6565 An Act relating to indigenous or traditional healing

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 732 of Title 59, unless there is
8080 created a duplication in numbering, reads as follows:
8181 A. As used in this section:
8282 1. “Culture” means a way of life of a group of people
8383 including, but not limited to, the behaviors, beliefs, values,
8484 customs, traditional practices, art, music, rituals, or ceremonies
8585 specific to a people;
8686 2. “Indigenous or traditional healing therapy ” means any
8787 healing art, practice, ritual, ceremony, or modality that has been

139139 historically performed or ut ilized by indigenous or native peoples
140140 or traditional healing practitioners; and
141141 3. “Traditional healing practitioner ” means any individual with
142142 a distinct culture, practice, be lief, or healing system that is
143143 practiced or performed to support wellness.
144144 B. The Legislature intends, by its enactment of this section,
145145 to protect and preserve by this state, unfettered public access to
146146 all indigenous or traditional healing therapies an d to protect and
147147 preserve the right to practice and provide services according to
148148 this section.
149149 C. Notwithstanding any other state law or rule, a traditional
150150 healing practitioner who does not hold a license, permit,
151151 certification, or registration as a hea lth care professional issued
152152 by this state shall not be in violation of any health care
153153 professional practice act or other law or rule if that individual or
154154 agent provides care or treatment in compliance with subsection D of
155155 this section and does not false ly represent himself or herself as a
156156 licensed practitioner of medicine or othe r health care professional
157157 as described in Title 59 of the Oklahoma Statutes, or fraudulently
158158 use any title or degree appertaining to the licensed practice
159159 thereof, or falsely cl aim any training, certification, or approval
160160 of any organization that he or she does not have.
161161 D. A traditional healing practitioner shall not:
162162 1. Perform surgery, or any intravenous medical procedure;

214214 2. Set fractures;
215215 3. Prescribe or administer x -ray or gamma ray radiation, or any
216216 other radiation field not inherent to the huma n body;
217217 4. Prescribe or administer a prescription drug or device, or
218218 any controlled substance;
219219 5. Recommend interruption or elimination of prescribed
220220 medications or treatments;
221221 6. Conventionally diagnose a medical disease;
222222 7. Move joints beyond their normal range of motion; or
223223 8. State, advertise, or otherwise falsely represent to any
224224 individual that the person is licensed by, certified by, or
225225 registered with this state to pr actice as a health care
226226 professional.
227227 E. Any person who fails to comply with this section may, as
228228 provided by law, be subject to administrative action by the
229229 appropriate licensing board, criminal prosecution, civil liability,
230230 or any other remedies provide d by law.
231231 SECTION 2. This act shall become effective November 1, 2025.
