183183 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
184184 SECTION 1. NEW LAW A new sect ion of law to be codified
185185 in the Oklahoma Statutes as Section 3 -116.7 of Title 70, unless
186186 there is created a duplication in numbering, reads as follows:
187187 A. Upon the effective date of this act and until March 31,
188188 2027, the Accreditation Standards Division of the State Department
189189 of Education shall be placed under the authority of th e Commission
190190 for Educational Quality and Accountability. Except as otherwise

242242 provided for in this section, the transfer shall include all records
243243 associated with the Accreditation Standards Division.
244244 B. Upon the effective date of this act, a ll employees of the
245245 Accreditation Standards Division of the State Department of
246246 Education, shall remain under the State Department of Education and
247247 shall, until March 31, 2027, make reports a nd recommendations
248248 regarding accreditation to the Commission .
249249 C. The Commission for Educational Quality and Accountability
250250 shall succeed to any contractual rights and responsibilities
251251 incurred by the Accreditation Standards Division of the State
252252 Department of Education.
253253 D. The rules of the State Board of Education relating to
254254 accreditation of schools in this state that are in effect on the
255255 effective date of this act , shall be enforceable by the Commission
256256 for Educational Quality and Accountability until March 31, 2027.
257257 SECTION 2. AMENDATORY 70 O.S. 2021, S ection 3-104, as
258258 last amended by Section 2, Chapter 445, O.S.L. 2024 (70 O.S. Supp.
259259 2024, Section 3-104), is amended to read as follows:
260260 Section 3-104. A. The supervision of th e public school system
261261 of Oklahoma shall be vested in the State Board of Education and,
262262 subject to limitations otherwise provided by law, the State Board of
263263 Education shall:
264264 1. Adopt policies and make rules for the operation of the
265265 public school system of the state;

317317 2. Appoint, prescribe the duties, and fix the compensation of a
318318 secretary, an attorney, and all other personnel necessary for the
319319 proper performance of the functions of the State Board of Education.
320320 The secretary shall not be a member of the Board;
321321 3. Submit to the Governor a departmental budget based upon
322322 major functions of the State Department of Education as prepared by
323323 the Superintendent of Public Instruction and supported by detailed
324324 data on needs and proposed operations as partially det ermined by the
325325 budgetary needs of local school districts filed with the State Board
326326 of Education for the ensuing fiscal year. Appropriations therefor
327327 shall be made in lump -sum form for each major item in the budget as
328328 follows:
329329 a. State Aid to schools,
330330 b. the supervision of all other functions of general and
331331 special education including general control, free
332332 textbooks, school lunch, Indian education, and all
333333 other functions of the Board and an amount sufficient
334334 to adequately staff and administer these servic es, and
335335 c. the Board shall determine the details by which the
336336 budget and the appropriations are administered.
337337 Annually, the Board shall make preparations to
338338 consolidate all of the functions of the Department in
339339 such a way that the budget can be based on t wo items,
340340 administration and aid to schools. A maximum amount

392392 for administration shall be designated as a part of
393393 the total appropriation;
394394 4. On the first day of December preceding each regular session
395395 of the Legislature, prepare and deliver electronically to the
396396 Governor and the Legislature a report for the year ending June 30
397397 immediately preceding the regular session of the Legislature. The
398398 report shall contain:
399399 a. detailed statistics and other information concerning
400400 enrollment, attendance, expenditure s including State
401401 Aid, and other pertinent data for all public schools
402402 in this state,
403403 b. reports from each and every division within the State
404404 Department of Education as submitted by the
405405 Superintendent of Public Instruction and any other
406406 division, department, institution, or other agency
407407 under the supervision of the Board,
408408 c. recommendations for the improvement of the public
409409 school system of the state,
410410 d. a statement of the receipts and expenditures of the
411411 State Board of Education for the past year, and
412412 e. a statement of plans and recommendations for the
413413 management and improvement of public schools and such
414414 other information relating to the educational

466466 interests of the state as may be deemed necessary and
467467 desirable;
468468 5. Provide for the formulation and adopti on of curricula,
469469 courses of study, and other instructional aids necessary for the
470470 adequate instruction of pupils in the public schools;
471471 6. Have authority in matters pertaining to the licensure and
472472 certification of persons for instructional, supervisory, a nd
473473 administrative positions and services in the public schools of the
474474 state subject to the provisions of Section 6 -184 of this title, and
475475 shall formulate rules governing the issuance and revocation of
476476 certificates for superintendents of schools, principals ,
477477 supervisors, librarians, clerical employees, school nurses, school
478478 bus drivers, visiting teachers, classroom teachers, and for other
479479 personnel performing instructional, administrative, and supervisory
480480 services, but not including members of boards of educ ation and other
481481 employees who do not work directly with pupils, and may charge and
482482 collect reasonable fees for the issuance of such certificates:
483483 a. the State Department of Education shall not issue a
484484 certificate to and shall revoke the certificate of any
485485 person who has been convicted, whether upon a verdict
486486 or plea of guilty or upo n a plea of nolo contendere,
487487 or received a suspended sentence or any probationary
488488 term for a crime or an attempt to commit a crime
489489 provided for in Section 843.5 of Title 21 of th e

541541 Oklahoma Statutes if the offense involved sexual abuse
542542 or sexual exploitation as those terms are defined in
543543 Section 1-1-105 of Title 10A of the Oklahoma Statutes,
544544 Section 741, 843.1, if the offense included sexual
545545 abuse or sexual exploitation, 865 et seq ., 885, 888,
546546 891, 1021, 1021.2, 1021.3, 1040.13a, 1087, 1088,
547547 1111.1, 1114, or 1123 of Title 21 of the Oklahoma
548548 Statutes or who enters this state and who has been
549549 convicted, received a suspended sentence, or received
550550 a deferred judgment for a crime or atte mpted crime
551551 which, if committed or attempted in this state, would
552552 be a crime or an attempt to commit a crime provided
553553 for in any of the laws, and
554554 b. all funds collected by the State Department of
555555 Education for the issuance of certificates to
556556 instructional, supervisory, and administrative
557557 personnel in the public schools of the state shall be
558558 deposited in the “Teachers’ Certification Fund” in the
559559 State Treasury and may be expended by the State Board
560560 of Education to finance the activities of the State
561561 Department of Education necessary to administer the
562562 program, for consultative services, publication costs,
563563 actual and necessary travel expenses as provided in
564564 the State Travel Reimbursement Act incurred by persons

617617 necessary by the State Board of Education for the
618618 improvement of the preparat ion and certification of
619619 teachers in this state. Provided, any unobligated
620620 balance in the Teachers ’ Certification Fund in excess
621621 of Ten Thousand Dollars ($10,000.00) on June 30 of any
622622 fiscal year shall be transferred to the General
623623 Revenue Fund of this state. Until July 1, 1997, the
624624 State Board of Education shall have authority for
625625 approval of teacher education programs. The State
626626 Board of Education shall also have authority fo r the
627627 administration of teacher residency and professional
628628 development, subject to the provisions of the Oklahoma
629629 Teacher Preparation Act;
630630 7. Promulgate rules governing the classification, inspection,
631631 and supervision, and accrediting of all public nursery ,
632632 kindergarten, elementary , and secondary schools, and on -site
633633 educational services provided by public school districts or state -
634634 accredited private schools in partial hospitalization programs, day
635635 treatment programs, and day hospital programs as defined in this
636636 section, Section 3-104.7 of this title, and Section 603.4 175.20 of
637637 Title 10 of the Oklahoma Statutes for persons between the ages of
638638 three (3) and twenty -one (21) years of age in the state. Beginning
639639 on the effective date of this act until March 31, 2027, the

692692 rules governing the accreditation of all public nursery,
693693 kindergarten, elementary, and secondary schools, and on -site
694694 educational services provided by public school districts o r state-
695695 accredited private schools in partial hospitalization programs, day
696696 treatment programs, and day hospital programs as defined in Section
697697 3-104.7 of this title and Section 175.20 of Title 10 of the Oklahoma
698698 Statutes for persons between the ages of th ree (3) and twenty-one
699699 (21) years of age in this state. Beginning April 1, 2027, the Board
700700 shall promulgate rules governing the accrediting of all public
701701 nursery, kindergarten, elementary, and secondary schools, and on -
702702 site educational services provided b y public school districts or
703703 state-accredited private schools in partial hospi talization
704704 programs, day treatment programs, and day hospital programs as
705705 defined in Section 3 -104.7 of this title and Section 175.20 of Title
706706 10 of the Oklahoma Statutes for per sons between the ages of three
707707 (3) and twenty-one (21) years of age in the state. However,
708708 beginning on the effective date of this act until March 31, 2027, no
709709 school shall be denied accreditation by the Commission for
710710 Educational Quality and Accountabili ty solely on the basis of
711711 average daily attendance. Beginning April 1, 2027, no school shall
712712 be denied accreditation by the Board solely on the basis of average
713713 daily attendance.

765765 Any school district which maintains an elementary school and
766766 faces the necessity of relocating its school facilities because of
767767 construction of a lake, either by state or federal authority, which
768768 will inundate the school facilities, shall be entitled to receive
769769 probationary accreditation from the Commission for Educational
770770 Quality and Accountability beginning on the effective date of this
771771 act, and beginning April 1, 2027, from the State Board of Education
772772 for a period of five (5) years after June 12, 1975, and any school
773773 district, otherwise qualified, shall be entitled to receive
774774 probationary accreditation from the Commission until March 31, 2027,
775775 and beginning April 1, 2027, from the State Board of Education for a
776776 period of two (2) consecutive years to attain the minimum average
777777 daily attendance. The Head Start and public nurserie s or
778778 kindergartens operated from community action agency funds shall not
779779 be subjected to the accrediting rules of the Commission until March
780780 31, 2027, and beginning April 1, 2027, from the State Board of
781781 Education. Neither will the Commission until March 31, 2027, and
782782 beginning April 1, 2027, neither will the State Board of Education
783783 make rules affecting the operation of the public nurseries and
784784 kindergartens operated from federal funds secured through community
785785 action agencies even though they may be oper ating in the public
786786 schools of the state. However, any of the Head Start or p ublic
787787 nurseries or kindergartens operated under federal regulations may
788788 make application for accrediting from the Commission until March 31,

841841 but will be accredited only if application for the approval of the
842842 programs is made. The status of no school district shall be changed
843843 which will reduce it to a lower classification until due notice has
844844 been given to the pr oper authorities thereof and an opportunity
845845 given to correct the conditions wh ich otherwise would be the cause
846846 of such reduction.
847847 Private and parochial schools may be accredited and classified
848848 in like manner as public schools or, if an accrediting associat ion
849849 is approved by the State Board of Education, by procedures
850850 established by the State Board of Education to accept accreditation
851851 by such accrediting association, if application is made to the State
852852 Board of Education for such accrediting;
853853 8. Be the legal agent of this state to accept, in its
854854 discretion, the provisions of any Act of Congress appropriating or
855855 apportioning funds which are now, or may hereafter be, provided for
856856 use in connection with any phase of the system of public education
857857 in Oklahoma. It shall prescribe such rules as it finds necessary to
858858 provide for the proper distribution of such funds in accordance with
859859 the state and federal laws;
860860 9. Be and is specifically hereby designated as the agency of
861861 this state to cooperate and deal with any officer, board, or
862862 authority of the United States Government under any law of the
863863 United States which may require or recommend cooperation with any

916916 unless otherwise provided by law;
917917 10. Be and is hereby designated as the “State Educational
918918 Agency” state educational agency referred to in Public Law 396 of
919919 the 79th Congress of the United States, as amended, which law states
920920 that the act may be cited known as the “National Richard B. Russell
921921 National School Lunch Act” Act, and the State Board of Education is
922922 hereby authorized and directed to accept the terms and provisions of
923923 the act and to enter into such agreements, not in conflict with the
924924 Constitution of Oklahoma or the Constitution and Stat utes of the
925925 United States, as may be necessary or appropriate to secure for this
926926 state the benefits of the school lunch program established and
927927 referred to in the act;
928928 11. Have authority to secure and administer the benefits of the
929929 Richard B. Russell National School Lunch Act, Public Law 396 of the
930930 79th Congress of the United State s, as amended, in this state and is
931931 hereby authorized to employ or appoint and fix the compensation of
932932 such additional officers or employees and to incur such expenses as
933933 may be necessary for the accomplishment of the above purpose, and
934934 administer the distribution of any state funds appropriated by the
935935 Legislature required as federal matching to reimburse on children ’s
936936 meals;
937937 12. Accept and provide for the administration of any l and,
938938 money, buildings, gifts, donation donations, or other things of

990990 value which may be offered or bequeathed to the schools under the
991991 supervision or control of the Board;
992992 13. Have authority to require persons having administrative
993993 control of all school d istricts in Oklahoma to make such regular and
994994 special reports regarding the activities of the schools in the
995995 districts as the Board may deem needful for the proper exercise of
996996 its duties and functions. Such authority shall include the right of
997997 the State Board of Education to withhold all state funds under its
998998 control, and to withhold official recognition including accrediting,
999999 until such required reports have been filed and accepted in the
10001000 office of the Board and to revoke the certificates of persons
10011001 failing or refusing to make such reports . Until March 31, 2027, the
10021002 Commission for Educational Quality and Accountability, and beginning

10041004 to withhold accreditation until such required reports have been
10051005 filed and accepted and to revoke the certificates of persons failing
10061006 or refusing to make such reports ;
10071007 14. Have general supervision of the school lunch program. The
10081008 State Board of Education may sponsor workshops for personnel and
10091009 participants in the school lunch program and may develop, print, and
10101010 distribute free of charge or sell any materials, books, and
10111011 bulletins to be used in the school lunch programs. There is hereby
10121012 created in the State Treasury a revolving fund for the Board, to be
10131013 designated the “School Lunch Workshop Revolving Fund ”. The fund

10701070 bulletins relating to the school lunch program. The fund shall be

10731073 15. Prescribe all forms for school district and coun ty officers
10741074 to report to the State Board of Education where required. The State
10751075 Board of Education shall also prescribe a list of appropriation
10761076 accounts by which the funds of sc hool districts shall be budgeted,
10771077 accounted for, and expended; and it shall be the duty of the State
10781078 Auditor and Inspector in prescribing all budgeting, accounting, and
10791079 reporting forms for school funds to conform to such lists;
10801080 16. Provide for the establi shment of a uniform system of pupil
10811081 and personnel accounting, records, and rep orts;
10821082 17. Have authority to provide for the health and safety of
10831083 school children and school personnel while under the jurisdiction of
10841084 school authorities;

11461146 21. Administer the State Public Common School Building
11471147 Equalization Fund established by Section 32 of Article X of the
11481148 Oklahoma Constitution. Any monies as may be appropriated or
11491149 designated by the Legislature, other than ad valorem taxes, any

11511151 may include, but not be limited to, grants-in-aid from the federal
11521152 government for building purposes, the proceeds of all property that
11531153 shall fall to the state by escheat, penalties for unlawful holding

11561156 Common School Building Equalization Fund. The fund shall be used to

12141214 declared that the term “school districts” as used in Section 32 of
12151215 Article X of the Oklahoma Constitution shall mean school districts
12161216 and eligible charter schools as defined in subsection B of this
12171217 section. The State Board of Education shall disburse redbud school
12181218 grants annually from the State Public Common School Building
12191219 Equalization Fund to public schools and eligible charter schools
12201220 pursuant to subsection B of this secti on. The Board shall
12211221 promulgate rules for the implementation of disbursing redbud school
12221222 grants pursuant to this section. The State Board of Education shall
12231223 prescribe rules for making grants of aid from, and for otherwise
12241224 administering, the fund pursuant to the provisions of this
12251225 paragraph, and may employ and fix the duties and com pensation of
12261226 technicians, aides, clerks, stenographers, attorneys, and other
12271227 personnel deemed necessary to carry out the provisions of this
12281228 paragraph. The cost of administering the fund shall be paid from
12291229 monies appropriated to the State Board of Education for the
12301230 operation of the State Department of Education. From monies
12311231 apportioned to the fund, the State Department of Education may
12321232 reserve not more than one -half of one percent (1/2 of 1%) for
12331233 purposes of administering the fund;
12341234 22. Recognize that the Director of the Department of
12351235 Corrections shall be the administrative authority for the schools

12901290 inspection, and accreditation of public schools shall be applicable
12911291 to such schools; and such schools shall comply with standards set

12931293 2027, the rules of the Co mmission for Educational Quality and
12941294 Accountability, and beginning April 1, 2027, the rules of the Board
12951295 for accreditation of public schools shall be applicable to such
12961296 schools; and
12971297 23. Have authority to administer a revolving fund which is
12981298 hereby created in the State Treasury, to be designated the
12991299 “Statistical Services Revolving Fund ”. The fund shall consist of
13001300 all monies received from the various school districts of the state,
13011301 the United States Government, and other sources for the purpose of
13021302 furnishing or financing statistical services and for any other
13031303 purpose as designated by the Legislature. The State Board of
13041304 Education is hereby authorized to enter into agreements with sc hool
13051305 districts, municipalities, the United States Government,
13061306 foundations, and other agencies or individuals for services,
13071307 programs, or research projects. The Statistical Services Revolving
13081308 Fund shall be administered in accordance with Section 155 of Titl e
13091309 62 of the Oklahoma Statutes.

14531453 eligible charter school.
14541454 2. For fiscal year 2 022, monies for the redbud school grants
14551455 shall be expended from the funds apportioned pursuant to Section 426
14561456 of Title 63 of the Oklahoma Statutes. For fiscal year 2023 and each
14571457 subsequent fiscal year, monies for the redbud school grants shall be
14581458 appropriated pursuant to Section 426 of Title 63 of the Oklahoma
14591459 Statutes, not to exceed three -fourths (3/4) of the tax collected in
14601460 the preceding fiscal year pursuant to Section 426 of Title 63 of the
14611461 Oklahoma Statutes as determined by the Oklahoma Tax Commission . For

15151515 grants, then an additional apportionment of funds s hall be made from
15161516 sales tax collections as provided by subsection D of Section 1353 of
15171517 Title 68 of the Oklahoma Statutes. If both funds are insufficient,
15181518 the Department shall promulgate rules to permit a decrease to the
15191519 baseline local funding per student to the highest amount allowed
15201520 with the funding available.
15211521 3. As used in this section, “eligible charter school ” shall
15221522 mean a charter school which is sponsored pursuant to the provisions
15231523 of the Oklahoma Charter Schools Act. Provided, however, eligible
15241524 charter school shall not include a statewide virtual charter school
15251525 sponsored by the Statewide Charter School Board but shall only
15261526 include those which provide in -person or blended instruction, as
15271527 provided by Section 1 -111 of this title, to not less than two -thirds
15281528 (2/3) of students as the primary means of instructional service
15291529 delivery.
15301530 4. The Department shall develop a program to acknowledge the
15311531 redbud school grant recipients and shall include elected members of
15321532 the House of Representatives and Senate who re present the school
15331533 districts and eligible charter schools.
15341534 5. The Department shall create a dedicated page on its website
15351535 listing annual redbud school grant recipients, amount awarded to

15941594 SECTION 3. AMENDATORY 70 O.S. 2021, Section 3 -104.3, is
15951595 amended to read as follows:
15961596 Section 3-104.3. A. The Legislature, recognizing its
15971597 obligation to the children of this state to e nsure their opportunity
15981598 to receive an excellent education, and recognizing its obligation to
15991599 the taxpayers of this state to ensure that schooling is accomplished
16001600 in an efficient manner, hereby establishes requirements for
16011601 compliance with quality standards which the public schools and
16021602 school districts, within the limits of resources now or subsequently
16031603 available, must meet.
16041604 B. State accreditation shall be withdrawn from or denied to
16051605 schools or school districts that do not meet the requirements of
16061606 Sections 2 3-104.4, 3 11-103, 6 11-103.6, 28 18-113.1, 29 18-113.2,
16071607 30 18-113.3, 44, 45, 46, 47, 48 18-114.15, and 49 5-141 of this act

16771677 recognized accreditation standards to the extent that the standards
16781678 are consistent with an academic results oriented approach to
16791679 accreditation. The accreditation adopted by the State Commission

17391739 B. Standards for accreditation adopted by the Commission for

17431743 provision of school counselors to the public school children of this

17471747 counselors serving each school site, the duties of all such
17481748 counselors including all administrative duties, the number of

17521752 C. Except as otherwise provided, scho ols shall meet the
17531753 accreditation standards as a condition of continued accreditation.
17541754 Nothing herein shall be construed as preventing changes to the
17551755 adopted standards by the Commission for Educational Quality and
17561756 Accountability until March 31, 2027, and b y the State Board of
17571757 Education beginning April 1, 2027, pursuant to the Admini strative
17581758 Procedures Act. The accreditation standards shall provide for
17591759 warnings, probation, or nonaccredited status for schools that fail

18151815 standards within thirty (30) days of receiving the complaint. If

18181818 school has failed to comply with the accreditation standards, the

18211821 nonaccredited accreditation status to the Commission for Educational
18221822 Quality and Accountability until March 31, 2027, and beginning April
18231823 1, 2027, to the State Board of Education within ninety (90) days.
18241824 If a school does not take action to comply with the accreditation
18251825 standards within ninety (90) days after a report is filed by the
18261826 Office until March 31, 2027, and beginning April 1, 2027, by the
18271827 Department, the Commission for Educational Quality and
18281828 Accountability until March 31, 2027, and beginning April 1, 2027,
18291829 the Board shall withdraw accreditation for the school. The State
18301830 Board Until March 31, 2027, the Commission ’s accreditation
18311831 regulations, and beginning April 1, 2027, the Board ’s accreditation
18321832 regulations shall provide for warnings and for assistance to schools
18331833 and school districts whenever there is reason to believe a school is
18341834 in danger of losing its state accreditation.

18881888 accreditation, the Commission for Educational Quality and

18911891 students to accredited schools within the d istrict or shall annex
18921892 the district to one or more other districts in which the students

18951895 Educational Quality and Accountability until March 31, 2027, and
18961896 beginning April 1, 2027, by the State Board of Education shall
18971897 include standards relating to the provision of educational services
18981898 provided in partial hospitalization programs, da y treatment
18991899 programs, day hospital programs, residential treatment programs , and
19001900 emergency shelter programs for persons between the ages of three (3)
19011901 and twenty-one (21) years of age. The accreditation standards shall
19021902 apply to on-site and off-site educational services provided by
19031903 public school districts or state -accredited private schools. Each
19041904 school which is providing or is required to provide educational
19051905 services for students placed in a program as described in this
19061906 subsection shall be actively monitor ed by the State Department of
19071907 Education. The Department shall determine on an ongoing basis if
19081908 the educational program and services are in compliance with the
19091909 accreditation standards.

19611961 F. The Commission for Educational Quality and Accountability
19621962 until March 31, 2027, and beginning April 1, 2027, the State Board
19631963 of Education shall provide assistance to districts in considering
19641964 the possibility of meeting accreditation requirements through the
19651965 use of nontraditional means of instruction. The State Commission
19661966 until March 31, 2027, and beginning April 1, 2027, the Board shall
19671967 also assist districts in forming cooperatives and making
19681968 arrangements for the use of satellite instruction or other
19691969 instructional technologies to the extent that use of such
19701970 instructional means meets accreditation standards.
19711971 G. 1. Accreditation shall not be withdrawn from or denied nor
19721972 shall a penalty be assessed against a school or school district for
19731973 failing to meet the media materials and equipment standards, media
19741974 program expenditure s tandards, and media personnel standards as set
19751975 forth in the accreditation stan dards adopted by the Commission for
19761976 Educational Quality and Accountability until March 31, 2027, and
19771977 beginning April 1, 2 027, by the Board.
19781978 2. The provisions of paragraph 1 of t his subsection shall cease
19791979 to be effective during the fiscal year which begins on the July 1
19801980 immediately succeeding the legislative session during which the
19811981 measure appropriating monies to the State Board of Education for the
19821982 financial support of public sc hools is enacted as law and such
19831983 appropriation amount is at least Fifty Millio n Dollars
19841984 ($50,000,000.00) greater than the amount of money appropriated to

20412041 Accreditation shall not be withdrawn from or denied nor shall a
20422042 penalty be assessed against a school or school district for failing
20432043 to meet the media personnel standards as set forth in accreditation
20442044 standards adopted by the Commission until March 31, 2027, and
20452045 beginning April 1, 2027, by the Board.
20462046 H. 1. The State Commission for Educational Quality and
20472047 Accountability until March 31, 2027, and beginning April 1, 2027,
20482048 the Board shall not assess a financial penalty against any school
20492049 district which is given a deficiency in accreditation status du ring
20502050 any fiscal year as provided for in this subsection.
20512051 2. Beginning with th e fiscal year which begins July 1, 2021, if
20522052 the amount of money appropriated to the State Board of Education for
20532053 the financial support of public schools including funds apportion ed
20542054 pursuant to Section 2 426 of this act Title 63 of the Oklahoma
20552055 Statutes, is at least One Hundred Million Dollars ($100,000,000.00)
20562056 greater than the amount of money appropriated to the State Board of
20572057 Education for the financial support of public schools for the fiscal
20582058 year ending June 30, 2019, pursuant to Chapter 146, O.S.L. 2018 , a
20592059 financial penalty shall be assessed against any school districts

21172117 3. The State Department of Education shall sub mit a report on
21182118 statewide classroom sizes to the President Pro Tempore of the
21192119 Oklahoma State Senate and the Speaker of the Oklahoma House of
21202120 Representatives no later than January 1, 2022.
21212121 I. Except as provided for in subsection J of this section,
21222122 beginning with the 2019 -2020 school year, evaluations of schools to
21232123 determine whether they meet the accreditation standards set forth in
21242124 accordance with this section shall occur once eve ry four (4) years
21252125 on a schedule adopted by the Commission for Educational Qual ity and
21262126 Accountability until March 31, 2027, and beginning April 1, 2027, by
21272127 the State Board of Education . The Commission until March 31, 2027,
21282128 and beginning April 1, 2027, the Board may interrupt the evaluation
21292129 schedule provided in this subsection for reasons including a change
21302130 in the superintendent of the school district; determination that one
21312131 or more school district board members have not met the continuing
21322132 education requirements as defined by this title; determination that
21332133 the school district falsifie d information submitted to any public
21342134 city, county, state, or federal official or agency; initiation of an

21882188 determination by the Commission until March 31, 2027, and beginning
21892189 April 1, 2027, by the Board that standards for accreditation are not
21902190 being met by the school district. The schedule adopted by the
21912191 Commission until March 31, 2027, and beginning April 1, 2027, by the
21922192 Board shall allow for school districts receiving no deficiencies for
21932193 two (2) consecutive years to be reviewed for accreditation less than
21942194 annually. Provided, however, that schools shall be evaluated
21952195 annually for the purposes of:
21962196 1. Local, state, and federal funding;
21972197 2. Health and safety;
21982198 3. Certification requirements for teachers, principals , and
21992199 superintendents;
22002200 4. School board governance , including instructional and
22012201 continuing education requirements for school board members; and
22022202 5. Any other requireme nts under state or federal law.
22032203 J. Beginning with the 2019 -2020 school year, if a public school
22042204 receives a deficiency on its accreditation report, the public school
22052205 shall be evaluated annually to determine if it meets the
22062206 accreditation standards set forth in accordance with this section.
22072207 If the public school receives no deficiencies for two (2)
22082208 consecutive years, the public school shall be subject to the
22092209 evaluation timeline esta blished in subsection I of this section.

22632263 Section 3-116.2. A. Effective January 1, 2013, there is hereby
22642264 created the Commission for Educational Q uality and Accountability.
22652265 The membership of the Commission shall consist of:
22662266 1. The Secretary of Education, who shall serve as the chair of
22672267 the Commission;
22682268 2. One member appointed by the Governor, with the advice and
22692269 consent of the Senate, representing business and industry from an
22702270 Oklahoma employer with five hundred (500) or fe wer employees;
22712271 3. One member, appointed by the Governor, with the advice and
22722272 consent of the Senate, who is a parent of a child enrolled in a
22732273 public school in this state;
22742274 4. One member, appointed by the Governor, with the advice and
22752275 consent of the Senate, who is an administrator of a public school
22762276 district;
22772277 5. One member, appointed by the Governor, with the advice and
22782278 consent of the Senate, who shall represent higher education t eacher
22792279 education programs;
22802280 6. One member appointed by the Governor, with the advice and
22812281 consent of the Senate, who shall be an active classroom teacher in

23372337 The terms of the initial appointed members shall commence on
23382338 January 1, 2013, and shall end on June 30, 2014. The terms of
23392339 subsequently appointed members shall c ommence on July 1 of each year
23402340 following the election of the Governor thereaft er and shall be for
23412341 four (4) years. If a vacancy occurs, the vacancy shall be filled
23422342 for the unexpired term in the same manner as the office was
23432343 previously filled.
23442344 B. A quorum of the Commission, which shall consist of four
23452345 members, shall be present in order for the Commission to transact
23462346 any business. Members shall be reimbursed for travel in the
23472347 performance of their official duties in accordance with the State
23482348 Travel Reimbursement Act.
23492349 C. Prior to July 1, 2013, the Commission shall meet to organize
23502350 and plan for the assumption of the powers and duties of the
23512351 Education Oversight Board and the Oklahoma Commission for Teacher
23522352 Preparation.
23532353 D. Beginning July 1, 2013, the Commission shall assume the
23542354 following duties:
23552355 1. Oversee implementation of the provisions of Enrolled House
23562356 Bill No. 1017 of the 1st Extraordinary Session of the 42nd Oklahoma

24142414 4. Set performance levels and corresponding cut scores pursuant
24152415 to the Oklahoma School Testing Program Act and as provided for in
24162416 Section 1210.541 of Title 70 of the Oklahoma Statutes this title.
24172417 E. Beginning July 1, 2013, the Commission shall govern the
24182418 operation of the Office of Educational Quality and Accountability
24192419 created in Section 3-117 of Title 70 of the Oklahoma Statutes this
24202420 title.
24212421 F. 1. Beginning July 1, 2014, the Commission shall assume the
24222422 following duties of the Oklahoma Commission for Teacher Preparation
24232423 according to the provisions of the Oklahoma Teacher Pre paration Act:
24242424 a. approval and accreditation of teacher education
24252425 programs, and
24262426 b. assessment of candidates for licensure and
24272427 certification.
24282428 2. To implement the provisions of this subsection the
24292429 Commission shall:
24302430 a. include the State Board of Education in the process,
24312431 b. review and assess approved, accredited , and new
24322432 programs of teacher education, and

24902490 of this title; and
24912491 2. Evaluating schools to determine whether they meet the
24922492 accreditation standar ds adopted by the Commission.
24932493 H. The Commission shall promulgate rules to imp lement the
24942494 provisions of this act.
24952495 SECTION 6. This act shall become effective July 1, 2025.
24962496 SECTION 7. It being immediately necessary for the pr eservation
24972497 of the public peace, health, or safety, an emergency is hereby
24982498 declared to exist, by reason whereof this act shall take effect and
24992499 be in full force from and after its passage and approval.
