person,
63	64		association, or firm engaged in furnishin g lights, heat, or power by
64	65		electricity or natural gas shall have and exercise the right of

91	93		eminent domain in the same manner and by like proceedings as
92	94		provided for railroad corporations by laws of this state.
93	95		B. The power of eminent domain shall not be used for the siting
94	96		or building of wind turbines energy facilities, solar energy
95	97		facilities, battery storage facilities, or hydrogen gas facilities
96	98		on private property.
97	99		C. Prior to seeking to exercise the right of eminent domain for
98	100		an electric transmissi on facility rated greater than three hundre d
99	101		(300) kilovolts, any person, firm, or corporation subject to the
100	102		requirements of subsection A of this section shall have obtained a
101	103		certificate of authority from the Corporation Commission.
102	104		SECTION 2. It being immediately necessary for the preservation
103	105		of the public peace, health or safety, an emergency is hereby
104	106		declared to exist, by reason whereof this act shall take effect and
105	107		be in full force from and after its passage and approval.
