4243 An Act relating to eminent domain; amending 27 O.S.
4344 2021, Section 7, which relates to eminent domain for
4445 light, heat, or power by electricity or gas;
4546 clarifying applicability of provisions to certain
4647 entities; prohibiting use of eminent domain for
4748 certain facilities; requiring authorization by
4849 Corporation Commission for exercise of eminent domain

5657 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5758 SECTION 1. AMENDATORY 27 O.S. 2021, Section 7, is
5859 amended to read as follows:
5960 Section 7. A. Except as otherwise provided in t his section,
6061 any person, firm, or corporation organized under the laws of this
6162 state, or authorized to do business in this state , to furnish light,
6263 heat, or power by electricity or natural gas, or any other person,
6364 association, or firm engaged in furnishin g lights, heat, or power by
6465 electricity or natural gas shall have and exercise the right of

9193 eminent domain in the same manner and by like proceedings as
9294 provided for railroad corporations by laws of this state.
9395 B. The power of eminent domain shall not be used for the siting
9496 or building of wind turbines energy facilities, solar energy
9597 facilities, battery storage facilities, or hydrogen gas facilities
9698 on private property.
9799 C. Prior to seeking to exercise the right of eminent domain for
98100 an electric transmissi on facility rated greater than three hundre d
99101 (300) kilovolts, any person, firm, or corporation subject to the
100102 requirements of subsection A of this section shall have obtained a
101103 certificate of authority from the Corporation Commission.
102104 SECTION 2. It being immediately necessary for the preservation
103105 of the public peace, health or safety, an emergency is hereby
104106 declared to exist, by reason whereof this act shall take effect and
105107 be in full force from and after its passage and approval.
