57	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	51		SECTION 1. AMENDATORY 63 O.S. 2021, Section 4002, as
59	52		amended by Section 199, Chapter 282, O.S.L. 2022 (63 O.S. Supp.
60	53		2024, Section 4002), is amended to read as follows:
61	54		Section 4002. As used in the Oklahoma Vessel and Motor
62	55		Registration Act:
63	56		1. “Boat livery” means a business establishment engaged in
64	57		renting or hiring out vessels for profit;
65	58		2. “Canoe” means a light narrow vessel with both ends typically
66	59		tapered to a sharp point which is propelled solely by its occupants,
	60	+	using a single-bladed paddle as a lever without the aid of a fulcrum
	61	+	provided by oarlocks, thole pins, crutches , or similar arrangements;

96	88		3. “Certificate of documentation ” means a document issued by
97	89		the United States Coast Guard which is legal proof of ownership of a
98	90		vessel;
99	91		4. “Certificate of registrati on” means a document which is
100	92		legal proof of registration of a vessel or motor;
101	93		5. “Certificate of title ” means a document which is proof of
102	94		legal ownership of a vessel and/or or motor;
103	95		6. “Service Oklahoma” means:
104	96		a. Service Oklahoma, or
105	97		b. the equivalent vessel registration and licensing
106	98		agency of a federally recognized Indian tribe in this
107	99		state;
108	100		7. “Dealer” means any person engaged in the business of
109	101		selling, trading, renting with option to purchase, or attempting to
110	102		negotiate or negotiating sales or exchanges of interests in new or
111	103		used vessels or motors, or new and used vessels or motors, or any
112	104		combination thereof;
113	105		8. “Dealer agreement” means the agreement, authorization , or
114	106		written contract between a manufacturer and distributor and a new
115	107		vessel dealer which purports to establish the legal rights and
116	108		obligations of the parties to the agreement, authorization , or
	109	+	written contract with regard to the purchase and sale of new vessels
	110	+	or new motors;

144		-	written contract with regard to the purchase and sale of new vessels
145		-	or new motors;
146	137		9. “Designated successor ” means one or more persons nominated
147	138		by the new vessel dealer, in a written document filed by the dealer
148	139		with the manufacturer or distributor at the time the dealer
149	140		agreement is executed, to succeed the dealer in the event of the
150	141		dealer’s death or incapacity. If a designated succes sor is not able
151	142		to succeed the new vessel dealer because of the designated
152	143		successor’s death or legal incapacity, the dealer shall execute a
153	144		new document nominating a designated successor within sixty (60)
154	145		calendar days after the date of the death or incap acity;
155	146		10. “Distributor” means a person, resident or nonresident, who
156	147		in whole or in part offers for sale, sells, or distributes a new
157	148		vessel or new motor to a new vessel dealer or who maintains a
158	149		factory representative, resident or nonresident, or who co ntrols a
159	150		person, resident or nonresident, who in whole or in part offers for
160	151		sale, sells, or distributes a new vessel or new motor to a new
161	152		vessel dealer;
162	153		11. “Distributor branch” means a branch office similarly
163	154		maintained by a distributor or wholesaler f or the same purposes a
164	155		factory branch is maintained;
165	156		12. “Distributor representative ” means any person, firm,
166	157		association, corporation , or trust and each officer and employee
167	158		thereof engaged as a representative of a distributor or distributor

	160	+	the sale of his or, her, its, or their vessels or motors, or for

195		-	branch of vessels or motors, for the purpose of making or promoting
196		-	the sale of his or, her, its, or their vessels or motors, or for
197	187		supervising or contacting his , her, its, or their dealers or
198	188		prospective dealers;
199	189		13. “Documented vessel” means any vessel in this sta te which
200	190		shall have and carry on board the original certificate of
201	191		documentation in legible form as issued by the United States Coast
202	192		Guard or federal agency successor thereto. All documented vessels
203	193		shall be required to display a current State of Oklahom a annual
204	194		registration decal;
205	195		14. “Factory branch” means a branch office maintained by a
206	196		person, firm, association, corporation , or trust who manufactures or
207	197		assembles vessels or motors for the sale of vessels or motors to
208	198		distributors, or for the sale of vessels or motors to dealers, or
209	199		for directing or supervising, in whole or in part, its
210	200		representatives;
211	201		15. “Factory representative ” means any person, firm,
212	202		association, corporation , or trust and each officer and employee
213	203		thereof engaged as a representat ive of a manufacturer of vessels or
214	204		motors or by a factory branch, for the purpose of making or
215	205		promoting the sale of his, her, its , or their vessels or motors, or
216	206		for supervising or contacting his, her, its, or their dealers or
217	207		prospective dealers;
	208	+	16. “Hull identification number ” means the serial number
	209	+	affixed to the outside of the hull of a vessel on the upper

245		-	16. “Hull identification number ” means the serial number
246		-	affixed to the outside of the hull of a vessel on the upper
247	236		starboard side (right) corner of the tra nsom (back wall) which is
248	237		assigned by the manufacturer or Service Oklahoma;
249	238		17. “Inboard motor” means an internal combustion engine mounted
250	239		inside a vessel which provides the transfer of power to move a
251	240		vessel through the water;
252	241		18. “Inboard/outboard motor ” means an internal combustion
253	242		engine mounted inside a vessel and an external stern drive attached
254	243		through the transom of the vessel providing the transfer of power to
255	244		move the vessel through the water;
256	245		19. “John boat” “Johnboat” means a narrow, flat -bottomed
257	246		square-ended vessel propelled by a pole, paddle , or a motor of less
258	247		than ten (10) horsepower;
259	248		20. “Kayak” means a light, narrow vessel with both ends
260	249		typically tapered to a sharp point and propelled by double-bladed
261	250		paddles as a lever without the aid of a fulcrum provided by
262	251		oarlocks, thole pins, crutches or similar arrangements by human
263	252		muscular effort by one or more individuals seated inside or on top
264	253		of the vessel and facing the direction of travel using double-bladed
265	254		paddles, hand cranks, or pedals;
266	255		21. “Kiteboard” means a vessel, similar in appearance to a
267	256		surfboard, with or without foot straps or bindings, combined with a
	257	+	large controllable kite to propel the rider and board across the
	258	+	water;

297	285		22. “Lifeboat” means a vessel carried on another vessel in
298	286		excess of sixty-five (65) feet for use if such other vessel has to
299	287		be abandoned;
300	288		23. “Manufacturer” means a person who manufactures or assembles
301	289		new vessels or new motors, or a distributor, factory branch, or
302	290		factory representative;
303	291		24. “Motor” means any internal combustion engine mounted at the
304	292		stern of a vessel or placed inside a vessel which pr ovides the
305	293		transfer of power to move the vessel through the water;
306	294		25. “New vessel dealer” means a person who holds a dealer
307	295		agreement granted by a manufacturer or distributor for the sale of
308	296		the manufacturer’s or distributor’s vessels or motors, who is
309	297		engaged in the business of purchasing, selling, exchanging, or
310	298		dealing in new vessels or new motors, and who has an established
311	299		place of business;
312	300		26. “Operate” means to navigate or be in actual physical
313	301		control of a vessel or otherwise use a vessel or mot or;
314	302		27. “Outboard motor” means an internal combustion engine
315	303		capable of being externally mounted at the stern of a vessel which
316	304		provides the transfer of power to move a vessel through the water;
317	305		28. “Owner” means a person, other than a lienholder, having a
318	306		property interest in or title to a vessel or motor. The term
	307	+	includes a person entitled to the use or possession of a vessel or
	308	+	motor subject to an interest in another person, reserved or created

346		-	includes a person entitled to the use or possession of a vessel or
347		-	motor subject to an interest in another person, reserved or created
348	335		by agreement and securing payment or performance of an o bligation,
349	336		but the term excludes a lessee under a lease not intended as
350	337		security;
351	338		29. “Paddleboard” means a vessel, similar in appearance to a
352	339		surfboard, intended to be propelled only by its occupants using a
353	340		single- or double-bladed paddle as a lever wit hout the aid of a
354	341		fulcrum provided by oarlocks, thole pins, crutches , or similar
355	342		arrangements;
356	343		30. “Paddleboat” means a vessel less than eight (8) feet in
357	344		length designed to be propelled solely by human power through a
358	345		belt, chain, or gears;
359	346		31. “Permanent number” means the distinctive and unique number
360	347		which:
361	348		a. Service Oklahoma permanently assigns to a vessel,
362	349		irrespective of any change of ownership of said the
363	350		vessel. The permanent number shall begin with the
364	351		letters “OK”, followed by four numerals, a nd then
365	352		followed by two letters, or
366	353		b. any federally recognized Indian tribe in this state
367	354		assigns to a vessel;
368	355		provided, the number is configured as pr escribed in 33 C.F.R., Parts
369	356		173 and 174;
	357	+	32. “Person” means a natural person, partnership, corporation ,
	358	+	association, trust, estate , or other legal entity;

397		-	32. “Person” means a natural person, partnership, corporation ,
398		-	association, trust, estate , or other legal entity;
399	385		33. “Proposed new vessel dealer ” means a person who has an
400	386		application pending for a new dealer agreement with a manufacturer
401	387		or distributor. Proposed new vessel dealer does not include a
402	388		person whose dealer agreement is being renewed or continued;
403	389		34. “Purchase date” means the purchase date on a bill of sale
404	390		or the date of complete assignment of tit le by the current owner;
405	391		35. “Sailboard” means a vessel, similar in appearance to a
406	392		surfboard, equipped with a swivel-mounted mast and sail not secured
407	393		to a hull by guys or stays;
408	394		36. “State” means the State of Oklahoma;
409	395		37. “State of principal use ” means the state where the vessel
410	396		or motor is used, is to be used, or remains for any period in excess
411	397		of sixty (60) calendar days;
412	398		38. “Vessel” means every device, other than a seaplane on the
413	399		water, used or capable of being used as a means of transportation on
414	400		water;
415	401		39. “Waters of this state ” means and includes all waters within
416	402		the territorial limits of th is state; provided, such phrase shall
417	403		not mean or include waters which are entirely owned by a private
418	404		person or persons, and to which the public is not permitted access;
419	405		and
	406	+	40. “Water-thrust device” means a device tethered to the water
	407	+	jet mechanism of a vessel in a manner so that the water jet of the

447		-	40. “Water-thrust device” means a device tethered to the water
448		-	jet mechanism of a vessel in a manner so that the water jet of the
449	434		powering vessel provides propulsion for the attached device. Such
450	435		devices shall be considered a compo nent of the powering vessel.
451	436		SECTION 2. This act shall become effective November 1, 202 5.
