8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be codified
8585 in the Oklahoma Statutes as Section 23 of Title 22, unless there is
8686 created a duplication in numbering, reads as follows:
8787 A. A person whose arrest booking photograph is p ublished or
8888 otherwise disseminated may make a request in writing to the business
8989 or individual who published or otherwise disseminated the photograph
9090 for the removal of the photo graph. The written request for removal
9191 of the arrest booking photograph shall be sent by registered mail

143143 and include sufficient proof of identification of the person whose
144144 photograph was published and specific information identifying the
145145 photograph the written request is seeking to remove.
146146 B. 1. Within ten (10) days after receipt of the written
147147 request for removal of the arrest booking photograph, the business
148148 or individual who published or otherwise disseminated the photograph
149149 shall remove the photograp h and may not republish or otherwise
150150 disseminate the photograph.
151151 2. The person whose arrest booking photograph was published or
152152 otherwise disseminated may bring a civil action to enjoin the
153153 continued publication of the photograph if the business or
154154 individual does not remove the arrest booking photograph within the
155155 required time. The court shall award court costs and reasonable
156156 attorney fees related to the issuance and enforcement of the
157157 injunction and may impose a civil penalty of One Thousand Dollars
158158 ($1,000.00) per day for noncompliance. Amounts recovered from civil
159159 penalties under this paragraph shall be deposited into the General
160160 Revenue Fund.
161161 3. If a business or individual is required to remove an arrest
162162 booking photograph under this section and la ter republishes the
163163 photograph, the person whose photograph is republished or otherwise
164164 disseminated may bring a civil action to enjoin the continued
165165 publication or dissemination of the photograph. The court shall

218218 issuance and enforcement of the injunction and may impose a civil
219219 penalty of Five Thousand Dollars ($5,000.00) per day for
220220 noncompliance. Amounts recovered from civil penalties under this
221221 paragraph shall be deposited into the General Revenue Fund.
222222 C. A business or individual engaged in the business of
223223 publishing or otherwise disseminating arrest booking photographs of
224224 persons who have been previously arrested may not solicit or accept
225225 a fee or other form of payment for the removal of the photographs.
226226 D. This section shall not apply to a business or individual
227227 that publishes or disseminates information relating to arrest
228228 booking photographs unless:
229229 1. The business or individual solicits or accepts payment for
230230 the removal of photograph s; or
231231 2. The business or individual ’s primary business model is the
232232 publishing and disseminating of arrest booking photographs for a
233233 commercial purpose or pecuniary gain.
234234 SECTION 2. This act shall become effective November 1, 2025.
