83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. NEW LAW A new section of law to be codified
85	85	in the Oklahoma Statutes as Section 23 of Title 22, unless there is
86	86	created a duplication in numbering, reads as follows:
87	87	A. A person whose arrest booking photograph is p ublished or
88	88	otherwise disseminated may make a request in writing to the business
89	89	or individual who published or otherwise disseminated the photograph
90	90	for the removal of the photo graph. The written request for removal
91	91	of the arrest booking photograph shall be sent by registered mail

143	143	and include sufficient proof of identification of the person whose
144	144	photograph was published and specific information identifying the
145	145	photograph the written request is seeking to remove.
146	146	B. 1. Within ten (10) days after receipt of the written
147	147	request for removal of the arrest booking photograph, the business
148	148	or individual who published or otherwise disseminated the photograph
149	149	shall remove the photograp h and may not republish or otherwise
150	150	disseminate the photograph.
151	151	2. The person whose arrest booking photograph was published or
152	152	otherwise disseminated may bring a civil action to enjoin the
153	153	continued publication of the photograph if the business or
154	154	individual does not remove the arrest booking photograph within the
155	155	required time. The court shall award court costs and reasonable
156	156	attorney fees related to the issuance and enforcement of the
157	157	injunction and may impose a civil penalty of One Thousand Dollars
158	158	($1,000.00) per day for noncompliance. Amounts recovered from civil
159	159	penalties under this paragraph shall be deposited into the General
160	160	Revenue Fund.
161	161	3. If a business or individual is required to remove an arrest
162	162	booking photograph under this section and la ter republishes the
163	163	photograph, the person whose photograph is republished or otherwise
164	164	disseminated may bring a civil action to enjoin the continued
165	165	publication or dissemination of the photograph. The court shall
166	166	award court costs and reasonable attorney fees related to the

218	218	issuance and enforcement of the injunction and may impose a civil
219	219	penalty of Five Thousand Dollars ($5,000.00) per day for
220	220	noncompliance. Amounts recovered from civil penalties under this
221	221	paragraph shall be deposited into the General Revenue Fund.
222	222	C. A business or individual engaged in the business of
223	223	publishing or otherwise disseminating arrest booking photographs of
224	224	persons who have been previously arrested may not solicit or accept
225	225	a fee or other form of payment for the removal of the photographs.
226	226	D. This section shall not apply to a business or individual
227	227	that publishes or disseminates information relating to arrest
228	228	booking photographs unless:
229	229	1. The business or individual solicits or accepts payment for
230	230	the removal of photograph s; or
231	231	2. The business or individual ’s primary business model is the
232	232	publishing and disseminating of arrest booking photographs for a
233	233	commercial purpose or pecuniary gain.
234	234	SECTION 2. This act shall become effective November 1, 2025.
