265265 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
266266 SECTION 1. NEW LAW A new section of law to be codified
267267 in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
268268 is created a duplication in numbering, reads as follows:
269269 A. This act shall be known and may be cited as the “Research
270270 and Education Protection Act of 2025 ”. The purpose of the act is to
271271 protect research and educational system operations in this state
272272 from malicious influence from foreign countries of concern.
273273 B. As used in this act:
274274 1. “Affiliate organization ” means any entity under the control
275275 of or established for the benefit of an organization required to
276276 report pursuant to this section including a direct -support
277277 organization;
278278 2. “Agreement” means a written or spoken statement of mutual
279279 interest in cultural exchange or academic or research collaboration;
280280 3. “Allied countries” means:

333333 defense treaties including the North Atlantic Treaty,
334334 the Agreement between the United States and Australia
335335 and New Zealand, the Philippine Treaty, the Southeast
336336 Asia Treaty, the Japanese Treaty, the Republic of
337337 Korea Treaty, or the Rio Treaty,
338338 b. any nation currently designated as a Major Non -North
339339 Atlantic Treaty Organization (NATO) Ally by the United
340340 States Department of Stat e, or
341341 c. the Republic of China;
342342 4. “Contract” means any agreement for the acq uisition by
343343 purchase, lease, or barter of property or services for the direct
344344 benefit or use of either of the parties;
345345 5. “Country of concern” means the People’s Republic of China,
346346 the Russian Federation, the Islamic Republic of Iran, the Democratic
347347 People’s Republic of Korea, the State of Qatar, the Republic of
348348 Cuba, the Venezuelan regime of Nicolas Maduro, the Syrian Arab
349349 Republic, or any foreign terrorist organization designat ed by the
350350 United States Secretary of State in accordance with the Immigration
351351 and Naturalization Act, as amended, including any agent of or any
352352 other entity under significant control of such foreign country of
353353 concern or any other entity deemed by the Gove rnor in consultation
354354 with the Oklahoma Office of Homeland Security;

406406 6. “Direct-support organization ” means an organization that is
407407 organized and operated to receive, hold, invest, and administer
408408 property and to make expenditures to or for the benefit of a n
409409 institution of higher education or for the benefit of a research and
410410 development park or research and development authority affiliated
411411 with an institution of higher education;
412412 7. “Foreign government” means the government of any country,
413413 nation, group of nations, or any province or political subdivision
414414 of any country, nation, or group of nations other than the
415415 government of the United States including any agent of such foreign
416416 government;
417417 8. “Foreign source” means:
418418 a. a foreign government or an agency o f a foreign
419419 government,
420420 b. a legal entity, governmental or otherwise, created
421421 solely under the laws of a foreign state or states,
422422 c. an individual who is not a citizen or a national of
423423 the United States or a territory or protectorate of
424424 the United States,
425425 d. a partnership, association, corporation, organization,
426426 or any other combination of persons organized under
427427 the laws of or having its principal place of business
428428 in a country of concern of subsidiary of such entity,

480480 e. an agent including a subsidiary or an affiliate of a
481481 foreign legal entity acting on behalf of a foreign
482482 source,
483483 f. a political party or a member of a political party.
484484 For the purposes of this subparagraph, the term
485485 “political party” means an organization or combination
486486 of individuals whose aim or purpose is, or who is
487487 engaged in any activity devoted in whole or in part
488488 to, the establishment, administration, control, or
489489 acquisition of administration or control of a
490490 government of a country of concern or a subdivision
491491 thereof or the furtheranc e or influencing of the
492492 political or public interest, policies, or relations
493493 of a government of a country of concern or subdivision
494494 thereof, or
495495 g. a program operated for the benefit of a government or
496496 political party of a country of concern including, but
497497 not limited to, the Thousand Talents Program, any
498498 program affiliated with United Front operations, or
499499 any program affiliated with a country of concern ’s
500500 ministry of education;
501501 9. “Gift” means any gift, grant, endowment, award, or donation
502502 of money or property of any kind, or any combination thereof,
503503 including a conditional or uncon ditional pledge of such gift,

555555 endowment, award, or donation. For the purposes of this paragraph,
556556 pledge means a promise, an agreement, or an expressed intention to
557557 give a gift, and grant means a transfer of money for a specified
558558 purpose including a conditional gift;
559559 10. “Institution of higher education ” means an institution of
560560 higher education within The Oklahoma State System of Higher
561561 Education or a private institution of highe r learning located within
562562 this state and accredited pursuant to Section 4103 o f Title 70 of
563563 the Oklahoma Statutes;
564564 11. “Interest” in an entity means any direct or indirect
565565 investment in or loan to an entity valued at five percent (5%) or
566566 more of the entity’s net worth or any form of direct or indirect
567567 control exerting similar or greater influence on the governance of
568568 the entity;
569569 12. “Partnership” means a faculty or student exchange program,
570570 a study abroad program, a matriculation program, a recruiting
571571 program, or a dual degree program; and
572572 13. “Public school” means a public school district, public
573573 charter school, or public statewide virtual charter school.
574574 SECTION 2. NEW LAW A new section of law to be codified
575575 in the Oklahoma Statu tes as Section 24-163 of Title 70, unless there
576576 is created a duplication in numbering, reads as follows:
577577 Upon the effective date of this act, no institution of higher
578578 education or public school shall accept any gift, research funding,

632632 SECTION 3. NEW LAW A new section of law to be codified
633633 in the Oklahoma Statutes as Section 24 -164 of Title 70, unless there
634634 is created a duplication in numbering, reads as follows:
635635 A. 1. Any public school or institution of higher education
636636 that has received directly or indirectly any gift with any value
637637 from any foreign source from a country of concern after December 31,
638638 2013, shall disclose such gifts in the following manner:
639639 a. public schools shall disclose such gifts to the State
640640 Board of Education and the State Department of
641641 Education within sixty (60) days after the effective
642642 date of this act, and
643643 b. institutions of higher educat ion shall disclose such
644644 gifts to the Oklahoma State Regents for Higher
645645 Education within sixty (60) days after the effective
646646 date of this act.
647647 2. Unless otherwise prohibited or deemed confidential under
648648 state or federal law, disclosure required by this sub section shall
649649 include the date the gift was received; the amount of the gift; the
650650 purpose of the gift; the identification of the persons the gift was
651651 explicitly intended to benefit; any applicable conditions,
652652 requirements, restrictions, or terms made part of the gift; the name
653653 and country of residence or domicile of the foreign source; the name

707707 3. Information submitted pursuant to paragraph 1 of this
708708 subsection shall be forwarded to the Office of Management and
709709 Enterprise Services (OMES), which shall maintain a public web portal
710710 to disclose information on past gifts from countries of concern.
711711 4. Upon a request from the Governor, the President Pro Tempore
712712 of the Senate, or the Speaker of the House of Representatives, the
713713 State Auditor and Inspector shall inspect or audit a past gift or
714714 gift agreement.
715715 B. 1. Any public school or institution of higher education
716716 that has been offered directly or indirectly a ny gift with any value
717717 from a foreign source from a country of concern after t he effective
718718 date of this act shall disclose such gift in the following manner:
719719 a. public schools shall disclose such gifts to the State
720720 Board of Education and the State Departme nt of
721721 Education before accepting such gifts, and
722722 b. institutions of higher education shall disclose such
723723 gifts to the Oklahoma State Regents for Higher
724724 Education before accepting such gifts.
725725 2. Unless otherwise prohibited or deemed confidential under
726726 state or federal law, disclosure required by this subsection shall
727727 include the date the gift was offered; the amount of the gift; the
728728 purpose of the gift; the identification of the persons the gift was

781781 requirements, restrictions, or terms made part of the gift; the name
782782 and country of residence or domicile of the foreign source; the name
783783 and mailing address of the disclosing entity; and, as applicable,
784784 the date of termination of the gift.
785785 3. Information submitted pursuant to paragraph 1 of this
786786 subsection shall be forwarded to O MES. Within thirty (30) days of
787787 receiving the disclosure of an offered gift, OMES shall issue a
788788 final decision to the public school or institution of higher
789789 education on whether and under what conditions the public school or
790790 institution of higher education may accept the gift. OMES shall:
791791 a. develop disclosure forms, rules, and procedures for
792792 deciding whether to allow a public school or
793793 institution of higher education to accept gifts from
794794 countries of concern, and
795795 b. maintain a public web portal disclosin g proposed gifts
796796 from countries of concern with the final decision from
797797 OMES on whether to allow the public school or
798798 institution of higher education to accept the gift.
799799 4. For the purposes of this section, a gift received by a
800800 public school or institution of higher education from a foreign
801801 source through an intermediary shall be considered an indirect gift
802802 and shall be subject to the approval process provided for in this
803803 subsection.

863863 entered directly or indirectly into any contract with any value from
864864 any foreign source from a country of co ncern after December 31,
865865 2013, shall disclose such contracts in the following manner:
866866 1. Public schools shall disclose such contracts to the State
867867 Board of Education and the Sta te Department of Education within
868868 sixty (60) days after the effective date of this act; and
869869 2. Institutions of higher education shall disclose such
870870 contracts to the Oklahoma State Regents for Higher Education within
871871 sixty (60) days after the effective dat e of this act.
872872 B. Unless otherwise prohibited or deemed confidential under
873873 state or federal law, disclosure required by subsection A of this
874874 section shall include the date of the contract; the amount of the
875875 contract; the purpose of the contract; the ident ification of the
876876 persons the contract was explicitly intended to benefit; any
877877 applicable conditions, requirements, restrictions, or terms made
878878 part of the contract; a copy of the contract; the name and country

933933 C. For the purposes of this section, a contract entered into
934934 with a foreign source through an intermediary or affiliate
935935 organization shall be considered an indirect contract to the public
936936 school or institution of higher education and shall be subject to
937937 the disclosure process provided for in this section.
938938 D. Information submitted pursuant to subsection A of this
939939 section shall be forwarded to the Office of Management and
940940 Enterprise Services (OMES), which shall mainta in a public web portal
941941 to disclose information on past proposed and entered into contracts
942942 with countries of concern.
943943 E. Upon the request of the Governor, the President Pro Temp ore
944944 of the Senate, or the Speaker of the House of Representatives, the
945945 State Auditor and Inspector shall inspect or audit a past contract.
946946 F. Any public school or institution of higher education that
947947 has been offered or has proposed directly or indirectly any contract
948948 with any value from or with a foreign source from a country of
949949 concern after the effective date of this act shall disclose such
950950 proposed contract in the following manner:
951951 1. Public schools shall disclose such contract to the State
952952 Board of Education and the State Department of Education before
953953 entering into such contract; and

10181018 section shall be forwarded to OMES. Within thirty (30) days of

10201020 shall issue a final decision to the public s chool or institution of
10211021 higher education on whether and under what conditions the public
10221022 school or institution of higher education may enter into the
10231023 contract. OMES shall:

10251025 whether to allow a public school or an institution of higher
10261026 education to enter into a contract with a country of concern; and

10821082 I. For the purposes of this section, a contract proposed from a
10831083 foreign source through an intermediary or affiliate organization
10841084 shall be considered an indirect contra ct with the public school or
10851085 institution of higher education and shall be subj ect to the approval
10861086 process provided for in subsection H of this section.
10871087 J. Upon the request of the Governor, the President Pro Tempore
10881088 of the Senate, or the Speaker of the Hou se of Representatives, the
10891089 State Auditor and Inspector shall inspect or audit a contract
10901090 entered into pursuant to this section.
10911091 SECTION 5. NEW LAW A new section of law to be codified
10921092 in the Oklahoma Statutes as Section 24 -166 of Title 70, unless there
10931093 is created a duplication in numbering, reads as follows:
10941094 A. A public school or institution of higher education that
10951095 knowingly, willfully, or negligently fails to disclose the
10961096 information required by the Research and Education Protectio n Act of
10971097 2025 shall be subject to a civil penalty of one hundred and five
10981098 percent (105%) of the amount of the undisclosed gift or contract,
10991099 payable only from non -state funds. The recovered funds shall be
11001100 deposited into the General Revenue Fund. The State Board of
11011101 Education or the Oklahoma State Regents for Higher Education may
11021102 administratively enforce the penalty provided for in this section as
11031103 an administrative penalty.

11551155 B. In the absence of enforcement by the State Board of
11561156 Education or the State Regent s, the Attorney General or the Office
11571157 of the State Treasurer may bring a civil action to enforce the
11581158 provisions of the Research and Education Protection Act of 202 5. If
11591159 such action is successful, the Attorney General or the Office of the
11601160 State Treasurer shall be entitled to reasonable attorney fees and
11611161 costs.
11621162 C. An employee of a p ublic school or an institution of higher
11631163 education who in good faith reports an undisclosed foreign gift or
11641164 contract to the Attorney General or the Office of the State
11651165 Treasurer shall be immune from employment discipline or civil
11661166 liability. The reporting employee shall be entitled to receive a
11671167 reward in the amount of twenty -five percent (25%) of any penalty
11681168 recovered by the State Board of Education, the State Regents, the
11691169 Attorney General, or the Office of the State Treasurer.
11701170 D. Information reported purs uant to Sections 2 and 3 of this
11711171 act shall not be deemed confidential except as provided for in the
11721172 Oklahoma Open Records Act.
11731173 E. The State Board of Education and the State Rege nts may adopt
11741174 promulgate rules to implement the provisions of this section.

12301230 participate in any cultural exchange agreement with a foreign source
12311231 from a country of concern, or any entity controlled by a country of
12321232 concern, which:
12331233 1. Constrains the freedom of contract of such public school or
12341234 institution of higher education;
12351235 2. Allows the curricula or values of a program in this state to
12361236 be directed, controlled, or influenced by a country of concern; or
12371237 3. Promotes an agenda detrimental to th e safety or security of
12381238 this state, its residents, or the United States.
12391239 B. Prior to the execution of a cultural exchange agreement with
12401240 a foreign source from a country of concern, the substance of the
12411241 agreement shall be shared with:
12421242 1. Federal agencies concerned with protecting national security
12431243 or enforcing trade sanctions, embargoes, or other restrictions under
12441244 federal law. If any federal agency provides information suggesting
12451245 that such an agreement promotes an agenda detrimental to the safety
12461246 or security of this state, the United States, or its residents, the
12471247 public school or institution of higher education may not enter into
12481248 the agreement; and
12491249 2. The Office of Management and Enterprise Services (OMES). If
12501250 OMES provides information suggesting that s uch an agreement promotes
12511251 an agenda detrimental to the safety or security of this state, the

13091309 B of this section to the Oklahom a State Regents for Higher
13101310 Education.
13111311 D. By December 1, 202 6, and each December 1 thereafter, the
13121312 State Regents and the State Board of Education shall each
13131313 electronically submit a report to the Governor, the President Pro
13141314 Tempore of the Senate, and the Sp eaker of the House of
13151315 Representatives relating to partnerships and agreements of
13161316 institutions of higher education and public schools, respectively,
13171317 made with educational institutions or other institutions based in
13181318 countries of concern. The report shall in clude at a minimum the
13191319 following information for the previous fiscal year:
13201320 1. Data reflecting any grant program, agreement, partnership,
13211321 or contract between an institution of higher education and any
13221322 college, university, or entity that is based in or cont rolled by a
13231323 country of concern or between a public school and any private or
13241324 public school that is based in or controlled by a country of

13831383 E. 1. No students’ or scholars’ association affiliated w ith
13841384 any public school or institution of higher education may accept any
13851385 gift or grant from a foreign source in a country of concern or enter
13861386 into any contract or agreement with a foreign source in a country of
13871387 concern. For the purposes of this subsection, member dues or fees
13881388 shall not be considered a gift or grant from a foreign source in a
13891389 country of concern.
13901390 2. A violation of the provisions of paragraph 1 of this
13911391 subsection shall result in the public school or institution of
13921392 higher education ending any affiliation with the students ’ or
13931393 scholars’ association.
13941394 F. Each public schoo l or institution of higher education that
13951395 has established or will establish an exchange program or
13961396 international cultural agreement concerning the Mandarin dialect of
13971397 the Chinese language or culture shall adopt a policy of prioritizing
13981398 partnerships with foreign sources from the Republic of China over
13991399 partnerships with foreign sources from the People ’s Republic of

14631463 research-related support positions; and
14641464 3. Applicants for positions of visiting researcher who are:
14651465 a. citizens of a foreign country and who are not
14661466 permanent residents of the United States, or
14671467 b. citizens and permanent residents of the United States
14681468 who have any affiliation with an institution or
14691469 program or at least one year of prior employment or
14701470 training in a country of concern, with the exception
14711471 of employment or training by an agency of the United
14721472 States government.
14731473 Screening required by this subsection shall be r equired prior to

15281528 B. In addition to satisfying all employment and enrollment
15291529 qualifications imposed by federal law, the governing board of
15301530 regents for each institution of higher education shall:
15311531 1. Require a foreign applicant to submit a compl ete copy of his
15321532 or her passport and most recently submitted Online Nonimmigran t Visa
15331533 Application, DS-160. After extraction and submission of all
15341534 information relevant to the requirements of this section, an
15351535 institution of higher education may destroy or re turn the copy of
15361536 the DS-160;
15371537 2. Require all individuals described in subsection A of this
15381538 section to submit:
15391539 a. a complete resume and curriculum vitae including every
15401540 institution of higher education attended,
15411541 b. all previous employment since the applicant reached
15421542 the age of eighteen,
15431543 c. a list of all published material for which th e
15441544 applicant received credit as an author, a researcher,
15451545 or otherwise to which the applicant contributed
15461546 significant research, writing, or editorial support,
15471547 d. a list of the applicant’s current and pending research
15481548 funding from any source including the source of funds,

16071607 described in subsection A of this section who have been continually
16081608 employed or enrolled in an institution of higher education in the
16091609 United States for twenty (20) years or more to submit employment
16101610 history prior to the most recent twenty (20) years.
16111611 C. The president of each institution of higher education or
16121612 affiliate thereof shall designate a research integrity office to
16131613 review all materials submitted pursuant to subsection B of this
16141614 section and take reasonable steps to verify all attendance,
16151615 employment, publications, and contributions included in the
16161616 submitted materials. Re asonable steps shall include but not be
16171617 limited to searching public databases for research publications,
16181618 presentations, and public conflict of interest records to identify
16191619 any research publication or presentation that may have been omitted
16201620 from the materials submitted pursuant to subsection B of this
16211621 section; contacting all employer s of the most recent ten (10) years
16221622 to verify employment; contacting all institutions of higher
16231623 education attended to verify enrollment and educational progress;

16811681 education or affiliate thereof may also direct the research
16821682 integrity office to approve applicants for hire based on a risk -
16831683 based determination considering the nature of the research and
16841684 background and ongoing affiliations of the applicant.
16851685 D. The provisions of this section shall be completed before an
16861686 institution of higher education or an affiliate thereof interviews
16871687 or offers a position to a n individual described in subsection A of
16881688 this section in any research or rese arch-related support position
16891689 and before granting such individual any access to research data or
16901690 activities or other sensitive data. An individual described in
16911691 subsection A of this section may not be employed in any research or
16921692 research-related support position if he or she fails to disclose a
16931693 substantial educational, employment, or research -related activity,
16941694 publication, or presentation at the time of submitting materials
16951695 required by subsection B of this section unless an institution of
16961696 higher education department head or his or her designee certifies in
16971697 writing the substance of the nondisclosure and the reasons for

17581758 thereof the identity of t he individual who was rejected for
17591759 employment based on the scrutiny required by this section or other
17601760 risk-based screening.
17611761 F. Each institution of higher education shall adopt a policy of
17621762 prioritizing foreign researchers from allied nations and joint
17631763 research projects with allied nations in the following order of
17641764 prioritization:
17651765 1. Members of the Five Eyes Intelligence Oversight and Review
17661766 Council;
17671767 2. Current signatories of the North Atlantic Treaty;
17681768 3. The State of Israel, the Republic of China, the Pe ople’s
17691769 Republic of Korea, Japan, the Philippines, and the Republic of
17701770 India; and
17711771 4. All other countries including remaining nations designated
17721772 as a Major Non-North Atlantic Treaty Organization (NATO) Ally by the
17731773 United States Department of State and remai ning allied countries.

18301830 research integrity office designated pursuant to subsection C of
18311831 this section, in addition to any other travel approval process
18321832 requirements applicable to the institutio n of higher education.
18331833 H. 1. Preapproval by an institution of higher educati on’s
18341834 research integrity office shall be based on the applicant ’s review
18351835 and acknowledgement of guidance published by the employing
18361836 institution of higher education or affiliate th ereof which relates
18371837 to countries of concern, countries under sanction, or other
18381838 restrictions or designations imposed by this state or the United
18391839 States government including any federal licensing requirements;
18401840 customs rules; export controls; restrictions on taking institutional
18411841 property including intellectual property abroad; restric tions on
18421842 presentations, teaching, and interactions with foreign colleagues;
18431843 and other subjects important to the research and academic integrity
18441844 of the institution of higher educa tion.
18451845 2. Preapproval by an institution of higher education ’s research
18461846 integrity office shall be based on the binding commitment of the
18471847 individual traveler not to violate the institution of higher

19021902 shall maintain records of all foreign travel requests and approvals;
19031903 expenses reimbursed by the institution of higher education or
19041904 affiliate thereof during s uch travel including travel, food, and
19051905 lodging; and payments and honoraria received during such travel and
19061906 activities including for travel, food, and lodging. The institution
19071907 of higher education shall retain the records for at least three (3)
19081908 years or any longer period of time required by any applicable state
19091909 or federal law.
19101910 J. The institution of higher education or affiliate thereof
19111911 shall provide an annual report of foreign travel to countries of
19121912 concerns listing individual travelers, foreign locations v isited,
19131913 and foreign institutions visited to its board of regents.
19141914 K. By July 1, 2026, the State Auditor and Inspector shall
19151915 perform an operational audit regarding implementation of the
19161916 provisions of this section.
19171917 SECTION 8. NEW LAW A new section of law to be codified

19751975 higher education maintains sufficient structural safeguards to
19761976 protect its intellectual property , the security of this state, and
19771977 the national security interests of the Unite d States. A board of
19781978 regents shall only approve an institution of higher education ’s
19791979 partnership if the board, in consultation with the Office of the
19801980 Attorney General, determine s the partnership meets the following
19811981 safeguard requirements:
19821982 1. Compliance with all federal requirements including the
19831983 requirements of federal research sponsors and federal export control
19841984 agencies, regulations regarding international traffic in arms and
19851985 export administration, and economic and trade sanctions administered
19861986 by the federal Office of Foreign Assets Control of the United States
19871987 Department of the Treasury;
19881988 2. Annual formal institution -level programs for faculty on
19891989 conflicts of interest and conf licts of commitment; and
19901990 3. A formalized foreign visitor process and uniform visiting
19911991 scholar agreement.
19921992 B. The board of regents of an institution of higher education,
19931993 in consultation with the Office of the Attorney General, shall have
19941994 full discretion to reject or terminate any research partnership
19951995 between the institution and an a cademic or research institution
19961996 located in a country of concern at any time and for any purpose.

20482048 SECTION 9. NEW LAW A new section of law to be codified
20492049 in the Oklahoma Statutes as Section 24 -170 of Title 70, unless there

20512051 A. No later than ninety (90) days after the effective date of
20522052 this act, the Governor shall appoint one qualified person who shall
20532053 be responsible for the “Report on Foreign Influence in Higher
20542054 Education”. The report shall be electronically submitted to the
20552055 Governor, the President Pro Tempore of the Senate, and the Speaker
20562056 of the House of Representatives and shall be published semi -annually
20572057 on a state website.
20582058 B. The Report on Foreign Influence in Higher Education:
20592059 1. Shall investigate and provide oversight of all attempted
20602060 foreign influence operations in higher education in this state; and
20612061 2. May include a synthesis of reports from the federal
20622062 government and state agencies, new findings and ongoing
20632063 investigations, and recommendations for limiting exposure to foreign
20642064 influence.
20652065 SECTION 10. NEW LAW A new section of law to be codified
20662066 in the Oklahoma Statutes as S ection 24-171 of Title 70, unless there
